Full textEurope in the 20th century was marked by the increase in power of local communities and of the European Union. Despite the limited interest originally granted by the Community institutions to Member States’ infra-state communities, this concomitant development incites to study the relations between the principle of autonomy of these communities and the European Union. Thus, the Europeanization of public life sets the question of its impact upon local autonomy. The European Union certainly tends to take into account the autonomy of infra-state communities, but in a minimal and relative manner. Its favourable effects towards local autonomy are thus limited. Besides, the neutrality displayed by the European Union is not borne out in practice. The principle of institutional and procedural autonomy, supposed to guarantee the indifference of the European construction towards the internal organisation of Member States actually turns out to be an instrument allowing these to channel the autonomy of their infra-state communities. The central State, notably in France, then comes out as an obligatory intermediary. In this respect, local communities are imposed Community law while they do not contribute to its adoption. Therefore, the European Union does bind, directly and indirectly, the local autonomy

Full textI) Limites inhérentes à l’interprétation juridique des Traités tels qu’ils se retrouvent dans les règles institutionnalisées du raisonnement de la Cour ;
II) L’interaction, au niveau européen, entre la Cour et les autres institutions ;
III) Les pressions et les stratégies d’influence des Etats membres vis-à-vis de la Cour comme agent de leurs préférences ;
IV) La dépendance structurelle de la Cour supranationale vis-à-vis ses interlocuteurs judiciaires au niveau national ;
V) Le degré d’obéissance que les appareils administratifs et exécutifs des Etats membres démontrent vis-à-vis la jurisprudence de la Cour.
Par rapport à ces facteurs, et leur importance relative dans la détermination de la ligne d’action de la Cour de Justice, la thèse évalue les changements et les défis auxquels est soumise la fonction de la Cour de justice au niveau de l’Union européenne, en particulier par rapport à l’environnement de plus en plus critique ou évolue la trajectoire jurisprudentielle de la Cour par rapport aux acteurs politiques et juridiques, l’érosion du caractère sui generis du droit communautaire dans le contexte du droit international, le rôle de plus en plus affiché des cours nationales, et le contexte institutionnel dans lequel se trouve à agir cette juridiction.

Full textAfter, on the one hand, having redefined the term “decentralized co-operation”, in “international co-operation of local authorities” and, on the other hand, defined the stake of territorial cohesion of intra-European co-operation and the stake of development aid of non-European co-operation, the analysis of the legal problems puts forward two parallel legal systems in the matter. The former, under of the State impulse, is governed by international treaties, the latter, under the local impulse, is governed by the law. These two systems provide a specific sphere of activity, rules of litigation under development, multiple actors with badly defined roles, and legal tools not always adapted to the fields of intervention of co-operation. The analysis of these four legal problems raises an empirical legal construction and results in reconsidering the matter. Indeed, it seems necessary to redefine globally the international co-operation of the local authorities around the two legal systems, and of the extra/intra European stakes, through a specific law, to provide co-operation, with the means of its ambition of development in a regained legal safety

Full textThe idea of "regionalization" is currently very successfull in most of the European countries, including the countries with a long centralizing tradition. It has an influence upon the europan community too. The classic European system, based on the relationship betweeen the community and its member states, don't be a reality any more and a new development appears in this relationship: the region. This notion has many differents meanings in each member state, but the situation of the federal republic of Germany is quite particular. It's the only federal state in the European Community , its "regions", the Länder, are federate states and have important powers. It's therefore interesting to analyse how a federal state with two levels of decesion, bund and Länder, could become integrated into a system already based on two levels, community and member states, without his federal characteristic disappears. The German Länder are direct and indirect in contact with the community and have some influence upon the decisions of the community. This relationship could be a model which could guide the relationship between the community and the European regions
