Full textLes resultats du travail sont exposes en deux parties : dans la premiere partie, intitulee le lien d'assurance, nous avons etudie la relation entre l'assureur et a l'assure; la deuxieme est consacree au droit de la victime a l'indemnisation. L'aboutissement de la these s'exprime ainsi par des propos brefs, mais significatifs: l'accroissement du role de l'assurance, le declin de la responsabilite et l'elargissement du droit de la victime a l'indemnisation que nous constatons en droit francais en matiere d'assurance obligatoire et de responsabilite automobile. Ainsi la vulgate, selon laquelle, l'interet de la victime serait mieux protegee dans un systeme d'assurance ou la theorie du risque est appliquee, n'est plus valable. En effet, on a pu constater qu'en irak, malgre que l'assurance est automatique, fondee sur la theorie du risque, plusieurs victimes sont encore privees du droit a l'indemnisation. Car, le legislateur a maintenu la notion de la causalite de l'accident, c'est a dire que le vehicule doit causer l'accident. Nous constatons, enfin, que la loi de la convention de la haye du 4 mai 1971, relative a la determination de la responsabilite civile automobile en cas d'accident international, a pu etablir des principes de rattachements souples. Mais, au niveau de la forme, certaines dispositions meritent d'etre refondues

Full textThis thesis is concerned with the Moroccan law as to the compulsory automobile insurance, which is known for its reciprocal feature, for to the obligation of «being insured»which is overwhelming to drivers corresponds the obligation to «insure»which is compulsory for the insurers. Within this framework, the Moroccan legislator has visibly adopted, just like his French counterpart, a compromise between two possible conceptions of the automobile risk: the «intuitu rei»conception and the «intuitu personae»conception: the one that links the warranty to the vehicle and the one that ties the warranty to the insured driver, leading thus to a hybrid system of insurance liability. The adoption of the first conception is the surest means to find a respondent for every accident caused by a determined vehicle. The second conception takes into account the qualities of the driver and encourages as a matter of fact the efforts of prevention. Therefore, the compulsory automobile insurance has brought deep transformation to the law of obligations as well as to the field of liability. Upon the view of private law contract, a legal status is imposed on the insured and insurers. The former becomes «subjugated» to the legal regime of insurance and the latter becomes supplier of warranty. The social role of this institution governs the following situation: insurance is at the service of the public

Full textFor a long time, insurance has been perceived as a way of transferring responsibilities from insured agents to insurers and thus as influencing insured agents' behavior. Two opportunist behaviors have been analyzed. First, the theory of adverse selection predicts that high-risk agents are likely to want more insurance than low-risk agents. Second, the theory of moral hazard predicts that the wider is insurance coverage, the lower is the level of preventive effort. Thus, both theories conclude that agents who are totally insured should have a higher probability of accident than those who are only partially insured, ceteris paribus. Nevertheless, one of the aims of insurance rating systems which use deductibles and bonus-malus systems and discriminate between insured agents according to drivers and vehicles' characteristics, is to control for these opportunist behaviors. In this thesis, we use individual data to see if the french automobile insurance rating system achieves this aim. In the first part, we present microeconomic contributions explaining adverse selection and moral hazard behaviors. In the second part, we estimate econometric models adapted to traffic risk analysis : count data models (poisson model, binomial negative model, etc). In the third part, we present the french automobile insurance market and build a model illustrating adverse selection and moral hazard behaviors. We conclude that insurance is no longer a factor of risk on its own : the french automobile insurance rating system is efficient to control insured agents opportunism. However, since insurance companies do not usually use mileage to calculate premiums, agents who take out the best insurance coverage drive more than others and thus, they have a higher probability of accidents

Full textThe Tunisian automobile insurance pricing is based on the power of the car and a posteriori pricing mechanism called bonus-malus system that has been adopted since 1993. This thesis proposes, after a presentation of the most significant results of the literature on adverse selection (chapter one) and moral hazard (chapter two), to attempt to analyze in chapter three the relative importance of factors explaining the number of accidents during a period of time and to build up optimal bonus-malus tables based on the number of past accidents by the individuals (Lemaire, 1985 ; Dionne and Vanasse, 1992). In chapter four, we evaluate the efficiency of the bonus-malus plan. Our analyse is based on panel data. The estimates are based on random effects Probit and negative binomial models. This chapter is an application and extension of the articles published by Dionne and Vanasse (1992-1997). We conclude by stating that the bonus-malus, applied by insurers, is not optimal in the actuarial sense and, that it doesn't present an incentive for prudence concerning high-risks

Full textThe motor insurance sector currently confronts regulatory, financial, behavioral and technological challenges. Under these circumstances, insurers must uphold in improving their pricing strategies. Two topics related to pricing innovation are discussed in this thesis. We first take up the pricing strategy optimization for new businesses, as well as the renewals. Secondly, we highlight in the usage of experiments in leading us to a better understanding of insurance demand factors.On the first part of this thesis, we address pricing optimization at renewal, then illustrate how empirical demand models that rely on observable data could help the insurers to boost their profits and clients retention rate. We extend afterwards this framework by considering the impact of current pricing decisions on future cash-flows. Consequently, we introduce the Customer Value metric which allows insurers to reflect over the customers' behavior during their lifetime, when it comes to constructing their pricing strategy. The empirical illustrations of the first two chapters rely on natural data observed by the insurer.On the second part of this thesis, field and laboratory experiments will give us better comprehension of the motor insurance demand. Data from a field experiment refine the measure of clients' price elasticity. Offline assessment of several reinforcement learning algorithms shows how pricing experiments can achieve better performances compared with the myopic strategy which does not apply any kind of experiment. Laboratory experiments contribute to the understanding of demand models as well. In particular, we analyze the added value of risk aversion and risk perception in explaining the insurance choices. Furthermore, we examine the external validity of the experiment, i.e. the similarity between the behaviors of the customers in a lab environment versus their factual behaviors in the market.Aside from the duality between experiments and optimization, this thesis also illustrates the duality between private and public data, as well as the duality between empirical and theoretical insurance demand model

Full textThis dissertation provides a contribution to the risk analysis on the French automobile insurance market. The objective of this thesis is threefold. The first aim relates to a theoretical framework applied on insurance market. An original model of double asymmetry of information is presented The main result that emerges is the existence of two kinds of contracts at equilibrium :a separating contract and a pooling contract. The second point concerns the past claims and the risk-coverage correlation. Bivariate and trivariate models are applied for this purpose. It results that the assumption of asymmetry of information is not rejected. The third issue is related to the over-premium that insurers apply quasi-systematically to the young drivers. We show, using econometric modeling, that this over-pricing compared to the experienced drivers’premium isnot necessary and its removal does not compromise the sustainability of the insurance company

Full textUntil the enactment of the so-called loi Badinter of 5 July 1985, the compensation of traffic accident victims was governed in France by the general principle of liability for the action of things developed by French case law on the basis of article 1384, paragraph 1, of the French Civil Code. The 1976 Jordanian Civil Code includes a principle of liability for the action of things inspired by the French model. However, this principle is not applied by Jordanian courts in the field of traffic accidents, in spite of the fact that there is no law in Jordan similar to the loi Badinter of 5 July 1985. Hence, compensation in cases of traffic accidents is still governed in Jordan by general rules of tort law which govern liability for one’s own actions and by a 2010 law creating a compulsory motor insurance scheme, which protects victims of accidents resulting from the use of motor vehicles. In accordance with these rules, the compensation’s debtor or her/his insurer is authorized to put forward the victim’s own harmful action, disregarding its seriousness. As a result, the victim’s right to full compensation ifs often reduced or even withheld
