This chapter focuses on key aspects of the cases brought to ICSID in its first two decades. Section I examines the ways in which successive Secretaries-General handled the registration of requests to institute proceedings and, in particular, their “screening” of such requests. Patterns in the constitution of the conciliation commissions and arbitral tribunals are traced in Section II, as are the first experiences of the Centre with the resignation and challenge of arbitrators. Section III discusses the distinctly pragmatic approaches of arbitral tribunals in this period to jurisdictional issues, especially the requirement of consent. There was controversy in the early 1980s as to the availability, in the context of an ICSID case, of court-ordered provisional measures. The controversy is reviewed in Section IV, which also looks at the first instances of arbitral provisional measures under Article 47 of the ICSID Convention. Section V examines the underlying interpretations of Article 42(1) of the Convention. Three ad hoc committee decisions rendered under Article 52 of the Convention are the subject of Section VI. Most of the few court proceedings for the enforcement of ICSID awards took place in these early years; the proceedings are reviewed in the concluding Section VII.

This chapter explores Article 8 of the ATT, which sets out the main obligations and entitlements specific to importing states parties to the ATT. When importing conventional arms, the state of final destination for those arms must provide information to the state that is considering exporting arms to it, if it so requests, in order to assist the ‘exporting state’ to conduct the export assessment contemplated in Article 7. The obligation to provide information is not absolute, and importing states may limit the information they provide to protect national security or commercial interests. It will, though, be in their interest to provide as much as possible of the information sought since this may assist the exporting state in its export assessment to be able to grant authorization. Importing states are also entitled to request information from an exporting state regarding export authorizations that are pending or which have been granted.

Abstract:
Contrary to judgments, arbitral awards are final in the sense that they are not subject to appeals. This chapter examines the very limited remedy of annulment or setting aside of the award in accordance with Article 190(2) PILA, emphasizing that the annulment grounds in that provision are essentially concerned with the manner in which justice was rendered, as opposed to the content of the decision. The chapter also covers all aspects of the annulment procedure before the Swiss Supreme Court, from the admissibility of the action to cost allocation. In that context, it addresses the possibility for parties not seated in Switzerland to waive their right to seek the annulment of the award (Article 192(1) PILA). The chapter further discusses the revision of the award, and, in its final section, the recognition and enforcement of foreign arbitral awards by the Swiss courts in accordance with the New York Convention.

This chapter considers recognition and enforcement under the Hague Convention. Hague applies only to judgments given by a court of a State to which the Hague Convention applies, and it applies only if the court of origin had jurisdiction under a choice-of-court agreement. The position under Hague is different from that under Brussels 2012 and Lugano 2007 since the court addressed is not precluded from deciding for itself whether the choice-of-court agreement was valid and the claim was within its scope. Apart from this, Hague has a great deal in common with Brussels and Lugano, though there are a number of additional provisions in the former that find no counterpart in the latter. The relevant provisions are found in Part III of the Convention. Article 8 lays down the general conditions for recognition; Article 9 provides certain specific grounds for non-recognition and subsequent Articles deal with special issues. Each of these provisions are considered in turn.

Abstract:
This chapter analyses Article 8 of the Vienna Convention on Diplomatic Relations which discusses the nationality of the diplomatic staff. The Article states the general principle that members of the diplomatic staff should be of the nationality of the sending State, and that the members may be appointed among persons having the same nationality of the receiving State as long as there is consent of that State. This consent may be withdrawn at any time. In addition, the Article expresses that the receiving State may reserve the same right with regard to nationals of a third State who are not also nationals of the sending State. The requirement for consent of the receiving State under the Article applies only to appointment of diplomatic staff and does not extend to the administrative and technical staff.
