Abstract:
The techniques for glancing-angle XAFS of ultrathin multilayer systems have been analyzed, with an emphasis on the conditions of detection modes under which distortion-free fine structure data are obtainable. The XANES of a multilayer system obtained in the total reflection geometry can be distorted because of anomalous dispersion effects in the sample layer and in adjacent media. The former plays a negligible role in ultrathin film cases. The latter, caused by the interference of the evanescent waves from the interfaces involved, cannot always be ignored. The distortion depends on the glancing angle, the composition of the layered structure (mainly the thickness of the layer of interest and the material of other layers), the energy from the absorption edge, and the detection modes adopted. Calculated results of these effects are presented and analytical expressions are provided in closed form. Experimental XANES data of a buried 8 monolayer (ML) Cu film, representing the thin limit, and 37 ML Ni, representing the medium thickness are used to illustrate the theory. In the thin limit, filtered fluorescence XANES data are independent of angle and are not distorted. However, total electron-yield and reflectivity data do depend on angle and are significantly distorted near the critical angle. The thickness dependence of the EXAFS measured at glancing angles is also analyzed. It is shown that both the distortions in EXAFS amplitude and phase caused by the anomalous scattering effects are strongly dependent on the sample film thickness, but when the sample thickness is in the range of 10 atomic layers the distortions are practically negligible for all X-ray incident angles. Experimental data for 8 ML bct Cu grown on Ag(001) substrate indicate that the phase and amplitude of the data have no detectable dependence on the X-ray incident angle through the critical-angle region, in agreement with the calculated results. This article assesses three broad issues from James Madison’s writings in Federalist 37 – (1) the nature of man, (2) the contestability of language, and (3) the relevance of theory to the real-world constitutional project. Part I discusses the implications of Madison’s conception of man, outlining some of the checks and balances that can limit political tyranny and assesses his idea of achieving stability by allowing faction in the new federal polity. Part II discusses the openness or contestability of language which Madison embraces in Federalist 37, and relates Madison’s position to the contemporary originalist or textualist approach to constitutional interpretation. Part III assesses implications that arise from Federalist 37 and concludes that, although real-life issues were at stake, the constitutional project was theoretical. Theory can incorporate real-life divergence of opinion.

Abstract:
This study aims to analyze the effectiveness of articles 25A and 37(b) in closing the gender gap in Pakistan's KP province. This stated Article explains the right to free and compulsory education up to the secondary level. The literature review has shown that two types of factors can affect achieving the goals defined by articles 25A and 37(b). Article 25A provides constitutional efforts to provide free and compulsory education in the chapter of fundamental rights. Article 37(b) enjoined the respective institutions' obligation to remove illiteracy and provide free and compulsory education to the secondary level within the minimum possible period. Clause (f) of the same Article declares how the State will enable Pakistani citizens to participate in national life through education. These claims were named as "efforts." The efforts are under human control. Some factors act against these stated efforts, known as "circumstances," which are natural and out of human control, such as gender gaps, poverty, Pashtunwali culture, etc. In Pakistan, the "efforts" are made to achieve the stated Articles' targets. Still, no policy was developed to answer the "circumstances." This attitude extends hurdles in educating KP girls. Suggestions were made to eradicate these "circumstances" entirely or partially to the extent possible. If these "circumstances" were removed, the girls' ratio of gross enrolment rate would be at least at a high level as boys, and thus the vision explained by the stated Articles can be achieved.

Purpose An observational study was conducted to identify and evaluate trends in the use of the Internet and social media by pharmacy publications. Methods The print and online versions of 10 pharmacy publications were compared at 2 different times separated by 3 years for similarities and differences in content and presentation. Characteristics and functions were evaluated for online publications, including subscription requirements for online access, the dates of online archived material, pre- and postpublication features, e-mail notifications, hyperlinks, and the use of social media and other specialty applications. Results Between 2007 and 2010, online functionality of selected pharmacy publications increased in 52% (12/23) of the features assessed; among these expanded features, the median percent increase was 20%. The 2 most prevalent online features among publications in 2007 and 2010 were article availability in portable document format (pdf) and the ability to submit articles online. The online feature most adopted during the study timeframe was the ability to e-mail friends about an article (increased by 40%). In 2010, the majority of publications offered social media or other specialty applications (80%) and required a paid subscription for online access (60%). Conclusion Currently, not all available online features have been adopted by the reviewed pharmacy publications. Overall, the online functionality of pharmacy publications was maintained or slightly increased from 2007 to 2010. It is important for publishers to continue to expand their presence on the Internet to improve accessibility to the scientific literature.

Drawing on Karin Bijsterveld’s triple definition of noise as ownership, political responsibility, and causal responsibility, this article traces how modern Japan problematized noise, and how noise represented both the aspirational discourse of Western civilization and the experiential nuisance accompanying rapid changes in living conditions in 1920s Japan. Primarily based on newspaper archives, the analysis will approach the problematic of noise as it was manifested in different ways in the public and private realms. In the public realm, the mid-1920s marked a turning point due to the reconstruction work after the Great Kantô Earthquake (1923) and the spread of the use of radios, phonographs, and loudspeakers. Within a few years, public opinion against noise had been formed by a coalition of journalists, police, the judiciary, engineers, academics, and municipal officials. This section will also address the legal regulation of noise and its failure; because public opinion was “owned” by middle-class (sub)urbanites, factory noises in downtown areas were hardly included in noise abatement discourse. Around 1930, the sounds of radios became a social problem, but the police and the courts hesitated to intervene in a “private” conflict, partly because they valued radio as a tool for encouraging nationalist mobilization and transmitting announcements from above. In sum, this article investigates the diverse contexts in which noise was perceived and interpreted as such, as noise became an integral part of modern life in early 20th-century Japan.

Abstract:
In 2007, Mayor Menino and the Boston Redevelopment Authority implemented Article 37, an amendment to the Boston Zoning Code requiring new construction approved under Large Project Review be designed and built to meet the U.S. Green Building Council's LEED certification. The amendment was intended to promote green building practices in the city and reduce the environmental impacts of buildings larger than 50,000 square feet. Article 37 dictates that buildings be LEED “certifiable,” but does not require that they actually achieve LEED certification. This study examines how this policy has affected building practice in the city. This research relied on several data sources including public records, communication with public officials, and qualitative research interviews with building industry professionals working in Boston. Interviews were conducted with 9 individuals at 7 firms. Both architecture and engineering firms were included and all have worked under Article 37. The experiences of each firm were treated as a case study, and cases were considered in relation to each other. A cross-case analysis was completed using the qualitative research methods of interpretation, synthesis, meaning condensation, and meaning categorization. It was concluded that Article 37 has advanced sustainability goals in Boston and has provided an educational benefit to building practitioners and clients. However, Article 37 has not had a substantial impact on building practice in the city. The LEED certifiable standard is not actually equivalent to LEED certification and does not set an aggressive goal. This research fills a gap in the literature and is an important step in critically examining the outcomes of green building policy. This understanding of how Article 37 has influenced building practice in Boston is valuable not only to the city, but also to the numerous municipalities that have adopted LEED-based requirements for private construction.

Abstract:
The study aims to formulate the proposals aimed at optimizing the Chapter 2 of the Criminal Procedure Code of the Russian Federation (CPC of RF), which enshrines the principles of criminal justice. The authors of the given article examine the content of the rules-principles, i.e. legislative regulations that express and enshrine the principles of law. It is stated that we should distinguish the rules-principles and rules-beginnings, rules containing general permis-sions and prohibitions and rules-definitions because of the first receive development and logi-cal expression in the second. Attention is drawn to the fact that when discussing the nature of the court procedure we should bear in mind that principles make up the content exclusively of legal awareness. At the stage of drafting of the rules, the principles-ideas become regulatory and legal in nature. The developers of the CPC of the RF are criticized, as they did not take advantage of the scientifically valid system of principles of the criminal proceedings. The authors ask why among the rules-principles reflected in the Chapter 2 of the CPC of the Russian Federation, there was no place for many provisions, previously traditionally recognized as such; why the fundamental provisions of the regulation in other laws, including the Constitution of the Rus-sian Federation, were not enshrined in the CPC of the RF. Based on the analysis of the scien-tific literature and the provisions of the criminal procedure law, the authors conclude that one of the obvious omissions of the developers of the CPC of the RF is the non-inclusion of the provision on equality of all before the law and the court in the number of rules-principles. Objections were raised against the absence of other provisions in the CPC of the RF, previouslyconsidered fundamental for criminal proceedings, namely, publicity (officiality) of criminal proceedings, as well as comprehensiveness, completeness, the objectivity of investigation of all the circumstances of the case. Besides, the authors concluded that the contents of separate articles of Chapter 2 of the CPC of the RF, and, in fact, such independent principles, designated by the legislators as "Respect for the honour and dignity of the individual" (Article 9 of the CPC of the RF); "Immunity of the individual" (Article 10 of the CPC of the RF); "The sanctity of the dwelling" (Article 12 of the CPC of the RF); "The secrecy of correspondence, tele-phone and other negotiations, postal, telegraph and other communications" (Article 13 of the CPC of the RF) can be combined into one group, in Article 11 of the CPC of the RF "Protec-tion of human rights and freedoms in criminal proceedings”. Critical assessment is given to the content of Article 7 of the CPC of the Russian Federation, which is reduced to a formal prohibition for the court, prosecutor, investigator, investiga-tive body and interrogator to apply federal law or other rules contrary to the CPC of the Rus-sian Federation. The current version of Article 7 of the CPC, which enshrines the fundamental principle of legality in criminal proceedings, is inconsistent with modern theoretical views on the essence, content and meaning of the principle of legality in law. The authors conclude that the content of the rules-principles, their system, enshrined in Chapter 2 of the CPC of the Russian Federation, are imperfect and need to be adjusted under the fundamental theoretical developments.

Abstract:
The amendments of the 1945 Indonesian Constitution between 1999 and 2002 have significantly changed the state system in Indonesia. In such a short period, the Constitution has been amended four times, provokes enormous additional norms and causes the establishment of several new institutions, including the Constitutional Court and Judicial Commission. However, after the amendments to the 1945 Indonesian Constitution on Chapter XVI about Amendments to the Constitution, the framers of the amended Constitution created Article 37 paragraph (5) that stated, the form of the unitary state of the Republic of Indonesia may not be amended. The Preamble is also implicit unamendable. My purpose in this article is to understand the original intent of Article 37 paragraph (5) of the 1945 Indonesian Constitution, the real function of the article and also to describes original intent arguments explaining why the Preamble of the Constitution also unamendable. Before the amendments between 1999 and 2002, there is no article and provision like that, especially in the original 1945 Constitution. At last, I found that two important points that explain why this new provision created. First, the framers still afraid of separatism based on experience in 1950’s when federalism occurred in Indonesia. Second, the procedure to amend the articles of the 1945 Constitution shows that the framers only wants to strengthen the important system of unitary state because there is no differences process to amend articles of the 1945 Constitution.

AbstractHistorians of the inter-war period usually view economic nationalism (in the form of protectionism) and internationalism (in the form of free trade policy) as conflicting concepts. This article argues that the transnational networks of sugar interest groups provided a new form of internationalism compatible with the policy of agricultural protectionism. By tracing the origins of the concept of international market intervention, the article also suggests a new perspective on the economic aspects of the League of Nations’ work and offers an insight into early attempts at agricultural Europeanisation.

Nephrotic syndrome (NS) is a common childhood kidney disease characterized by protein leakage from the blood to the urine through the glomeruli, resulting of proteinuria, hypoalbuminemia, generalized edema and hypercholesterolemia. The prevalence of minimal change nephrotic syndrome is higher in Indian subcontinent. Such incidence in Bangladesh is yet unknown. The idea of a legal state demands the state administration and the government must be based on law and provide assurance of the basic rights of the people as stipulated in the law. Notary as a general official is appointed by the state, he/she does not receive honorarium from the State, but receives honorarium for legal services provided in accordance with his authority in accordance with Article 36 paragraph (2) of the UUJN. The purpose of this study was to analyze the meaning of article 37 paragraph (1) and (2) UUJN to notaries who provide legal services for free, to find and to analyze constraints in the application of article 37 paragraph (1) and (2) UUJN in providing services the law in the notary field to a poor person by a notary in Brebes Regency. This article examines the rise of the Scottish Patriot movement in the 1720s and 1730s, asserting that Patriotism provided a partisan channel for Scots who supported the British union, but took issue with the English Whig ministry and its disregard for their nation's political and economic needs. It traces three events critical to the development of Scottish Patriotism: the malt tax crisis of 1724–5, the election of 1734 and the Porteous crisis of 1736–7. These moments of political confrontation gave Scottish Patriots an opportunity to advance a platform that included the reform of Britain's tax structure, investment in Scottish manufactures and an interventionist American-focused foreign policy. First and foremost, Scottish Patriots sought to create a more equitable British political system, in which Scotland's rights and institutions were accorded the same value as England's. The Patriots' message proved attractive to Scotland's political elite and urban commercial classes, giving rise to new partisan alignments and new ideas about Scotland's future within the British state.

The basic tasks of the article are through these stories to analyze the artistic interpretation of the people of war on a scientific basis, to classify the features of the images of people of war. In the course of the analysis, examples were given from the literary text of the works and the ideas were substantiated. At the end of the article, the results obtained as a result of the analysis is summarized.

Recently, the production of plastics has increased several times and the demand for plastic materials continues to grow, which leads to an increase in plastic waste, which creates a number of environmental problems, as well as the potential for the waste management industry. The article considers the issues of environmental pollution due to the increase in the amount of plastic waste, their accumulation with an emphasis on various chemicals contained in plastic products to improve the properties of polymers and extend their service life. The qualitative and quantitative composition of additives, such as plasticizers, flame retardants, heat stabilizers, functional additives, dyes and fillers, which may contain heavy metals, halogens, fluorine, tosho. The impact of plastic waste on the environment and the impact on public health have been established, and the ways in which harmful substances enter the environment have been identified. Methods for detecting toxic substances in water, air and soil, and some harmful substances released from plastic products in different conditions are considered. The release of chemicals into the environment occurs during various processes of plastic waste management, as well as from products made from secondary raw materials. Therefore, the rational collection, transportation, sorting, storage, disposal, disposal and disposal should be carried out in such a way as to exclude the formation and release of harmful substances at every stage, ensuring continuous protection of the environment and human health, such as personnel working at sorting stations or at waste processing plants. The detection of hazardous substances in the environment and waste processing products is recognized, therefore the methodology of ensuring the safety of plastic waste management at all stages is proposed.

The article explains the problem questions from the field of economic development of rural communities of the Khotyn region – the ancient Ukrainian land, which, under conditions of statelessness, was at different times in the composition of different states; its historical territory location and the economic life of rural communities. The paper shows that at the end of the nineteenth century – the beginning of the twentieth century this territory occupied a considerable territory of Northern Bessarabia. It is proved that the economic life of rural communities was determined by the agrarian economy, which was associated with the fate of the vast majority of the population. In all Pridnestrovie (Transdniestrian) counties there was an urgent need for agricultural land. The article describes the leading role of grain production in agriculture in Khotyn region, especially rye, wheat and corn. Extensive livestock farming continued to occupy an important place in the agricultural sector of the county. The author gives results of research as for some progress in growing agricultural products, in gardening, which acquired an industrial character. It is clear that land shortages and agrarian overpopulation have become the reasons for the agricultural earnings of the local population. AbstractThis article examines the treatment of physical drill as a curricular subject in primary schools in the Irish Free State in the period from 1922 to 1937. In particular, it assesses the reasons why its status as an obligatory subject was reduced in the mid 1920s. It will show that the availability of facilities, resources and teaching staff with suitable qualifications were all considerations, while some teachers were not physically capable of teaching the subject in the early years of the Irish Free State. In addition, a strong emphasis on the Irish language and the view that a reduced curriculum was more beneficial to learning meant that some subjects, including physical drill, were deemed optional. However, the decision to reduce the subject's status had not been supported by everyone and it was mainly the Irish National Teachers’ Organisation which was behind the move. Following its reduction from an obligatory subject to an optional one as a result of a decision taken at the Second National Programme Conference in 1926, a lack of a clear policy on the subject became evident. By the early 1930s, the subject was receiving more attention from the Irish government, which made some efforts made to integrate the Czechoslovakian Sokol system into Irish schools. In examining conflicting views on how to implement the Sokol system, and the work of Lieutenant Joseph Tichy, the man recruited to develop it within the Irish army, this article also identifies the reasons why this method of physical training was not a success in Irish schools.

In this article Psalm 37 is viewed hermeneutic-homiletically. The socio-historical context of Psalm 37 is considered. Furthermore, the structure of the Psalm receives attention, as does its posture. Particular emphasis is placed on the term "righteous" as it functions in the Psalm. More specifically, manifestation of the Psalm is traced in the homiletics of H J C Pieterse. The "just man” serves as the sermon's homiletic context within his homiletics, and preaching the gospel to the victims of social injustice stands central to it. This article expresses an appreciation for the valued contribution, particularly in homiletics, that has been made by Pieterse.

The citation impact of a comprehensive sample of articles published in social and personality psychology journals in 1998 was evaluated. Potential predictors of the 10-yr. citation impact of 1,580 articles from 37 journals were investigated, including number of authors, number of references, journal impact factor, author nationality, and article length, using linear regression. The impact factor of the journal in which articles appeared was the primary predictor of the citations that they accrued, accounting for 30% of the total variance. Articles with greater length, more references, and more authors were cited relatively often, although the citation advantage of longer articles was not proportionate to their length. A citation advantage was also enjoyed by authors from the United States of America, Canada, and the United Kingdom. 37% of the variance in the total number of citations was accounted for by the study variables.

Psalm 37 is one of the most typical wisdom texts in the Book of Psalms. In comparison to other psalms it contains a high number of information on the righteous and the wicked person. The paper aims to present and analyse in detail all contexts in which mentions of the righteous and the wicked appear in order to answer the question what function these information have. The paper is divided into five parts. In the first one is given a short introduction into psalm’s genre and its main topic. The second one reflects all mentions of the righteous and the wicked in Ps 37, such containing the key terms as qyDic' and [v'r' but also those which are thematically connected with them. In the third and fourth part of the paper the information about the righteous and the wicked are analysed in detail and the main contexts of their using are defined. The righteous as supported by God are mainly viewed as existential winners in contrast to the wicked presented as life losers. The final part of the article explains the role of the information on the righteous and the wicked in the psalm taking into account the actual situation of the psalm’s addressee.

This paper analyses how the European Court of Human Rights has applied Article 37 of the European Convention on Human Rights that gives it the power to strike out pending cases in the current context of an overwhelmed Court by individual applications. This article shows that the Court’s interpretation of Article 37, while being casuistic and pragmatic, has evolved along the principles of subsidiarity and procedural justice and that the Court has used its discretion, notably to end cases regarding the expulsion of migrants. Yet this tool has not been a way of disposing repetitive applications which account for half of the pending cases.

These are typical examples of the main types of the forenamed dialectics. Each of them therefore fits well in its peculiar way into the modern social-psychological and social-political context, indicating the applicability of the genre.
