The road to net neutrality within the European Union (EU) has been slow and winding. However, a major milestone was reached in August 2016 through the publication of the BEREC Guidelines on the Implementation by National Regulators of European Net Neutrality Rules. These Guidelines, which must be given the “utmost consideration” by national regulators, provide the EU’s first detailed and unambiguous regulatory commitment to net neutrality, and are carefully crafted to balance the needs of content providers and network operators. This extended article explores the scope of the net neutrality principle as understood and applied in a number of jurisdictions. The approach in the EU is contrasted with the approaches of the Federal Communications Commission (FCC) in the United States (US) and of a number of other countries. Although there are some constants that recur for net neutrality in all of the countries examined, there remain a variety of specific local connotations.The article indicates that the question, “What is net neutrality?” will continue to be asked and continue to be very apposite for some time. The EU approach, with the BEREC Guidelines, will likely be central to a more harmonised approach worldwide.It also argues that the new EU framework is likely to be even more influential than its highly publicized but politically fractious US equivalent. The EU approach to net neutrality will find greater favour among developing countries, as it provides sufficient flexibility to offer network investment incentives whilst retaining appropriate competition and user safeguards. As with the earlier EU ex-ante regulatory frameworks for market analysis and cost-based interconnection, the BEREC paper paves the way for continued export of best practice regulation from the EU to the rest of the world. However, there are issues that demand caution in how the BEREC approach might be implemented.The authors have extensive experience as consultants and commentators on telecommunications industry and regulatory issues in many countries. David Rogerson and Jim Holmes are founding partners of Incyte Consulting, located in Falkirk (Scotland) and Melbourne, respectively. Pedro Seixas is a Principal Associate of Incyte Consulting located in Frankfurt.

Podstawowym zadaniem Organu Europejskich Regulatorów Łączności Elektronicznej (Body of European Regulators in Electronic Communications — BEREC) jest doradzanie Komisji Europejskiej oraz organom regulacyjnym krajów członkowskich wchodzącym w jego skład, a po-nadto wspieranie Parlamentu Europejskiego i Rady w sprawach dotyczących stosowania unijnych ram regulacyjnych dotyczących łączności elektronicznej. Jego działalność pozwala zapewnić uczci-wą konkurencję i spójność regulacji na rynku wewnętrznym w dziedzinie łączności elektronicznej, z korzyścią dla europejskich konsumentów. Obecnie BEREC ma status niezależnego organu regula-cyjnego, skupiającego w swej strukturze decyzyjnej krajowe organy regulacyjne, czerpiąc w swojej działalności z ich wiedzy eksperckiej i doświadczeń regulacyjnych. Jakkolwiek regulacja w sektorze telekomunikacyjnym w dalszym ciągu leży w gestii krajowych organów regulacyjnych, ponieważ to one są najbliżej rynków, które mogą lepiej regulować. W artykule zostały omówione zasady organizacji oraz funkcjonowania Organu Europejskich Regulatorów Łączności Elektronicznej w kontekście zgodności przepisów regulujących jego dzia-łalność z zasadami dobrego zarządzania jako wartościami administracyjnymi i organizacyjnymi, które powinny determinować sposób korzystania przez instytucje unijne z uprawnień udzielonych im przez obywateli. W tekście zwrócono także uwagę na planowaną kompleksową reformę regu-lacji w sektorze łączności telekomunikacyjnej jako niezwykle ambitny projekt w ramach strategii Jednolitego Rynku Cyfrowego.

Abstract:

Tanulmányunk témája a netsemlegesség. Először magát a fogalmat definiáljuk többféle módon, majd a netsemlegességgel kapcsolatos törvényhozói, internet- és tartalomszolgáltatói, valamint felhasználói kihívásokat, problémákat és válaszokat mutatjuk be. Számos szerző szerint az internet legnagyobb, immár tradicionális értéke a nyíltság, sokszínűség, tartalomgazdagság, tértől és időtől független társadalmi és perszonális kommunikációba való szabad belépés és a szabad verseny lehetősége. A netsemlegesség mellett és ellen felhozott érvek bemutatását is ezek a szempontok alapján tesszük. Kiemelt szerepet kap a netsemlegesség megsértésének kategorizálása is. Tanulmányunkban közlünk egy törvényalkotási kronológiát, mely az USA-ra, az EU-ra és Kelet-Ázsiára fókuszál, illetve ismertetjük a BEREC 2011-es felmérésének az EU-ban alkalmazott, internetszolgáltatói gyakorlatra vonatkozó eredményeit. A munkát az Internet.org kezdeményezést vizsgáló esettanulmány zárja, végül ezt követik a jövővel kapcsolatos kérdések, és néhány lehetséges válasz. --- Net neutrality - definitions and the standpoints of legislators, content providers, Internet service providers and users This article examines the topic of net neutrality. Firstly, it provides us with a theoretical insight and several definitions. Then it presents the issues and challenges legislators, ISP’s, content providers and users face. Several authors state that the biggest virtue and value of Internet lies in open access, diversity, richness of content, free competition, and low barrier entry for users in order to participate in personal social communication. Our presentation of arguments pro and cons net neutrality will be built on the basis of these considerations. Priority will be given to the introduction of several categories of net neutrality violations. In our paper we will present a legislative chronology in the topic focusing on USA, EU and Korea-Japan as well as the findings of the 2011 BEREC survey. Finally we examine the Internet.org project. In the conclusion, the article offers several more issues to be discussed and provides some possible answers.

Abstract:

The pace and scope of changing technologies are constantly challenging social structures and the need for dexterous policy framework is becoming more and more indispensable. While technological evolution and market forces have driven the information and communication revolution, the European Union has played a significant role in creating an effective framework for the maintenance and development of this progress. In order to regulate the market and keep pace with the ICT (Information and Communications Technology) environment, the EU has introduced rules that ensure fair access to all EU citizens and stimulate competition for companies. The Body of European Regulators for Electronic Communications (BEREC) serves entirely this function, becoming a pan-European regulatory agency. Aside the regulatory role, EU's economic growth strategy involves a great number of policies and measures to capitalize on digital revolution. The Digital Agenda for Europe (DAE) targets not only on citizens, but businesses of Europe as well, to benefit from the technological revolution. The former and the new goals of the renewed agenda raise the bar of smart, sustainable and inclusive growth. Finally, to ensure the maximization of use of information technologies, EU has supported the expansion of e-business and online public services. E-government services have facilitated interaction between government, citizens and businesses, while it simplified all facets of operations of governmental organisations. This article is looking at EU's role in digital environments, examining the three initiatives as platforms of technological evolution in Europe. The three case studies used, the BEREC, DAE and e-Government initiatives, will provide an analysis of the services with a prospective evaluation of the technological strategies involved, while the qualitative and quantitative data in each case will help us analyse the quota and draw conclusions on the functionality and effectiveness of the services. We expect to evaluate the levels of digital growth and online adaptation of the Union and/or the need for further expansion. The study is discussing EU's technological competiveness and the analysis targets the policy initiatives taken towards this direction, while it provides multipolar, but useful information for EU citizens and businesses.

Abstract:

The purpose of the article is to provide a list and briefly analyze international legal mechanisms, as well as legal sources and acts of the EU aimed at regulating the use of the Internet and electronic communication technologies within the organization; identify areas, status and directions of internal and external harmonization of the described regulatory mechanisms. Scientific novelty of the work is to consider the mechanisms and basic regulations of the European Union in the process of their creation and in terms of their role in the formation of a single digital space of the organization. Specific works of domestic scientists in the relevant field were generalized and supplemented, as well as the basis for further research was established. In the early 2000s, EU lawmakers focused on the develop-ment of basic regulations in the field of telecommunications, digital networks and Internet services. As a result, a number of Directives and decisions have been adopted since 2002; at the same time, the development of regulatory mechanisms that would operate within the digital space of the EU actively lasts since 2009. This new stage in the process of developing harmonized mechanisms for regulating electronic communications services and the Internet culminated in the adoption in 2009 of a number of legal documents, including Regulation (EU) 1211/2009, which established the Body of European Regulators for Electronic Communications (hereinafter – BEREC), which took over the role of the national regulatory authority (hereinafter – NRA). In 2018, as part of the creation of a single digital space in the EU, an updated BEREC Regulation was adopted, as well as the Electronic Communications Code (hereinafter – the Code).Now the field of electronic communications and the Internet is undergoing numerous stages of development and reform. The research identified the main directions of EU policies, which include measures to harmonize and unify legislation for more effective interaction within both the EU and external partners: cybersecurity, copyright and personal data, and telecommunications services. These areas, since 2013, have been the focus of efforts, given the complexity of regulation and a rapid development of technologies. In the article, the author covers come theoretical and practical aspects of the European Commission’s activities on Internet regulation and describes the creation of the EU single digital space in terms of the process as a whole.Thus, the result of the study was a descriptive analysis of the process of formation of the EU’s legal framework, roles of organizations and institutions and the status of electronic communications and the Internet regulatory mechanisms.

<p>La neutralidad en la Red es el principal pilar de Internet: asegura derechos fundamentales y un Internet abierto. Se supone que las compañías suministradoras de Internet no deberían discriminar, en términos generales, entre los contenidos de la Red. La neutralidad en la Red es imprescindible para preservar el acceso de todos a Internet. De otra manera, las corporaciones dividirían la Red entre líneas rápidas o lentas y sería el fin del Internet abierto. La Unión Europea trató de fortalecer la neutralidad en la Red al requerir a los suministradores del servicio el tratamiento igual de todo el tráfico sin favorecer a unos servicios sobre otros (EU la regulación sobre Internet abierto entró en vigor el 30 abril de 2016, de acuerdo a (EU) 2015/2120 de 25 noviembre 2015). No obstante, la regulación contiene lagunas que plantean dudas tanto a defensores de la neutralidad como del libre mercado. El Cuerpo de Reguladores Europeos para Comunicaciones Electrónicas (BEREC) publicó unas directrices para la aplicación de las obligaciones de las autoridades regulatorias nacionales con el fin de contribuir a la aplicación de la regulación que se adoptó el año anterior. Estas directrices no aclaraban la regulación. Este artículo se propone analizar la legislación. Se concentra en la discusión sobre la generación de líneas rápidas para servicios especializados, o el <em>zero rating</em>, bajo la cual ciertos servicios no consumirían datos del contrato mensual. Abstract:

Digital Single Market is the new world in the EU and it is perceived as primary public interest because it was one of the ways the EU found to become more financially attractive and better suited to innovation. To accomplish that, several legal solutions appear to be unsuitable for the present time EU is living in. Concerning electronic communications, its legal and regulatory framework needed to be recasted and a new Electronic Communications Code proposal was made by the European Commission. Among many innovative solutions, it aims at redefining EU universal service, to update it to connectivity solutions of our time, and at revising the Body of European Regulators for Electronic Communications’ role, granting it further competences on crossborder dispute resolution and articulation between European institutions and national regulatory authorities. These dimensions rethink both social and institutional regulatory framework and this text wants to understand what their strengths and weaknesses are.

Penelitian ini dilaksanakan di kelas II SD Inpres Bere-Bere Kecil, dengan waktu kurang lebih 3 bulan, tanggal 20 September sampai 20 Desember 2019. Subjek penelitian ini adalah siswa kelas II SD Inpres Bere-Bere Kecil, semester ganjil 2019/2020, dengan jumlah siswa 20 orang, terdiri dari 13 orang perempuan dan 7 orang laki-laki Pada siklus I siswa yang berhasil 11 siswa (55%) dari jumlah keseluruhan 20 siswa (100%), sedangkan 9 siswa (45%) belum berhasil. Peneliti melakukan penelitian ke siklus II. Penelitian pada siklus II, terjadi peningkatan dari 11 siswa (55%) yang berhasil, menjadi 17 siswa (85%) yang berhasil, sehingga peningkatan hasil belajar dari siklus I kesiklus II sebesar 30%. Hasil penelitian ini, karena penggunaan pendekatan pesruasif terhadap keterampilan membaca permulaan siswa sudah efektif dari guru. Berdasarkah hasil penelitian yang di lakukan dalam dua siklus, maka peneliti berkesimpulan bahwa penelitian dengam menggunakan pendekatan persuasif dalam pembelajaran Bahasa Indonesia untuk meningkatkan keterampilan membaca permulaan dengan materi tentang teks bacaan “Minggu Bersih” pada siswa Kelas II SD Inpres Bere-bere Kecil berhasil.

The Supreme Court’s case law has proclaimed the assimilation of those instruments of organization to the category of general provisions just for exclusive procedural purposes. However, its true legal nature is that of sui generis administrative acts. The discrepancy between its legal definition and the regime of review creates important imbalances which as a whole provokes legal uncertainty.

AbstractBerea sandstone, a potential Global Heritage Stone Resource, has been one of the most widely used sandstones in North America. This Paleozoic sandstone, quarried for more than 200 years in Ohio, has been used across much of the continent. Thousands of commercial, residential, ecclesiastical, government and other structures have been built with Berea sandstone, including Thomas Worthington's mansion in Chillicothe, Ohio, the Michigan Capitol in Lansing, Michigan, the Carnegie Library and Natural History Museum Building in Pittsburgh, Pennsylvania, and parts of the Parliament buildings in Canada. Grindstones made from Berea sandstone were shipped throughout North America, as well as to the Caribbean, South America, Europe and Asia. The stone is celebrated in a number of locations, notably Berea and Amherst, where quarries have been important historical sources of this stone. It has been known by a number of different geological and commercial names, including Berea grit and Amherst stone, complicating its identification from historical sources. Stone from the most productive quarries, however, was known to be homogeneous and can be identified by its quartz–arenite to sublithic–arenite composition, its fine to medium sand (125–350 µm) grain size and iron-cement spots. Berea sandstone continues to be quarried today in Erie and Lorain counties.

Tolkien valued music in his private life, and this is mirrored in his works about Middle-Earth, which owes its very existence to music. It is born out of the song of the Ainur. But the role of music does not end with this creative act, rather, it continues to influence the history of Middle-Earth. The paper aims to analyze the role of music in the tale of Beren and Lúthien in the published Silmarillion. The tale of Beren and Lúthien was of personal significance to Tolkien himself. It also includes numerous allusions to music. It is the language of love for both Beren and Lúthien, who make their own songs. Lúthien’s music has power which allows her to overcome Sauron and Morgoth and to win a second life for Beren from Mandos, while Finrod uses music in his duel with Sauron. Music affects both positive and negative characters, including Sauron and Morgoth. Its importance is also emphasized by the existence of professional musicians, such as Daeron, Thingol's minstrel. The story "Of Beren and Lúthien" demonstrates the power of music, which has a huge impact on the entire history of Middle- Earth. Without it, many events would never have happened.

Abstract:

In the past, people watched a theater called Ludruk on the mobile stage and on television. However, currently Ludruk's art is almost out of date. From this phenomenon, the researchers formulated the problem, namely how the local story artworks of Sawonggaling content can be transformed into a motion comic animated film using a three-act structure. The method of making comic motion animation for the legend of Jaka Berek uses two approaches, namely the method of making animation and the method of making comics. Both of them are done in 3 stages, namely pre-production, production and post-production. The results of the making of this motion comic animation show that the effort to bring back the legendary story that has long been drowned requires some appropriate medias that is easily understood by the current generation. The making of motion comics originating from legendary stories must be based on research and literature studies in order to give the spirit to the artwork that will be produced.

Apabila zakat dikelola dengan baik dan pendistribusiannya tepat sasaran maka dapat meningkatkan kesejahteraan umat sehingga bisa mengatasi kemiskinan. Misalkan, salah satu lembaga pengelola dana zakat yang memiliki program pemberdayaan masyarakat adalah Dompet Dhuafa Yogyakarta. Pada lembaga ini telah memiliki bidang yang secara khusus melakukan pengembangan ekonomi dengan konsep Warung Beres—singkatan dari Bersih Enak Sehat. Dengan begitu, artikel ini mendeskripsikan bagaimana konsep, strategi, dan dampak program Warung Beres bagi masyarakat yang tergabung dalam Kelompok Kerja di Kecamatan Playen Kabupaten Gunungkidul. Artikel ini yang ditulis merupakan pengembangan dari metode penelitian kualitatif-studi kasus. Hasil simpulan dalam artikel ini terbagi ke dalam tiga kontens, yaitu (1) konsep Warung Beres adalah upaya pemberdayaan ekonomi bagi para pedagang kali lima khususnya pedagang angkringan melalui pendekatan penerapan prinsip hidup bersih sehat; (2) implementasi program dalam pemberdayaan masyarakat melalui Warung Beres melalui beberapa tahapan kegiatan yang dilalui antara lain: pelatihan usaha angkringan, bantuan modal peralatan usaha, membentuk paguyuban pedagang angkringan “Warung Beres Gunungkidul”; (3) dampak program bagi peningkatan perekonomian adalah terbangun sikap dan perilaku bisnis angkringan yang berorientasi pada bersih, enak dan sehat, memiliki peralatan usaha yang lebih meningkat, memiliki paguyuban para pedagang angkringan, mendapat kemudahan dalam meminjam modal usaha, dan peningkatan pendapatan. Dari hasil simpulan ini, diharapkan memiliki kontribusi nyata dalam bidang pengembangan ilmu pengetahuan pemberdayaan masyarakat dan menjadi output pengembangan kebijakan pemerintah dalam menyusun program anti-kemiskinan.

Summary Recent laboratory studies have shown that fines migration induces a decrease in rock permeability during CO2 injection. This study uses X–ray microcomputed tomography (micro–CT), nitrogen permeability, and Itrax X–ray fluorescence (Itrax–XRF) scanning to investigate the mechanism of fines migration during CO2 injection. We perform CO2–flooding experiments on two Berea core samples. The cores are characterized using nitrogen permeability, micro–CT, scanning electron microscopy with energy–dispersive X–ray spectroscopy (SEM–EDS), and Itrax–XRF scanning. The cores are flooded with fresh water, then CO2–saturated water, and finally water–saturated supercritical CO2 (scCO2). To calculate permeability, the pressure difference across the core samples is monitored during these fluid injections. The produced–water samples are analyzed using inductively coupled plasma–optical emission spectrometry (ICP–OES). After the flooding experiments, nitrogen permeability, micro–CT, SEM–EDS, and XRF scanning are repeated to characterize pore–scale damage. Micro–CT image–based computations are run to estimate permeability decrease along the core–sample length after injection. Results show the dissolution of dolomite and other high–density minerals. Mineral dissolution dislodges fines particles, which migrate during water-saturated–scCO2 injection. During CO2–saturated–water injection, the permeability of Berea 1 and Berea 2 increase by 29 and 13%, respectively. After water–saturated–scCO2 injection, the permeability of Berea 1 and Berea 2 decrease by 60%. The permeability damage of the sample can be explained by fines migration and subsequent blockage. SEM–EDS images also show instances of pore blockage.

Gassmann’s original equation provides a means to relate bulk elastic parameters of a porous material with the compressibility of the pore fluid. The original analysis assumed microhomogeneity and isotropy, which assumed that pore compressibility was equal to grain compressibility. Although subsequent theoretical arguments have shown that Gassmann’s original assumption is violated for most rocks and that pore compressibility need not equal grain compressibility, few experimental studies have compared the two compressibilities; the assumption that pore compressibility equals grain compressibility is still commonly made. We measured hydrostatic poroelastic constants of Berea sandstone and Indiana limestone under drained, undrained, and unjacketed conditions over a range of confining and pore pressures to test the assumption that pore compressibility equals grain compressibility. These two rocks were chosen because they havesimilar values of porosity but different elastic behaviors: Berea sandstone is nonlinearly elastic, especially at low effective stresses, but Indiana limestone is linearly elastic at nearly all stresses. At low effective stresses below [Formula: see text], the pore compressibility for Berea sandstone does not equal grain compressibility but approaches fluid compressibility. Even at higher effective stresses, pore compressibility for Berea sandstone does not equal bulk grain compressibility but approaches a value approximately two to three times the bulk grain compressibility. In contrast, pore compressibility for Indiana limestone does seem to be equal to grain compressibility except perhaps at low effective stresses below [Formula: see text]. The difference between pore compressibilities of these two rocks is likely from the presence of more compliant clay minerals mixed with quartz grains with more microcracks in the Berea sandstone as compared to the well-cemented Indiana limestone.

Introduction: In their previous work, the authors reported findings from 30 years on the incidence of hematological malignancies in Szabolcs-Szatmár-Bereg county, Hungary. Until now there are no other studies on this topic available in Hungary. Aim: Detailed analysis of epidemiologic features of patients with myeloma. Method: During a 33-year period (between January 1, 1983 and December 31, 2015) 4521 adult patients with hematologic malignancies were recorded in the leukaemia/lymphoma registry of Szabolcs-Szatmár-Bereg county. Among them 440 patients with myeloma (9.73%) were registered (397 multiple myeloma, 38 solitary, bone/soft tissue plasmocytoma, 5 primary plasma cell leukaemia). Results: The incidence of myeloma in Szabolcs-Szatmár-Bereg county showed an increasing tendency, with an overall incidence rate of 2.33/100 000 inhabitants/year. The male:female ratio was 45.9%:54.1%, the average age of patients was 65.1 (28–90) years, and 59.4% of the patients with multiple myeloma had IgG-type monoclonal immunoglobulin. There was no town or village in this county where the occurrence of patients with myeloma in one thousand inhabitants was significantly higher, than the average (0.78). Conclusions: The epidemiologic features of myeloma in Szabolcs-Szatmár-Bereg county – except a moderate female dominance – is essentially similar to data published in the literature. Orv. Abstract:

Abstract Background and Aims Manganese (Mn) deficiency in barley is a global problem. It is difficult to detect in the early stages of symptom development and is commonly pre-emptively corrected by Mn foliar sprays that can be costly. Landraces adapted to marginal lands around the world represent a genetic resource for potential sustainability traits including mineral use efficiency. This research aims to confirm novel Mn use efficiency traits from the Scottish landrace Bere and use an association mapping approach to identify genetic loci associated with the trait. Methods A hydroponic system was developed to identify and characterize the Mn deficiency tolerance traits in a collection of landraces, including a large number of Scottish Bere barleys, a group of six-rowed heritage landraces grown in the highlands and islands of Scotland. Measuring chlorophyll fluorescence, the effect of Mn deficiency was identified in the early stages of development. Genotypic data, generated using the 50k Illumina iSelect genotyping array, were coupled with the Mn phenotypic data to create a genome-wide association study (GWAS) identifying candidate loci associated with Mn use efficiency. Key Results The Bere lines generally had good Mn use efficiency traits. Individual Bere lines showed large efficiencies, with some Bere lines recording almost double chlorophyll fluorescence readings in limited Mn conditions compared with the elite cultivar Scholar. The Mn-efficient Bere lines had increased accumulation of Mn in their shoot biomass compared with elite cultivars, which was highly correlated to the chlorophyll fluorescence. Several candidate genes were identified as being associated with Mn use efficiency in the GWAS. Conclusions Several genomic regions for Mn use efficiency traits originating from the Bere lines were identified. Further examination and validation of these regions should be undertaken to identify candidate genes for future breeding for marginal lands.
