Abstract:
The markets for audiovisual content are subject to dynamic change. Where once “traditional” television was dominating, i.e. linear audiovisual media services, markets display nowadays the strong growth of different types of video-on-demand (VoD), i.e. nonlinear audiovisual media services including paid-for VoD such as Netflix and advertised-financed VoD like YouTube. This article aims at providing insights into the VoD market in general and the competitive environment in particular. For doing so, the authors first present recent developments in the German VoD market. In the second part of this article, the authors focus on the (perhaps special) role of YouTube in the market for audiovisual (online) services. Thereby arguments for and against YouTube exerting competitive pressure on i) other non-linear audiovisual media services (e.g. Netflix) as well as ii) on other linear audiovisual media service providers (TV stations) are discussed. The article concludes that there are numerous pros and cons speaking for a relevant role of YouTube for both markets.

Abstract:
Revision of the Audiovisual Media Services Directive in the light of European media policy The Audiovisual Media Services Directive, 2010/13/UE, due to development of convergence and digitalization phenomena, has responded to the technological paradigm shift, thereby continuing the late 1980s standard of transfrontier television. The dramatic shift of all aspects of audiovisual sector which has occurred for the last decade, triggered the adoption of its revision on the 14th of November, 2018 which creates a media framework for the 21st century. The aim of the article is to point out – within the frame of historical aspects of European media policy, including a digital single market impact – the wide spectrum of its implications, taking into consideration the dual – cultural and economic – status of audiovisual media services. Hence, the analysis of certain regulatory changes, concerning the following issues, ought to be mentioned: 1) the scope of the audiovisual media notion; 2) principles of jurisdiction; 3) independence of national media regulators; 4) promotion of European works; 5) requirements for audiovisual commercial communications; 6) consumer protection. The presentation of the subject in the light of the regulation historical aspects allows to come to the certain conclusions regarding the political, economic, social and cultural feasible results of the mentioned changes and their impact on media organisation and management in the new audiovisual environment. Therefore, the legal approach is justified; the interpretation of the law with the subsidiary role of methodological trend of legal hermeneutics are applied.

Abstract:
The paper attempts to outline the Polish National Broadcasting Council’s establishing and evaluating its activities. The author observes that after 1989, one of the most essential achievements of the Polish media market was the creation of the National Broadcasting Council (Krajowa Rada Radiofonii i Telewizji KRRiT), that laid the foundations for a new media landscape in Poland. In a broader perspective, despite being criticized, the National Broadcasting Council is to meet high expectations for the electronic media regulation, its impact on state policy in implementing cultural and educational tasks by the Polish community broadcasters. Concurrently, making mistakes and handling criticism was partly caused by the Council politicization bias, a large executive subordination that doesn’t comply both with the Law “On Television and Radio Broadcasting” and European practice. Notable, the success of community broadcasters, who value interaction with viewers and listeners, should be a model for audiovisual sector to emulate.

Abstract:
The article discusses the changing role of the European Community and its impact on national media systems and policies. It claims that the EC-policies advocate total freedom to provide services across borders, and that, therefore, total liberalization may lead to a future cultural synchronization and economic oligopolization of Europe. The main arguments presented are: 1. The national, and especially the European policies regarding telecommunication services in general and broadcasting in particular are based on economic in stead of cultural considerations. This trend will continue after 1992. 2. The public service broadcasting structure and philosophy has undergone major changes throughout the last decades. These changes, initiated by internal as well as external factors, have affected the organizational and finance structures, and the programming of public service broadcasting. 3. It is questionable whether the European policies will be in the advantage of the so-called smaller countries in the European Community, like for instance Belgium or the Netherlands, on the one hand, and whether these policies will be able to secure a free and balanced flow of information, ideas, opinions and cultural activities within the Community on the other hand.

Abstract:
Recent challenges in the EU business sector also comprise the revision of the Audiovisual Media Services Directive (the new text in force since December 2018), the main media policy tool of the EU which establishes the legal framework for a convergent media landscape that comprises linear, non-linear audiovisual media services and, recently, also video-sharing platforms (VSPs) and user-generated content. One of the novelties in the revised text of the AVMSD is the new set of legal provisions enshrined in Art. 4 referring to the anti-circumvention procedure, a phenomenon the European media landscape has long been familiar with (i.e. broadcasters from another Member State circumventing the stricter rules of the target Member State). The need for a more transparent and efficient regulation originated in the practical difficulties of applying (pre-revision) Art. 4 by national regulating authorities (NRAs) as in many cases providers of audiovisual media services falling under another Member State’s jurisdiction refused to comply with their stricter rules or did not show any willingness to collaborate. The burden of proving the existence of circumvention or the evidence base to identify has proved to be a particularly difficult task for NRAs. The amended text of the AVMSD extends the power of the Member States to trigger the anti-circumvention procedure based on reasonable cause rather than the former requirement to prove the intention of circumvention by the provider. Also, the new set of provisions allows Member States to have circumvention reasonably established. Another novelty in the anti-circumvention procedure is the mandatory opinion that is to be requested by the European Commission from the European Regulators Group for Audiovisual Media Services(ERGA). The paper proposes to discuss the evolution of anti-circumvention measures in the two versions of the AVMSD as well as the projected effect on the phenomenon of circumvention of stricter rules on the new provisions.

Abstract:

"Product placement and its legal aspects." Master's thesis, Vysoká škola ekonomická v Praze, 2009. http://www.nusl.cz/ntk/nusl-17010.

Abstract:
The thesis deals with analysis of legal aspects of product placement. First, it looks at product placement from a general point of view. The work explains past legal framework where product placement was a part of "unfair competition" both in EU and Czech Republic. Then, it analyzes particular articles of directive 2007/65/EC which regulates the term product placement as the first in the history. The analyses showed that there are a lot of vague and disputable terms, e. g. "significant value", provision "free of charge", or ensuring that viewers are "clearly informed" about existence of product placement. Further, the work analyzes an implementation of the directive to the czech law and its comparison with Slovakia. Product placement was translated into czech law as "umístění produktu". The implementation is reflected in the "on-demand audiovisual media services Act" but also in the amendment of Act Nr. 231/2001 Sb. By contrast, Slovakia did not create a new special Act for non-linear audiovisual media services, just amended Act Nr. 308/2000 Z.z. and some other affecting laws. Finally, the work confronts the legal theory with praxis. This is done by a survey. The most important result of the survey showed that almost a half of the respondents think that product placement is not a commercial practice. This fact highlights the importance of ensuring that viewers are "clearly informed" about the existence of product placement and also the provision of consumer protection.

Pastorino, Agnese.

Full text
Abstract:
Audiovisual media expose adolescents to the vision of sexual contents on the Internet. Within public debate, online availability of material « likely to harm » or « seriously harming » children generates forms of moral panic. A major concern derives from sexual risks, such as pornography, sexting and child-pornography. At the European political-institutional level, the measures implemented are based on auto-regulatory, co-regulatory and regulatory solutions. Among these initiatives, the most important ones have been the Safer Internet programme and two directives respectively focused on children protection with regards to Audiovisual Media Services (2010/13/UE) and on combating the sexual abuse and sexual exploitation of children and child pornography (2011/92/UE). Methodologically, the thesis analyzes 45 debates of the European Parliament which dealt with these issues between 2001 and 2016. This corpus has been examined through an original quali-quantitative protocol, with a content analysis and the Alceste method applied via the softwares ATLAS.ti and IRaMuTeQ. This work wishes to contribute to research on audiovisual media, online sexual contents, adolescents and children, by proposing an original point of view on European policy. The main hypothesis has been that European parliamentary debates are limited in terms of representativeness of national cultures; starting from this premise, several aspects have been surveyed, either juridical, scientific, ethical and political issues. The main results respectively refer to different elements: 1. the variety of political-juridical interpretations of some concepts and the definitions of a few terms, besides the study of some juridical principles involved (fourth chapter); 2. the descriptions of online audiovisual sexual risks and the difficulties of European policy retrieved within parliamentary debates (fifth chapter); 3. the limits of European scientific knowledge in terms of representativeness of national culture, through the analysis of mentioned statistical data and studies (sixth chapter); 4. the multiplicity of ethical considerations, even based on different national cultures (seventh chapter); 5. the choice to favor self-regulatory measures (eight chapter)

Abstract:
This research analyzes the main digital transformations of CCMA (TVC and Catalunya Ràdio) related to the evolution of its audience (linear, digital and social), the digital and social managers’ professional routines of each media between 2014 and 2018, and the future challenges fort this public corporation. For the analysis, we set a methodology that combines a quantitative exploitation of all available audience data for each environment, the development and application of our own matrix, a qualitative analysis through an in-depth interview (digital and social managers) and a prospective survey to national and state experts in the communication sector. All this methodology, except for the expert panel, have been applied to a representative sample of 34 TVC and Catalunya Ràdio programs. The findings reveal that the CCMA steadfastly addresses the challenges that arise from a constantly changing audiovisual market. However, the results present important challenges for their media regarding the aging of the public profile in all areas and for most examined programs. On the other hand, the need to formulate digital strategies that consider an accelerated transformation of professional routines where we find a complex process of transition between linear and digital professional culture. Finally, the experts consider that the Corporation can still reach its maximum potential in the digital field, although they are aware that the current circumstances pose obstacles to reverse the tendencies of consumption and to change the state of the professional structure that we have detected.

Abstract:
As a result of economic liberalism in the eighties and the current socio-economic crisis in Europe, and much of the western world, governments are carrying out policy which threatens the stability of public services in diverse areas. The role of television as a public service has been in question for years. This is due to the emergence of private stations, its alleged inability to fulfil its public service role and because of political media manipulation which has raised much debate concerning its value. The situation of RTVE has not improved over the last thirty years. The different reconfiguration processes have led to debt increases from year to year. Another continuing problem is highlighted by critics who cite manipulation and lack of impartiality as a constant theme. Therefore, this leads us to consider the need for changes which can make this entity to fulfil its audiovisual and informative purpose.

Abstract:
Advertising has played a central role in shaping the history of modern media. While often identified with American consumerism and the rise of the 'Information Society', motion picture advertising has been part of European visual culture since the late nineteenth century. With the global spread of ad agencies, moving image advertisements became a privileged cultural form to make people experience the qualities and uses of branded commodities, to articulate visions of a 'good life', and to incite social relationships. Abandoning a conventional delineation of fields by medium, country, or period, this book suggests a lateral view. It charts the audiovisual history of advertising by focussing on objects (products and services), screens (exhibition, programming, physical media), practices (production, marketing), and intermediaries (ad agencies). In this way, the book develops new historical, methodological, and theoretical perspectives.

Abstract:
The digitalization of media content and communication processes has been used as the main justification for an important turn in the design of regulations affecting various audiovisual media services and information industries, more in general. A brief case study presented in this chapter will testify that from the 1950s until the 1990s the United States’ regulator facilitated the introduction of fundamental innovations by preventing vertical mergers between different audiovisual media services. On the contrary, nowadays regulators in different parts of the world seems to agree that differentiating between different technological platforms can hinder the emergence of new multimedia services based on technology convergence as well as the establishment of inter-platform competition. Alternative economic principles and the rationale of the old regulatory regime are used here to challenge these mainstream arguments, which justify the raise of the new and ‘converged’ information conglomerates.

Abstract:
The tourism industry has found an incredibly fertile ground to reach potential customers with the growth of social media. With the influencers’ tendencies to share moments in their lives and especially about their travels, social networks have become one of the most powerful weapons that travel agencies and hotels use to attract as many customers as possible. The phenomenon of influencers is one in development in our country as well. New accounts are constantly appearing on social networks, promoting brands from many fields (beauty, fashion, cooking, sports and even tourism). We are witnessing a revolution in the consumption of audiovisual content, and the development of the concept of influencer confirms this. The main purpose of this paper is to explore how influencers can influence consumers’ decisions in choosing a hotel. It will focus on research on attitudes and opinions on social media and information in tourism in Romania. The data were collected through an online opinion poll and were analyzed using descriptive statistics. Research has shown a great advantage in using influencers to attract customers. However, customers who choose certain hotels through influencers come with higher expectations, which is why the quality of services must rise to the highest standards.

Abstract:
This paper describes an effective methodological strategy that the Consolidated teaching innovation group in Communication and Audiovisual Media (In-COMAV), composed of a multidisciplinary teaching team, has been developing since 2016 within the Audiovisual Communication degree program offered by the University of Barcelona. This strategy consists of promoting service-learning projects within the context of various courses. Here we present the viability criteria established for the acceptance of projects oriented toward collaboration with organizations outside the university, the critical success factors and the results that this initiative has had on students, teachers, the university and society. Such results are perceived positively, yet there are still challenges and limitations to be overcome to ensure the continuity, sustainability and effectiveness of service-learning projects in higher education.
