This chapter examines the design of Article 260 TFEU and its application by the Commission and the ECJ. Much has been written on Article 260 TFEU, and the refrain continues along the lines that it is a potentially effective instrument for securing compliance with EU law which has yet to materialize. Some have started to question whether pecuniary sanctions can ever be an effective tool and have eyed the political procedure in Article 7 TEU with a glimmer of hope. But since money talks and the conditions in Article 7 TEU are onerous, it seems premature to discard the value of Article 260 TFEU just yet. Hence the chapter considers the issues surrounding Article 260 TFEU and their possible remedies.

Articles 101 and 102 of the Treaty on the Functioning of the European Union (TFEU) prohibit anti-competitive business practices. The European Commission, national competition authorities, and national courts enforce Articles 101 and 102 under powers conferred by Regulation 1/2003. From time to time, the European Commission issues non-binding notices providing clarification of the competition rules. This chapter focuses on Article 101, but begins with an outline of Articles 101 and 102 and the rules on enforcement. In broad terms, Article 101 prohibits business agreements or arrangements which prevent, restrict, or distort competition within the internal market and affect trade between Member States.

Abstract:
This chapter analyses Article 7 TEU on sanctions against Member States for certain potential and actual breaches of the values enshrined in Article 2 TEU, and the related ‘Rule of Law initiatives’. It argues that the debates over these reveal a twofold boundary issue: that of the legal delimitation of the procedures and powers under Article 7, and that of the fuzzy boundaries of the Member State political orders as distinct from the EU political order. The very identity of the foundational values of the Union and of the Member States makes it impossible to delimit the scope of EU law from that of Member State orders when it comes to guaranteeing these values. This also explains the politically highly sensitive nature of doing so. Thus, this chapter seeks to define the contours of the ensuing problems with a precise legal reconstruction of Article 7 TEU and its development.

This chapter examines Article 7 of the ATT. Article 7 is closely related to Article 6 which handles the prohibition of export. If a proposed export is not prohibited, the exporting state party must, before deciding whether or not to authorize any export of arms within the scope of the ATT, assess the potential that the export concerned would contribute to or undermine peace and security. Since this assessment is not confined to contributions or threats to international peace and security, it extends to what a state party considers a contribution or threat to its own peace and security. If, however, the exporting state party determines that the proposed export of arms or items would contribute to peace and security, the exporting state party’s assessment must then consider the potential that the arms or items could be used to commit acts of terrorism or transnational organized crime.

This chapter considers Article 7 of the Vienna Convention on Diplomatic Relations which deals with the appointment of the members of the diplomatic mission to foreign States. According to the Article, the State may freely appoint and dismiss the members of the staff of the mission, and that in case of military, naval, or air attachés, the State may require the submission of their names for approval. Subject to Article 9, the receiving State may declare persona non grata or unacceptable before arrival to any member of the mission. In addition, the Article confers the sending State the freedom to specify the functions of each member. The State specifies them classifies them as either part of the diplomatic staff, administrative staff, or technical staff. As Article 7 deals with members of the staff of the diplomatic mission, the chapter also discusses a member’s exemptions from a receiving State’s immigration control and the immunity from employment claims.

This chapter considers litigation under the Alien Tort Statute, which provides for jurisdiction over suits brought by aliens for torts in violation of international law. The chapter begins by exploring Congress’s likely intent in enacting the Statute in 1789, and how the Statute may have related to Article III of the Constitution. The chapter then describes how the Statute received little attention until the Filartiga decision in 1980, which allowed for it to be used by aliens to sue other aliens for human rights abuses committed abroad. The chapter proceeds to explore a variety of doctrinal issues relating to this human rights litigation, including the source of the cause of action, the standards for bringing a claim, and the ability to sue corporations. The chapter then discusses the Supreme Court’s 2013 decision in Kiobel v. Royal Dutch Petroleum, in which the Court substantially curtailed the territorial reach of claims that could be brought under the Statute.

This chapter examines the extent to which security interests and title-based interests should be asserted by default in proceeds, products and fruits of the original asset. It considers whether allowing or disallowing a secured creditor or a supplier to automatically have a proprietary interest in the proceeds, products and fruits should be a default or a mandatory rule. It also explains how the extent to which extending interests to proceeds, products or fruits affects the categorization of interests as security or title-based finance. After discussing the issue of reform of the English law governing secured transactions and title-based finance, the chapter analyses property law and economic efficiency considerations in shaping the default rules. It also looks at security in proceeds under Article 9 of the U.S. Uniform Commercial Code (UCC) and asks whether reform of the English law should follow Article 9 UCC.

This chapter comments on Article 7 of the Rome Statute of the International Criminal Court. Article 7 defines crimes against humanity, one of four categories of offence within the subject-matter jurisdiction of the International Criminal Court. The classic definitions of crimes against humanity, in such instruments as the Charter of the Nuremberg Tribunal, are vague and open-ended, leaving courts to interpret the scope of such expressions as ‘persecution’ and ‘inhumane acts’. Out of concern with the uncertain parameters of the crime, the drafters of the Rome Statute included extra language designed to restrain efforts at generous or liberal interpretation. The five distinct ‘contextual elements’ of crimes against humanity are: (i) an attack directed against any civilian population; (ii) a State or organizational policy; (iii) an attack of a widespread or systematic nature; (iv) a nexus between the individual act and the attack; and (v) knowledge of the attack.

The article discusses the central obligations with respect to parts and components, requiring states parties to regulate the export of these items through their national control systems and to apply the provisions of Article 6 (Prohibitions) and Article 7 (Export and Export Assessment) to such exports. In general terms, states parties are only required to regulate the export of parts and components, not other types of transfers. Additionally, Article 4 requires states parties to regulate the export of parts and components where the export is in a form that provides the capability to assemble the conventional arms covered in Article 2(1) through a national control system.

This chapter explores Article 28 of the ATT. The article defines all six official UN language versions of the text of the Convention as ‘equally’ authentic—Arabic, Chinese, English, French, Russian, and Spanish—despite the fact that most of the texts forming the basis of preparatory discussions and negotiations were in English. The particularities of English pose a problem with regard to the definition of some terms. For example, the word ‘overriding’, controversially included in Article 7(3), was clearly the basis for negotiations as the translations were amended so as to give equivalent effect to the term’s apparent balancing effect.

This chapter comments on Article 77 of the Rome Statute of the International Criminal Court. Article 77 sets out the penalties the Court may impose on a person convicted of a crime. These include imprisonment for a specified number of years, which may not exceed a maximum of 30 years; a term of life imprisonment when justified by the extreme gravity of the crime and the individual circumstances of the convicted person; a fine under the criteria provided for in the Rules of Procedure and Evidence; and a forfeiture of proceeds, property, and assets derived directly or indirectly from that crime, without prejudice to the rights of bona fide third parties.
