Abstract:

The thesis proves the advantage of potential use of this term in both Czech and international courts practise.

In international human rights law, authors’ and users’ human rights are two sides of the same coin: both derive from human dignity and contribute to the development of the human personality. Authors have a set of moral and material interests that entitle them, as a minimum, to an adequate standard of living, to be (or not to be) associated with their intellectual works, and to object to any distortion or mutilation of those works. Open access publishing is an initiative that aims to provide universal, unrestricted free access to full-text scholarly materials via the Internet. This presents a radically different approach to the dissemination of research articles that has traditionally been controlled by the publishing enterprise that regulates access by means of subscriptions and licences fees levied on users, predominantly academic libraries. In presenting the case for open access publishing, the thesis explores the contemporary research environment, changing modes of knowledge production, the problems associated with t

Moral rights in copyright Abstract This thesis, after a brief introduction to the issue of copyright, defines the basic concepts relating to author's moral rights and its nature. It provides an insight into the issue from various different points of view, focusing on the natural nature of moral rights and the natural nature of an author's work, that is reflected in the copyright legislation. The thesis also offers a comparison of two major legal systems of copyright - the authors' right system and the copyright system, which demonstrate the key institutes and characterize both legal cultures t

South African science shows a decline in its global competitiveness in that its scholarly publication rate has not kept pace with that of other countries, both developed and developing. This, together with a decline in publication rate especially among junior South African scholars, suggests a structural problem in the South African national system of innovation. A declining publication rate indicates a problem of knowledge diffusion for South Africa, and hints at a possible knowledge generation problem. This thesis limits itself to the dynamics of knowledge diffusion with specific reference t

Song as an author's work and protection of its authors This diploma thesis deals with songs. Each of us listens to them on a daily basis, whether we turn on the radio or Internet TV, go shopping to the mall or directly to the live concert. All the songs have something in common - they are an author's work and we could never listen to them without their authors, who have certain rights for writing lyrics or composing music. The aim of the diploma thesis is to describe what might interest each author of the song. In addition to copyright theory, the author analyzes the song as a separate type of
