Abstract:
The techniques for glancing-angle XAFS of ultrathin multilayer systems have been analyzed, with an emphasis on the conditions of detection modes under which distortion-free fine structure data are obtainable. The XANES of a multilayer system obtained in the total reflection geometry can be distorted because of anomalous dispersion effects in the sample layer and in adjacent media. The former plays a negligible role in ultrathin film cases. The latter, caused by the interference of the evanescent waves from the interfaces involved, cannot always be ignored. The distortion depends on the glancing angle, the composition of the layered structure (mainly the thickness of the layer of interest and the material of other layers), the energy from the absorption edge, and the detection modes adopted. Calculated results of these effects are presented and analytical expressions are provided in closed form. Experimental XANES data of a buried 8 monolayer (ML) Cu film, representing the thin limit, and 37 ML Ni, representing the medium thickness are used to illustrate the theory. In the thin limit, filtered fluorescence XANES data are independent of angle and are not distorted. However, total electron-yield and reflectivity data do depend on angle and are significantly distorted near the critical angle. The thickness dependence of the EXAFS measured at glancing angles is also analyzed. It is shown that both the distortions in EXAFS amplitude and phase caused by the anomalous scattering effects are strongly dependent on the sample film thickness, but when the sample thickness is in the range of 10 atomic layers the distortions are practically negligible for all X-ray incident angles. Experimental data for 8 ML bct Cu grown on Ag(001) substrate indicate that the phase and amplitude of the data have no detectable dependence on the X-ray incident angle through the critical-angle region, in agreement with the calculated results. Abstract:
This article assesses three broad issues from James Madison’s writings in Federalist 37 – (1) the nature of man, (2) the contestability of language, and (3) the relevance of theory to the real-world constitutional project. Part I discusses the implications of Madison’s conception of man, outlining some of the checks and balances that can limit political tyranny and assesses his idea of achieving stability by allowing faction in the new federal polity. Part II discusses the openness or contestability of language which Madison embraces in Federalist 37, and relates Madison’s position to the contemporary originalist or textualist approach to constitutional interpretation. Part III assesses implications that arise from Federalist 37 and concludes that, although real-life issues were at stake, the constitutional project was theoretical. Theory can incorporate real-life divergence of opinion.

L'inflation legislative est un phenomene relativement meconnu, alors meme qu'il se manifeste de facon universelle. Sa perennite sous la cinquieme republique est d'autant plus paradoxale que les articles 34 et 37 de la constitution avaient tente de limiter strictement le domaine de la loi. Cette tentative a echoue et dans un contexte institutionnel, politique et sociologique eminemment propice aux interventions legislatives, le legislateur se montre tres prolifique. Cette activite debordante se repercute sur la legislation qui apparait des lors proliferante. De la multiplication des initiatives et des deficiences de la technique legislative resulte une serieuse degradation de la loi. En consequence, ses destinataires semblent perdus et il se cree au sein meme de la societe une veritable fracture legale. Des moyens existent pour pallier les effets de la multiplication des lois, telle une meilleure information ou une codification ambitieuse, mais le mal est profond et les tentatives mises en oeuvre pour enrayer le phenomene paraissent encore insuffisantes
Although it manifests itself universally, legislative inflation is a relatively unknown phenomenon. Its ubiquitousness (perennial aspect) under the fifth republic is all the more paradoxical that articles 34 and 37 of the constitution tried to strictly limit the domain of the law. This attempt failed and as a result, legislators have become very prolific within an institutional, political and sociological context eminently favourable to legislative interventions. This unruly activity has an effect upon legislation which itself then proliferates. A serious degradation of the legal system occurs as a result of multiplication of initiatives and of deficiencies of legal writing. Therefore, it is unclear to whom the legislation applies and its focus become ambiguous which brings inequality deep in the centre of society. Current measures to alleviate effects of legal proliferation such as extensive information or overly ambitious codification have shown an inability to put an end to this deeply rooted phenomenon

O presente trabalho tem por objetivo aprofundar o regime jurídico disciplinar do servidor público temporário. Analisam-se as características principais dessa espécie de agente público que o diferenciam dos demais servidores e que justificam um regime disciplinar próprio. Em uma breve investigação sobre as prováveis origens do temporário, constata-se a presença desse servidor na Administração Pública brasileira desde 1823. No direito estrangeiro (particularmente, no direito francês e no direito português), verifica-se a existência de figuras assemelhadas ao servidor público temporário brasileiro, que é uma espécie de servidor público do gênero agente público, exercendo uma função pública, mas não ocupando nem cargo, nem emprego públicos, sendo contratado por tempo determinado para atender a necessidade temporária de excepcional interesse público. A Constituição Federal, em seu artigo 37, IX, indica que a lei estabelecerá os casos de contratação por tempo determinado, mas não há uma uniformidade entre os entes da federação sobre o regime jurídico adotado para o servidor temporário. Esta análise concentra-se na Lei Federal n.º 8.745/93, que disciplina o assunto. No âmbito federal, o servidor público temporário é dotado de um regime jurídico com características mais próximas do regime jurídico administrativo, sendo recrutado por meio de contrato administrativo assemelhado ao regime estatutário. Tal contratação deve pautar-se pela observância dos princípios da continuidade do serviço público, da moralidade, da impessoalidade, da razoabilidade, da proporcionalidade e da motivação. Focaliza-se a responsabilidade do servidor público temporário no âmbito administrativo, procurando-se demonstrar que tal servidor, por um princípio de equiparação, submete-se a um processo administrativo disciplinar para apuração de suas faltas, o qual cumpre prazos especiais e condições específicas em razão do vínculo temporário com a Administração Pública, em tudo sendo respeitado o devido processo legal, a ampla defesa e o contraditório. Analisam-se as diferenças entre o processo disciplinar do servidor temporário (sindicância) e o processo do servidor público em geral, os ritos adotados, os prazos, as penalidades e os recursos, constatando-se que o servidor público temporário responde pelos atos ilícitos em todas as esferas: penal, civil, administrativa e por atos de improbidade. A transitoriedade na função não o exime de responsabilidades, por isso, com as devidas adaptações, está sujeito aos ônus e bônus do serviço público. Daí a necessidade de construir, com base nas características próprias dessa espécie de servidor público, um regime adaptado às especificações do vínculo especial a que se submete o servidor público temporário. Propõe-se aqui um miniprocesso disciplinar ou um processo disciplinar especial, ou uma minissindicância ou uma sindicância especial, sui generis.
This paper examines at a deeper level the disciplinary legal regime of temporary public servants. Some particularities of this kind of public agent are analyzed in order to identify the main characteristics that differentiate them from other servers thus justifying its particular legal regime. From a brief history of its origin, the presence of temporary servers has been found in the Brazilian Public Administration since 1823. Based on the study of foreign laws, the existence of servants that resemble the Brazilian temporary public servant was detected particularly in French and Portuguese laws. The temporary public servant is a kind of public servant, a genre of public agent, who exercises a public function, but does not hold a public office and is not a public employee. This type of servant is hired for a specific time to meet a temporary professional demand of exceptional public interest. As indicated by Article 37, IX of the Brazilian Federal Constitution, a regulatory law must determine the cases of employment for a pre-determined term, and there is no uniformity among Brazilian States about the legal framework adopted for temporary public servants. This study is based on the Brazilian Federal Law number 8.745/93, which governs the matter. At federal level, temporary public servants are covered by a legal regime that is similar to the administrative legal regime. They are hired via an administrative contract that resembles the statutory regime. This contract shall be governed by the observance of the principles of public service continuity, morality, impartiality, reasonableness, proportionality and motivation. Public temporary servers are subject to the administrative proceedings and through the principle of assimilation are subject to disciplinary administrative proceedings to investigate their faults, under specific terms and conditions due to their temporary bond with the Public Administration. Such administrative proceedings, however, must follow the rules of the due legal process, namely the principle of unlimited right of defense and the adversary system. The differences between the disciplinary process of the temporary server (inquiry) and the process of public servants in general are analyzed, as well as the adopted rites, deadlines, penalties and appeals, noting that temporary public employees are liable for torts in all areas: criminal, civil, administrative and acts of misconduct. The transience function does not exempt temporary public servants from liability therefore, mutatis mutandis, they are subject to all rights and obligations of public service. Hence the need to build, based on the characteristics of this kind of public servant, a regime tailored to the specifications of the special bond that undergoes temporary public service. A disciplinary mini-process, or a special disciplinary proceeding, or a small inquiry, or a special sui generis inquiry is proposed herein.

Abstract:
In 2007, Mayor Thomas Menino and the Boston Redevelopment Authority (BRA) implemented an amendment to the Boston Zoning Code Article 37 (Green Buildings) requiring new construction approved under Article 80B (Development Review and Approval: Large Project Review) be designed and built to meet the United States Green Building Council’s Leadership in Energy and Environmental Design (USGBC LEED) certification. This amendment is intended to promote green building practices in the city and reduce the environmental impacts of buildings larger than 50,000 square feet. Article 37 does not require that the buildings actually achieve LEED certification, but they need to be LEED certifiable as determined by an interagency review committee and with the endorsement of a LEED Accredited Professional. This study examines how environmental goals have been translated into policy and how this policy has affected building practice in the City of Boston. The Green Buildings amendment was enacted to help curb greenhouse gas emissions by reducing the energy consumption of the building stock and is expected to help achieve the City’s goal of reducing carbon emissions by 25% by the year 2020 and 80% by the year 2050. This is not possible without a shift in the current building and construction paradigm. Through interviews with building professionals we assess whether this building code amendment has resulted in any necessary changes in practice and whether or not those working under the standard of LEED certifiability believe it to be an effective policy.

Most of the Road Traffic Regulations on Administrative Penalties articles are provisions of the punishment. Chapter I General Rules in the road traffic regulations on administrative penalties in addition to identifying the legislative purpose, its positioning as the Basic Law, the term explained, furthermore, authorized road or police authorities, when necessary, to issue an order to maintain traffic safety and smooth. Such "management" is not the penalty nature administrative behavior. Chapter II of the Road Traffic Regulations on Administrative Penalties, in accordance with the types of vehicles, is followed by cars, slow cars, particularizing in the chapter II and the chapter III, and the violators are punished respectively by the road competent authorities and by the police authorities.Pedestrian norms and punishment is in chapter Ⅳ, the Chapter Ⅴ is to regulate matters on the road barriers, Chapter VI is annex. These a large number of penalties, in fact, interspersed with some qualitative administrative acts which are not provisions of punishment nature, such as the behavior of the police drawing a car grid, notifying the owner of the vehicle cleaning up his car before deadline, ordered the violators to drive the car away in the spot when the drivers violated the parking regulations, and the disqualification based on criminal records for taxi drivers in article 37 of the road Traffic regulations on Administrative Penalties, etc., because these above mentioned are not penalties, so does not apply to the administrative Punishment Law of the principles. Therefore, which provisions possess penalty nature and which don't are essential. In Chapter II of this thesis will first define what is meant by administrative control , and list some of the administrative regulations in the Road Traffic Regulations on Administrative Penalties for distincting from administrative penalties and administrative execution behavior. And then, in the chapter Ⅲ, the administrative regulation in the Road Traffic Regulations on Administrative Penalties which is more worthy of discussion--article 37 of the road Traffic regulations on Administrative Penalties involved in taxi drivers negative qualifications is to be an extension of discussion. The strict new regulation( compared with the initial provision 37-1,1981) is only on the ground "to protect the safety of passengers who travel by taxi, and in accordance with the resolutions of the National Security Conference," and therefore left behind by the Road Traffic Regulations on Administrative Penalties 37 some problems: why select only those types of crimes to restrictions and how to meet the criminal policy on recidivism prediction theory to work out a more detailed and reasonable limits or propose other solutions.

Abstract:
This chapter discusses Articles 37–42, considering legal implementation and international cooperation and assistance. Article 37 recognizes that treaties, agreements, and other constructive arrangements between States and indigenous populations reflect legally important entitlements that have to be honoured by applying the standards of modern treaty law, while taking into consideration the facts of cases at hand and later developments, and including the interests of other parties than the original ones. In addition, the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) might be a declaration ‘only’, but it cannot be simply considered as ‘just another’ non-binding argument. Large parts of Articles 37–42 — particularly Article 37, relating to the right that treaties concluded with indigenous peoples are honoured and respected by States, and Article 40, proclaiming the right of indigenous communities to access to justice and to remedies — do have customary international law character, while other parts also reflect more than moral or political commitments ‘only’.

Abstract:
All books in this flagship series contain carefully selected substantial extracts from key cases, legislation, and academic debate, providing able students with a stand-alone resource. This chapter considers Articles 34-37 of the Treaty on the Functioning of the European Union (TFEU). Article 34 is the central provision and states that: ‘quantitative restrictions on imports and all measures having equivalent effect shall be prohibited between Member States’. Article 35 contains similar provisions relating to exports, while Article 36 provides an exception for certain cases in which a state is allowed to place restrictions on the movement of goods. The European Court of Justice’s interpretation of Articles 34-37 has been important in achieving single market integration. It has given a broad interpretation to the phrase ‘measures having equivalent effect’ to a quantitative restriction (MEQR), and has construed the idea of discrimination broadly to capture both direct and indirect discrimination.

This chapter comments on Article 37 of the Rome Statute of the International Criminal Court. Article 37 consists of two paragraphs, the first concerning the election of a replacement judge in the event of a vacancy, and the second dealing with the term of office of the new judge. A vacancy may be created by death or incapacitation of a judge, by resignation, or by removal pursuant to article 46 of the Statute. It may also occur when a judge has actually been elected but withdraws prior to taking the oath of office. The term of a replacement judge is the remainder of the predecessor's term. It begins on the date of election.

Abstract:
This chapter explores Article 32 of the Vienna Convention on Diplomatic Relations which highlights the waiver of immunity of diplomatic agents. According to Article 32, the immunity from jurisdiction of diplomatic agents and of persons enjoying immunity under Article 37 may be waived by the sending State. In addition, the Article also states that the waiver sent must always be express and that the initiation of proceedings by a diplomatic agent or by a person enjoying immunity from jurisdiction under Article 37 shall preclude him from invoking immunity from jurisdiction in respect of any counter-claim directly connected with the principal claim. Finally, the Article also states that waiver of immunity from jurisdiction in respect of civil or administrative proceedings shall not be held to imply waiver of immunity in respect of the execution of the judgment, for which a separate waiver shall be necessary.

This article is a comparative study between not only two manuscripts of constitutions of Japan, but also analytic research revealing all the cultural, ideological, and political aspects that led the Japanese authorities to adopt each of them. The Meiji Constitution was proclaimed in 1889 during the imperialistic phase of Japanese history where the country was named Empire of Greater Japan (大日本帝国), where Tokyo was a dominant world power. While the recent Constitution of Japan (日本国憲法) was issued in 1947 under the supervision of the Supreme Commander for the Allied Powers (SCAP), which is eventually, a foreign occupation authority. Through the detailed analysis, premising, and reasoning this study will reveal the historical events that resulted those constitutions and will open the debate to discuss the future prospects of the Japanese armament attempts, which is confined and restricted by Article 9 (日本国憲法第9条).

The article presents the results of the theoretical analysis of the main aspects of sports training in cyclic sports. To effectively solve the problem of training in cyclical sports, it is necessary to study the laws of the reaction of the body of athletes, including the processes of fatigue and recovery in response to the physical exertion of various directions. It is very important to individualize the training process, taking into account the functional state and reserve adaptive capabilities of the body. The authors identify such reasons that influence the development of cyclical sports as socio-economic and political transformations that are constantly taking place in Russia; demographic changes caused by the decline in the population of Russia due to the collapse of the Soviet Union; structural and organizational reasons that suggest the existence of an outdated system for training highly qualified athletes, the lack of modern centers and bases for Olympic training, an effective management system for Olympic training in General, and a targeted policy for training coaches and sports and medical personnel. The technological reasons that arose as a result of a sharp reduction in targeted research in all branches of sports science and an archaic mechanism for the development and implementation of effective innovative technologies are revealed. There is a significant lag in the medical and biological provision of training for Olympic athletes, etc. The analysis showed that the lag in the structural, organizational, and technological blocks of Olympic training is caused by a decrease in the effectiveness of scientific research.

The changes in digitalized society are reflected in the family and school environment. Nowadays children are characterized as “Homo zappiens” (Veen & Vrakking, 2011) or “digi” generation (Gold, 2016) because they are growing up using modern technology (mobile phone, computer, iPod etc.) since early childhood. The use of new communication technologies by children induced major changes in play, learning and parenting. They learn and play in a global and digital culture. This could lead to huge discrepancies between generations, especially between parents and children, children and educators. This is because homo zappiens are digital, whereas parents are analogous sometimes. If we add to these characteristics of society the values that dominate postmodernism (hedonism, individualism etc.) we will have a clearer picture of the challenges of education today and especially, in parenting. We need to redefine the children-parents-educators relationship through a new set of criteria. Wellbeing is an important aspect of the family environment which determinates school integration and success. This article focuses on research in parents` perception regarding the parenting in digitalized society and children`s wellbeing. The research was embedded in a constructivist-interpretivist paradigm, which employed both quantitative and qualitative methods for data collection. This study included a number of 100 participants, children and their parents. Conclusion: The parents need to develop a new mind, set on children`s wellbeing and rethinking the parenting in digitalized society. A training program for parents must be a solution for develop children`s well-being at home as a condition for school.

Abstract:
The aim of the article was to identify the level of association between fishing and selected attributes, especially from the field from tourism, traditions or basic functions of ponds, especially the between generation of YZ. Furthermore, the aim was to verify whether there are statistically significant differences between the associations of generations using the Kruskal - Wallis test. The analysis of the questionnaire survey showed that the connection between fish farming and selected attributes with the coming generations is decreasing. More than tourism, the young generation recalls ponds with traditional Christmas holidays, fish on a plate with fishing ponds. These new generations (YZ) will form a significant segment of tourism. For the development of fishing tourism, it is necessary to create products and communication strategies tailored to these generations, cooperate with influencers, use Facebook, Instagram or stimulate demand with the help of fish gastronomy and catch, which are closest to the younger generation.
