Full textThe thesis aims to examine the principle of distinction between politics and administration, regarded from the angle of the discipline of the bureaucracy, especially the leadership. Summarizing the results of research, the work moves results in contrast to the current doctrinal and jurisprudential views, generally attracted by the problem of impartiality and to fight corruption, topics that typically underlie a judgment of undemocratic matrix. The basic idea is that the creation of a clear break between politics and administration, such as to sever the eliminated elements of the trust- appointments, can only lead to a questioning of the entire model of the distinction, especially in reference to the discretionary choices highest rate of political nature, in relation to which still appears unavoidable, while recognizing the technical and investigative prerogatives of the administration, the remission of the choice that the managerial bodies legitimized popular investiture.

Full textThe thesis aims to investigate the role that criminal law can play in dealing with the so-called "problems of modernity". In particular, the paper investigates the real capabilities that the criminal instrument can have in guaranteeing adequate protection to ecological systems. The first chapter of the work is dedicated to the critical examination of the doctrinal positions in order to define danger as a constitutive element of the crime, while the second focuses on the analysis of the precautionary principle. In the following chapters, the study focuses on the complex reality of environmental legislation and aims to highlight, on one hand, how crimes of abstract danger cannot guarantee adequate protection to the complex system constituted by the ecological matrices and, on the other hand, how the recent introduction of crimes against the environment within the criminal code has not at all remedied the different profiles of ineffectiveness of the system. In conclusion, a new model of managing environmental issue is proposed, based on a more marked enhancement of the profiles of responsibility of the legal person, the only subject really able to prevent and counter the most serious facts of environmental compromise.

Full textMore than one decade after the lack of implementation of the 2001constitutional reform leads to a forthcoming constitutional review. Recently, due to undergoing changes of the constitutional framework, the State and local authorities have focused their attention on establishing a large number of mutual agreements, arrangements and further consensual paradigms. The system of Conferences undertook an examination which emphasizes their essential role to coordinate both the political and administrative actions of local authorities, as well as necessity of further consensual paradigms rarely taken into account by the legislative field. The principles of subsidiarity and fairness often lead to unclear and confusing heterogeneous forms of agreements. although they are considered contributions of legal authors and jurisprudence, the intervention of the legislator should be required. Having regard to the relation between the State and the local autonomies, the analysis revealed an ambiguous trend between autonomist and centralist positions. In conclusion, in order to achieve significant and rapid changes in the second part of the Constitution, the aim is rationalization and simplification of the functions and procedures, which leads to time, energy and resources efficiency.

Full textThe audit of the italian Court of Auditors: the evolution because of administrative innovation, constitutional reform and european integration First of all, there are an analysis about the historical reasons that were the basis of the Court’s institution and a general study about the l. n. 800/1862; subsequently, in the 1948, the Italian republican Constitution provides for the presence of an independent national control’s organ, like the Court, and, also, for the control over regions and local authority. Three different reasons bringed about an audit’s transformation, now in progress: at first, the development of public administration, today oriented towards economics and managerial profiles, to carry out the results and the targets; these development was promoted by important cultural studies, like “Rapporto Giannini” in the seventies, and by the legislative elaboration of principles like efficiency, effectiveness and economically. Second reason for the evolution of Court of auditors, was the constitutional reform in the 2001: the recent constitutional law n. 3/2001 supported the local authority’s autonomy and selfgovernment; consequently the Court’s role is today more important than in the past because this is a republican, and not only statal, independent audit’s organ. At last, third reason is the European integration’s process: the relationship between Italian Court, European Court of Auditors and others Supreme Audit Institutions national of control are problematic; the Treaty requires the Court's audit visits in the Member States to be carried out in liaison with the national supreme audit institutions or other competent national audit bodies: the cooperation is also the general principle.

Full textThe thesis reconstructed the theme of the exercise of administrative power by consensus. We started from the observation that in the current scenario the action of the administration according to negotiated models has become increasingly widespread. More specifically, in the absence of a rule that regulates the process of forming the public agreement, the research investigated what are the powers due to the administration andthe citizen in the preparatory phase to the conclusion of the agreement. It was also highlighted how we are witnessing a phenomenon of expansion of the institute under consideration even beyond the regulatory dictate. The research also addressed the issue of the possible contents of public agreements and identified the contractual clauses that are most frequently included in conventional documents, among which the focus was on the clauses containing the cd. "exorbitant charges". The central question is whether and to what extent the public administration can, through these clauses, achieve greater results than those achievable by unilateral administrative measure, without violating the principle of legality. Theadministrative case-law, which currently prevails, considers that these clauses are fully legitimate as the result of the free consent of the private individual. The analysis had as a reference point of all the research the question of whether and how the consensual principle can be combined with the principle of legality. Finally, the research concerned the identification of limits to the negotiating autonomy of the private sector and the administration.

Full textDuring last decades, two trends have been underlined in Europe: laws on local authorities (municipalities, provinces and metropolitan areas) are getting less differing, enhancing the role of these entities (except for the phase following latest economic crisis) and we see a progressive transfer of decision-making powers from National States to European Union. It’s interesting – as it was done in this study – to understand how the two trends are connected and, particularly, how the European Union influences local authorities of member States. In order to appreciate differences and underline trends who associate different systems (also in the light of recent reforms), the analysis is focused on the evolution of legislation about local authorities, not only in Italy, but also in other States of European Union, Then, turning to European Union legislation, particular attention is dedicated not only to general principles listed into primary law, but also to the analysis of specific policies endowed with consideration for the role of local levels (primarily the policies about economic, social and territorial cohesion). In this way, a data comparison was made possible to understand whether the reforms interesting local authorities in recent past has been generated by legislation, by policies and actions of European Union, and to what extent. Finally, an attempt to outline the possible and future role of local Authorities into European architecture has been made, in a potential multi-level federalism perspective.
