Abstract:
This chapter focuses on the Bahamas Trustee Amendment Act 2011 (amending the Bahamas Trustee Act 1998 and adding new sections 91A, 91B, and 91C), which introduced a comprehensive regime for the arbitration of trust disputes. The goal of the new regime is to enable settlors to impose mandatory arbitration of all internal trust disputes and questions so as to avoid any need to involve the court. In addition to introducing mandatory arbitration, the legislation also provides for wide powers, equivalent to those of the court, to be given to the arbitral panel, including express provision for the appointment of representatives on behalf of minor, incapacitated, and unborn beneficiaries.

McGregory, Jerrilyn. One Grand Noise. University Press of Mississippi, 2021. http://dx.doi.org/10.14325/mississippi/9781496834775.001.0001.

Abstract:
This study interrogates the Boxing Day holiday which is globally celebrated on December 26. Although it is a long standing bank holiday for members of the British Commonwealth of Nations, no monograph exists attesting to its origin, especially as longstanding cultural holiday in the Protestant circum-Caribbean Basin. After historicizing its connection to ancient festivals and Catholicism, Jerrilyn McGregory explores how the Anglicized Caribbean World constitutes a gombe-complex marked by the privileging African-based rhythms and drums. McGregory considers Bermuda’s Gombey dancers, Bahamian Junkanoo, Garifuna Jankunú, Trinidadian style Carnivals in St. Croix and St. Kitts, and even a North Florida Shooting Match with semblances to these Caribbean festival arts. Ultimately, McGregory argues for an interpretive approach to deconstruct the vernacular tropes: “one grand noise”, “Foreday morning”, and “from back-o-town.” Therefore, rather than an island-by-island interrogation, this study will illuminate cultural resonances antithetical to hegemonic rule noise, darkness, and temporal-spatiality. While the cultural producers adhere to variant historical contexts, all function as forms of persistence and resistance. In the final analysis, McGregory documents the move from the simply carnivalesque to the ritualesque with the insinuation of their offspring to ensure continuity without fixity to ward off the threat of cultural tourism.

Jelly-Schapiro, Eli. Security and Terror. University of California Press, 2018. http://dx.doi.org/10.1525/california/9780520295377.001.0001.

Abstract:
When in 1492 Christopher Columbus set out for Asia but instead happened on the Bahamas, Cuba, and Hispaniola, his error inaugurated a specifically colonial modernity. This is, Security and Terror contends, the colonial modernity within which we still live. And its enduring features are especially vivid in the current American century, a moment marked by a permanent War on Terror and pervasive capitalist dispossession. Resisting the assumption that September 11, 2001, constituted a historical rupture, Eli Jelly-Schapiro traces the political and philosophic genealogies of security and terror—from the settler-colonial conquest of the New World to the wars in Afghanistan, Iraq, and beyond. A history of the present crisis, Security and Terror also examines how that history is registered and reckoned with in significant works of fiction and theory. In critical dialogue with novels by Teju Cole, Mohsin Hamid, Junot Díaz, and Roberto Bolaño, and the theoretical interventions of Jean Baudrillard, Giorgio Agamben, Judith Butler, Michael Hardt and Antonio Negri, and others, Jelly-Schapiro reveals how the erasure of colonial history enables the perpetual reproduction of colonial culture.

Buschfeld, Sarah, and Alexander Kautzsch, eds. Modelling World Englishes. Edinburgh University Press, 2020. http://dx.doi.org/10.3366/edinburgh/9781474445863.001.0001.

Full text
Abstract:
This volume brings together different varieties of English that have so far been treated separately: postcolonial and non-postcolonial Englishes. The different contributions examine these varieties of English against the backdrop of current World Englishes theorising, with a special focus on the Extra- and Intra-territorial Forces (EIF) Model (Buschfeld and Kautzsch 2017). Building on the general conception of Schneider’s (2003, 2007) Dynamic Model, the EIF Model aims at integrating postcolonial and non-postcolonial Englishes in a unified framework of World Englishes. The editors of the proposed volume claim that in the development of any kind of English around the world, forces from both outside and inside the community are in operation and lead to different outcomes as regards the status and characteristics of English. Each chapter tests the validity of this new model, analyses a different variety of English and assesses it in relation to current models of World Englishes. The case studies examine English(es) in England, Namibia, the United Arab Emirates, India, Singapore, the Philippines, South Korea, Japan, Australia, North America, The Bahamas, Trinidad, Tristan da Cunha, St. Helena, Bermuda, the Falkland Islands, Ireland, Gibraltar and Ghana.
