Abstract:
Urban design is concerned with the purposive production of urban meaning, through the coordinating design of conjunctures or relationships between spatial elements. It is argued that, in capitalist society, this production of meaning has typically supported shifts in capital accumulation, social reproduction, and legitimation in ways crucial to the reinforcing of dominant interests. Its effect has been to help counteract instability, system ‘degeneration’ (from the standpoint of such interests), and any fundamental transformation of the social system, This effect is termed ‘counteraction 1’. From considerations of urban design as production of values and as a body of practice, it is concluded that an urban design practice that is counteractive to dominant interests is, however, possible (‘counteraction 2’), Such a practice will be characterised by three ‘rules’, relating to the aesthetic program, the discursive penetration of the social context of urban design, and the breaking down of the present autonomisation and obfuscation of design as a domain of social interaction or discourse.

Abstract:
This paper addresses the following research question: what shaped the emergence of sociological research during the period of late socialism in Albania? The second aim of the paper is to reveal the causal mechanism by which a liberalised cultural policy brought about a shift. The traditional role of the socialist intelligentsia lessened in importance while the role of social scientists emerged. In the very final years of the state socialist regime, in 1989 to 1990, these latter were pitted against Party cadres and representatives in defending a limited yet free academic practice. In order to explain the intricate, early process of the emergence of sociology under state socialism in Albania, this paper utilises a layered theoretical framework that tries to capture the interaction between stages of regime development, the coexistence of various competing modes of legitimation, and the transformation of the heteronomous sector of cultural production into an emergent field of cultural production.

Résumé Au début du mandat français en Syrie et au Liban, le Saint-Siège renouvelle ses objectifs et ses moyens d’ action dans la région. Nous avons étudié ce mouvement à travers les lettres adressées à Rome par Mgr Frediano Giannini, vicaire apostolique d’ Alep et délégué apostolique en Syrie de 1905 à 1936. Les rapports de Giannini constituent un bon exemple de la manière dont les missionnaires participent à la production de connaissances sur les communautés chrétiennes orientales. En rendant compte des épreuves et des migrations qui leur sont imposées, Giannini participe au développement d’ une nouvelle perception de ces communautés, vues comme des minorités persécutées. Giannini sollicite les autorités françaises pour défendre les intérêts des chrétiens (à la fois les catholiques et les orthodoxes). Sa position est ambiguë : alors qu’ il exprime sa nostalgie au sujet du fonctionnement traditionnel du protectorat français, Giannini s’ implique lui-même dans le domaine politique et prend en charge une partie de l’ ancien rôle des Français. Cette ambivalence révèle l’ émergence d’ une nouvelle politique pontificale, fondée sur un double mouvement d’ autonomisation et de centralisation.

Abstract:
Beginning with a presentation of the asymmetry between philosophical and economic reflection, the article assesses the possible effects of practical philosophy in relation to the critical analysis of the independent economic domain. The article emphasizes the importance of political genealogy of capitalism which explains conceptual mutations leading to a) autonomisation of economic reflection, b) self-hegemonic economic reflection, c) domination of “real abstraction” that reflects not mental operations but social practice in capitalism. It is necessary to conceive differences between economics, the economy and economic domain, as well as to establish mediation between these domains. It is important not to perceive theoretical production as passive reflection in relation to reality, but to consider the theory as a constitutive-practical factor, as the condensation of certain social relationships. For economics (“dismal science”), this means that it is co-constitutive in relation to “economic reality”. Practical philosophy can contribute to the self-awareness of economic reflection in three domains: a) the relevance of ideology in relation to the autonomy of the economic sphere, b) the importance of the measure for the economizing, c) the form–substance problem. Based on the effects in the mentioned domains, practical philosophy could evoke the fact that the core of the economy is something that transcends the phenomenon of economy. The foundation of the economy is based on non-economic categories.

Abstract:
Le roman féministe camerounais est un roman de combat. Il agit comme une forme de plaidoyer que formule l’écrivain en vue de la postulation des rapports sociaux de sexe plus dignes. Dans ce roman, le démiurge lutte pour l’avènement d’un ordre social plus juste au cœur duquel tous les genres se valent et tous les sexes se doivent un respect mutuel. Ce roman travaille dans plusieurs sens: redorer le blason de la femme en matière de droits et lui permettre de disposer de son propre corps comme une personne humaine respectée. Cet objectif de réappropriation du corps féminin bute cependant contre une certaine vision phallocratique des rapports de genre visant à maintenir la femme dans le giron sexiste. Dès lors, comme mode de déclinaison de la violence sexuelle, l’agression sexuelle ne participe-t-elle pas des stratégies dont la finalité n’est que la réification de la femme ? En nous inspirant de l’appareillage conceptuel sociocritique formalisé par Pierre Barbéris ainsi que l’approche genre, nous répondons à cette question de recherche. Le travail est organisé en trois parties. Dans la première, nous scrutons les formes de violence dont la femme fait les frais dans le texte féministe examiné. La deuxième partie porte sur la stylisation des violences sexuelles. Elle questionne les formes linguistiques à l’œuvre dans le texte littéraire, puisque l’œuvre littéraire se veut avant tout une œuvre d’art : par-delà la reproduction des faits observés, elle est production de langage. La dernière partie se préoccupe du message des romanciers ou encore leur vision du monde sur la question de l’agression sexuelle. Il s’agit dans cette partie de montrer que le viol constitue une grave enfreinte des droits de la femme, un obstacle majeur à son autonomisation et à l’affirmation de son identité.

La production affranchie de toute subordination à un système de besoins socialement déterminés, la production devenue une fin en soi, est une des caractéristiques des temps moderne. Dans ses analyses économiques, Marx désigne la transformation générale de la force de travail en marchandise comme une des conditions nécessaires de ce processus d’émergence de a production en sphère autonome ; cette thèse suppose logiquement la liberté juridique du travailleur. L’examen montre que l’homme effectivement libre est un individu qui a reçu une détermination politique, c’est-à-dire le citoyen. Aussi la liberté juridico-politique de l’individu ne peut-elle être considérée comme une modalité d’existence sociale purement contingente, dictée par les exigences d’un développement économique particulier; elle est plutôt la condition de ce développement. Ce n’est que dans une structure sociale spécifique - l’Etat de droit – où les individus – les travailleurs – sont reconnus comme êtres politiques que la production s’autonomise.

C'est en 1954 que les paysans de la commune rurale d’Imanan, située dans l’Ouest du Niger, ont commencé la pratique de la culture de pomme de terre. D’une simple culture d’appoint associée à d’autres spéculations, la production de pomme de terre fait partie intégrante des systèmes de productions locaux. C’est la principale stratégie adaptative des paysans de l’Imanan pour faire face aux crises alimentaires. Plusieurs facteurs d’ordres économique, social et politique, en lien étroit avec l’évolution et les événements locaux ont contribué à sa diffusion et à son expansion. Culture de rente tournée vers le marché, la pomme de terre permet aux exploitants d’accéder à des revenus contribuant fortement à la subsistance des ménages. Dans un contexte marqué par des différenciations économiques et sociales entre groupes sociaux, la production de pomme de terre, de par les revenus qu’elle procure aux paysans, favorisent l’autonomisation des groupes sociaux défavorisés dont les jeunes et les femmes. Mais seuls les exploitants qui peuvent mobiliser suffisamment de ressources financières peuvent rentabiliser la production. La différence des revenus que tirent les producteurs de la culture de la pomme de terre est notamment liée à l’accès de ceux-ci aux plants, à l’utilisation de la motopompe et à l’emploi d’une main d’œuvre agricole externe. Le manque d’organisation adéquate de la filière pomme de terre conjugué à la faiblesse des alternatives de financement ne permettent pas à certains producteurs de s’en passer des commerçants (Maï Gida) grossistes de la filière pomme de terre. Les producteurs sont contraints de vendre leurs produits aux commerçants du « Petit marché » de Niamey
It is in 1954 when the farmers of the rural district of Imanan, situated in the West of Niger, began the practice of the culture of potato. Of a simple culture of supplement associated with other speculations, the production of potato is an integral part local systems of productions. It is the main adaptive strategy of the farmers of the Imanan to face food crises. Several factors of economic, social and political orders, in narrow link with the evolution and the local events contributed to his distribution and to its expansion. Culture of pension was turned (shot) to the market; the potato allows the developers to reach income contributing strongly to the subsistence of the households (house works). In a context marked by economic and social differentiations between social groups, the production of potato, due to the income which she (it) gets to the farmers, favor the empowerment of the disadvantaged social groups among which the young people and the women. But only the developers who can mobilize enough financial resources can make profitable the production. The difference of the income which pull the producers of the culture of the potato is bound in particular to the access of these to plants, to use of the motor-pump and to employment of an external agricultural workforce. The lack of adequate organization of the sector apple of earth conjugated to the weakness of the alternatives of financing does not allow certain producers to take place storekeeper (Maï Gida) wholesalers of the sector potato. The producers are forced to sell their products to the storekeepers of the " Small market " of Niamey

La problématique de cette recherche est la professionnalisation, construite et vécue par les directeurs des centres de formation d’apprentis du bâtiment et des travaux publics (CFA-BTP) qui font partie d’un système paritaire national de formation professionnelle coordonné par le Comité de concertation et de coordination de l’apprentissage du BTP (CCCA-BTP). L’objectif principal est de comprendre et d’interpréter les différentes situations d’interaction et d’interdépendance qui permettent à ces sujets-acteurs de développer leurs capacités et de faire évoluer leurs postures professionnelles. C’est une recherche qualitative, basée sur des critères de crédibilité, de transférabilité, de fiabilité et de confirmation des résultats d’analyse pour laquelle un corpus empirique composé d’entretiens avec des directeurs de CFA-BTP et de documents décrivant la prescription institutionnelle en relation avec les processus de professionnalisation a été constitué, croisé et interprété. Ce travail a permis de comprendre les intentions institutionnelles, les compréhensions et les interprétations de ces intentions par les sujets-acteurs concernés et, enfin, les réalisations et les usages qui en sont faits. En termes de résultats, l’auteur soutient que la professionnalisation des directeurs de CFA-BTP est construite principalement sur l’imprévisibilité des situations-expériences au travail auxquelles ces sujets-acteurs sont confrontés, ce qui leur permet, simultanément, de construire de nouvelles visions de leur fonction, ainsi que d’appréhender des missions et objectifs professionnels en transformation
La problematic of this research is the professionalization, built up and experienced by directors of training centres of apprentices of building and public works (CFA-BTP), which is part of a national paritary system of vocational training coordinated by the French National Committee of Cooperation and Coordination of Apprenticeship in the Construction Sector, called CCCA-BTP. Principally, it is a matter of comprehension and interpretation of different situations of interaction and of interdependence which enable these subjects and actors to develop their capacities and to advance their professional attitudes. This is a qualitative research, based on the criteria like credibility, transferability, liability and confirmation of results of the analysis where the empirical corpus, composed of the outcomes of interviews with the CFA-BTP directors and of the documents describing the institutional prescription related to the professionalization process were put together, criss-crossed and interpreted. This work permitted to understand institutional intentions and their interpretations by the subjects and actors concerned and, finally, the achievements and use done with them. In terms of results, the author supports that the professionalization of the CFA-BTP directors is principally constructed on the unforeseen aspects of the situations and experiences, which these subjects and actors have to face at work. This enables them, simultaneously, to acquire new visions of their function and to achieve new missions and professional objectives, which are in a permanent transformation

La deuxième partie de l''ouvrage cherche dans d''autres courants des sciences cognitives, en particulier ceux se rapprochant de la biologie et de l'énaction - qui développent la notion d''autonomie forte - les pistes permettant de dépasser ces limites.

Dans le contexte actuel de forte visibilité des enjeux de sécurité intérieure et de critiques sur la construction européenne, cette thèse s’intéresse à la trajectoire institutionnelle d’Europol des années 1990 à 2018. Elle étudie la manière dont celui-ci a évolué d’une organisation intergouvernementale, débutant formellement ses activités en 1999, en une agence de l’UE aux ressources et prérogatives croissantes. À ce titre, ce travail propose de développer un cadre d’analyse alternatif au modèle principal-agent, dominant les travaux sur les agences, en s’appuyant sur la littérature relative à l’autonomie, renouvelée par une approche cognitive et sociologique. À partir d’une démarche méthodologique qualitative, cette recherche met en lumière la pluralité des acteurs et dynamiques internes et externes à l’agence alimentant son processus de création et d’autonomisation. Elle démontre la pertinence de saisir les différentes facettes de l’autonomie d’Europol, plongé dans un environnement complexe et multi-niveaux, composé à la fois d’acteurs nationaux et européens, techniques, bureaucratiques et politiques. Ce travail considère dès lors non seulement le degré d’autonomie de cette agence, mais identifie également les acteurs par rapport auxquels cette autonomie peut être pensée. Ainsi, cette étude entend plus largement proposer de nouvelles perspectives de recherche sur les agences de l’UE opérant dans un domaine régalien
Facing the current salience of internal security issues and criticism regarding the European construction, this dissertation focuses on Europol’s institutional trajectory from the 1990s to 2018. It analyses how it has evolved from an intergovernmental organisation, officially starting its activities in 1999, to an EU agency benefiting from growing resources and prerogatives. Therefore, this research offers an analytical altenative to the dominant principal-agent model in the field of agencies, by exploring the academic works on autonomy, renewed by a cognitive and sociological approach. Using a qualitative methodology, this thesis highlights the diversity of internal and external actors and dynamics contributing to Europol’s creation and autonomisation processes. It reveals the promises offered by the multi-faceted concept of autonomy, used to Europol, inserted in a complex and multi-level environement due to its national and European, technical, bureaucratic and political stakeholders. Such perspective aims thereby to understand not only the degree of Europol’s autonomy, but intends also to identify from whom this autonomy must be considered. Thus, this dissertation tends more broadly to develop new research perspectives on EU agencies operating in a core-state power

En matière internationale, le tribunal arbitral n’a d’autre choix que de se fixer sur le territoire d’un État afin de rendre sa sentence. Le choix de cet « État hôte » emporterait alors fixation du siège de l’arbitrage international. Mais quel choix faire ? Comment ? Par qui ? Que faire en cas d’incertitude dans ce choix ? Quels effets cette fixation aura-t-elle ensuite lors de la création du tribunal, du rendu et de l’exécution de sa sentence, ou encore du choix des lois applicables ? Il n’est pas une réponse unique à ces simples questions. Pour cause, le droit de l’arbitrage international accorde une importance variable à la notion de siège. En ce sens, elle dépendra principalement de la vision que l’on a de la place et de la source de l’arbitrage vis-à-vis de la justice étatique. C’est par l’étude des différents courants de pensée philosophique, retenus par l’un ou l’autre des courants doctrinaux, qu’il sera possible d’expliquer les différentes représentations qui existent au sein de la communauté juridique internationale de la notion du «siège de l’arbitrage». Aussi, ce manuscrit amène-t-il in fine à de profonds questionnements sur la source de la juridicité d’une sentence arbitrale internationale. Plus l’on considèrera que la sentence puise sa source dans l’ordonnancement juridique de l’État dans lequel se situe le tribunal, plus l’on verra l’arbitrage et l’arbitre faire partie intégrante de cet ordonnancement, et plus alors le droit du siège aura de prise sur le déroulement du processus arbitral, l’organisation du tribunal et la vie de la sentence. Ainsi, après l’étude des différentes conceptions philosophiques de l’arbitrage puis des représentations du siège s’y rattachant – étude au passage de laquelle il sera constaté une révolution de la théorie dominante, passant d’un modèle territorial à un modèle délocalisé (évolution qui sera perceptible à travers une analyse comparée des lois d’arbitrage de différents pays) – une analyse des conséquences résultant d’un impact plus ou moins fort de ce siège sur le processus arbitral amènera à un constat flagrant. Quelle que soit la théorie du siège de l’arbitrage envisagée, ce dernier fait l’objet d’un net recul dans sa prise en compte de l’application de ses lois de procédure ou de fond.Néanmoins, bien que régulièrement battue en brèche par la doctrine internationale, la notion de siège n’en demeure pas moins persistante. Ce constat sera particulièrement marqué lors de la recherche de l’actuelle utilité du siège dans sa mission d’assistance au tribunal arbitral (c-à-d : appel au juge d’appui). Seulement, les visions des États sur l’arbitrage n’étant pas identiques, une analyse des lois et de la pratique arbitrale de certains pays amènera à douter de la répartition actuelle du contrôle des sentences opérées par la Convention de New York de 1958 entre le pays du siège et les pays d’accueil de l’arbitrage. L’interprétation de cette Convention conduit en effet à être actuellement le prétexte d’un affrontement indirect des visions de l’arbitrage international des États, sur l’importance du concept du siège de l’arbitrage international. L’actualité de cette question interrogera alors de manière légitime la pertinence actuelle de la notion du siège arbitral comme élément clé d’une lecture de l’arbitrage international
In international matters, the arbitral tribunal has no choice but to settle in the territory of a State in order to render its award. The choice of this "host State" would then determine the seat of international arbitration. But what choice do we make? How? By whom ? What to do in case of uncertainty of this choice? What effects will this determination then have in creating the tribunal, in rendering and enforcing its award, or in choosing the applicable laws? There is no single answer to these simple questions. Indeed, international arbitration law attaches varying importance to the notion of seat, in the sense that it will depend primarily on one's vision of the place and source of arbitration in relation to state justice. It is through the study of various philosophical thoughts, used by different academic point of views, that it will prove possible to explain the diversified representations that exist within the international legal community of the notion of "arbitration seat". Thus, this manuscript raises complex questions about the source of the juridicity of an international arbitral award. Indeed, the more the award is considered to have its source in the legal order of the State in which the tribunal is located, the more arbitration and arbitrators will be seen to be an integral part of that order, and more the law of the seat will have influence on the conduct of the arbitral process, the organization of the tribunal and the award. Therefore, after the study of the different philosophical conceptions of arbitration and the representations of the seat attached to it - a study in which it will be noted a revolution of the dominant theory, passing from a territorial model to a delocalized model (evolution which will be perceptible through a comparative analysis of the laws of arbitration countries) - an analysis of the consequences resulting from a more or less strong impact of this seat on the arbitral process will lead to a clear observation. Whatever the theory of the seat of the arbitration considered, it can be seen a decline in of the application of its procedural or substantive laws.Nevertheless, although the concept of the seat is regularly demolished by international doctrine, it remains persistent. This observation will be particularly obvious during the study of the current utility of the seat in its support to the arbitral tribunal (i.e. help of the juge d’appui). However, since States' views on arbitration are not identical, a survey of the laws and arbitration practice in a number of countries raises doubts about the current distribution of the control of awards under the 1958 New York Convention between the country of the seat and the other countries. The interpretation of this Convention is indeed a pretext for an indirect confrontation of the visions of international arbitration by States, through the concept of the seat of international arbitration. The topicality of this question will then legitimately interrogate the current relevance of the notion of the arbitral seat as a key element of international arbitration

Les institutions structurent la vie en société selon des schémas de remise en ordre multiples : biologiques, sociaux, éducatifs, judiciaires, etc. Elles définissent ce qui relève de leur champ et ce qui n’en relève pas. Entre les limites des diverses institutions se place un espace entre deux, une faille que l’on peut qualifier d’interstice. Quel type d’intervention est-il possible d’envisager au sein de cet interstice, en dehors ou au-delà des institutions ? Après une définition de l’institution et de l’interstice ainsi que de leurs occupants, le travail vise à élaborer un type d’intervention pédagogique spécifique à l’interstice. Trois situations vécues et travaillées aux plans théorique et pratique sont convoquées : les enfants des rues, l’éducation pour la santé, l’éducation thérapeutique du patient, afin d’identifier comment l’interstice existant ou engendré au sein d’institutions fortes (Éducation Nationale, Hôpital) nécessite la mise en place d’une pédagogie particulière. Celle-ci, la pédagogie de l’interstice, mobilise imaginaire, croyance, affectivité, sensorialité, corporéité, émotion, appartenance afin de déboucher sur l’empowerment des participants, dans un cadre éthique bien déterminé. Ces différentes notions s’articulent selon un modèle proposé dont la pertinence dépasse le seul champ de la santé. Ainsi, appliqué à plusieurs types d’actions, le modèle permet d’analyser les caractéristiques des dispositifs mobilisés et, pour certains d’entre eux, discriminer leur non appartenance à la pédagogie de l’interstice. Certaines conditions éthiques et postures pratiques mobilisées autour et pendant l’intervention apparaissent incontournables
Institutions build society following very precise ordering schemes: biological, social, educative, judiciary, etc. They define what belongs to their universe and what is beyond. Between the different institutions’ limits, is an interspace, a chink which can be called interstice. Which kind of intervention is it possible to organize within this interstice, away and beyond the institutions? After a definition of institution and interstice and their occupants, this work aims at defining which kind of pedagogical intervention could be suitable to the interstice. Three situations are studied: street children, health education and therapeutic patient education to identify how existing, or created interstice within strong institution (National education, Hospital), needs special pedagogical approach. This interstice’s pedagogy mobilizes imaginary, beliefs, affectivity, sensoriality, corporeity, emotion and feeling of belonging so as to empower the participants within a precise ethic frame. These different concepts articulate within a model which accuracy overtakes the sole health field. Thus, applied to different kinds of action, the model can analyze characteristics of devices and, for some of them, discriminates whether or not they belong to what is called here interstice’s pedagogy. Some ethical conditions and positions around and during intervention appear unavoidable
