Abstract:
This chapter focusses on how ‘Free Trade Agreements’ (FTAs) fit within the existing multilateral framework, primarily with the Trade Related Aspects of International Property Rights (TRIPS) Agreement which most FTAs take as basis and benchmark from which the contracting parties modify rules among another (inter-se). In this context, the most prominent issue is the effect the continuous strengthening of the standards of intellectual property (IP) protection and enforcement has on the optional provisions and flexibilities of the TRIPS Agreement. The chapter examines whether and how the TRIPS addresses such further increases in protection and enforcement. It also looks at conflict clauses in FTAs and how they perceive their relation with the multilateral IP rules, especially the TRIPS Agreement. The principal question here is whether rule-relations within the international IP system are still primarily determined by harmonious interpretation — or if conflict resolution rather functions by choosing one rule over another.

This handbook presents the state-of-the-art of the statistics dealing with functional data analysis. With contributions from international experts in the field, it discusses a wide range of the most important statistical topics (classification, inference, factor-based analysis, regression modeling, resampling methods, time series, random processes) while also taking into account practical, methodological, and theoretical aspects of the problems. The book is organised into three sections. Part I deals with regression modeling and covers various statistical methods for functional data such as linear/nonparametric functional regression, varying coefficient models, and linear/nonparametric functional processes (i.e. functional time series). Part II considers related benchmark methods/tools for functional data analysis, including curve registration methods for preprocessing functional data, functional principal component analysis, and resampling/bootstrap methods. Most assessments of the ICTY’s performance derive benchmarks for assessment from claims set forth in official instruments or made by Tribunal officials and scholars. This chapter instead derives such benchmarks from the expectations of Bosnians who embraced the Tribunal, exploring the kind of justice they expected it to provide. For many victims, retributive justice is fundamental. Many Bosnians also highly value what scholars call the expressive function of international criminal tribunals. Other goals Bosnians hoped the Tribunal would advance include: preventing future atrocities, dispelling denial and fostering acknowledgment about wartime atrocities, and removing war criminals from their midst.

Arab Sunni Muslim discourses and experiences of physical and sensory impairments are surveyed from the rise of Islam in the seventh century until about 1800. The geographical focus of this discussion, which is primarily a function of the available scholarship, is Egypt and Greater Syria, the area that corresponds roughly to today’s Syria, Lebanon, Jordan, and Israel and the Palestinian territories. Impairments appear frequently in premodern Arabic writings, especially in literature, chronicles, biographies and autobiographies, legal texts, and medical compendia, leaving the reader with the impression that people with impairments were everywhere in the Arab world. Yet, to date only a handful of articles and two historical monographs about the Arab world are explicitly situated within the field of disability history. This chapter provides a new benchmark on which historians of disability working in the Arab world can build in future studies.

This chapter analyses the Italian corporate network along the twentieth century focusing on seven benchmark years (1913, 1927, 1936, 1960, 1972, 1983, and 2001). For each year, the top 250 companies (50 financial and 200 non-financial) by total assets have been selected. After showing some descriptive statistics, the chapter develops a network connectivity analysis of the system. This is integrated by a prosopographic study of the big linkers, defined as those directors who had the highest number of board positions in each year. The big linkers who held directorships in both banks and industrial firms functioned as the nation’s financial elite. These relationships were assured for a long time principally by industrialists and financiers. Bankers surged to a prominent position only at the end of the century, after the massive privatizations of the 1990s.

This chapter provides an introduction, explicating the book’s mission and its interdisciplinary methodology while illuminating the most important concepts. The book proposes a more effective way for European Union (EU) Institutions to pursue legal integration while respecting language diversity, choosing the integration of contract law as its case study. The combined policy objectives of legal integration and language diversity function as normative benchmarks for critically assessing EU’s multilingual practices and procedures of the EU Institutions, or “Institutional Multilingualism.” It concentrates both on “EU Translation,” that is, the work of EU translators and lawyer–linguists in EU legislative bodies who produce EU’s multilingual legislation, as well as the ways in which the Court of Justice of the EU attributes uniform meaning to the various language versions of EU legislation. Finally, these evaluations are framed in terms of translation “orientations,” as expounded in a 19th-century essay by Friedrich Schleiermacher.

While criminalisation may be justified whenever an offender commits a sufficiently serious moral wrong requiring that he or she be called to account, the doctrine of fitness to plead calls this principle into question in the case of a person who lacks the capacity to participate meaningfully in a criminal trial. In light of the emerging focus on capacity-based approaches to decision making and the international human rights requirement that the law should treat defendants fairly, this volume offers a benchmark for the theory and practice of fitness to plead, considering differing perspectives and debate on the future development of a doctrine which has up until now been under-discussed and under-researched. The fitness-to-plead rules stand as an exception to notions of public accountability for criminal wrongdoing yet, despite the doctrine’s long-standing function in criminal procedure, it has proven complex to apply in practice and has given rise to many varied legislative models and considerable litigation in different jurisdictions. Particularly troublesome is the question of what is to be done with someone who has been found unfit to stand trial. Here the law is required to balance the need to protect these defendants who are unable to participate effectively in their own trial, whether permanently or for a defined period, with the need to protect the public from people who may have caused serious social harm as a result of their antisocial behaviour. The challenge for law reformers, legislators, and judges is to create rules that ensure that everyone who can properly be tried is tried, while seeking to preserve confidence in the fairness of the legal system by ensuring that people who cannot properly engage in the criminal trial process are not forced to endure it.
