Full textThe social and ethical problem of abortion reemphasized by the german unification and the german federal courts decision on 28th may 1993. Invalidating the liberal pangermanic abortion law (enacted in 1992), as by the reactualisatuion of the abortion controversy in numerous occidental countries - is analysed through a comperative study in two european countries: the federal german republic and france. The historical dimension underlines the ancient philosophical and political concepts which underlie the contemporary debate. The comparative historical analysis shows the relativity of legislative issues. But it also focuses on analogies. Differences, inter actions and interdependancies of these two countries through this particular debate. The analysis of the socio-cultural factors determinating the specific evolution of this controversy and aborton legislations in both countries is completed by the perspective of the european union

It shows how, throughout this period, one description can turn central, how particular categories can be developed, and a system of actions are stabilized. The description that became central can be synthesized as follows: the "affaire Paulina" is the story of a young mexican girl who suffered a double violation. The first is a physical rape dated the night of 31st of July, 1999; the second, the violation of her rights committed by different authorities of "Baja California", by rejecting her right to a legal abortion, on the basis of their religious beliefs. The thesis also analysis the relation between the public problem of abortion, an issue dated from the seventies in Mexico, and it's re-emergence in the context of "l'affaire Paulina" and how at this particular occasion some arguments became more important that others

The artificial procreation is latter the objectif a profond study through history, the present state all the techniques, the consequences of the treatments, today the legislation the abuses and finaly the opinion of the women users, of the feminists and of the ethic have been taken into consideration. Then, those two medicals pratices are compared around common value : the embryon, the desire to have children, the programed children and eugenism. The last part is consacrate at a comparison of these two practices in europ, in u. S. A. , in chili, in japan. Full textThe in vitro fertilization (ivf) is used to overcome the sterility of the couple. But this technique raises serious ethical, social and economical questions. Indeed, many embryos are created by ivf and are frozen to be transfered to the woman. But the controversy that already surrounds ivf is about those frozen embryos called "sprade embryos" waiting for a decision. What's the destiny of "sprade embryos"? the new modes of procreation permit cognitive research on the embryo then its manipulation and destruction. Also donation to another childfree couple can be possible in case of desertion. Is this technique acceptable from the point of view of basic cultural beliefs?. Can the embryo be treated as a person or as a thing? to be able to answer at these questions, another basic one needs close inspection: the definition of the person's concept from a philosophical point of view. Shoud the society, to resolve the issue of the human embryo, take as a model the way that she acted about the in vivo embryo, in the abortion's law of 1975? in the meantime, the french parliament has engaged in legislative action and adopted the bioethic's law of 1994. How does the legislature consider the human embryo? is his position about the embryo produced by ivf opposite to the abortion's law concerning the in vivo embryo? this research is meant to be argumentative rather than informative. Each of the two sections is devoted to a major aspect of french bioethics discussion. The first section studied women's points of view on the embryo's place in their requirement for volontary abortion or demanding for ivf, especially when "frozen embryos" are abandoned. What are their motivations? the second section analyzed the discussion from the side of specialists, the reflections and recommandations of the national consultative ethics committee and legilative's actions concerning procreation, particulary on the embryo's issue. The discussion of those issues has been largely a result of an ongoing public debate. The society tries to find a morally acceptable compromise in a pluralistic society in which there are various views on the relative importance of different stages of human development. People disagree about issues such as the role of potentiality, the importance ofindividuation, or the value of medical knowledge and legitimate agreement among these multiple views and interests

Wade) which, in 1973, legalized abortion, the american catholic church decided to react. It believed that abortion was murder, but did not intend to stop at religious and moral discourse. Soon, it mounted a campaign to press for the passage of a human life amendment, the only means to overturn the supreme court decision. In 1975, looking ahead to the 1976 presidential and legislative elections, the catholic hierarchy released an unprecente d document : the pastoral plan for pro-life activities. Finally, by the late 1970's, it gained a very important ally : the new right, which viewed abortion not only as murder, but also as an assault on the traditional and nuclear family. Full textHow did women's movements mobilize for women's rights and how did they influence agenda setting in European countries ? The rise of the women's movements in the late sixties and the seventies was one of the main features common to western democracies. The protest of women not only concerned the decriminalization of abortion, nor was it limited to political participation demands. By linking relations between men and women on the one hand and power relations on the other hand, the women's movements asked for gender equality in "all" areas of society. This spread of grievances was due to a broad definition of politics, accentuating the political character of the privat. In this, the women's movements followed the anti-authoritarian revolt of 1968 declaring "the privat" as "political". The study which falls within the scope of historical as well as social scientist research is to focus the women's movements in France and in West-Germany. The movements of these countries are chosen because of, at first, their connection to the left movements of the late sixties. .

Full textThis research in ends to define the importance of abortion in togo's methods of births' prevention. It has permitted to give a volume's measure of provoked abortions in that country. Valuing with accuracy this prevalence is a fastidious task, because of the subject's nature and in consideration of environment's specifics in which the phenomenon takes place. To succeed, and for the studies to be the most original as possible, we relied on three inquiries, including two which took place in three family planing centres, and the third one in a middle schoolgirl population. We have made the statement of family planing in togo and then studied the recourse of abortion. The context in which unfolds the phenomenon is distinguished by deep changes which shake the family and by evolution of family's structures towards several shapes of unpublished (new) organisations. Provoked abortion remains in togo a criminal act punished by the law of 1920 and by the one of may 16th 1984, relative to protection of girls and boys who are validly registered in school. Diffusion of contraception is done by two ways in togo, an informal one through the sale, on open markets and other places, of a large range of products supposed to be contraceptives and/or abortives, and a formal one owing to the distribution's modem circuit. Offer of planing is very insufficient compare to demand, especially for the one coming from young people. The most recommended methods and the most prescribed ones are injection, infra-uterine apparatus and norplant. Finally, we estimate, comparing all results, to one abortion in average per woman, the number of abortions submitted by women of 35 years old and more in togo. This number could increase to two if the contraceptive use don't get any better. We have also noticed an increase trend to abortion's recourse this last few years. However, we have to stress that the use of provoked abortion is huge for pregnant schoolgirls because of their fear to be compelled to leave school. Full textBrucellosis, an infectious disease caused by bacteria of the Brucella genus, is one of the major zoonosis around the globe. Initially an animal disease, the infection can be passed onto humans and increases the risk of obstetrical complications in pregnant infected women. During pregnancy, specialized placental cells called trophoblasts ensure the main functions of the placenta. Several of these functions involve the host protein CD98hc. This surface glycoprotein was shown by our group to be important during Brucella infection in different cell types. In this work, we studied the importance of CD98hc in Brucella infection of human trophoblasts and tried to decipher which specific function(s) of the protein was (were) hijacked by the bacteria. Knocking out the SLC3A2 gene (coding for CD98hc) turned out to be impossible, showing that this gene is essential in human trophoblasts. We could however obtain a cellular clone expressing a CD98hc protein with conformational and glycosylation changes in its C-terminal domain and that seems to be trapped in recycling endosomes. Nonetheless, such modifications were compatible with Brucella infection, giving clues about how bacteria could use CD98hc during infection. In another chapter of this work, we identified Gefitinib, an EGFR inhibitor used in the treatment of non-infectious diseases, as a promising drug to fight against brucellosis. This drug was shown to be effective in vitro against the 3 main zoonotic species of Brucella in human trophoblasts as well as murine macrophages. These findings provide new insights into the role of CD98hc in Brucella infection and new leads toward the development of improved brucellosis treatments

Full textAs western modern societies have gradually liberalised their abortion laws, Ireland took the opposite way by adopting the eighth amendment vindicating the right to life of the “unborn” in 1983, an amendment clearly influenced by the prevailing Catholic ethos. The aim of this research is to give sense to this landmark event which we interpret as a moral blocking. To this end, we put the debate in perspective within the secularisation process, the advance of which we propose to assess. The abortion issue is encompassed here as a privileged tool to assess this process both at the individual and institutional level (Church-State relationship) levels. However, the debate is not confined to Ireland and occasionally takes a European dimension. Indeed, the Irish position on abortion is an exception within the EU and has developed as a symbol of the country's Catholic identity when defending its values on unborn human life on the European stage as occurred during the ratification processes of the Maastricht and Lisbon treaties. We analyse Europe's approach to the right to life as guaranteed by the European Convention on Human Rights in relation to the Irish context. Although Europe does not privilege the “unborn's” right to life over the woman's right to choose and vice versa, it might be a Trojan Horse as European institutions are generally in favour of women's rights and reproductive health, and the EU resisted pressure from the Vatican to have any Christian religious denomination engraved in its constitution

Full textCivil disobedience can be defined as a non-violent act publicly and deliberately done, in violation of the law, on moral or political grounds. I argue that the disobedient whose action was motivated by a differing but plausible interpretation of fundamental rights may expect to be allowed to express his views in court. Civil disobedience relies upon the inclusiveness of fundamental rights, the interpretation and application of which is determined through an insightful balancing of interests between conflicting rights and in close relation to the circumstances of each case. This link between rights and civil disobedience makes sense in the light of the figure of an enlightened judge, able and willing to discuss the merits of the law openly within his judgement. The open texture of human rights expresses the indeterminacy of language at the origin of the recognition of 'hard cases'. It equally emphasises the crucial role of judges in justifying the current interpretation of the right at issue. However, this close link between rights and civil disobedience depends on the engagement of judges in justifying their solutions. On the topic of abortion, many judgements of the American Supreme Court develop a socially responsive judgement, through overt deliberation of the issues and by integrating divergent and dissenting opinions as well as extra-legal matters. This is in sharp contrast with the discourse of the Cour de cassation. Even if the disobedient's claim is to be finally rejected by both American and French Courts, the unity of legal interpretation will be better ensured by a more detailed and transparent consideration of conflicting views by the highest courts

Full textThis dissertation focuses on the issues of contraception and abortion in France, from the opening of a debate on birth control in 1956 to the legalization of the voluntary termination of pregnancy, in 1979. Drawing on archives of the mobilization, the media coverage and the central administration of the state, the author analyses the political and cultural change that led from repression to liberalization. The dissertation highlights the gendering of contraception and abortion issues making women the objects as well as the subjects of discourses and actions. However, this process was complex and non-linear. Strategies of legitimization alternated between moments when women acted on their own behalf and moments when men acted on behalf of the common good. From 1956 to 1967, a new interpretation introduced the idea that couples should have the liberty to decide issues of conception and contraception as a necessary condition for a happy family life. This new framing of the issue made the legalization of birth control possible in 1967. Afterwards, from 1968 to 1973, contraception and abortion were reinterpreted through the subversive lens of sexual liberation both by sexologists and grassroots mobilization. The feminist movement, in particular, claimed a woman’s right to control her own body. Finally, from 1973 to 1979, abortion reached the political agenda and went from being perceived as a public health issue to being considered as a women’s issue, defended by women, for women. The gendering of abortion is one of the key elements that made consensus possible in a very controversial context

Full textThe main object of this study of abortion law reform in england is to assess the evolution of attitudes between 1927 and 1977. The thirties were a watershed in this evolution : the severe law of 1861 was still in force but it was being questioned in a context of low birth rate and maternal mortality and thanks to famous abortion trials. Moreover, the use of birth control was becoming widespread and the main pressure group fighting for the repeal of the law (alra) was founded. Reform remained pending, however, until the sixties, when the climate of opinion was favourable to change, due to rumours of overpopulation in england, the advent of the permissive society and the thalidomide tragedy. Pro-and anti-abortion lobbies were ready for the fight, but the reformers took precedence over roman catholics and supporters of strict morals whose action could not counter alra and its sympatizers. Various private members'bills were introduced between 1961 and 1966 but they were generally talked out. In 1967, david steel succeeded in pushing through a bill with the help of the labour government. Abortion became legal on medical, eugenic and social grounds, but the opponents of reform attempted to bring the commons to adopt restrictive amendments. Their failure showed, however, that the reversal of the climate of opinionwas more apparent than real. The views and feelings of english women, ten years after the adoption of the abortion act, were studied through depth interviews and two main themes emerged from the content analysis : the experience of abortion and the attitudes towards the question. Far from vindicating the abortion myths, the interviews highlighted the tolerence of the speakers and their deep concern for the quality of life.
