Abstract:
Occupied Jammu and Kashmir is not the only state in the Indian constitution with special status but in addition to Article 370, there is also an Article 371 in the Indian Constitution which has 10 sub-clauses that give special status to other 9 states and territories. The nature of relations of these states is explained in these clauses of article 371 which is very helpful to understand article 370 of the Indian constitution. As far as Kashmir and Article 370 are concerned, the Indian government of Narendra Modi has axed the Indian position itself as all other states with constitutional guarantees are suspicious about their future in the Indian union. By repealing Article 370, Indian Prime Minister Narendra Modi has brought to an end the false or true annexation of Kashmir with India. Thus, if there was any annexation of Kashmir with India, Indian Prime Minister Narendra Modi had cut down that relation on 5 August 2019. Article 370 is not a myth, it is a historical fact as Article 370 specifies that apart from Foreign Affairs, Defense, Communications and subsidiary matters (matters that were specified in the Instrument of Accession to India), in all other matters and subjects Parliament of India needs the approval of assembly of the people of Kashmir. Thus, Kashmir residents lived under a distinct set of laws, together with those linked to fundamental rights, citizenship, and ownership of property as compared to other citizens of India. Occupied Jammu and Kashmir were the only states to be stripped of its status of special unite of Indian federation. As of August 5, 2019, India had 29 states in principle, but with the repeal of Article 370, there are now 28 states. Prime Minister Narendra Modi’s actions regarding Occupied Jammu and Kashmir have raised concerns in these 28 states especially the states with special status like Kashmir. These concerns and reservations will sow the seeds of insincerity in the Indian Union. Expressing concern over national security, the Indian Home Ministry spokesman said separatist activities were on the rise in 200 of the country's 600 districts. Not only separatist movements but racial conflicts and caste disputes have increased after the August 5 action in Kashmir. The main reason for this unrest in India is that the states with special status under article 370 and 371 have started to ponder the federation of India as a union that is established through a system of repression. In the intellectual circles, these development are not normal as intellectuals of India are not happy with the approach of Indian Prime Minister Narendra Modi as they are taking it dangerous for the federation of India that will be left with no confidence of the federating unite.

Abstract:
Original Article 370 of the Indian Constitution is temporary, transitional. Special Provision of the State of J&K, This provision grants J&K an autonomous status. In contrast, Article 35A is incorporated into the constitution in 1954, grants special rights and privileges to state citizens. Since its inception, Article 370 has been considered a controversial provision in the constitution. It has been politicized in one or another way. The abrogation of Article 370 cannot be viewed in isolation, as it has proximity with historical, political, and constitutional dimensions. The abrogation of Article 370 is a key issue so far as the autonomy of the people of J&K is a concern. The mode and manner in which Article 370 has been abrogated and the procedure adopted for making Article 370 virtually ineffective is of great concern from the constitutional law point of view. The alarming terrorism in Kashmiris is a persistent threat to the unity and integrity of the nation and Indian democracy. Undoubtedly human rights violation of Kashmiri people through militant has always been an issue of great concern for Indian patriotism. In furtherance to the unity and integrity of the nation and to resolve the issue of Jammu and Kashmir with intent to have uniform opportunities of development, all the states, including Jammu and Kashmir, the Article 370 has been abrogated. Even though this decision was a courageous attempt on the government's part, it is not free from wide controversies. This paper examines the constitutional and political dimensions of the abrogation of Article 370 and its impact on the people of Jammu and Kashmir. The research paper examines the political, social, and legal intricacies, including the logical insight into how abrogation was politically judicious; however, the constitutionality is debatable. Paper squarely covers the historical, political, and constitutional dimensions of the abrogation of Article 370 and examines it from a constitutional point of view. The researchers have pertinently tried to analyze and evaluate the abrogation of Article 370 as a political necessity on the touchstone of constitutional principle and have correlated it with human rights.

Abstract:
Kashmir dispute is one of the contentious issues between India and Pakistan since their inception as independent states in 1947. This paper addresses this dispute that how it has been a primary cause of contention between India and Pakistan. How is it a huge humanitarian crises in the South Asia and ultimately the cause of a bulk of defence expenditures by India and Pakistan. Nonetheless, both the countries realize that the problem of Kashmir can and should be resolved through peaceful negotiations to reach a non-military solution. Both the states continue giving it a central importance in their internal and external policies. This resultant peaceful cooperation between the two nuclear powers is a central part of complex interdependence theory, which is used in this paper for analysing the issue. Thus, the paper investigates the Kashmir conflict and the cooperation between India and Pakistan to seek a peaceful resolution. The paper qualitatively assesses the situation emerged in the Kashmir after the abolishment of Article 370, for which some key people are interviewed. The findings show that the unilateral abrogation of the article 370 by the Modi government that changed the status of Kashmir further intensified the conflict and undermined the peaceful efforts made so far.

Their structures have been established by X-ray diffraction, and show the bridgehead nitrogen atoms to be predominantly sp2 hybridized. The structures accord with 1H and 13C NMR spectra. Variable temperature NMR studies show that the diperoxide 3a begins to undergo rapid inversion (on the NMR time scale) at about 303 K; up to 370 K the diperoxides 3b and 4 show no conformational change.Key words: cage compounds, formaldehyde, peroxides, amine nitrogen, hybridization.

Abstract:
The establishment of Rashtriya Swayamsevak Sangh (RSS) during 1940-1944 in the state of Jammu & Kashmir paved way for the execution of Hindutva ideology. With the rise of BJP in the center, Prime Minister Narendra Modi abolished ‘article 370’ stripping Kashmir from its special status on 5 August 2019. The socalled ‘Modi’s masterstroke’ is aimed at converting Muslim majority into a minority. The move has provoked widespread public protests in the region, leading to the imposition of prolonged curfew and suspension of basic human rights in the state. This paper would highlight the effects of Hindutva ideology and the impact of the recent ‘Modi’s masterstroke’ on the region. It would also scrutinize the role of RSS backed BJP in creating a ‘life imprisonment’ situation for the Muslim majority state.

Permerius, Filip. "Article 370 of the Indian Constitution: Conceptualizing Autonomy Retraction." Thesis, Linnéuniversitetet, Institutionen för samhällsstudier (SS), 2020. http://urn.kb.se/resolve?urn=urn:nbn:se:lnu:diva-97738.

Full text
Abstract:
Autonomy is a concept often used within International law and conflict studies as a tool to resolve tensions between state and a distinct group wanting to break free from the state. However, autonomy has no real definition within international law. Similarly, autonomy retraction lacks a clear definition and conceptualization, mostly due to it being a rare occurrence. There are five known cases of autonomy retraction. The most recent is India’s revoking of article 370 of the Indian constitution previously granting the region of Jammu and Kashmir a special status of autonomy. This thesis used this case to try and conceptualize autonomy retraction by looking at the historical context of autonomy retraction comparing how the region of Assam, Kosovo, Sudan and Tibet lost their autonomy. Historical context tells us that retraction usually comes from legislative changes and increased nationalistic policy making by central governments. Additionally, the case of Jammu and Kashmir has been examined using an altered version of an existing framework developed by the author Maria Ackrén where she looked at how regional/territorial autonomy is established. The altered version used in the thesis looks at if her framework can be used to see how and why autonomy was retracted in Jammu and Kashmir. Evidently, ideology and growing asymmetric power structures and authoritarian tendencies imposed by the Bharatiya Janata Party in India seem to be at the core to the revocation of article 370. The ultimate goal in this thesis was to conceptualize autonomy retraction and while certain components such as ideology and ethnicity plays a large part as evident in the case of India revoking article 370, further research would be beneficial to identify additional components needed to generalize the concept of autonomy retraction.

Full text
Abstract:
The proliferation of international courts and tribunals combined with the expansion of the areas and density of regulation of international law has given rise to a debate on the issue of fragmentation of international law. Within this context and as a possible response to this fear of fragmentation, the issue of interpretation with specific reference to Article 31(3)(c) of the Vienna Convention on the Law of Treaties has come to the forefront. The overarching aim of the present thesis entitled ‘Article 31(3)(c) of the VCLT and the Principle of Systemic Integration’ is to provide a comprehensive analysis of the content and the function of Article 31(3)(c) both as a conventional and as a customary rule (i.e. as principle of systemic integration). To this end, the thesis adopts a two-pronged approach. In the first Part of this thesis the analysis is based on the text of the provision itself, both on its written and unwritten elements (intertemporal law considerations). This analysis demonstrates that a proper understanding of Article 31(3)(c) leads us to the adoption of the proximity criterion as the only appropriate in the application of Article 31(3)(c). Having concluded the textual analysis, the thesis then, in the second Part, considers Article 31(3)(c) from a different vantage point. It examines Article 31(3)(c) from the more general perspective of the system as a whole and analyses what the effects of more systemic considerations to the content of Article 31(3)(c) are. Within these parameters two issues arise: i) The principles of conflict resolution, which the thesis proves can be applied, in certain scenarios, in the interpretative process of Article 31(3)(c) and ii) more importantly the notion of interpretation of customary law. The relevant Chapter establishes that customary international law can be the object of interpretation and in such an interpretation Article 31(3)(c), as custom, plays a pivotal role. Through this approach, both from a textual and a systemic perspective, the thesis offers a new and complete understanding of Article 31(3)(c) in all its manifestations and spheres of application.

Whiting, Caroline. "School based training : a comparative case study of an articled teacher course and a one year PGCE." Thesis, University of Plymouth, 1994. http://hdl.handle.net/10026.1/760.

Full text
Abstract:
This research is based on a case study of two primary Post Graduate Certificate in Education (PGCE) courses at the same university which was carried out at a time of rapid change and major reform. One of those courses, the Articled Teacher (AT) PGCE was of the 'school based' variety much heralded at the time as the way forward for the preparation of teachers. In this scheme, learner teachers were based, usually alone, for two years in one school in the care of a mentor, with a chance of a 'teaching practice' in another school. The ATs came into the university for seminars, lectures and tutorials. The other route was a more traditional one year course where the students, 75 in number, were based in the university and were sent out, sometimes alone, sometimes in groups, into two or three different schools for 'teaching practice' or 'school experience'. The research focussed on three major factors in making comparisons between the two groups: 1) patterns of loyalty to, and support from, the university and the school; 2) the sources of their theorising about teaching - the ATs relying more on their own personal experience mainly because of their constant need to survive in their schools; 3) the differences between the course providers in schools and in the university which were more important for the ATs because of their course's emphasis on 'partnership' rather than 'integration'. The findings of the fieldwork are placed in the context of a discussion of the recent reforms in initial teacher education with particular reference to their implications for school based training.

Abstract:
The article is based on a multinational study involving five countries (Romania, Portugal, Italy, North Macedonia, and Iceland) facing the return migration or remigration situation. Pupils (n = 1615), teachers (n = 370), future teachers (n = 166) and youth workers (n = 30) were questioned about various aspects regarding the subject. Among the matters, cultural needs appear to the most important. Based on the statistical analysis, the article describes the dynamics of the dependent variables, with highlighted interest on cultural needs. Psychological and social needs, cultural needs, and educational needs are discussed and link conclusions appear. Following the analysis, an intervention plan is built and tailored activities for teachers are proposed. Breaking stereotypes is a sensitive aspect of the intervention for the integration of remigrated children in the country of origin. The paper presents a possible intervention plan, with the elaborated activities and argues the elaborative process by calibrating each interference with the dynamics of the studied variables.

Abstract:
Based on the characteristics of a carbon steel-naphthalene heat pipe, a new type of medium temperature heat pipe solar receiver has been developed. According to Direct Steam Generation (DSG) with solar parabolic trough concentrators, a simulation experiment is founded which used a new half-circumferential heating method. At the working dip angles 4° and 8°, the working temperature of heat pipe is stabilized at 250°C, 300°C, 350°C, 380°C, respectively. In this article, the temperature uniformity in circumferential direction, thermal resistance and heat transfer coefficient of the carbon steel-naphthalene has been analyzed and studied. The results indicate: the temperature uniformity in circumferential direction is below 20°C. The optimum filling ratio is 30% and when used this filling ratio, the total thermal resistance basically maintained below 0.23°C/W. Heat transfer coefficient increased with the increase of the transfer power. This article serves as a reference to understanding the heat transfer performance of the carbon steel-naphthalene heat pipe in medium soar receiver.

Harris, Gregory, Brooke Hatchell, Davelin Woodard, and Dwayne Accardo. Intraoperative Dexmedetomidine for Reduction of Postoperative Delirium in the Elderly: A Scoping Review. University of Tennessee Health Science Center, July 2021. http://dx.doi.org/10.21007/con.dnp.2021.0010.

Full text
Abstract:
Background/Purpose: Post-operative delirium leads to significant morbidity in elderly patients, yet there is no regimen to prevent POD. Opioid use in the elderly surgical population is of the most significant risk factors for developing POD. The purpose of this scoping review is to recognize that Dexmedetomidine mitigates cognitive dysfunction secondary to acute pain and the use of narcotic analgesia by decreasing the amount of norepinephrine (an excitatory neurotransmitter) released during times of stress. This mechanism of action also provides analgesia through decreased perception and modulation of pain. Methods: The authors developed eligibility criteria for inclusion of articles and performed a systematic search of several databases. Each of the authors initially selected five articles for inclusion in the scoping review. We created annotated literature tables for easy screening by co-authors. After reviewing the annotated literature table four articles were excluded, leaving 11 articles for inclusion in the scoping review. There were six level I meta-analysis/systematic reviews, four level II randomized clinical trials, and one level IV qualitative research article. Next, we created a data-charting form on Microsoft Word for extraction of data items and synthesis of results. Results: Two of the studies found no significant difference in POD between dexmedetomidine groups and control groups. The nine remaining studies noted decreases in the rate, duration, and risk of POD in the groups receiving dexmedetomidine either intraoperatively or postoperatively. Multiple studies found secondary benefits in addition to decreased POD, such as a reduction of tachycardia, hypertension, stroke, hypoxemia, and narcotic use. One study, however, found that the incidence of hypotension and bradycardia were increased among the elderly population. Implications for Nursing Practice: Surgery is a tremendous stressor in any age group, but especially the elderly population. It has been shown postoperative delirium occurs in 17-61% of major surgery procedures with 30-40% of the cases assumed to be preventable. Opioid administration in the elderly surgical population is one of the most significant risk factors for developing POD. With anesthesia practice already leaning towards opioid-free and opioid-limited anesthetic, the incorporation of dexmedetomidine could prove to be a valuable resource in both reducing opioid use and POD in the elderly surgical population. Although more research is needed, the current evidence is promising.

Abstract:
This fortnightly Covid-19 (C19), Conflict, and Governance Evidence Summary aims to signpost the UK Foreign, Commonwealth and Development Office (FCDO) and other UK government departments to the latest evidence and opinions on C19, to inform and support their responses. Based on the feedback given in a recent survey, and analysis by the Xcept project, this summary is now focussing more on C19 policy responses. This summary features resources on: how youth empowerment programmes have reduced violence against girls during C19 (in Bolivia); why we need to embrace incertitude in disease preparedness responses; and how Latin American countries have been addressing widening gender inequality during C19. It also includes papers on other important themes: the role of female leadership during C19; and understanding policy responses in Africa to C19 The summary uses two main sections – (1) literature: – this includes policy papers, academic articles, and long-form articles that go deeper than the typical blog; and (2) blogs & news articles. It is the result of one day of work, and is thus indicative but not comprehensive of all issues or publications.

Abstract:
This article explores the rationale behind a performance given by the authors at the Unfolding the Process symposium held in Oslo in November 2015. For this occasion, the authors devised a new version of Bach’s Goldberg Variations that builds upon Emmerson’s arrangement of the work for two pianos in 2012. A shortened version of the work (c.30 minutes) was designed that aimed nonetheless to maintain the original work’s sense of structural balance and coherence. This version involved the transposition of a number of variations into different keys to explore the possibility of adding a satisfying tonal structure to our experience of the work, in a context where both performers see potential communicative value in 'playing with' dimensions of original masterworks with a view to giving fresh perspective to the listener experience. The article is written from the alternating perspectives of the authors; one of which is primarily concerned with the rationale and process of devising the arrangement while the other reflects upon the performative aspects and implications arising from it.

Full text
Abstract:
This article provides an overview of financing for long-term services and supports (LTSS) in the United States, paying special attention to how it has changed and not changed over the last 30 years. Although LTSS expenditures have increased greatly (like the rest of health care), the broad outline of the financing system has remained remarkably constant. Medicaid—a means-tested program—continues to dominate LTSS financing, while private long-term care insurance plays a minor role. High out-of-pocket costs and spend-down to Medicaid because of those high costs continue to be hallmarks of the system. Although many major LTSS financing reform proposals were introduced over this period, none was enacted—except the Community Living Assistance Services and Supports Act, which was repealed before implementation because of concerns about adverse selection. The one major change during this time period has been the very large increase in Medicare spending for post-acute services, such as short-term skilled nursing facility and home health care. With the aging of the population, demand for LTSS is likely to increase, placing strain on the existing system.

Mendoza, Waldo, Marco Vega, Carlos Rojas, and Yuliño Anastacio. Fiscal Rules and Public Investment: The Case of Peru, 2000-2019. Inter-American Development Bank, January 2021. http://dx.doi.org/10.18235/0003018.

Full text
Abstract:
This article has three goals. First, it describes the genesis of fiscal rules in Peru and its degree of compliance. Second, it estimates the effect of fiscal rules adoption on public investment. Last, it analyzes the impact of alternative fiscal rules on public investment and public debt sustainability. Our main results are as follows. First, the implementation of fiscal rules in the year 2000 caused a 60 to 80 percent fall in public investment relative to several counterfactuals. Second, our DSGE model suggests a Structural Fiscal Rule would have increased the consumers welfare in the period 2000-2019 more than other fiscal designs. This rule reduces the procyclicality of public investment under commodity price shocks and macroeconomic volatility under world interest rate shocks. Third, a Structural Fiscal Rule has the lowest probability of exceeding the current public debt limit (30 percent of GDP), although there is a trade-off between investment-friendly rules and fiscal sustainability issues. Nevertheless, our quantitative results are limited to short spans of analysis. With a long-run perspective, we may say that fiscal rulesdespite constant modifications and recurring non-compliancehave fulfilled their original and most important goal of achieving the consolidation of public finances.

Maternal, Fetal, and Child Outcomes of Mental Health Treatments in Women: A Systematic Review of Perinatal Pharmacologic Interventions. Agency for Healthcare Research and Quality (AHRQ), April 2021. http://dx.doi.org/10.23970/ahrqepccer236.

Full text
Abstract:
Background. Untreated maternal mental health disorders can have devastating sequelae for the mother and child. For women who are currently or planning to become pregnant or are breastfeeding, a critical question is whether the benefits of treating psychiatric illness with pharmacologic interventions outweigh the harms for mother and child. Methods. We conducted a systematic review to assess the benefits and harms of pharmacologic interventions compared with placebo, no treatment, or other pharmacologic interventions for pregnant and postpartum women with mental health disorders. We searched four databases and other sources for evidence available from inception through June 5, 2020 and surveilled the literature through March 2, 2021; dually screened the results; and analyzed eligible studies. We included studies of pregnant, postpartum, or reproductive-age women with a new or preexisting diagnosis of a mental health disorder treated with pharmacotherapy; we excluded psychotherapy. Eligible comparators included women with the disorder but no pharmacotherapy or women who discontinued the pharmacotherapy before pregnancy. Results. A total of 164 studies (168 articles) met eligibility criteria. Brexanolone for depression onset in the third trimester or in the postpartum period probably improves depressive symptoms at 30 days (least square mean difference in the Hamilton Rating Scale for Depression, -2.6; p=0.02; N=209) when compared with placebo. Sertraline for postpartum depression may improve response (calculated relative risk [RR], 2.24; 95% confidence interval [CI], 0.95 to 5.24; N=36), remission (calculated RR, 2.51; 95% CI, 0.94 to 6.70; N=36), and depressive symptoms (p-values ranging from 0.01 to 0.05) when compared with placebo. Discontinuing use of mood stabilizers during pregnancy may increase recurrence (adjusted hazard ratio [AHR], 2.2; 95% CI, 1.2 to 4.2; N=89) and reduce time to recurrence of mood disorders (2 vs. 28 weeks, AHR, 12.1; 95% CI, 1.6 to 91; N=26) for bipolar disorder when compared with continued use. Brexanolone for depression onset in the third trimester or in the postpartum period may increase the risk of sedation or somnolence, leading to dose interruption or reduction when compared with placebo (5% vs. 0%). More than 95 percent of studies reporting on harms were observational in design and unable to fully account for confounding. These studies suggested some associations between benzodiazepine exposure before conception and ectopic pregnancy; between specific antidepressants during pregnancy and adverse maternal outcomes such as postpartum hemorrhage, preeclampsia, and spontaneous abortion, and child outcomes such as respiratory issues, low Apgar scores, persistent pulmonary hypertension of the newborn, depression in children, and autism spectrum disorder; between quetiapine or olanzapine and gestational diabetes; and between benzodiazepine and neonatal intensive care admissions. Causality cannot be inferred from these studies. We found insufficient evidence on benefits and harms from comparative effectiveness studies, with one exception: one study suggested a higher risk of overall congenital anomalies (adjusted RR [ARR], 1.85; 95% CI, 1.23 to 2.78; N=2,608) and cardiac anomalies (ARR, 2.25; 95% CI, 1.17 to 4.34; N=2,608) for lithium compared with lamotrigine during first- trimester exposure. Conclusions. Few studies have been conducted in pregnant and postpartum women on the benefits of pharmacotherapy; many studies report on harms but are of low quality. The limited evidence available is consistent with some benefit, and some studies suggested increased adverse events. However, because these studies could not rule out underlying disease severity as the cause of the association, the causal link between the exposure and adverse events is unclear. Patients and clinicians need to make an informed, collaborative decision on treatment choices.
