This chapter examines the design of Article 260 TFEU and its application by the Commission and the ECJ. Much has been written on Article 260 TFEU, and the refrain continues along the lines that it is a potentially effective instrument for securing compliance with EU law which has yet to materialize. Some have started to question whether pecuniary sanctions can ever be an effective tool and have eyed the political procedure in Article 7 TEU with a glimmer of hope. But since money talks and the conditions in Article 7 TEU are onerous, it seems premature to discard the value of Article 260 TFEU just yet. Hence the chapter considers the issues surrounding Article 260 TFEU and their possible remedies.

This chapter focuses on Article 2(4) of the UN Charter, which prohibits the use of force in international relations. After discussing pre-Charter attempts to restrict states’ freedom to resort to warfare, it examines the emergence of a normative doctrine on a bellum justum. It considers the history of Article 2(4) and the other articles of the Charter that touch on the use of force and outlines exceptions to the prohibition on the use of force, including the so-called Uniting for Peace procedure. It examines the interpretation of Article 2(4) in the practice of the General Assembly, Security Council, and International Court of Justice), together with its inclusion in a number of multilateral treaties. Finally, it assesses the question whether the use of force after 1945 conforms to the object and purpose of Article 2(4), as well as the legal status of the prohibition to use force in contemporary international law.

States and commentators generally agree that the prohibition is not only a treaty obligation but also customary law. However, there are disagreements between states on the interpretation and application of Article 2(4): does ‘the use of force’ include not only armed force but also economic coercion and, more recently, cyber attacks. This chapter focuses on the use of cyber force on and off the battlefield within the framework of international law. Drawing on the work of the Tallinn Manual on the International Law Applicable to Cyber Warfare (2013), it considers the jus ad bellum issues surrounding cyber operations. In particular, it examines when cyber operations violate the prohibition on the use (or threat) of force set forth in Article 2(4) of the UN Charter and customary international law, and when a state that has been the target of cyber operations may retaliate with its own use of force. The chapter also discusses two exceptions to the prohibition on the use of force under Article 51 of the UN Charter, one of which is the exercise of the right of self-defence. Finally, it analyses state interpretations of international law’s prescriptive norms regarding the use of force when applied to cyberspace.

Adult brains maintain the ability to reorganize throughout life. Cortical reorganization or plasticity includes modification of synaptic efficacy as well as neuronal networks that carry behavioural implications. Transcranial magnetic stimulation (TMS) allows for the study of primary motor cortex reorganization in humans. Motor-evoked potential (MEP) amplitudes change in response to practice. This article gives information about the effect of practice on TMS measures such as motor-evoked potential amplitudes, motor maps, paired-pulse measures, and behavioural measures. These changes may be accompanied by down-regulation of activity in nearby body part representations within the same hemisphere and in homonymous regions of the opposite hemisphere, mediated by interhemispheric interactions. There is evidence pointing towards the influence of practice on a distributed network of cortical representations within regions of cerebral hemispheres. This has lead to the formulation of intervention strategies to enhance the training effects by cortical or somatosensory stimulation in health and disease.

This article focuses on templated carbon nanotubes (CNTs) and how their cavities can be used for the synthesis of nanomaterials. In particular, it demonstrates how effectively the CNTs can be functionalized by the template carbonization technique. The article first describes the method for synthesizing CNTs and carbon nano-test-tubes (CNTTs). It then considers the controlled filling of magnetic materials into CNTTs, taking into account the electrochemical deposition of Ni-Fe alloy and the magnetic properties of NiFe-filled CNTTs. It also examines the synthesis of water-dispersible and magnetically responsive CNTTs, with emphasis on water dispersibility and the effect of magnetic interaction. Finally, it shows how the cavities of templated CNTs can be utilized as a reaction field for the hydrothermal synthesis of one-dimensional nanomaterials.

This review article presents a summary of the existing literature on well-established CBT treatments for substance use disorder. It provides an overview of the origins, procedure, and evidence for six CBT treatment models: relapse prevention (RP) and mindful-based relapse prevention (MBRP), guided self-change (GSC), community reinforcement approach (CRA), behavioral couples therapy (BCT), and personality-targeted brief interventions. Common intervention components include orienting clients towards a meaningful goal, teaching necessary skills to reduce substance use and successfully achieve the goal, and establishing plans to face potential relapses, which generally appear to produce moderate to large effects across contexts and substance-related outcomes.

More specifically, it discusses the conditions under which an act may be considered a threat of force contrary to the UN Charter. It shows that a threat is unlawful under Article 2(4) of the UN Charter when the use of force contemplated by the threat would itself be unlawful. The chapter also examines the application of the rule prohibiting the threat of force by focusing on three cases: the US and British threats of force against Iraq in 2002 and 2003; the dispute between Suriname and Guyana in 2007; and the conflict involving Russia and Georgia in 2009.

This chapter focuses on the role of the UN, illustrating the interpretation and application in practice of Chapter VII of the UN Charter and the development through practice of the institution of peacekeeping. The aim of the drafters of the UN Charter was not only to prohibit the unilateral use of force by states in Article 2(4) but also to centralize control of the use of force in the Security Council under Chapter VII. However, the formal scheme of Chapter VII under which the Security Council would have its own standing army and respond to breaches of the peace, threats to the peace, and acts of aggression did not stand up to the pressure of the Cold War. The chapter shows how peacekeeping has evolved since the end of the Cold War and examines recent proposals for reform.

This chapter looks into Article 27.3 and Article 27.4 of the Vienna Convention on Diplomatic Relations. Both of the sections refer to the diplomat bag used by members of diplomatic missions. Article 27.3 states that the diplomatic bag shall not be opened or detained, while Article 27.4 states that the packages constituting the diplomatic bag must bear visible external marks of their character and may contain only diplomatic documents or articles intended for official use. Given the vulnerability of communications sent by wireless, by telephone, or by correspondence through public facilities—described in the commentary on Article 27.1 and 27.2 and apparently increasing as technology advances and leaking meets with public sympathy—States attach prime importance to the security of the diplomatic bag for reliable transmission of confidential material.

This chapter examines the use of force from a feminist perspective and its prohibition in Article 2(4) of the UN Charter. Using structural bias feminism, it demonstrates how the gendering of international legal categories contributes to the harm and discrimination experienced by women worldwide. The chapter cites UN Security Council action in Libya in 2011 as an example of the normative and organizational exclusion of women and the justification of the use of force. It discusses the relationship between race and gender privilege in international law and argues that the Council’s resolutions on women, peace, and security, support, and legitimate use of force undermine feminist peace activism. It proposes a transformative approach to the foundations of international law that articulates the prohibition on the use of force as a useful first step for imagining the potential of humanity rather than justifying further force, further violence, or further destruction.

This chapter comments on Article 102 of the Rome Statute of the International Criminal Court. ‘Extradition’ is a concept that raises difficult problems in national legal systems. For example, many States prohibit the extradition of their nationals. Article 102 attempts to address potential difficulties in this area by specifying that transfer of a person by a State to the Court is not ‘extradition’ but rather ‘surrender’. The drafters of the Rome Statute chose to use the term ‘surrender’ to govern the procedure of transfer of a suspect from a State to the Court so as to emphasize the sui generis nature of the process.

This chapter comments on Article 14 of the Rome Statute of the International Criminal Court. Article 14 is really the completion of article 13(a). Article 13 lists three sources of ‘triggering’ or authorization for exercise of jurisdiction: the Security Council, a State Party, and the propriomotu initiative of the Prosecutor. Article 14 contrasts with the brief text governing Security Council referral found in article 13(b). Arguably, the two processes are similar, and the different formulations of the concept of referral in articles 13(b) and 14 are puzzling. It would have been preferable to use equivalent language and terminology, given the substantive similarities. The differences can be explained by the complex drafting process, and the fact that the two concepts originate in different provisions within the early versions of the Statute.

This chapter analyses Article 11 of the ATT. The article includes a series of obligations and commitments aimed at preventing, addressing, and comprehending the diversion of conventional arms, generally understood as delivery to an unauthorized end user or unauthorized use by an authorized end user. The commitments pertain to all states parties involved in the transfer of arms including exporting, importing, transit, and trans-shipment states, as well as those involved in any brokering activities relating to a proposed transfer. The obligations concern only the possible diversion of conventional arms covered under Article 2(1), not ammunition/munitions or parts and components. Co-operation and assistance, particularly information-sharing among states parties, are central to the provisions in Article 11, highlighting that the diversion of conventional arms is not something that states can prevent or address in isolation from each other.
