Abstract Eustache Deschamps writes in 1392 his Art de Dictier, an art of writing (ars dictandi) and, according to its added title, an art of “making songs, balads, virelais and rondeaux.” He introduces it, therefore, as a versification treatise that is exemplary for his generation of nonmusician poets, unlike Machaut, his most probable initiator into metrics. In so doing he introduces the concept of natural music, a genre proper to inspire poets for whom lyrical musicality is entirely produced by poetic language alone. Without perceiving, perhaps, the novelty of this poetic aesthetics, he thus opens the avenue for a new poetry, freed from Rhetorics and from added music, more precisely for a poetic art.

The more we learn about the quantity and diversity of the copies, commentaries, and adaptations of Ciceronian rhetoric that have survived from the medieval period, the more we are led to ask why these materials were preserved and how they were used. The question of practical utility has especially concerned those students of medieval commentaries on the De inventione and Rhetorica ad Herennium who are faced with the task of explaining why these treatises continued to be copied and studied long after the demise of both the Roman law courts and the Roman schools. While the use to which the ars dictaminis was put is considerably more evident, there is still much to be learned about the circumstances in which it was taught. Since twelfth-century teachers of dictamen generally saw themselves as the heirs of Cicero, study of their works and the curricula in which they found their place often casts light on the status of rhetoric instruction as a whole. Nowhere is this complementarity so manifest as in central France, by the mid-twelfth century widely regarded as the foremost center for study of the auctores. During the second half of the twelfth century, even as the concise, functional artes dictandi from Italy were rapidly establishing themselves alongside the more traditional commentaries on the classical rhetorics, the French grammar masters were busy refining the synthesis of ars grammatica and ars rhetorica, of Horace and Cicero, preserved in Matthew of Vendôme's Ars versificatoria (ca. 1175).

The intensification of intellectual endeavour which characterises the twelfth century is manifested in the art of rhetoric no less than in the other fields of learning. Two new types of theoretical manual represent the trends of twelfth-century rhetoric: the artes dictandi, which apply rhetorical doctrine to the composition of letters and documents, and the artes poetrie, which are primarily concerned with the writing of verse. This creative momentum continued after 1200, particularly in Italy, where dictamen underwent rapid development. There the ars notarie emerged as a semi-autonomous discipline, which was exclusively devoted to the composition of legal documents. Moreover, Italian dictatores of the thirteenth century began to turn their attention to secular speeches, creating a new offshoot of dictamen which is sometimes called the ars arengandi. Boncompagno of Signa's Rhetorica novissima (finished in 1235) is by far the most ambitious of these new treatises on public speaking. Most of the early works on oratory are collections of models, consisting either of exordia or of entire speeches. The Rhetorica novissima, however, not only provides models, but attempts to lay out a completely new theoretical foundation for the art of speech-making.

Abstract:
Denna uppsats har två övergripande syften. För det första gör jag en utgåva – det vill säga en transkription, översättning och kommentar – av det medeltida diplomet SDHK nr 12636. Detta gör jag för att bidra till Svenskt Diplomatariums löpande publicering av de bevarade medeltidsbreven. För det andra undersöker jag variationen i utformningen av ett antal brevformler som ingår i tio medeltida diplom utfärdade i Vadstena socken mellan åren 1374 och 1423. I denna del av studien lägger jag fokus vid fem formler ur det brevideal som stundom kallas Ars dictandi. I dessa fem formler tittar jag på en rad variabler för att undersöka förhållandet mellan konstans och variation. Detta görs ofta med utgångspunkt i stereotypa formuleringar och jag studerar både hur dessa har använts och deras inre variation. Resultaten pekar på att nästintill samtliga undersökta formler realiseras med stereotypa formuleringar, vilket innebär att det studerade materialet innehåller en tämligen stor grad av konstans. Icke desto mindre kan formlernas utformningar varieras på detaljnivå.

Memoria (licenciado en ciencias jurídicas y sociales)
I. El “Caso Clarín” El día dos de octubre de mil novecientos noventa y siete don Víctor Pey Casado, actuando a nombre propio y en representación de la Fundación Presidente Allende (entidad española sin fines de lucro) presentó una solicitud de arbitraje en contra del estado de Chile, ante el Centro Internacional de Arreglo de Diferencias relativas a Inversiones (CIADI), dando origen a un extenso litigio internacional vigente hasta nuestros días. En su demanda, los actores sostienen que Chile ha incurrido en violaciones respecto de su inversión extranjera, según el Acuerdo entre España y Chile para la Protección y Fomento Recíprocos de Inversiones (APPI España-Chile); luego, en el año 2002, los actores interpusieron una Demanda Complementaria alegando nuevas vulneraciones, relativasa actuaciones de la República (administrativas y judiciales) llevadas adelante en el periodo comprendido entre 1995 y 2002. Chile se defendió impugnando la competencia del Tribunal de Arbitraje, al señalar -entre otras cosas- que los Demandantes no cumplen con el requisito de “extranjería”, prescrito tanto en el Convenio CIADI como en el APPI España- Chile para su demanda. Respecto a la Demanda Complementaria, la República fundó su defensa en señalar que los gobiernos democráticos de la década del 90’ han destinado todos sus esfuerzos a indemnizar y reparar, en la medida de lo posible; los perjuicios sufridos por quienes fueron víctimas de actos ilegales 8 y/o arbitrarios llevados adelante por el régimen de facto que gobernó el país en el periodo 1973-1990; y se ordenó indemnizar a los verdaderos propietarios de los derechos alegados por los actores, los que resultaron ser personas distintas de los demandantes. Luego de un extenso procedimiento de arbitraje, el 08-05-2008 el Tribunal de Arbitraje dictó el Laudo en el que puso fin a la controversia, declarándose competente para conocer del asunto; en cuanto al fondo, el Tribunal determinó que Chile había violado las disposiciones del APPI España-Chile al no establecer un “tratamiento justo y equitativo” hacia los Demandantes, e incurrir en “Denegación de Justicia” respecto de los mismos; en los siguientes actos: a) la Decisión 43 de 2000, por medio de la cual, Chile otorgó una indemnización a personas distintas de aquellas a las que el Tribunal de Arbitraje reconoció como los legítimos propietarios de la inversión extranjera afectada, es decir, los demandantes y b) El periodo de 7 años sin que la justicia chilena haya emitido una decisión de fondo a la acción reivindicatoria interpuesta por los actores respecto de la máquina rotativa Goss que formaba parte de la inversión; por todo lo anterior, el tribunal condenó a Chile al pago de US$ 10 millones a los Demandantes por concepto de indemnización, más intereses y costas. Chile solicitó la nulidad del Laudo y el 18-12-2012 un Comité Ad hoc designado por el CIADI,emitió su Decisión de Anulación; en la que declaró la 9 nulidadparcial1 del Laudo;actualmente sólo queda por definir el “Quantum” de la pena asignada a Chile, para poner fin a éste prolongado litigio internacional conocido mediáticamente en Chile como el “Caso Clarín” que a nuestros días se ha extendido por casi 17 años. II. Memoria de Investigación Nuestra investigación se dedicará a analizar los aspectos jurídicos más relevantes de éste arbitraje, los que a juicio de los autores se encuentran recogidos en el Laudo del año 2008, y son los siguientes: En primer lugar, la controversia sobrela nacionalidad de los demandantes, en especial, la nacionalidad de Víctor Pey entre 1973 y 1997.La importancia de éste punto es evidente, ya que tanto el Convenio CIADI como el APPI España- Chile, requieren que los inversionistas que alegan su protección sean “extranjeros”, es decir, que tengan una nacionalidad distinta a la del estado en que realizan su inversión; el cumplimiento de éste requisito es vital para la competencia del Tribunal de Arbitraje y será el tópico analizado en el capítulo primero de ésta memoria. En segundo lugar, el debate de las partes sobre la aplicabilidad del APPI España-Chile al caso concreto, como la competencia ratione temporis del 1 Específicamente de aquella parte dedicada a la Determinación del Daño, esto significa que el Comité ad hoc dejó firmes los aspectos esenciales del Laudo, a saber: la competencia del Tribunal de Arbitraje y la condena a Chile por las violaciones normativas en materia de inversión extranjera. 10 Tribunal de Arbitraje respecto a hechos anteriores a la entrada en vigencia del APPI, la aplicabilidad ratione temporis de las disposiciones sustantivas del APPI o la cláusula fork in the road, cuestiones que han sido determinantes, ya sea para declarar la competencia del Tribunal o a la hora resolver el fondo del asunto, al estudio de éstas cuestiones se dedicará la primera parte, del capítulo segundo de nuestra memoria. Finalmente, los autores consideramos importante estudiar la obligación que impera a los estados de otorgar a sus inversionistas extranjeros un Tratamiento Justo y Equitativo absteniéndose de toda Denegación de Justicia, que fueron las causales por las que el Tribunal de Arbitraje condenó a Chile; al respecto, consideramos relevante realizar un análisis jurídico respecto de éstas instituciones, el que tendrá lugar en la segunda parte, del capítulo segundo de la presente memoria

Abstract:
This chapter focuses on the immense work of refoundation of political language and culture carried out by two groups in the communal age: the experts of the Ars dictandi and the jurists. The former, through the reworking of materials from the distant past (ancient republicanism, Cicero, then, from the end of the thirteenth century, also Aristotle), came to identify the essence of politics in the government of the community through justice, which alone could guarantee peace and collective profit. The latter, meanwhile, developed the instruments to affirm the primacy of the commune both within and outside the city. The effect was twofold: to legitimize the efforts of the commune, committed to promoting itself as a public power, and to lay the foundations for a relationship with the jurists that would become osmotic and pregnant with consequences.

Abstract:
Since the thirteenth century, the poetrie are an instrument of prescriptive codification for poetic composition. The bucolic genre, even though it was sporadically present in the IX-XII centuries, was employed by several authors thanks to Virgilian eclogues. The fourteenth century starts a period of intensified pastoral composition, which will notably increase in the following two centuries. The link between XIII-XV intellectuals and ars dictandi and ars poetria is undeniable; the remarks made by these authors on literary genres is programmatic and continuous. This paper aims to investigate what the poetrie (together with commentaries and notes) teach with relation to bucolic production and their weight in the pastoral composition of the XIII-XV centuries.

Gervase of Melkley, a younger contemporary of Geoffrey of Vinsauf, writes his De arte versificatoria et modo dictandi at the peak of a revisionary movement that places the discussions of figures and tropes inherited from classical and medieval grammatical and rhetorical traditions in new contexts, creating what we now call the Arts of Poetry and Prose. Gervase’s art draws upon the works of Matthew of Vendome, Geoffrey of Vinsauf, and Bernardus Silvestris for its doctrine and its examples. But how often does Gervase refer to these writers? How does he use their arts in his art? When does he borrow from them? What doctrine and which examples does he borrow? Does he cite his references and, if so, what are his citation practices? This chapter surveys Gervase’s borrowings from the works of Matthew, Geoffrey, and Bernardus by way of a review of the Index nominum and Index scriptorium of Hans Jurgen Graebener’s modern edition of the De arte versificatoria. The review locates Gervase’s borrowings of doctrine and examples with greater precision, and corrects errors in the indices as needed. Charting the precise citation practices of Gervase clarifies the meaning of his hierarchy of the three writers, places his long supposed use of the Poetria nova in serious doubt, and reopens the question of his art’s date.
