In view of the fact that it is difficult to get court judgments recognized and enforced, arbitration has gained a great foothold in international commercial disputes. The leading international legal framework for recognition and enforcement of arbitral awards is the New York Convention of 1958 with 142 Member States as of today. The arbitration clause is the clause by which the parties to a contract agree to submit the conflicts that may rise from their contractual relationship to an arbitral tribunal. A principle of autonomy is associated to this type of clause: on the one hand, the arbitration clause is separable from the main contract; on the other hand, it is independent from any state law. To a certain extent, one may even link this principle to other principles concerning the arbitration clause, such as the Kompetenz-Kompetenz principle. However, the enforcement of such measures within the EU lacks a legal framework. This is due, primarily, to two interrelated reasons. The first is the failure of

Abstract:
This thesis examines the conceptual problems and practical issues that arise if a party commences proceedings under the Brussels I Regulation in another Member State in breach of an agreement that provides for arbitration in England. The focus is on the jurisdiction and powers of the English court when enforcing an arbitration agreement and the limits imposed by the Regulation's regime and underpinning principles regarding the relationship between Member State courts. Thus, the conflict between the English court and the foreign court is on the allocation of competence to decide upon the arbitr

Magister Legum - LLM (Mercantile and Labour Law)<br>The decision by countries to relax the common law doctrines of maintenance and champerty to accommodate Third Party Funding (TPF) in dispute resolution has sparked a worldwide debate. The controversial practice of funding disputes in exchange for a share of a successful outcome or settlement has left courts and administering institutions in a compromising position. South Africa joined the debate in 2004 after the Supreme Court of Appeal (SCA) relaxed the application of the doctrines in favour of TPF. The SCA found that domestic courts have th
