AbstractIn life, language, and argument, we need to feel at home. “Anchoring” connects whatever seems “new” to what is considered familiar. This paper studies the argumentative use of “anchoring” in the wider context of its role in language use. “Anchoring” provides a unifying perspective in analyzing linguistic and rhetorical elements identified by different schools of thought (Sect. 2). Several features of language, elsewhere studied in the context of “discourse linguistics”, direct the addressee on how to anchor new information to the common ground. Categorizing, labeling and naming (topics from philosophy and psychology) can be considered anchoring functions. And formal linguistic iconicity anchors linguistic representations in evolutionarily older senso-motor systems. Section 3 discusses the anchoring effects of some specific discourse types: genealogy, mythology, aetiology, and etymology. All of these frequently take the form of narrative and are used in affective, “engaged” argumentation. Finally, the rhetorical and argumentative implications of the terminology of “new” and “old” itself are discussed, and one specific “anchoring trope” is analyzed, which sets up an anchor as a reference point for something new: the phrase “X is the new Y” (Sect. 4).

Abstract Autonomy and efficiency are among the key topics that dominate the current higher education agenda and will shape the future of the European higher education landscape in the next decade. The capacity of higher education institutions and systems at large to respond to the rapidly changing needs of the society and economy will largely depend on what they can deliver and how autonomous, effective and efficient they are. The paper presents an analytical framework that connects the concepts of institutional autonomy, efficiency and effectiveness and explores the links between efficiency in university management, autonomy and accountability. It builds on (i) EUA’s work on institutional autonomy and the University Autonomy Scorecard, assessing the main components of institutional autonomy, and (ii) the higher education efficiency framework developed by EUA in the framework of the USTREAM project. This paper explores the following questions: (i) What mechanisms connect regulatory frameworks to efficiency in university management? (ii) How can autonomy be converted into efficiency and effectiveness at universities? (iii) How can efficiency support accountability? Methodologically, this paper will follow the four-pillar structure of the Autonomy Scorecard (organisational, financial, staffing and academic autonomy) and support its argumentation with several case studies.

Basic to the approach was a challenge to the ‘value free’ positivist orientation that has shaped the field of policy analysis, underscoring in particular the limits of the technocratic practices to which it gave rise. After tracing the political and academic debates that surrounded the uses of policy analysis, the chapter presents the alternative argumentative orientation and its post-positivist methodological perspective. The discussion emphasizes its language-based foundations and outlines the logic of a deliberative-analytic framework for the assessment of policy argumentation. It illustrates the ways that policy analysis needs to integrate empirical and normative inquiry. Policy findings and practical policy argumentation are interpreted by decision-makers and citizens in terms of their relations to the larger framework of norms and values that imbue them with social and political meanings. Moving beyond a narrow empirical assignment, the argumentative turn seeks to assist these actors by also drawing out these normative connections. It is, as such, an effort to make good on Harold Lasswell's call for a 'policy science' of democracy.

The discourse model of legal argumentation is presented in this chapter as a reaction to the weaknesses or deficiencies of alternative models. The most important alternative models are the model of deduction, the model of decision, the hermeneutic model, and the model of coherence. The discourse model connects the institutional or real dimension of legal argumentation with its non-institutional or ideal dimension. The result is the special case thesis. It combines institutional arguments, based on the authority of positive law, with substantive arguments, based on practical reason. This connection of the real dimension of legal argumentation with its ideal dimension is a central element of the institutionalization of practical reason.

This chapter presents the argument that the rational application of constitutional rights necessarily presupposes proportionality analysis as defined by principles theory and that proportionality analysis can be rational only if it is embedded in a theory of legal argumentation. The basic elements of principles theory are the Law of Balancing, explicated by the Weight Formula, and the Law of Competing Principles. Both concern the formal rationality of balancing. The connection of this formal dimension of rationality with the theory of legal argumentation connects the formal with a substantive dimension. The result of this connection is a system that is compatible with the requirements of universalizability and legal certainty.

Abstract:
Balancing is one of the main issues in current debates on the interpretation of constitutional rights. Numerous authors have raised the objection that balancing is both irrational and subjective. It is argued that this objection is unjustified. To show this, balancing is embedded in a theory of discursive constitutionalism that connects the concept of balancing with the concepts of constitutional rights, discourse, constitutional review, and representation. The main theses are these: first, balancing is based on a rational form of argument that can be made explicit by means of the Weight Formula, and second, constitutional review comports with the requirements of democratic legitimation to the extent that it succeeds in becoming an argumentative representation of the people.

In a global context of social metamorphosis, it is important to understand how and why the reconfiguration of work experiences comes about in relation to the modifications produced by the digitalisation of society. All areas of people's lives are colonised by the logic of the digital, and the different work experiences are affected. This chapter aims to explore the connections between these two critical dimensions of the social structuration process in Latin America, which have reached a superlative role in the context of the COVID-19 pandemic. In order to do that, it considers “digital labor” and particularly the work of deliveries by platforms as a paradigmatic experience that condenses the tendencies mentioned. The selected argumentative strategy proposes to contextualize the expansion of “digital labor” in the region by drawing from the analysis of secondary data, and from primary data generated through virtual ethnography oriented to capture the experiences of workers (deliveries by platforms).

In this essay, James Edward Ford III addresses Du Bois’s extensive use of poetry in Black Reconstruction in America, 1860–1880, particularly the multilevel argumentation through form and content that allows the poetry closing each chapter to act as a door allowing concepts to flow between disparate modes of articulation. The tension between the poetic passages and the prose pushes the reader to engage heavily with the text and discover why Du Bois chose particular poems, as well as how the poetry connects with and enhances the prose analysis of racist national culture and imperialism.Though the prose of the text never addresses the questions arising from Du Bois’s argument that racist assumptions precede legal concepts, the poetry throughout the text provides glimpses of the answers.
