Abstract:

Syftet med arbetet har varit att utreda vilka lösningar det finns vid en standardavtalskollison i både svensk och utländsk rätt. Samt vilken lösningsmodell som är den mest lämpliga. I Sverige saknas relevant lagstiftning på området. Någon träffande rättspraxis finns inte heller att tillgå och diskussion i doktrinen har med några få undantag varit väldigt begränsad. Detta innebär att rättsläget i Sverige fortfarande är oklart. Kollisionen mellan två standardavtal benämns battle of forms och frågan blir om det finns ett avtal mellan parterna och vilka villkor som ska reglera parternas förpliktelser. De faktorer som anses vara av vikt är att lösningen bör vara förutsägbar, den ska innebära att parterna har en fortsatt avtalsrelation till varandra, den bör lösa tvisten snabbt och effektivt samt att den bör ta hänsyn till parternas egna krav och önskemål. <p>Denna uppsats behandlar frågan om kolliderande standardavtal, internationellt benämnt battle of the forms. Problematiken grundas i att två parter i en avtalsförhandling har tillsänt varandra olika standardavtal med motstridiga villkor. Tvist uppkommer sedan oftast när parterna börjat prestera eller till och med fullbordat avtalet. Frågan uppkommer då vilka villkor som skall gälla samt hur denna problematik bör lösas. Eftersom problematiken är sparsamt utredd i svensk rätt har vi valt att studera tre nationella och tre internationella rättskällor och regelverk för att söka ledning i frågan.

The neuronal ceroid lipofuscinosis (NCLs, Batten Disease) are inherited, fatal neurodegenerative disorders of childhood. In all forms of NCL, astrocyte activation occurs early in the disease and precedes neuronal loss. However, in the most common juvenile form (JNCL), which is caused by a mutation in the Cln3 gene, this astrocyte response appears to be compromised. The neuronal ceroid lipofuscinoses (NCLs) are a group of inherited lysosomal storage disorders that cause profound neurodegeneration and predominantly affect children. Currently, there are no effective treatments available for any form of NCL.
