Full textThe restructurings which have taken place in Benin have generated not only some disorganization in staff representative bodies, the alteration of labour contracts, but have also affected the status of employees. With the rebirth of private initiative, the establishment of a basis of a restructuring policy able to better protect employees' interest is of a great importance. Regarding this fact, the first part of this dissertation has been dedicated to the restructuring impact on the employees' interest. Employees have to take part in the operations and try to influence the employer's decision in a bid to limit the loss of job. However, the loss of job is sometimes inevitable despite the provisions of article 60 of the labour code. In the second part, we have tried to show that the consequences of restructuring may be triugh the special measures currently in force in Benin and the adoption of social plan practice. The attenuation may also depend on the settlement question to preserve the acquired gains

Full textOptimistic perception that people have of the future has been the subject of numerous studies. They led to observe an advantageous self expression when comparing his future to that of others (i.e., comparative optimism). These studies have scrutinized the conditions of its emergence and its intra-individual explanations (motivational and cognitive). Other studies rare but often compelling, showed the impact of the situation, social position and culture in which the comparative optimism is expressed. Explanations ensuing question more broadly the influence of ideological systems in which people are inserted, the expression of comparative optimism. The latter, obtained mainly in Western cultures and liberal ideological systems, characterized by strong competitive dimension, maintains many links with the competition. To test the competitive dimension of comparative optimism or to what extent the competition facilitates the expression of comparative optimism, we conducted seven studies. In essence, they show that the competition tends to be associated with comparative optimism and grow. In addition, they show the dimension of social utility of comparative optimism and the relationship between competition and comparative optimism is mediated by performance goals. We conclude that the comparative optimism, reflecting the competition induced by comparison to others, is the expression of conditions, including ideological, ultra-competitive in our Western societies in which it is expressed

Full textTrust may play an intra-organizational coordination role, source of economic performance. We investigate the pivotal role of management between employees and shareholders expectations. We adhere to social exchange theory positioning management as an initiator of trust, that - when aggregated at the organizational level into a relational capital - constitutes a source of competitive advantage. We consider Great Place To Work® rankings based on trust as an accurate empirical field. We combine three different databases to conduct research at the individual level, and we aggregate data at the organizational level to conduct longitudinal research (i.e., over 5 years). First, we proceed with an exploratory factor analysis to introduce a new trust in management scale. Second, we cluster trust in management into a relational capital and proceed with hierarchical linear modelling to conclude that best workplaces generate more heterogeneous capital than organizations that did not make the list. Third, we rely on a random sample to address endogeneity issues and identify organizations experiencing above-normal levels of relational capital. We conduct propensity score matchings to compare their return on assets with similar organizations. We find that organizations with above-normal levels of relational capital outperform their competitors. We contribute to a silent literature on heterogeneous relational capital as a source of competitive advantage. Research implications are addressed to improve management actions towards employees. Finally, our findings and limitations call for future research on the role of managers, generating a heterogeneous relational capital

El marco de la creación de marca se ha construido a partir de un extenso análisis de la literatura existente y cubre una amplia gama de conceptos, entre ellos el valor, la ventaja competitiva y la marca, desde las perspectivas de la teoría de gestión y cultura de consumo. La investigación está basada en encuestas cualitativas a profesionales del branding para validar el marco de referencia y proporcionar insights sobre cómo pueden enfrentarse las empresas al proceso de cocreación del valor de marca. El valor de esta tesis radica en la descripción holística del proceso de cocreación del valor de marca, la creación de un marco de referencia para guiar a los profesionales en su trabajo diario y la validación de este marco con una relevante muestra de expertos en branding.
In light of the novelty and increasing importance of the concept of brand co-creation, this thesis aims to develop a framework that helps practitioners to use brand co-creation as a source of competitive advantage for companies. The framework of brand co-creation is derived from current literature covering a wide range of concepts related to value, branding and competitive advantage from management and consumer culture theory. Qualitative research with practitioners has been undertaken to validate the framework and to provide insights on how companies can approach the brand value co-creation process. The research identifies important differences between the academic research on brand value co-creation and its applicability to current branding strategies. The value of this thesis lies in the holistic overview of the brand value co-creation process, the creation of a framework to guide practitioners in their daily work and the validation of this framework through a relevant sample of branding experts.

Full textThe Subject of this thesis is to analyze the determiners of the community involvement of a company (RSE) in an emerging country such as Morocco. The purpose of the present research is to analyze this relation empirically. In fact, the new international economic environment characterized by deep changes, particularly, economic and financial globalization as well as the important regulatory and technological modifications that are taking place nowadays tend to give the priority to other strategic orientations relating to the prospects of sustainable development, and clarifying the societal commitment in managerial practices. The main goal of any company is to ensure its sustainability to the benefit of its customers, its shareholders and its collaborators. A company can become a committed social actor and not simply content itself with being an economic agent generating wealth. It can also get involved and adhere to better positioning itself with regard to the sustainable development which requires the production and sale within the best economic conditions while keeping a good image, namely, its ethical behavior, and by guaranteeing that its products are socially humanly and ecologically correct. Thus it can reconcile the safeguarding of the environment, social equity and the financial and economic requirements. Therefore, two parts were devoted to elucidating the various questions raised in this respect: The first part presents a review of the theoretical and conceptual approaches of the social responsibility of a company and its overall Performance and the potential links between these two components. The second part is devoted to the epistemological and methodological positioning, to the presentation of the model and the research hypotheses, as well as the analysis of the results of the empirical study. The results make it possible to answer our question: What are the determiners of the community involvement of the certified Moroccan companies RSE?

Full textThe corporate interest is the main reason behind the regulation of related party transactions. Its limits are defined by similar interests and the personal interest embodied in these transactions. The inter-action of these conflicting interests may harm the company. The existence of a conflict and of its justification may be presumed. The corporate interest is from now on that of the enterprise seen within its wide economic context and the interest of a group of companies is distinctively acknowledged. The qualification of those transactions helps identify those that are subject to scrutiny. The protection of the corporate interest is achieved by the prevention of the conflicts of interests through the disclosure of the personal interest. This disclosure triggers the concerned corporate bodies’ evaluation process. Legislative and jurisprudential guarantees ensure the predominance of the corporate interest through limitations on the exercise of certain rights and a strict judicial enforcement of legal duties laid on the interested party. The fraudulent transaction is void. The unauthorized one that is damaging to the company is voidable and its consequences are assumed by the interested party who may be exposed to civil and, sometimes, criminal liability. The comparison of the treatment of this subject in the Lebanese, French and American legal systems revealed the weaknesses in the first two; amendment proposals are made

Full textCette thèse prétend faire une évaluation des compétences communicatives acquises dans une langue étrangère inconnue par des sujets placés en situation d’immersion linguistique, en reliant lesdites compétences avec le bagage linguistique, culturel et procédural des sujets et les paramètres plus classiques de l’appropriation des langues étrangères. Notre étude s’applique à un échantillon de quelques quatre-vingts étudiants universitaires nouveaux venus dans une région d’Espagne, la Catalogne et inscrits, pour la plupart dans des programmes de mobilité. Nous prétendons vérifier dans le cadre de ce travail d’éventuelles relations de cause à effet entre le degré de compétence communicative obtenue dans une langue étrangère inconnue (ici le catalan) et les différents paramètres qui conditionnent l’apprentissage des langues : d’une part, la motivation, l’attitude générale, l’exposition à la langue, et le type d’apprentissage ; et d’autre part le profil langagier de la personne (langues à partir desquelles le sujet pourra établir des transferts positifs), la perception et les représentations qu’il en a et les usages qu’il en fait. En ce qui concerne les facteurs classiques, d’appropriation d’une langue étrangère, nous nous proposons de vérifier l’impact d’une attitude positive, d’une motivation élevée, d’une exposition suffisante sur l’acquisition de compétences en langue cible. Et nous postulons, suivant en cela les auteurs des courants de la « didactique du plurilinguisme », que la « proximité » génétique et/ou structurelle entre d’une part, les langues présentes dans le répertoire langagier préalable et, d’autre part, la langue inconnue favorise la progression dans la compétence communicative. Nous souhaitons également contribuer à la définition du plurilinguisme dans la mesure où nous tâchons de valider expérimentalement des descriptions réalisées sur la base de différents outils de référence issus de la recherche en intercompréhension, tels que le référentiel de l’intercompréhension, les catégorisations de Coste ou les principes pédagogiques de Meissner ; en partant tout autant de données objectives du degré de plurilinguisme telles que les expériences linguistiques préalables au séjour que de données plus subjectives comme le sont la propre évaluation par le sujet de son degré de plurilinguisme ou son opinion quant aux avantages et aux inconvénients de cette caractéristique. D’autre part, nous nous intéressons à l’impact possible d’un profil « diversifié », « hétérogène », « complexe » (d’un point de vue à la fois linguistique et culturel) sur les capacités d’appropriation d’un système linguistique autre. Nous travaillons surtout sur des données déclaratives issues de questionnaires on-line inspirés des portfolios européens des langues (COE) et dont la fiabilité est vérifiée par une courte hétéro-évaluation des compétences réceptives réalisée par un sous-groupe. L’implémentation informatique, des modèles aussi bien que des procédures de traitement des données rend l’expérience et les analyses reproductibles et applicables à un échantillon de plus grande taille ou d’une autre composition, sur la base d’autres modèles. Les résultats obtenus indiquent un effet positif important et significatif du facteur « attitude envers les langues et envers la langue inconnue » ; et le nombre de langues acquises/apprises et leur proximité génétique à la langue méta s’avèrent aussi pertinents. En revanche, l’effet des transferts structurels d’un autre type, n’a pas été démontré.
This thesis claims to make an evaluation of the communicative skills acquired in an unknown language by subjects placed in linguistic immersion, relating the aforementioned skills with the linguistic, cultural and procedural background of the subjects as well as the more usual parameters which condition the appropriation of foreign languages. Our study applies to a sample of some eighty university students who have recently moved to a region of Spain, Catalonia and belong, for the most part, to mobility programs. In this work we attempt to confirm any causal relationship between the degree of communicative skills acquired in an unknown language (Catalan in that case) and the various parameters which condition language learning: on the one hand, motivation, general attitude, language exposure and the type of learning; on the other, the linguistic profile of the subjects (which allows positive transfers), the way they use it and how they perceive it. As regards the traditional factors of appropriation of a foreign language, we claim to confirm the impact of a positive attitude, a high motivation, and sufficient time of exposure on the acquisition of communication skills in the target language. We postulate, following researchers in "didactics of plurilingualism", that the genetic and/or structural proximity between the language(s) of anyone’s linguistic repertoire and the unknown target language is very likely to favour the development of such communicative skills. Moreover we hope to contribute to the definition of plurilingualism since we attempt to validate experimentally some descriptions realized on the basis of various reference tools coming from the research on intercomprehension, such as the skills reference data on multilingual communication in intercomprehension, Costes’s categorizations or Meissner’s didactic principles. Besides, our research is based on objective as well as subjective data related to the degree of plurilingualism of each subject, such as their preliminary linguistic experiences; their own evaluation of their level of plurilingualism, or their view on the advantages and drawbacks of such characteristic. Finally, we are highly interested in the possible impact of a "diversified", "heterogeneous", "complex" profile on the capacities of appropriation of another linguistic system. We have worked mostly on declarative data, collected from on-line questionnaires inspired by the European Languages Portfolios (COE) and the accuracy of such data has been confirmed by a short hetero-evaluation of receptive skills achieved by a subgroup of our sample. The computer implementation of the models as well as of data processing procedures make it possible for the experiment and the analyses to be reproduced and applied to a sample of a bigger size or of another composition, on the basis of other models. The results point out an important and significant positive effect of the factor labelled “attitude towards languages and towards the unknown target language”. In the same way, the number of acquired / learnt languages and their typological genetic proximity to the target language have proved quite relevant. Yet, the effect of other kinds of structural transfers has not been evidenced.

Full textAs a fundamental driving force of public economy, public procurement has traditionally been an area of diverse and often competing interests. Such contradictory interests are the efficiency of budgetary management and transparency in public life within national legal systems, free competition and open access of financial stakeholders in award procedures within the European regulatory framework. At the same time, the instrumentalisation of public procurement in order to serve political goals not directly linked to it has triggered considerable debate. The attempt of conciliation of social and environmental considerations with the financial requirements of public procurement law aims at enhancing this legal and financial instrument. The role and the legal means for the integration of social and environmental considerations in public procurement, which serve general interest purposes and overriding European law objectives, have not yet been clarified. The regulatory interventions of the Member States, on the one hand, and the harmonization attempts of the European Union, on the other, create a constantly changing political climate. In that context, the role of social and environmental policies is redefined both within the framework of primary objectives of public procurement law, as well as outside this regulatory framework which is used as a policy tool in this context

Full textThe objective of this thesis is to understand the impact of innovative and traditional perks on workers’ intent to stay through the mediating effect of organizational commitment. Three hypotheses were proposed to study this question based on Blau’s Social Exchange Theory (1964) and Balkin and Bannister’s Resources Dependence Theory (1993). Our first hypothesis states that innovative perks have a positive and indirect effect on workers’ intent to stay through the mediating effect of organizational commitment. Our second hypothesis indicates that traditional perks have a positive and indirect effect on workers’ intent to stay through the mediating effect of organizational commitment. Our third and last hypothesis suggests that innovative perks have a greater effect on workers’ intent to stay through the mediating effect of organizational commitment than traditional perks. The longitudinal data used in this thesis comes from a broader investigation called « The Links Between Compensation, Training and Development Skills with the Attraction and Retention of Key Employees ». The sample consists of newly hired employees from a global Information Technology and Communication (ITC) company based in Montreal. Data from this organization was collected from 235 employees hired between April 1, 2009 and September 30, 2010. Our findings confirm our first two hypotheses. Our results indicate that both innovative and traditional perks have a positive and indirect impact on workers’ intent to stay through the mediating effect of organizational commitment. Our results also indicate that traditional perks have a greater effect than innovative perks on workers’ intent to stay through the mediating effect of organizational commitment. Perceived organizational support and working under supervision also have an impact on workers’ intent to stay. We conclude this thesis with practical implications for managers with regards to employee retention in the ITC sector. We also present the limitations of our study and the implications for future research.

Full textL’objectif de ce mémoire est de comprendre l’impact de la satisfaction envers les avantages sociaux novateurs sur l’intention de rester des travailleurs du secteur des technologies de l’information et des communications (TIC). Pour étudier cette question, une hypothèse générale de recherche a été émise basée sur la revue de littérature ainsi que sur les théories de l’échange social de Blau (1964) et de la théorie des besoins de Maslow (1943). L’hypothèse générale de recherche soutient que la satisfaction envers les avantages sociaux novateurs fait augmenter l’intention de rester des travailleurs dans le temps. Les données utilisées dans ce mémoire ont été recueillies dans le cadre d’une enquête portant sur les relations entre la rémunération, la formation et le développement des compétences avec l’attraction et la rétention des employés clés. De nature longitudinale, les données proviennent du bureau situé à Montréal d’une entreprise d’envergure internationale du secteur des TIC. L’échantillon est composé d’employés embauchés entre le 1er avril 2009 et le 30 septembre 2010. Les résultats confirment l’hypothèse générale de recherche voulant que la satisfaction envers les avantages sociaux novateurs fait augmenter l’intention de rester des employés dans le temps. Parmi les différents avantages sociaux novateurs étudiés, les résultats indiquent que c’est la satisfaction envers le gym au travail qui prédit le mieux l’intention de rester des travailleurs. Les autres avantages sociaux novateurs trouvés significatifs en lien avec l’intention de rester sont la ludothèque, le lounge/salle de repos, la clinique médicale et la bibliothèque sur les lieux du travail. De plus, les analyses longitudinales révèlent que ce sont surtout les différences entre les caractéristiques individuelles des employés qui expliquent le mieux l’intention de rester et non les différences à travers le temps chez un même travailleur. Ce mémoire se termine en discutant de la meilleure façon pour les gestionnaires en relations industrielles d’utiliser les résultats dans le but de retenir leurs employés performants. Puis, les limites de l’étude et certaines pistes de recherches futures sont également présentées.

Full textThis dissertation explores the effect of organizational attributes on the attraction of new talent. Specifically, it examines the impact of innovative perks, training and development opportunities, as well as the presence of strong ethical ideals within an organization. Moreover, the presence of a moderating effect of gender within these relationships is also investigated. In order to carry out the objectives of the study, several different hypotheses were developed in line with the reviewed literature and theoretical frameworks. The first hypothesis, which is divided into three sub-hypotheses, stipulates that the offer of innovative perks, the presence of many training and development opportunities as well as the extent to which an organization emphasizes ethical behavior, each increase organizational attractiveness. The second hypothesis suggests that an organization offering a combination of innovative perks, training and development opportunities, as well as emphasizing strong ethical ideals further increases attractiveness. The final hypothesis suggests that gender moderates the relationship between the three organizational attributes and attractiveness. The current study utilizes data gathered through a quasi-experimental study conducted among 340 future graduates from two universities in Montreal. The results reveal that innovative perks, the presence of many training and development opportunities, as well as strong ethical ideals each positively influence organizational attractiveness. Moreover, the results indicate that organizational attractiveness is further increased when innovative perks are combined with very few training and development opportunities. The effect of innovative perks in combination with the presence of strong ethical ideals also further increases organizational attractiveness. Finally, the results reveal that gender plays a moderating role in the relationship between only one organizational factor and attractiveness. More precisely, the results reveal that for women, the presence of innovative perks leads to increased attractiveness whether organizations have few or many training and development opportunities. For men, however, the presence of innovative perks leads to increased attractiveness only in situations with few training and development opportunities. Thus, the interaction effect of innovative perks on attractiveness is nuanced by gender. This dissertation provides a discussion of the results and suggests strategies that could be implemented by managers to improve workforce attraction, which constitutes a major issue currently faced by organizations. In light of the empirical results found in this study, it can be concluded that the presence of innovative perks, which is part of the indirect compensation an organization offers to its employees as well as two specific organizational practices (training and development and strong ethical ideals) can give organizations a competitive advantage with regard to attracting new talent. Finally, the finding revealing a moderating role of gender can be useful for managers in the context of employment equity.

Full textAu fil des ans, beaucoup d'entreprises ont ignoré que certains de leurs biens les plus précieux ne sont pas inclus dans leur bilan. La reconnaissance de ce fait par le monde académique, qui a débattu de ce sujet pendant longtemps, a déclenché une refonte des priorités de l'entreprise, grâce à de grands investissements orientés vers le développement de pratiques responsables. Cet ouvrage souligne l'importance des investissements RSE dans le quotidien des entreprises, notamment l'impact en matière de renforcement de leur réputation. Bien qu'aucune tendance claire ne soit apparue, une relation entre ces deux variables a été identifiée. Comme suggéré dans des ouvrages publiés précédemment, la RSE présente une construction hétérogène dans laquelle différentes dimensions ont des effets mitigés sur la réputation des entreprises. La présente étude souligne les épreuves auxquelles les entreprises sont confrontées au moment de mesurer ces biens immatériels et d'en tirer profit dans leurs stratégies. Il suggère en outre qu'une approche novatrice de cette problématique est possible.
Ao longo dos anos, temos visto muitas empresas a ignorar o facto de alguns dos seus ativos mais valiosos não serem necessariamente aqueles que fazem parte do seu balanço. O debate deste tema no mundo académico já vem de há algum tempo e desencadeou um reorganizar das prioridades empresariais, nomeadamente através de um aumento substancial dos investimentos canalizados para práticas responsáveis. Este trabalho destaca a importância que o investimento em Responsabilidade Social tem para as empresas, analisando o seu impacto no desenvolvimento da Reputação Empresarial. Embora não tenhamos encontrado nenhum padrão entre as duas variáveis estudadas, conseguimos provar a significância da sua interação. Tal como sugerido em estudos anteriores, a Responsabilidade Social apresenta uma construção multidimensional, e os seus diferentes componentes terão impactos distintos na Reputação de uma empresa. O presente estudo salienta ainda as dificuldades das empresas medirem os seus ativos intangíveis e sobretudo de os conseguir integrar de uma forma estratégica; adicionalmente sugere uma abordagem inovadora a esta problemática.

Full textThe rapid development in the field of biotechnology can be attributed to a large degree to the innovative use of genetic resources (GR), a significant portion of which were based on traditional knowledge (TK). The biotechnological inventions resulting from these resources and knowledge are, for the most part, subject to patent protection. This legal protection is designed to allow creators of innovative inventions the possibility to recoup their investment by limiting the use of the resulting creation by people other than the inventor and his assignees. Indeed, the gradual recognition of the scientific and commercial value of such resources and associated knowledge has raised interest and fuelled rivalries that eventually led to conflict over the use and trade of such products between user and producing States. A possible solution to resolve this conflict is the use of access and benefit-sharing agreements. One requirement proposed by producing States is an obligation to disclose the origin of GR and TK in patent applications. However, since the issues in this area, generally, exceed the national sphere, producing countries are attempting to make this requirement recognized at an international level. Accordingly the most effective and efficient means of doing so would be via the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS) in the World Trade Organization WTO. In this thesis, we will demonstrate that the obligation to disclose the origin of GR and TK in patent applications does not constitute an appropriate means that would lead to a fair and equitable sharing of benefits arising out of their use.

Full textMixed use has become a key planning principle, promoted as essential for urban quality, vibrancy, and sustainability. However, in practice, mixed use remains mostly a tool for the intensification – notably on a vertical dimension – of inner-city districts with tight housing market and land scarcity. Still, in that context, it encounters cultural barriers. It is therefore appropriate to examine the opportunities and issues – from the perspective of occupiers – in vertically mixed residential and commercial development (functions usually considered as complementary and compatible, and frequently combined at the building scale), and the conditions in which such experiences arise. To address this, semi-structured interviews were conducted with ten residents and six retailers of five new vertically mixed residential and commercial properties located in Montreal. Benefits in terms of proximity to retail stores and services, economic vitality, quality of the built environment, vibrancy, perceived security and community life have been highlighted. Land-use conflicts (direct), conflicts of scale, conflict of interest (indirect), and space and use constraints have been discerned from the cross-case analysis. The study illustrates a dialectic relation between building-complex and local scales; the difficult task of implementing a mix limited to compatible functions; and the challenge of integrating various uses to capitalize on synergies and prevent conflict and constraints. In this last respect, the study considers the opportunity presented, in Quebec, by the by-law on conditional use. It also points out the significance afterwards of the property management in the harmonious integration of various uses.
