Full textThis thesis is an analysis of the participation of social organizations in the legislative assemblies in the period 2003-2010. In all state parliaments is forecast in its internal rules, and participatory mechanisms, which are classified into two groups. The first is composed of instances aimed at providing the manifestation of social organizations and even individuals. This group of public audiences, thematic forums, seminars, popular discourse on tribunes during legislative sessions and attending meetings of legislative committees. The second group of participatory processes incorporates the presentation of proposals, including bills of popular initiatives, legislative proposals and suggestions. In 2002 starts the process of creating commissions participatory legislation in state parliaments of the states of Acre, Alagoas, Amazonas, Mato Grosso do Sul, Rio Grande do Sul, Santa Catarina, Paraiba, Sao Paulo and Minas Gerais. The study also includes an analysis of the content of legislative output of the state representatives of the legislatures of Rio Grande do Sul, Santa Catarina, São Paulo and Minas Gerais, where there was a record of proposals sent to their respective commissions participatory legislation, including period before the formation of committees (1995-1998 and 1999-2002) and the period after the beginning of its activities (2003-2006 and 2007-2008). The presentation of proposals by social organizations, even after the formation of committees of participatory legislation, failed to materialize. Even in the case of the Committee on Legislation Popular de Minas Gerais, where there is a large number of propositions, more than half between 2003 and 2010 originated in structures coordinated by the Executive Branch. The content of legislative production in states with commissions also did not change effectively.

Em ambos os casos, o polÃtico parlamentar cumpriria seu mandato tendo em vista se reeleger na eleiÃÃo seguinte, seja ao mesmo cargo no legislativo, seja a outro cargo polÃtico. Para viabilizar a pesquisa foi necessÃrio, como perspectiva metodolÃgica, perceber a importÃncia do espaÃo geogrÃfico, ou seja, importÃncia analÃtica da geografia polÃtica para compreender quais as demandas sugeridas aos nossos representantes atravÃs das estratÃgias adotadas pelos candidatos na Assembleia Legislativa e, assim, perceber como a representaÃÃo e a representatividade polÃtica sÃo exercidas na aÃÃo legislativa estadual. Elaborei, ao final, tipologias para interpretar a distribuiÃÃo de votos dos deputados estaduais. No resultado, temos a formaÃÃo de circunscriÃÃes informais e a presenÃa de bases eleitorais territoriais que conduzem a aÃÃo polÃtica de grande parte dos deputados pesquisados.
The research aims to observe whether the political actions of the representatives at the Legislative Assembly of the State of Cearà were directed to the municipalities in which they obtained most of their vote and how was their relationship with their political parties. Politicians fulfill their term of office in order to be granted a new mandate in the next election. This mandate might be a renewed one at the Legislative Assembly or a new mandate at another political office. The political geography of the Assembly elections was analyzed to understand the relationship between vote distribution and the type o parliamentary activity. A typology of vote distribution was elaborated leading to the conclusion that there are informal territorial constituencies and that most politicians guide their actions towards these constituencies.

Full textA relação entre governadores e assembleias estaduais no Brasil é marcada pela tese de que os governadores possuem ampla capacidade para estabelecerem um pacto homologatório com os legislativos estaduais. Literatura recente tem buscado comparar as experiências dos diferentes estados. O Rio de Janeiro tem se destacado como um dos casos em que o legislativo conseguiu espaço para levar adiante uma agenda própria. Esse diagnóstico contrasta não só com a tese do poder dos governadores, mas também com a experiência histórica da máquina política chaguista no Estado. Essa tese busca entender como que a relação dos governadores do Estado do Rio de Janeiro com a Assembleia Legislativa do Estado se desenvolveu desde a retomada das eleições diretas para esse cargo em 1982 até o ano de 2010. A principal hipótese é a de que as mudanças no federalismo brasileiro e o ajuste fiscal levados a cabo durante os anos 1990 foram centrais para repactuar a relação entre os dois poderes. Essas mudanças nacionais permitiram que um desejo de maior independência na relação entre os poderes ganhasse espaço. A mudança na relação entre os poderes é comprovada pelo crescimento temporal na quantidade de vetos do governador derrubados pelo legislativo. A tese mostra, no entanto, que o ganho de espaço para atuação do legislativo não significou uma restrição às agendas do Executivo que continuou a ser ator central da política estadual.
The relationship between governors and state legislatures in Brazil is marked by the thesis that the governors have the capacity to establish a ratification pact with the state legislatures. Recent literature has sought to compare the experiences of different states. The Rio de Janeiro has emerged as one of the cases where the legislative was able to carry forward their own agenda. This diagnosis contrasts not only with the thesis of the governors powers, but also with the historical experience of chaguista political machine in the state. This thesis seeks to understand how the relationship of state governors of Rio de Janeiro with the State Legislative Assembly has developed since the resumption of direct elections for this position in 1982 through the year 2010. The main hypothesis is that the changes the Brazilian federalism and fiscal adjustment carried out during the 1990s decade were central to renegotiate the relationship between the two powers. These national changes allowed a desire for greater independence in the relationship between the powers to gain space. The change in the relationship between the powers is demonstrated by the growth in the amount of governor vetoes overturned by the legislature. The thesis shows, however, that the gain of the legislative did not meant a restriction on the agendas of the Executive which continued to be a central actor in state politics.

Full textThe Brazilian political science produced consistent explanations about the functioning of democracy in the post-1988 period. The mechanisms of governability and decision-making of the Brazilian political system are widely discussed in the literature under the rubric of coalition presidentialism. However, two research agendas on our political system have not been sufficiently tested, namely: the study of the Executive-Legislative relations in subnational units and mechanisms of checks and balances in our democracy. The goal of this dissertation is to analyze the touch point or even the junction between these two frameworks: the dimension of supervision and control in the Brazilian subnational units. To accomplish these objectives, the research design consists in the review of the relevant literature, along with the analysis of data from 20 states of the Brazilian Federation - from 2007 to 2010.

This work evaluates the organization of the legislative activities and the decision-making process within the Legislative Assembly of RN, emphasizing the role of ruling institutions on the Legislative Power working, as well as the structure of its decisions. The organization and the production of the decision-making process inside the Legislative Assembly will be seen along with how institutional norms determine the nature of the legislative process and influence his legal production. The period under study extends from 1990/94 to 1994/97 legislatures. The work is divided in three parts. The first analyzes the legislative process, the role of legal production, the nature of the legislation produced during the time referred and the role of the decisory instances: the directive Table, the leaders collegiate and the permanent commissions; the second part will present the results of questionnaires made to the deputies about their perspective concerning the actual power structure, as well as a more desirable power distribution among different decisory instances in the Assembly. At last, part three will focus on the Executive power role exerted on the legislative process, analyzing how it makes use of his initiating and veto prerogatives, via the study of some laws sanctioned in 1990-1997

Full textThe object of the study here presented is the legislative process in the Brazilian Federation\' State-members. Since the 1988 Federal Constitution no more imposes, expressly, a compulsory observance of the federal legislative process to the state constituent, it is an object of analysis the peculiarities adopted by the State Constitutions and Legislative Assemblies\' Rules of Procedure concerning the law formation process. An analysis of the evolution of the regional Legislative branches during the Brazilian colonial era was made, giving special attention to the structure, authority and operation of the Provincial Legislative Assemblies. The peak of the State-members\' autonomy occurred under the 1891 Constitution ruling, with State Legislatives having both unicameral and bicameral chambers, as well as the implementation of certain rules by the States\' Constitutions that were not implemented by the Federal Constitution, eg, the partial veto - implemented in some State Constitutions, such as Bahia\'s, Cearás\'s Maranhão\'s, Pará\'s and Minas Gerais\' - wich would be incorporated to the Federal Constitution only after the 1926 reform. Another example of the States\' autonomy was the popular participation, conjunctly with the City Council in the Rio Grande do Sul legislative process, with the Representatives\' Assembly having almost no importance and the State\'s President having great powers in the creation of rules. However, in the 30\'s, there has been an emptying of the States\' legislative authorities, that were gradually transferred to the Federal authority since 1934 to nowadays. Analysing the State Constitutions in force, it is possible to say that the representatives were concemed in granting the state legislative process some peculiarities: (i) some states have not adopted all the legislative forms provided by the Federal Constitution, such as the delegated legislation, (adopted by Acre, Espírito Santo, Maranhão, Paraíba, Piauí, Rio Grande do Sul, Santa Catarina, São Paulo and Tocantins), and the provisional measure, which was only established in Acre, Maranhão, Paraíba, Piauí, Santa Catarina and Tocantins; (ii) fourteen states enable the popular initiative to the state constitutional amendment proposition, a possibility that does not exist within the federal sphere; (iii) the Rio Grande do Sul\' City Councils have authority to present statutory law and complementary law projects to the state legislative process; (iv) ostensible vote in order to consider the veto (Rio Grande do Sul and São Paulo, within the 1989 Constitutions\' sphere, and later, through constitution amendments, states of Acre, Maranhão and Rio de Janeiro); (v) non-adoption of the suspension rule of the propositions within the Agenda, when the rejected legislative bills and some Chief Executive\'s projects that contains constitutional urgency request are brought to vote (states of Roraima and São Paulo); (vi) restriction of the matters that can be object of constitutional urgency request by the Chief Executive; (vii) inadmissibility of secret plenary sessions (state of São Paulo). There are singularities in the parliament practice regarding the state legislative process by virtue of specific regimental rules, such as leadership vote and deadlines. Other singularities can be originated from the Questions Order: doubts about interpretation of the Rules of Procedure, when related to its exercise or to Federal or State Constitutions. The significance given by the constituents and the Legislative Assemblies regimental lawmakers to the state legislative process shows the importance that needs to be credited to the state legislative branch\'s role as a harbinger of new experiences, specially in a Federation, such as the Brazilian one.

O presente trabalho de dissertação versa sobre a importância do Papel do Legislativo na definição da agenda governamental, com o objetivo de buscar compreender de que modo a produção legislativa dos Deputados Estaduais contribui para a formação da agenda governamental no Rio Grande do Norte. Quanto aos aspectos metodológicos, a pesquisa tem abordagem qualitativa, trata-se de um estudo de caso na Assembleia Legislativa do Rio Grande do Norte. O estudo se baseia no modelo de Múltiplos Fluxos (Multiple Streams Model) de Kingdon (2011), considerando suas categorias analíticas: fluxos de problemas, fluxos de soluções, fluxos políticos e a janela de oportunidade. Os dados foram coletados por meio de entrevistas orientadas por questionário semiestruturado com deputados líderes e/ou vice-líderes de bancadas e chefes de gabinetes, assim como foram usadas 2082 proposições apresentadas no Parlamento Potiguar no ano de 2016. A verificação de dados se deu por meio de análise de conteúdo, preconizada por Bardin (2011). Os resultados apontaram para um contexto de multiplicidade de ações desenvolvidas nos Gabinetes Parlamentares, identificação de problemas, feedback, formulação e acompanhamento de proposição. Verificou-se, ainda, um desequilíbrio na produção legislativa por mesorregião e as dificuldades para análise de custos quando da formulação dos requerimentos. A pesquisa focou também no papel que o deputado desempenha como articulador na aprovação e no encaminhamento da proposição para inclusão na agenda. Se almeja com o resultado dessa pesquisa contribuir para melhoria da produção legislativa da Assembleia do Rio Grande do Norte, assim garantir o avanço de qualidade das políticas públicas procedidas das proposições apresentadas pelos Parlamentares.
This dissertation deals with the importance of the Legislative’s role in the definition of Governmental Agenda, aiming to try to understand how the legislative production of State Representatives contributes to the formation of the governmental agenda in Rio Grande do Norte. As for the methodological aspects, the research has a qualitative approach, it is a case study in the Legislative Assembly of Rio Grande do Norte. The study is based on Kingdom's Multiple Streams Model (2011), considering its analytical categories: Problem Flows, Policy Flows or Solutions, Political Flows, and the Opportunity Window. Data were collected through semi-structured questionnaire-based interviews with State Representatives that were first and second in command of their Parties and chiefs of staff, as well as the use of 2082 proposals presented at the Potiguar Parliament in 2016. It was used content analysis by Bardin (1977) for data verification. The results pointed to a context of multiplicity of actions developed in the Parliamentary Offices, problem identification, feedback, formulation and proposal follow-up. There was also an imbalance in the legislative production by mesoregion and difficulties in cost analysis when formulating the requirements. The research also focused on the role that the deputy plays as an articulator in approving and submitting the proposal for inclusion on the agenda. The aim of this research is to contribute to the improvement of the legislative production of the Assembly of Rio Grande do Norte, thus guaranteeing the quality improvement of the public policies stemming from the proposals presented by the Parliamentarians.

This is a study of the legislative production in education carried through in the State legislature of the State of Para in the period that corresponds its 13th and 14th legislatures (1995-2002). The objective of the work was to identify to the type legislative activity that state parliamentarians had developed in the educational area in the ALEPA by means of the analysis of the profile of the distribution of benefits that they had intended to make with this production and of the factors that intervened in its definition. The initiative of this research was provoked for the predominant consideration concerning the parliamentary performance that attributes to an essentially distributive character (clienteles) in the concession of benefits in sight of returns politicians to it (electoral). Thus, the analysis was confronted with two empirical problems of inquiry: first, to discover which the profile of benefits that them state parliamentarians had looked for to grant in education by means of legislative production e, second, as to explain its emergency in the context of the studied legislatures? In this direction, the work was divided in two parts: in the first one it became the survey of the data of the legislative proposals in the educational area in the ALEPA in the indicated period. For the analysis of the profile of benefits it was used theory of the legislative decisions; the result was collated, in the second part, with the main explicative approaches of the parliamentary behavior. One concluded that, in contrast of the predominantly perspective, the profile of distribution of benefits found, did not present an essentially distributive character, however, its importance is secondary in the constitution of the educational legislation of the State, therefore the factors that intervene in its definition elapse of the institutional restrictions that conform the space of the legislative production in education in the ALEPA, which structuralize the strategic options of them parliamentarians stimulating an performance, in this scope, of not distributive character, however, on the other hand, it removes them the possibility to intervene with the educational policy.
Este é um estudo da produção legislativa em educação realizada na Assembléia Legislativa do Estado do Pará no período que corresponde as suas 13ª e 14ª legislaturas (1995-2002). O objetivo do trabalho foi identificar o tipo atividade legislativa que os parlamentares estaduais desenvolveram na área educacional na ALEPA por meio da análise do perfil da distribuição de benefícios que pretenderam fazer com esta produção e dos fatores que interviram na sua definição. A iniciativa desta pesquisa foi provoca pela consideração predominante acerca da atuação parlamentar que lhe atribui um caráter essencialmente distributivo (clientelista) na concessão de benefícios em vista de retornos políticos (eleitorais). Assim, a análise defrontou-se com dois problemas empíricos de investigação: primeiro, descobrir qual o perfil de benefícios que os parlamentares estaduais procuraram conceder em educação por meio da produção legislativa e, segundo, como explicar a sua emergência no contexto das legislaturas estudadas? Neste sentido, o trabalho foi dividido em duas partes, na primeira fez-se o levantamento e a organização dos dados das proposições legislativas apresentadas na área educacional na ALEPA no período indicado. Para a análise do perfil de benefícios empregou-se a teoria das decisões legislativas; o resultado foi confrontado, na segunda parte, com as principais abordagens explicativas do comportamento parlamentar. Concluiu-se que, ao contrário da perspectiva predominantemente, o perfil de distribuição de benefícios encontrado, não apresentou um caráter essencialmente distributivo, contudo, sua importância é secundária na constituição da legislação educacional do Estado, pois os fatores que intervem na sua definição decorrem das restrições institucionais que conformam o espaço da produção legislativa em educação na ALEPA, os quais estruturam as opções estratégicas dos parlamentares incentivando uma atuação, neste âmbito, de caráter não distributivo, porém, por outro lado, lhes retira a possibilidade de interferir na política educacional.

Full textThe aim of the thesis consists of a research on party migration in a state of Brazil, through a case study of the 15th Legislature (2003-2007) of the Legislative Assembly of Paraná (ALEP). The phenomenon of party migration received considerable attention from researchers interested in the Brazilian political institutions in post-88. However, there is a gap: few studies of political science were concerned to measure the party switching in Brazilian Legislative Houses; the focus mostly refers to the House of Representatives. There are five procedures to investigate why the state representatives switch to a different party after election and which is the direction of the exchange, (i) analysis of the institutional context in Paraná – the ALEP’s internal organization and ALEP party framework from 1986 to 2006 – through the bylaws of assembly and details of the voting statistics; (ii) quantitative survey of all the party changes elected state from 1987 to 2007, the source is the records of the Assembly and information provided by the Board’s Legislative ALEP; (iii) discussion of the literature on party switching in the House of Representatives and comparison of the main findings of the present study to those found by researchers at the federal level; (iv) from a database on the political career of the majority elected on 2002 on Paraná (the information are from the ALEP) and the pattern of distribution of votes received (data obtained from the site of the TSE), analyzes the micro dimension of the phenomenon to measure the prior political experience of the migrant and the positions occupied in the 15th Legislature; (v) last case concerns the analysis of six in-depth interviews conducted with members who switched sides from 2003 to 2007 in the Legislative on Paraná state.
