Abstract:
Particular attention has been paid on the necessity and urgency of developing a methodology for investigating the false suggestion of the court or other authorized agency, where a compulsory element of the criminalistic characteristic is the offender’s personality. It has been offered to divide the basic data about a person who commits false suggestion of the court or other authorized agency into the following groups: 1) biological: age, sex, anatomical and physiological qualities; 2) social: education, employment, marital status, criminal experience, communication with the person who committed the casual crime, motive. It has been noted that a large part of the studied crimes are committed with the purpose of concealing the crimes already committed, including with the aim of rebutment of the criminal’s guilt, that is, the majority of these crimes are derivative (casual) crimes from the main crime, where a certain subject is false suggested. It has been noted that most of the persons who commit the false suggestion of the court or other authorized agency have social relations with the person who committed the casual crime. Studying the materials of investigative and court practice indicates that family relationships are typical for these crimes. Besides, relations to such criminal offenses are characterized by the existence of friendly or conversely hostile relationships. The author has noted the existence of correlated relations between the person who commits the false suggestion of the court or other authorized agency with the motives for committing the crime. It has been established that researched crimes are most often committed for the following motives: 1) pity or desire to cover up the offender with whom the person has friendly or family relationship; 2) revenge, negative relationships, the desire to aggravate the situation of the offender; 3) benefits; 4) shame.

Abstract:
Aim. To conduct a detailed study of the requirements of good distribution practice. Materials and methods. The analysis of the current Guidelines on good practices (GxP), in particular the Guideline ST-N 42-5.0:2014 of the Ministry of Health of Ukraine “Medicines. Good Distribution Practice” was performed. Interpretations for the implementation of the requirements of good distribution practice based on the experience of audits of distribution companies for GDP compliance with the requirements were proposed. Results and discussion. The dependence of the correct distribution of medicines on the personnel involved in this process has been studied, and the negative impact on the activity of a wholesale pharmaceutical company in case of non-compliance by the personnel with the relevant requirements has been determined. The benefits and risks that may arise during the distribution of medicines related to the staff have been identified. The requirements for the Authorized (Responsible) Person, the knowledge and experience that he must possess have been determined. The job description of the Authorized (Responsible) Person has been considered in detail. The responsibilities of the Authorized Person of a distribution company are listed. Conclusions. The detailed analysis proposed will minimize the risks and errors that can lead to a negative impact on the quality of medicines. The appointment of the Authorized Person of a distribution company, the requirements imposed on him, the knowledge and experience that the Authorized Person must possess have been studied in detail. The advantages and risks of the personnel management of a distribution company have been identified.

To prevent and identifying the theft problem, smart car is an ultimate solution. When a person enters into car, automatically takes the photos of driver .Using Principal Component analysis algorithm, checks the photos of driver already stored in the database and decide the person is authorized or unauthorized. If the person is authorized, the person can access the vehicle. When the person is unauthorized. Using GSM and MMS modem, send messages to the user’s mobile number and then the car speed gets slow down. The ignition unit of the car can stops and the door cannot open. Using GPS, the location of the car and thief can easily identified using algorithmic approach. Any facial expressions and background conditions can changes in images, detection cannot takes place. To avoid this problem, face recognition and face detection algorithm can be used.

With Angela Merkel favoured to win the German election again, several political books about the German chancellor were published during 2013. Both in Germany and abroad, observers puzzled over the reasons for the on-going success of Mrs. Merkel, the scientist from East Berlin who became an internationally honoured stateswoman. One book stood out because of the label ‘authorized biography’ on the cover: Angela Merkel. The Chancellor and her world, written by Stefan Kornelius. Whether Merkel asked Kornelius, head of the international section of the Süddeutsche Zeitung, to write a book about her political career and vision, or just commented and approved a book Kornelius had written independently, is not mentioned. However, the fact is that Kornelius’ book is the first biography for which Merkel gave her consent. The question is: what new light does this authorized biography shed on the person behind the politician? This article was first published in EJLW on 14 October 2014.

Abstract:
The article is devoted to the study of the compliance of the rights and obligations of the person authorized to perform the functions of the state or local government to the right to respect for private life, including the submitting and publishing property declaration. The author determines the approaches of national and foreign researchers to the essence of the concept of the right to privacy and concludes that it is a natural right, that includes the right to respect for private and family life, housing and correspondence. The norms of the Constitution of Ukraine and the Convention for the Protection of Human Rights and Fundamental Freedoms of 1950 concerning the human right to privacy are revealed. It іs determined that one of the main reasons for the need to introduce in Ukraine the institution of declaring for officials of public authorities is the obligation of Ukraine to comply with the United Nations Convention against Corruption, and found that domestic law is stricter than the Convention. It is concluded that human rights are the priority area of state protection, so the requirements of anti- corruption legislation on disclosure of information about personal and family life of persons, authorized to perform state and local government functions, in the declaration and access of such information is a violation of Art. 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms and Art. 8, 32 of the Constitution of Ukraine. The author affirms that the disclosure of such a volume of information about any person is an indisputable violation of his right to privacy and family life. Authorized Persons (AP) play a critical role in the design and construction of building works in Hong Kong. Under the Building Ordinance, design and construction of building works need to be coordinated and monitored by an AP registered with the Buildings Department. Professionally qualified Architects, Engineers and Surveyors are eligible to register as AP after completing the prescribed assessment. In addition, the project AP is often appointed by the project owner to be the project team leader. In these capacities, a project AP is exposed to various risks. This paper seeks to identify the fee sensitive risk exposures of project APs. Through an ANOVA study, these risks exposures are those due to liabilities under the Building Ordinance at the construction stage, those towards the third parties and the clients.

Abstract:
The article deals with the problems of searching missing persons and inviolability of private life of a person, namely, how proportionate, and reasonable is the publication of sensitive data of a person in the mass media when disappearance of a person reported. Analysis of the statistical indicators of the searching of missing persons gives basis for the conclusion that a significant number (80%) of persons reported as missed, in fact they are not such, but without warning their relatives were absent for various reasons – somewhere stayed late, left their place of residence for other reasons, went abroad. Nevertheless, photographs and other sensitive data of such persons are published in the mass media. Moreover, there was an opinion on the need to bring to administrative responsibility those who left the place of residence without warning their relatives. On the author’s opinion, one of the reasons for the unjustified use of the media for searching for persons and violating the privacy of a person is the poor performance of the preliminary searching measures for clarify the circumstances and causes of disappearance. The article also proposes to amend the definition of the missing person, clarify the essence of the notion of “to declare a search”, the procedure and officials authorized to declare such a search, and also introduce the category “Persons who have lost contact with relatives”.

Abstract:
The purpose of the article is that on the basis of the analysis of positions of scientists-administrators and norms of the current legislation it is necessary: first, to find out the meaning of the term competence in activity of public administration bodies issues of prevention and detection of corruption, secondly, to clarify the basic rights and responsibilities exercised by the authorized units (authorized persons) on the prevention and detection of corruption as part of the administrative and legal status of the latter. The relevance of the article is that one of the main problems associated with the high level of corruption in the activities of public authorities is the lack of effective departmental anti-corruption programs. The annual plans to prevent corruption in public authorities are mostly formal and reproduce the provisions of the relevant higher-level acts. The detection of corruption is virtually nullified, as there are no systems for detecting and analyzing the risks of corrupt procedures, and there is a neglect of the implementation of mechanisms for reporting suspicions of corruption and protecting those who report them. The article provides a scientific review. The article provides a scientific review of the positions of scientists on understanding the competence of public authorities. The competence of the authorized unit (s) to prevent and detect corruption is considered from the standpoint of the legally established possibility of implementing the set of rights assigned to the authorized units (authorized person), which contribute to the implementation of anti-corruption legislation in terms of prevention and detection. It is proved that the competence of the authorized unit (s) to prevent and detect corruption is a component of the administrative and legal status of the authorized unit (s) and ensures the implementation of the entire functional spectrum of prevention and detection of corruption at the local level. In order to clearly regulate the competence of the authorized unit (s) to prevent and detect corruption, the article draws attention to the need to make appropriate changes to both legislative and local regulations, which will contribute to the formation of a culture of unacceptable corruption.

In the thesis, considering the fundamental changes anti corruption legislation (inconsequence the ratification a number of international anti-corruption legal acts by Ukraine) the detailed and complex analysis of the item of crimes in the area of service and professional activities related to the provision of public services has been made. The author observed the historical experience of doctrine about the item of crime, writer singled out three periods of its evolution: 1) absorption the concept "item of crime" by the concept "object of crime" (XIX century – 1917 year); 2) the conception of "the item of crime" has acquired classical meaning (1917–1991 years); 3) the pluralism of scientific concepts over the legal nature of "the item of crime" (1991 year – until present). Furthermore, it has been described the basic concepts of the essence of the item of crime ("material theory" and " the mixed nature theory" of item of crime); its place in the structure of the offense; relationship with other elements of crime (victims of crime and the tools of its commission) and the conceptual aspect of "crimes without item" from the position of the service activity crimes and professional activity crimes related to the provision of public services. Classification of item of the crimes in the area of service and professional activities related to the provision of public services has been developed on the basis of general philosophical, rational-philosophical and specialized criteria. The comparative legal analysis of item of crimes in the area of service and professional activities related to the provision of public services has been made under the criminal law of Ukraine and countries in which the main sources of criminal law are penal codes: continental legal family (Federal Republic of Germany, French Republic), Muslim legal family (Republic of Turkey, Arab Republic of Egypt and the Hashemite Kingdom of Jordan), the socialist legal family (People's Republic of China), East-European legal family (Republic of Belarus and Russian Federation) and Common law family (United States). The basic aspects of the concept of “undue advantage” formation have been set. Those are historical and international legal aspects. Moreover, it was found that the concept of "undue advantage": first, is complex, because it stands on the verge of two Science (Economics and Jurisprudence), and secondly, it is a systematic (consisting of a large number of categories which are exposed to the depth analysis). Revealed that the concept of "a significant amount assets" is a hard-structural and formally complies the requirements of the UN Convention against Corruption, however, its legal content is not perfect. The basic features of the official document have been outlined: formal (content, form, requisites, material carrier) and essential (the role of an official document and the individual who made and certified it). The main features of the declaration of the person authorized to perform state functions or local government are: general data (basic personal data of individual and his family, information about employment and residence), information on property and income, information on costs and financial obligations and corporative rights information. Special attention is paid to the impact of the item of crimes in the area of service and professional activities related to the provision of public services on the criminal legal qualification. In particular, outlines the aspects of criminal legal significance of undue advantage, official documents and declarations of person authorized to perform state functions or local government, to qualify the crimes in the area of service and professional activities related to the provision of public services, ensuring completion of construction of corpus delicti, and separating non-criminal acts from criminal acts and offenses among themselves.

Авторка у свої роботі звернула увагу на декілька нерозв’язаних проблем, які існують у функціонуванні системи гарантування вкладів в Україні: 1) відсутність правового механізму включення інших осіб, які провадять депозитні операції окрім банків (наприклад, кредитні спілки) до системи суб’єктів гарантування вкладів фізичних осіб в Україні; 2) відсутність правового механізму захисту прав вкладників відмінних від фізичної особи – юридичних осіб.
Автор в своей работе обратила внимание на несколько нерешенных проблем, которые существуют в функционировании системы гарантирования вкладов в Украине: 1) отсутствие правового механизма включения других лиц, осуществляющих депозитные операции кроме банков (например, кредитные союзы) к системе субъектов обеспечения вкладов физических лиц в Украине; 2) отсутствие правового механизма защиты прав вкладчиков отличных от физического лица - юридических лиц.

Abstract:
The thesis discusses a category of cultural heritage that has been labelled "Sami circular offering sites", aiming to establish some basic facts about their origin, distribution and use, as well as their cultural and socio-political context and influence. The stone enclosures in question have been interpreted as Sami offering sites since the mid-19th century, but a discourse analysis of the research history indicates that this may have been based on a scholarly hypothesis rather than ethnographic or archaeological evidence. Furthermore it is questioned if all the structures that are currently included in this category are in fact remains of the same cultural practice. This is investigated through surveys of 81 suggested circular offering sites in Norway, two excavations and analyses of the find material. The large stone enclosures in counties Finnmark and Troms that were first categorised in this way prove to have quite consistent builds and measurements and a find material mainly dating between the 13th and 17th centuries. These structures are here labelled type 1. In contrast, constructions that have later been added to the category, particularly in other areas, have other and less consistent characteristics and seem to include remains of a range of different activities. They are here divided into two generic types 2 and 3. The thesis further discusses alternative interpretations for the type 1 structures, concluding that their materiality, construction, location, topography and finds are consistent with archaeological, historical and ethnographic evidence for wolf traps. Their distribution indicates a regional Sami cultural practice related to inland winter habitation and travel routes, while also apparently coinciding with the Russian/Karelian taxation area in northern Norway in the Middle Ages. Thus the builds may have been inspired by the fur trade or other activities of the latter groups. It is uncertain when exactly the installations fell into disuse, as datings are calibrated to AD 1450-1650. The abandonment could be related to the decline of Novgorod as a fur trade centre, Russian loss of taxation rights in northern Norway, increased Swedish impact in the inland areas and Norwegian activity along the coasts, which all led to changes in administration, taxation, trade patterns and demand for furs. The contemporary decimation of the wild reindeer population, increased reindeer herding and introduction of new weapons like crossbows, guns and foothold traps, may all have made permanent trapping installations less useful. The sites may, however, have gone out of use at different times. Certain finds of marrow split bones, very recent coins and other objects suggest a later reconceptualisation of some structures as offering sites, whether as a local explanation or inspired by the later scholarly definition. Throughout the thesis, the construction and distribution of the archaeological category and the preference for the ritual or religious interpretation are discussed as results of specific socio-political contexts, where stereotypical notions about Sami identity and culture have had a strong impact. The thesis explores how academic and other narratives influence each other within certain discourses of power and indigenous "rights and rites", and the continuous mutual impact on individual actions and emotions through networks of people, power and things. The present reinterpretation challenges existing academic and local narratives. It is based on the materiality of the structures, but the offering site explanation is not positively refuted. Yet, as part of an authorised heritage discourse, the present statement is more likely to impact future categorisation and practices than other narratives within other discourses, expressing a persistent and inherent power inequality. This may be ethically problematic in the context of an indigenous minority, but it may also be argued that the role of the archaeologist expert is precisely to expose the insisting materiality of the past and the power/knowledge networks that promote specific narratives about it.

Склалася ситуація, коли правоохоронні органи самостійно не спроможні протидіяти корупційним злочинам і при цьому недостатньо співпрацюють із громадськістю. Між ними немає довіри і бажання спільно працювати на результат. Велика кількість громадських організацій в антикорупційній сфері діє хаотично і розрізнено, часто, на жаль, непрофесійно. Вищевикладене спонукає до переосмислення ролі й місця громадськості в системі запобігання корупційним злочинам, вироблення загального підходу до вирішення цього завдання, розроблення комплексу запобіжних заходів. Мета дослідження полягає в розробленні рекомендацій щодо шляхів і заходів підвищення ефективності «зв’язної сили» в запобіганні корупційним злочинам. Досягнення поставленої мети передбачає вирішення таких завдань: – охарактеризувати історичний досвід залучення громадськості до запобігання корупційним злочинам; – розробити поняття «громадськість як суб’єкт запобігання корупційним злочинам»; – дослідити правові засади участі громадськості в заходах запобігання корупційним злочинам в Україні; – з’ясувати тенденції поширення корупційних злочинів в Україні; – оцінити результати діяльності громадськості щодо запобігання корупційним злочинам; – дослідити міжнародні стандарти залучення громадськості до антикорупційної діяльності і визначити перспективні напрями їх впровадження; – узагальнити найкращі міжнародні практики участі громадськості в заходах запобігання корупційним злочинам; – запропонувати заходи запобігання корупційним злочинам за участю громадськості у сфері приватноправових відносин; – розробити комплекс заходів із підвищення ефективності участі громадськості в запобіганні корупційним злочинам в Україні. EN : The qualification work consists of 114 pages, contains 102 sources of information used. Corruption in Ukraine is recognized as a threat to national interests, sustainable development and European integration. Despite considerable efforts made by the state and international institutions to tackle corruption in major areas of public life, its level remains high. The anti-corruption reform launched in 2014 is only partially implemented. International projects in the area of combating corruption are gradually being phased out. The incompleteness of anti-corruption reform and the lack of political will bring real change lead to despair and disappointment in the society, giving rise to radical sentiments. A situation has arisen when law enforcement agencies are not capable of combating corruption crimes on their own and are not cooperating with the public. There is no trust between them and a desire to work together for the result. A large number of NGOs in the anticorruption sphere operate in a chaotic and disparate manner, often unfortunately unprofessionally. The above leads to a rethinking of the role and place of the public in the system of preventing corruption, developing a common approach to solving this problem, developing a set of preventive measures. The purpose of the study is to develop recommendations on ways and measures to improve the effectiveness of "cohesive power" in preventing corruption. Achieving this goal involves the following tasks: - Describe the historical experience of involving the public in preventing corruption; - to develop the concept of “the public as a subject of corruption prevention”; - to investigate the legal framework for public participation in preventing corruption in Ukraine; - find out the trends of corruption in Ukraine; - to evaluate the results of the public activity on prevention of corruption crimes; - explore international standards of public involvement in anti-corruption activities and identify promising areas for their implementation; - to summarize the best international practices of public participation in measures to prevent corruption; - to propose measures for the prevention of corruption crimes involving the public in the field of private legal relations; - Develop a set of measures to increase the effectiveness of public participation in preventing corruption in Ukraine. The object of the study is the public relations that are designed to prevent corruption. The subject of the study is the nature and importance of "cohesive power" in the activities of persons authorized to perform the functions of the state as a means of preventing corruption: national and international legal standards.

Abstract One of the central tenets of contemporary bioethics is that mentally competent persons have a right to refuse medical treatment, even if the refusal might lead to the individual’s death. Despite this principle, laws in some jurisdictions authorize the nonconsensual treatment of persons with tuberculosis (TB) or other serious infectious diseases, on the grounds that doing so is necessary to protect the safety of others. This chapter argues that, in the vast majority of situations, overriding a refusal of treatment for infectious disease is not justifiable, as the risk to third parties can be avoided by the less restrictive alternative of isolating the patient. At the same time, it rejects the extreme position that the nonconsensual treatment of infectious disease is never appropriate. Instead, it concludes that compelling an individual to undergo treatment for infectious diseases may be ethically justifiable in exceptional situations if a refusal of treatment poses a grave risk to third parties, the treatment is not overly burdensome and has been established to be safe and effective, and less restrictive alternatives, including humanely isolating the patient, are not feasible under the circumstances. The burden should be on those seeking to compel unwanted treatment to demonstrate that these requirements have been met.

The problems related to the procedure of detention by an authorized official without the decision of the investigating judge or court, of a person suspected of committing a crime have been studied, namely: the uncertainty about who is authorized to detain persons under Art. 208 of the Criminal Procedure Code of Ukraine; lack of understanding or authority of the above-mentioned persons to detained persons before entering information into the Unified Register of Pre-trial Investigations, to execute search warrant of detained person and to carry out temporary seizure of things and documents and whether further evidence obtained during such proceedings will be declared inadmissible; the lack of an effective mechanism for ensuring the rights of detainees, in particular, round-theclock urgent linguistic assistance for persons under criminal prosecution, etc. The purpose of the study is the new scientifically substantiated results of detention by an authorized official without the decision of the investigating judge, of a person suspected of committing a crime, as well as formulating on their basis scientifically based proposals and recommendations for improving criminal procedure law and practices of its application in the aspect of the subject of research. It is concluded that in today’s actuality it is possible to change the practice of detention only by taking comprehensive measures. The first aspect is related to legislative changes. We believe that the law should be clear. Consequently, the CPC of Ukraine must clearly define, first, the procedural status of a detained person, with the provision in a separate rule of his concept, rights and responsibilities; second; the issue of legality of detention before entering information into the Unified Register of Pre-Trial Investigations has been resolved; thirdly, the procedure for searching of a detained person has been regulated. The second aspect is related to the development of bylaws on the algorithm of actions of the authorized official, which would clearly define his powers; the order of interaction between different services and units during the detention of a person. The third aspect is related to the continued implementation of pre-trial investigation and pre-trial detention facilities in all units of the Custody Records system, which allows recording of all actions of a detainee from the moment of his/her actual detention until the issue of choosing a measure of restraint against him/her is resolved, in particular – and during the explanation of the rights of the detainee by the officials responsible for the stay of the detainees. The fourth area is to strengthen the measures of respect of the rights of the detained person and, in particular, the need to develop a procedure for hiring an interpreter through the Centers for Free Secondary Legal Aid and an effective round-the-clock mechanism for providing urgent linguistic assistance to detainees who do not speak the language of criminal justice.

Therefore, the authors intend to aid in the security of such organisations by bringing a video based human authentication system for access control which is a type of cyber physical system (CPS). CPS is an integration of computation and physical processes; here the computation is provided by face detection and recognition algorithm and physical process is the input human face. This system aims to provide a platform that allows any authorized person to enter or leave the premise automatically by using face detection and recognition technology. The system also provides the administrator with the access to the logs, wherein he/she would be able to access the details of the people entering or leaving the organisation along with the live video streaming so that there is no sneaking of any unauthorized person with any other authorized person. The administrator can also do registration on behalf of a new person who requires access to the premises for a restricted amount of time only as specified by the administrator.

Various techniques and technologies are being explained to detect the details of the driver, and also Various vehicle thefts are being done in spite of various surveillance cameras are set down to keep an eye on the activities and various technologies are being implemented to diminish the vehicle robbery. So, we proposed the system with the concept of deep learning. As compared to normal detection techniques deep learning collects N number of input samples and compares it with the database details. After the authentication process the engine mechanism starts, if not authorized it gives a buzzer sound and vehicle doesn’t start until the details of registered person is authenticated.

Smart houses represent a modern technology which can secure and facilitate our life. The objective of this chapter is to adapt medical sensors to home automated systems, which collect medical data such as blood pressure, heart rate and electrical heart activity for elderly and/or disabled persons. Firstly, the collected data is transferred to a home server and to an external manager for further analysis. Subsequently, data is stored at a database where monitoring is available only for authorized users via a simple web interface. The IEEE 802.15.4 wireless standard has been chosen as the preferred solution for communication in the smart house. Finally, two implementation scenarios of the smart house for an elderly and/or disabled person are simulated using the Custodian software tool. This case study shows that simulating the automation system of a smart house before the implementation is advantageous.

Security is the most notable fact of all computerized control gadgets. In this chapter, a voice ID computerized gadget is utilized for the security motivation using speech recognition. Mostly, the voices are trained by extracting mel frequency cepstral coefficient feature (MFCC), but it is very sensitive to noise interference and degrades the performance; hence, dynamic MFCC is used for speech and speaker recognition. The registered voices are stored in a database. When the device senses any voice, it cross checks with the registered voice. If any mismatches occur, it gives an alert to the authorized person through global system for mobile communication (GSM) to intimate the unauthorized access. GSM works at a rate of 168 Kb/s up to 40 km and it operates at different operating frequencies like 800MHz, 900MHz, etc. This proposed work is more advantageous for the security systems to trap the unauthorized persons through an efficient communication.

Abstract:
The impact of the COVID-19 outbreak is being endured throughout the world, and the European Union (EU) is no exception. The rapid spreading of the virus effected, among other things, restriction on the freedom of movement. The EU member states introduced national response measures to contain the pandemic and protect public health. While broadly similar, the measures differ with regard to strictness and the manner of introduction, reflecting the political legitimacy of the respective country. With the ‘Guidelines concerning the exercise of the free movement of workers during COVID-19 outbreak’ – its first COVID-19-related Communication – the European Commission (EC) attempted to curb differing practices of the EU member states and ensure a coordinated approach. Ultimately, this action was aimed at upholding of fundamental rights as guaranteed to EU citizens, one such being the freedom of movement. Thus, from the very start of the pandemic, the coordinated actions of EU institutions sought to contain the spread of COVID-19 infections with the support and cooperation of EU member states. This is confirmed by the most recent Council of the EU (Council) recommendation on a coordinated approach to restrictions to freedom of movement within the EU of October 2020. While they did prevent the spread of infection and save countless lives, the movement restriction measures and the resulting uncertainty have greatly affected the people, the society, and the economy, thereby demonstrating that they cannot remain in force for an extended period. This paper examines the measures introduced by EU member states and analyses the legal basis for introducing therewith limitations on human rights and market freedoms. To what extent are the EU and member states authorized to introduce restrictions on the freedom of movement in the interest of public health? Have the EU and member states breached their obligations regarding market freedoms and fundamental rights under the Treaty? And most importantly: have they endangered the fundamental rights of the citizens of the EU?

Established as a personal right, the right to free speech implies obligations and duties, which may generate possible restrictions. Freedom of expression works correctly in a legal framework when it comes to a legitimate aim in a state law. Article 10, paragraph 2, of the Convention explains the conditions under which the right to freedom of expression is justified by the need to protect certain public interests (such as those relating to national security, the territorial space of the state, public order, the prevention of crimes, the protection of health and social morals, the guarantee of authority and the impartiality of the judiciary) but also to protect certain private interests, such as reputation and the rights of others. persons or the need to prevent the publication of secret information. This paragraph basically authorizes states to take certain measures to protect those interests, which materialize through rules and normative rules of the right to conscience, opinion and freedom of expression States enjoy a margin of appreciation for establishing the need for such reactions in a state governed by the rule of law, but in the end it is also up to the European Court of Human Rights to rule on the compatibility of interference with the provisions of the Convention, assessing on a case-by-case basis if the interference arises as a result of the urgent social issues and whether it is fair.

The paper elucidates a process integration method in which the virtual reality (VR) application moves beyond being just a visualisation tool to functioning as an interface for collaboration. The central module of this system is the so-called session manager. The session manager co-ordinates the collaboration of several authorised individuals and various software tools all working together on one development project. The session manager is at the centre of the product data management (PDM) system managing product structure, product documents and project state. The associated VR system synchronously presents the current state of the project. It is thus possible to visualise changes in geometry, appearance or structure in real time. In this way, VR can be integrated into a heterogeneous system consisting of CAD workstations and simulation applications. Integration is based on a bi-directional link among all applications via the PDM system. Thus, it is possible to use and represent not only the product’s design and structure, but also its non-geometric information using PDM. Additionally, the persons working with it may select product components in VR and assign tasks to workstations or persons, since, in VR, relevant information from the PDM is available.

Abstract:
Organ transplantation, as an extremely demanding, but impоrtant medical intervention, has always provided significant scope for opposing different legal and ethical principles. That scope is being expanded by considering the possibility that a sensitive category of persons, such as minors, may appear in the role of donor. While transplantation of organs from living minors is prohibited for the above reasons, cadaveric transplantation of organs from deceased children is legal in the law of the Republic of Serbia. This paper analyzes precisely such legally regulated organ donation, which implies the possibility of the appearance of a deceased minor as a donor. While, on the one hand, there is a growing need to take organs from children in order to transplant them and preserve the life of another child of appropriate age, such a decision has a significant emotional impact, above all, on the parents of the child. Keeping in mind that parents appear as the only authorized holders of the right to decide on the transplantation of an organ of a deceased minor, it is necessary to analyze the legal nature of the rights they have on the body and organs of the child. Also, it is necessary to point out the importance of more precise legal regulation of the conditions under which such transplantation can be performed, as well as the necessity of ensuring the autonomy of the will of the minor in terms of organ donation, which he could achieve for life.

Abstract:
The outbreak and the rapid spread of global COVID-19 pandemic have put significant strains on the institutions. The need to adapt to “new normal” and contain the rapid spread of disease, while maintaining a functional society, resulted with introduction of numerous new legal mechanisms and adaptation of the existing ones. However, it seems that one area of law remains on the fringes: the regulation of wills. Even before the start of the pandemic many authors often pointed to the fact that the current legal framework does not follow modern technological developments, but no significant attempts were made to overhaul the inheritance law. Also, once the pandemic started in its full, there were no references to introduction of extraordinary mechanisms or new legal solutions to overcome the potential difficulties in forming wills. Comparative analysis yielded no better results: although some countries (such as Austria) recently completely overhauled their regulation of inheritance law, it seems that no attempts were made to introduce new types of wills or new methods of drafting wills into their regulations. Furthermore, following the spread of the pandemic, increasing number of potential testators find themselves unable to use traditional methods of drafting wills as they, or the authorized persons tasked with assistance and creation of wills, remain isolated from one another due to various reasons (lock-downs, isolation in case of experiencing symptoms, etc.). Having in mind these circumstances, it is necessary to ascertain whether there is a genuine need to introduce new types of wills into existing legal framework, or to adapt the current legal framework by facilitating the communication between citizens and the institutions. Also, it is necessary to analyze whether the interpretation of the existing legal framework enables the introduction of certain facilitating mechanisms. In order to reach these goals and clarify the possibilities within the current legal framework, interpretative and comparative method are used.

The data on the health status of a policyholder represent a significant circumstance for risk assessment and concluding a life insurance contract, and are also legally relevant circumstances for exercising the rights from that contract. The author starts from a theoretical analysis of the perception of data on the health status of policyholders as personal data, comparing the right to confidentiality of such data with the duty to report them (before concluding a life insurance contract) in terms of reporting all circumstances relevant to the insurance risk assessment. In order to properly fulfil the obligation of pre-contractual nature, the paper analyses the legal norms governing this issue and also provides a comparative overview of the Croatian and German insurance legislation with special emphasis on the scope of health data that the insurer is authorised to require, the clarity of legal standards and legal insurance norms contained in the insurance questionnaires and the life insurance offer. Presenting the importance of COVID-19 infection and possible chronic consequences for human health, the author indicates the extent to which COVID-19 infection (mild or severe form of disease, possible need for hospital treatment) will have an impact on the design of new insurance questionnaires and the relevance of genetic testing results in the context of concluding future life insurance contracts.

In developing international humanitarian law (IHL), States have aimed in part to lay down the primary normative and operational framework pertaining to principled humanitarian action in situations of armed conflict. The possibility that certain counterterrorism measures may be instituted in a manner that intentionally or unintentionally impedes such action has been recognized by an increasingly wide array of States and entities, including the United Nations Security Council and the U.N. Secretary-General. At least two aspects of the contemporary international discourse on intersections between principled humanitarian action and counterterrorism measures warrant more sustained attention. The first concerns who is, and who ought to be, in a position to authentically and authoritatively interpret and apply IHL in this area. The second concerns the relationships between IHL and other possibly relevant regulatory frameworks, including counterterrorism mandates flowing from decisions of the U.N. Security Council. Partly in relation to those two axes of the broader international discourse, a debate has emerged regarding whether the U.N. Security Council may authorize one particular counterterrorism entity — namely, the Counter-Terrorism Committee Executive Directorate (CTED) — to interpret and assess compliance with IHL pertaining to humanitarian action in relation to certain counterterrorism contexts. In a new legal briefing for the Harvard Law School Program on International Law and Armed Conflict (HLS PILAC), Dustin A. Lewis, Naz K. Modirzadeh, and Jessica S. Burniske seek to help inform that debate by raising some preliminary considerations regarding that possibility. The authors focus on the possible implications of States and other relevant actors pursuing various responses or not responding to this debate. One of the authors’ goals is to help raise awareness of this area with a focus on perspectives drawn from international law. Another is to invite a broader engagement with the question of the preservation of the humanitarian commitments laid down in IHL in a period marked by a growing number — and a deepening — of the intersections between situations of armed conflict and measures to suppress terrorism.
