Abstract:
The monograph is devoted to a comprehensive study of the concept of "objectivity" in civil proceedings. The formation and development of the concept in legislation and science are considered and analyzed, the modern meaning of the objectivity of judicial proceedings is formulated and its place among the principles of civil procedure is determined. In the content of the objectivity of the trial, the author considers three interrelated components — the activities of an impartial court, the conscientious behavior of the persons involved in the case, and the result of these activities. The standard of conscientious behavior is formulated, its criteria are defined and the existing measures of responsibility for deviation from such behavior are studied. Fairness is considered as a requirement for a judicial decision in situations where the court uses discretionary powers. The connections that arise between the principle of the objectivity of judicial proceedings and some principles of civil procedure are analyzed. It is intended for researchers and practitioners, undergraduates and postgraduates of legal specialties, as well as for anyone interested in the problems of civil procedure law.
