Full textAs all commodities, books have their identification codes. Users identify books according to author, name, publishing house, typography, etc. These things in the book market are conceptualized as trademarks. This research concerns certain author, whose name can work as a strong motive in choosing a book to buy, as a trademark. In this work the term trademark is being understood as full range of associations that appear in the buyers mind when he/she sees or encounters an item, service or certain name, i. E. author’s name. When this element of a book overshadows the design of the book, the typography, publishing house or even the price of the book, i.e. determines the decision of the reader, it should be admitted that the author has already became a “trade mark”. The object of the research is supposed to help to answer the above mentioned questions. So the object of the recent work is the authors of the modern fiction whose creative output is the steady number of novels. The chosen authors are divided into two groups. The authors that will be considered to be trade marks are the following: Jurga Ivanauskaitė, Renata Šerelytė, Sigitas Parulskis, Juozas Erlickas (belonging to the first group) bei Edmundas Malūkas ir Edvinas Kalėda (belonging to the second group). Full textIn this master work there is a research of copyright management of music authors, which is relevant to every representative of music, including creators and users. There is also analyzed copyright management system of music and theoretical copyright protection models and discussed copyright protection institutional and legitimate system, emphasizing the distribution of royalties and its impact on creators in Lithuania and worldwide. In the qualitative and quantitative researches there is analyzed the distribution of royalties and there is a comparison with other countries such as Denmark, Belgium and France. There is studied copyright issues and discussed the overall situation in the investigated area in Lithuania. This work answers to important questions which arise for ordinary people: how to reward the artists for their intellectual and creative results of works which also promotes social progress? How to balance the rights of holders and the rights of users' interests in the growing commerce of intellectual property and in the progress of modern technology in society? Esta dissertação investiga os jogos eletrônicos enquanto obras intelectuais a serem protegidas pelos Direitos Autorais a partir da categorias das obras audiovisuais, observando suas particularidades que não se encontram em outras criações do espírito. Jogos Eletrônicos (ou games) são obras audiovisuais, apresentando também a complexa discussão acerca da autoria, já enfrentada pelos Direitos Autorais de obras cinematográficas. Por serem obras criadas geralmente por uma coletividade (desenvolvedor, roteirista, artista, produtor, etc) não é simples definir quem seria o verdadeiro autor de um Jogo Eletrônico. Discute-se o jogo eletrônico enquanto merecedor de uma categoria própria dentro dos Direitos Autorais, vez que, diferentemente das demais obras audiovisuais, este é protegido também enquanto programa de computador. Trata-se de pesquisa que busca inaugurar este ramo de estudo da Propriedade Intelectual no Brasil. A indústria de Jogos Eletrônicos é um dos setores mais expansivos do país, conforme se discute no capítulo 1 por meio de dados relevantes que refletem o processo de desenvolvimento das empresas brasileiras. Entretanto, tal crescimento não vem acompanhado do preparo jurídico para lidar com a matéria, de tal forma que dúvidas e discussões controversas parecem inevitáveis assim que lides começarem a alcançar os tribunais nacionais. Para tanto o presente trabalho aborda alguns casos de tribunais norte-americanos, que desde o final dos anos 70 vem enfrentando a complexa questão autoral dos Jogos Eletrônicos.O problema maior reside na impossibilidade de se equiparar integralmente as aplicações os institutos jurídicos norte-americanos e brasileiros no que se refere a Direitos Autorais. É sabido que o direito dos Estados Unidos apresenta uma fundamentação relativamente mais patrimonialista que aqueles oriundos do direito romano-germânico, que privilegiam mais o aspecto autoral. Isto se demonstra com a impossibilidade de autoria de pessoa jurídica no direito autoral brasileiro, diferente da situação norte-americana. Portanto, muitas questões polêmicas que foram facilmente solucionadas nos Estados Unidos representarão obstáculo maior quando chegarem aos tribunais brasileiros.O presente trabalho, baseado em método indutivo, utilizando-se principalmente da pesquisa bibliográfica, propõe a criação de uma categoria específica aos Jogos Eletrônicos, ou ao menos regras específicas, tornando-o distinto das demais obras audiovisuais, como tentativa de melhor recepcionar juridicamente esta obra. Entende-se que a proteção jurídica adequada é indispensável para auxiliar a indústria a prosseguir em seu processo de desenvolvimento.
Resumen : Esta disertación investiga los juegos electrónicos como obras intelectuales que deben ser protegidas por el Derecho de Autor en lacategoría de obras audiovisuales, destacando sus peculiaridades que no se encuentran en otras creaciones del espíritu. Juegos electrónicos (o games) son obras audiovisuales, presentando también con el complejo debate sobre la autoría, antes enfrentada por las obras cinematográficas. Por lo general, las obras creadas por una colectividad (desarrollador, escritor, artista, productor, etc) no son fáciles de definir quién es el verdadero autor. Se discute el juego electrónico, mientras que merece su propia categoría en el derecho de autor, ya que, a diferencia de las demás obras audiovisuales, esto también se protege como un programa de computador. Es una investigación que trata de marcar el comienzo de esta rama de estudio de la Propiedad Intelectual en Brasil. La industria de los juegos electrónicos es una de más expansivas del país, como se discute en el Capítulo 1 hay datos relevantes que reflejan el proceso de desarrollo de las empresas brasileñas. Sin embargo, este crecimiento no se acompaña con la preparación para hacer frente a los asuntos legales, por lo que las dudas y discusiones polémicas parecen inevitables para así que comienzan a alcanzar los tribunales nacionales. Por tanto, este documento aborda algunos casos de los tribunales de EE.UU., que desde finales de los años 70 ha tenido que hacer frente a la compleja cuestión del autor en los juegos electrónicos de. El mayor problema radica en la imposibilidad de conciliar plenamente las aplicaciones de institutos legales estadounidenses y brasileños en materia de Derecho de Autor. Es sabido que el derecho de los Estados Unidos presenta una serie de razones relativamente más patrimoniales que los países del derecho de origen romano-germánico, que favorecen más los derechos del autor (en persona). Esto demuestra la imposibilidad de autoría corporativa del derecho de autor en Brasil, a diferencia de la situación de EE.UU.. Por lo tanto, muchas cuestiones controvertidas que se resolvieron con facilidad en los Estados Unidos representan el mayor obstáculo cuando llegan a los tribunales brasileños. Este trabajo, basado en el método inductivo, utilizando principalmente la investigación bibliográfica, propone la creación de una categoría específica para juegos electrónicos, o al menos normas específicas, por lo que es distinta de otras obras audiovisuales, en un intento de dar recepción mejor a los juegos electrónicos en el ordenamiento jurídico brasileño. Se entiende que la protección legal adecuada es esencial para ayudar a la industria para continuar su proceso de desarrollo.

Full textCommunication networks have driven a significant displacement in the authorship processes of writing, which acquire a new dynamic in the digital media, presenting themselves more and more like an interactive action between different creation agents. Based on the thought of Michel Foucault on the subject of authorship, this thesis explores the meaning of the sliding position of the author or author-function as the philosopher proposes, currently structured in a network of interactions. In order to build a reflection on this phenomenon, we start from the research on the historicity of the concept of authorship, trying to explore the various constitutions of the social practices of text production through history, from Antiquity to the present electronic networks times. In this route, Modernity is recognized as the specific period in which the authoring process acquires a more individual-centered setting, time when the notion of closed and proprietary work gains space. Taking the formation of history as a complex process in which correlate several dimensions of events, some aspects that articulate to this question are detailed in the form of intertexts. Thus, in different chapters are discussed the following themes: the specificities of digital media language and its implications for the authorship issue; the changes in the forms of creation and circulation of intellectual goods brought about by the advent of cognitive capitalism; new forms of discursive textual production validation in electronic publications that are being created as alternatives to centralized publishing model typical of print medium. Finally, in order to bring empirical elements for the research, were conducted sites participant observation studies and observational ones on Wikipedia and Overmundo, and also developed a blog and a wiki experiment specially for the research. Grounded on these studies, a typology of interactive authoring network was proposed, namely the collaborative one, when the authorship process is done throughout the work of two or more people interacting in the preparation of a text in a cooperative way, and the dialogic one, when a dialogic interaction between the main text and interventions in the form of comments, making the end a whole discourse, can be observed. Full textThe book publishing was strongly restricted in Lithuania during the Nazi occupation. The occupants had rights to control the whole process of book publishing, i.e the verification of a book‘s contents, editing, to assign paper for printing and even the placing of the books among Lithuanian bookstores. The Nazi published the whole bunch of rules and orders to make it easier for them to control the publishing of books in the ocupated country. They conjoined the printing houses in Lithuania, during summer times the most productive were closed, they controled the number of bookstores in cities and many more. Despite of the Nazi‘s struggle to fully enslave lithuanians and their culture, to make Lithuania a place for german people, lithuanians managed to survive. Lithuanian books had a significant role in it. Thanks to Lithuanian publishers, who often risked their lives to make a book available for the readers, many different publications were printed in Lithuania during the occupation.

O presente trabalho é uma pesquisa qualitativa de caráter etnográfico e memorialístico e visa avaliar, a partir de exercícios propostos pela professora, se nos textos produzidos pelos alunos do 6º ano B, turno matutino, do Colégio Estadual Monsenhor Manoel Barbosa (Salvador, Bahia), há indícios de autoria e a relação que se estabelece entre o exercício de autonomia e a prática autoral. Para tanto, a professora selecionou um conjunto de atividades com o objetivo de se discutir as concepções de leitura e escrita, considerando os elementos que fazem parte do processo de produção textual, desde a leitura de mundo e a interação com o outro, até a escrita e o reconhecimento de si como autor. A escolha dessa população se deu pelo fato de o 6º ano do Ensino Fundamental ser a fase no período de escolarização na qual o estudante terá que: manejar novas disciplinas em conjunto com as já conhecidas; aprender a lidar com a segmentação de conteúdos e diferentes professores especialistas que se responsabilizam apenas por suas áreas. Essa é uma etapa, de certo modo, confusa e inquietante para os educandos e para todos que fazem parte da comunidade escolar. Numa perspectiva que focaliza a concepção de língua como espaço-tempo de interação humana – em que os sujeitos constroem e são construídos – foram escolhidos exercícios de leitura e escrita das situações do cotidiano. À professora de Língua Portuguesa coube abrir questões sobre a importância da leitura e, principalmente, da escrita e da reescrita enquanto instrumentos de interação com o outro e estimular os alunos à descoberta de informações sobre as práticas autorais e autônomas na escola. Para tanto, a orientação metodológica seguida nessa pesquisa se ampara nos conceitos de etnografia e autobiografia dos pressupostos teóricos de André (1995), Bortoni-Ricardo (2008), Camargo (2010), Fino (2003, 2008), Genzuk (2003), Rolnik (2011), na propositura e execução de sequências didáticas, de Antunes (2009), Cosson ( 2006) Marcuschi (2008), Schneuwly e Dolz (2004), Schneuwly, Dolz e Noverraz (2004), Solé (1998) e, para as discussões sobre autoria, Possenti (2001, 2002), Orlandi (2008, 2012) e Tfouni (2008, 2010) entre outros.
This study is a qualitative study of ethnographic and memorialistic and aims to assess, from exercises proposed by the teacher in the texts produced by the students of 6th grade B, morning shift, the Colégio Estadual Monsenhor Manuel Barbosa (Salvador, Bahia) there is evidence of authorship and the relationship established between the exercise of autonomy and copyright practice. Therefore, the teacher has selected a set of activities with the aim of discussing the conceptions of reading and writing, considering the elements that are part of the text production process, from the world of reading and interacting with each other, to the writing and recognition of oneself as an author. The choice of this population was made because of the 6th year of elementary school is the phase in schooling period in which the student will have to: handle new disciplines along with the already known; learn to deal with the segmentation of content and different specialist teachers who are responsible only for their areas. This stage, in a way, confusing and unsettling for students and for all who are part of the school community. A perspective that focuses on the conception of language as human interaction in space-time - in which the subjects build and are built - reading exercises were chosen and written in everyday situations. To the teacher of Portuguese fell open questions about the importance of reading and especially writing and rewriting as interaction tools with each other and encourage students to discover information on authorial and autonomous practices in school. Therefore, the methodological approach taken in this research supports herself on the concepts of ethnography and autobiography of the theoretical assumptions of André (1995), Bortoni-Ricardo (2008), Campbell (2010), Fine (2003, 2008), Genzuk (2003) Rolnik (2011), and bringing the teaching execution sequences, Antunes (2009), Cosson (2006) Marcuschi (2008), Schneuwly and Dolz (2004), Schneuwly, Dolz and Noverraz (2004), sole (1998) and for discussions about authorship, Possenti (2001, 2002), Orlandi (2008, 2012) and Tfouni (2008, 2010) among others.

Sob o contexto da Sociedade da Informação, a pesquisa teve como objetivo identificar como a lei brasileira aborda as garantias do direito do autor que elabora os conteúdos utilizados nos programas de Educação a Distância, e como esses direitos estão sendo tratados na prática pelas instituições que propõem os cursos e pelos profissionais envolvidos na criação. A Educação a Distância inaugura um novo formato de veiculação de conteúdos e ensinoaprendizagem, e nesse sentido, a Ciência da Informação está presente, ante a preocupação do compartilhamento de informação responsável e acessível, ampliando a possibilidade da produção de conhecimento dos usuários, respeitando-se os direitos autorais, visando à recuperação e organização dos estoques informacionais para a construção desse novo segmento educacional, verificando como poderia ser classificado e caracterizado o material produzido para ser oferecido na Educação a Distância. Para verificação da existência e aplicabilidade da legislação nacional foi efetivado um levantamento sobre a Lei dos Direitos do Autor, e para o conhecimento do funcionamento do programa Educação a Distância, a pesquisadora participou de dois cursos nessa modalidade. Ante a insuficiência da coleta de dados no que concerne aos direitos do autor foi realizada uma pesquisa qualitativa com coordenadores e professores ligados a instituições que atuam na área, por meio de questionários, os quais foram analisados juntamente com dois contratos particulares realizados com conteudistas, comparando o que ocorre na prática, com a legislação existente sobre a matéria. Os resultados revelaram que não há um parâmetro na contratação dos profissionais e que há o desconhecimento da legislação brasileira, tanto pelas instituições, como pelos professores e coordenadores. Concluiu-se que não há legislação e regras específicas sobre o tema, bem como, quanto aos direitos e deveres destes autores/conteudistas e de suas modalidades de criação, havendo necessidade de estudos mais aprofundados face ao franco crescimento da Educação a Distância no Brasil. ________________________________________________________________________________________ ABSTRACT
Based on the Information Society context, the research had as an objective to identify how the Brazilian law deals with the guarantees of the author’s right, the one who prepares the content used in Distance Education programmes and how these rights are being treated in practice by the institutions which offer the courses and by the professionals involved in the creation. The Distance Education uses a new format of content and teaching-learning propagation and, in this direction, the Information Science is present, faced with the concern of sharing the responsible and accessible information, enlarging the possibility of the users’ knowledge production, respecting the copyrights, aiming the recovering and the organization of the information stocks for the construction of this new educational segment, checking how the produced material could be classified and characterized to be offered in the distance education. To verify the existence and applicability of the national legislation it was accomplished a survey about the Copyright Law, and to have knowledge about the functioning of the Distance Education Program, the researcher participated in two courses at this modality. In view of the shortage of the data collection relating to the author´s right, it was made a qualitative research with the coordinators and teachers joined to the institutions who work in the modality. Questionnaires were applied which were analysed together with two private contracts achieved by the responsibles for the content, comparing what it occurs in the practice with the existing legislation about the subject. The results showed that there is not a parameter at the act of contracting with the professionals and that there is the unfamiliarity about the Brazilian Legislation, both by the institutions and by the teachers and coordinators. It is concluded that there is not legislation and specific rules about the theme, as well as the rights and duties of these authors/ content responsibles and of their modalities of creation, which shows a necessity of deeper studies face to the clear growth of the Distant Education in Brazil.

Accordingly, the aim of this work is to analyse the marketing communication tools used in publishing of scholarly journals and to assess their usefulness communicating with customers. To achieve this aim the following tasks were set: to analyse the typological changes of scholarly journal; to review the interests of participants in publishing scholarly journal; to assess the changes in scholarly publishing industry; to determinate the aspect of Lithuanian scholarly journals publishing; to analyse the changing marketing process and its tools; to find out the Lithuanian academic publishers used marketing communication tools in their scholarly journals websites. This research paper used such methods as comparison quantitative and qualitative data analysis. The results of analysis revealed that scholarly journals websites are commonly used to achieve publisher’s aims in communication and that Lithuanian publishers of scholarly journals don’t use all the possibilities of electronic publishing and communication tools through websites for assessing wider audiences.
