Abstract:
L'étude porte sur deux oeuvres capitales de Nicolas Poussin (l'autoportrait et les bergers d'arcadie), et sur les projets du Bernin pour le Louvre de Louis XIV en 1665, oeuvres et faits dont le sens et la portée historique sont restitués. La première partie fonde les méthodes d'investigation dans l'esthétique, entendue comme travail hermeneutique particulier. Le constant souci éthique de la pensée de l'art est dégagé qui peut être saisi comme le horizon du sens donné à l'art dans un contexte historique, et qui permet d'approfondir la compréhension des oeuvres et des processus creatifs. Les oeuvres de Poussin sont interprétées en accord avec l'analyse de l'idée de l'art du peintre, Nicolas Poussin, idée morale conciliant le don individuel et le travail méthodique et rationnel de la représentation. La troisième partie rouvre le dossier des plans du Bernin pour le Louvre rejetés au profit de l'actuelle colonnade. La base des investigations est constituée par l'édition critique du journal de Chantelou à laquelle est joint un nombre important de documents d'archives ( en annexe). L'interprétation concentre les aspects multiples de l'affaire Bernin sur le divorce entre le génie artistique et le decorum princier. À travers l'échec de l'artiste, l'idée d'une autonomie morale de l'art s'est trouvée singulièrement affirmée
The study concerns essentially two paintings of n. Poussin (the self-portrait and the arcadian shepherds), and the architectural projects of Bernini for the louvre in the reign of louis XIV (1665), a new approach restoring the sense and the historical importance of this works. The first part of the study intends to found the methods of its enquiries on the aesthetics, philosophical discipline which is supposed to be preceeding in this case as a particular hermeneutics. Constant ethical solicitudes for the thought concerning art are elucitated, solicitudes which are recognised in the study as horizons of sens attributed to art in particular historical contexts and which allow to go further in the comprehension of the works of art as well as of processes of creation. The paintings of poussin are thus interpreted according to the painter's conception of art, a moral conception which reconciles his personal, individual talent, and his rational work on the pictorial representation. The third part of the study deals with bernini's plans for the louvre, plans finally rejected and replaced by the present colonnade. The enquiry is based upon a new (critical) edition of chantelou's diary, and upon an important number of archive documents (edited in annex). The interpretation of facts and projects is focused on the esential gulf introduced between the genius of the artist and the decorum of the prince

Abstract:
The aim of this study is to show how much Nicodemus Tessin the younger was inspired by the architecture of Gianlorenzo Bernini, while building the Tessinska palace in Stockholm. The investigation is based on comparative analysis of Tessinska palace with various architectural works by Bernini. The author also investigates the influence Bernini had on Tessin t.y. by studying the personal relation between the architects.The investigation shows that every external surface of the Tessinska palace contain many architectural details and elements that share similarities or look equal to the ones used by Bernini in a variety of his roman buildings, to name a few: Palazzo Barberini, Palazzo Ludovisi, Collegio di Propaganda Fide, Palazzo Chigi and more. The analysis of the biographical background and relationship between the architects shows that Nicodemus Tessin t.y. was very influenced by Bernini and his work, which he writes about in several occasions in his works and notes. Investigation shows that Tessin t.y was using Berninis architectural details consciously and with full awareness.

Abstract:
The nation stood in either awe or disbelief when Bernie Sanders, a political Independent, only recently turned Democrat, defeated the establishment candidate and former first lady, Hillary Clinton, in the early 2016 New Hampshire primary. As the primaries concluded, it became clear that Sanders’ message resonated. But why was this the case after eight years of “hope and change” under the Obama administration? Furthermore, to what extent did Sanders align with traditional Democrats or traditional Socialists and how can we understand the unprecedented success of a presidential candidate who identifies with socialism? My thesis seeks to answer these puzzles. I do so by: interviewing Sanders supporters, investigating the development of American Socialism and Sanders’ own political identity, and analyzing the economic and social factors leading up to the 2016 primaries. Ultimately, my thesis proposes that Sanders’ ability to win over twelve million votes in the Democratic Party primaries stems from his creation of his own brand of socialism that merged traditional socialist principles of championing the working person with the economic and social realities of twenty first century middle-class America.

Sculpteur du règne de Louis XIV, Jean-Baptiste Théodon (1645-1713) se rattache à l’école française autant qu’à l’école romaine de sculpture. Formé auprès de Charles Le Brun à la Manufacture royale des Gobelins, il y rencontre Jean-Baptiste Colbert qui devient son premier mécène. Protégé par ce dernier qui l’envoie en Italie, Théodon rejoint en 1677 l’Académie de France à Rome où il sculpte pour Louis XIV et le château de Versailles. Parallèlement il prend part à la vie académique romaine. Membre actif de l’Accademia di San Luca et de la congrégation des Virtuosi al Pantheon, Théodon devient l’un des sculpteurs les plus recherchés de la Rome de la fin du Seicento, sollicité par les papes Innocent XII et Clément XI à Saint-Pierre de Rome et au Latran, et par les congrégations et les ordres religieux au Gesù et au Monte di Pietà. Appelé par Louis XIV, il revient à Paris en 1705 et contribue, durant ses dernières années, à la décoration des Maison royales de Marly et de Meudon. Abordant avec brio l’allégorie et la sculpture animalière pour Colbert, la mythologie et le genre historique pour Louis XIV, la sculpture funéraire et l’art du portrait pour Christine de Suède, le sculpteur s’illustre avant tout dans l’art religieux. Brillante personnalité artistique du XVIIe siècle, Théodon méritait une étude. Nous avons considéré sa vie et sa carrière, analysé sa manière et établi le corpus exhaustif de son œuvre
Jean-Baptiste Théodon (1645-1713) was a French sculptor of the reign of Louis XIV who belonged both to the French and Italian schools of sculpture of the Seventeenth-Century. In the 1670’s during his training at the ‘Manufacture des Gobelins’ he worked under the supervision of Charles Le Brun and met the minister Jean-Baptiste Colbert. In 1677 he joined the French Academy in Rome where he carved garden sculptures for royal estates and for his protector Colbert. Early in his Roman carrier he was made member of the Academy of St Luke and member of the Congregazione dei Virtuosi al Pantheon where he met Bernini, the architect Carlo Fontana and the painter Carlo Maratta. Appreciated by the Pope Innocent XII he obtained several commissions at Saint-Peter’s (Baptismal chapel, Monument to Christine of Sweden) and at the same time he worked for the Jesuits at the Sant’Ignazio chapel at the Gesù. As one of the most significant sculptors of the end of the Roman Seicento he dedicated his last years in Rome to the pope Clement XI and the papal basilica before his return to Paris in 1705 where he worked for the Sun King and the ‘Maisons’ of Meudon and Marly. With the same maestria Jean-Baptiste Théodon carved allegories for Colbert, mythological and historical figures for Louis XIV, funeral sculptures and portrait for Christine of Sweden as well as works of art for Roman churches. The Ph.D. dissertation consists of a study of the career of the sculptor with an analysis of his artistic manner and its evolution from Paris to Rome. In addition the thesis includes the complete ‘catalogue raisonné’ of his works, sculptures and drawings

Abstract:
In international commercial arbitration the recognition and enforcement of the award is a very important aspect of the whole arbitration process since recognition and enforcement can ultimately ensure a successful recovery of monies due. It is therefore critically important for parties to be certain that if an award is made in their favour that the award will not be refused recognition and enforcement in the country where they will ultimately seek enforcement of the award. The New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958 provides in article V(2)(b) that the recognition and enforcement of an award may be refused if the award is contrary to the public policy of that state. South Africa is a party to the New York Convention. This led to the enacting of the Recognition and Enforcement of Foreign Arbitral Awards Act 40 of 1977. The wording of section 4(1 )(a)(ii) of the Foreign Awards Act has the same effect as article V(2)(b) of the New York Convention. This dissertation attempts to determine the circumstances under which a South African court will come to the conclusion that an international commercial arbitration award is against South African public policy and accordingly unenforceable in South Africa. When trying to resist the enforcement an international commercial arbitration award on the basis that enforcement of the award will be against public policy, then the applicable public policy is not the domestic public policy but the international public policy of the relevant country. Domestic public policy means those moral, social or economic considerations which are applied by courts as grounds for refusing enforcement of a domestic arbitral award. The term international public policy, on the other hand, indicates those considerations which are applied by the enforcing courts when enforcing foreign arbitral awards rather than domestic awards. International public policy is understood to be narrower than domestic public policy. The application of an international public policy in the enforcement of international commercial arbitration awards was envisaged by the authors of both the New York Convention and the UNCITRAL Model Law. English arbitration law is an example of a jurisdiction that is well equipped to deal with the enforcement of international commercial arbitration awards and embraces the concept of international public policy. English law, and specifically English case law, may therefore provide a framework to compare the South African legal principles applicable to the public policy exception with, and to determine improvements that should be made. South African law allows for the public policy exemption to be applied and case law does indicate the application of international public policy. South African courts are well capable of dealing with any issue of enforcement of a foreign arbitral award but our legislation is inadequate and our case law limited. South Africa therefore needs to urgently pass new commercial arbitration legislation to develop our arbitration law and to instil confidence in South Africa as a venue for the conduct of international commercial arbitration. In this regard English law can be of assistance, not only because of the shared heritage but also because that law is one of the most developed regimes of arbitration law.

The Art, in its different languages, becomes an element of integration, releasing and an opportunity for comprehension for communities and individuals. Through art, it may be shortened distances and consolidate paradigms. This project has as object of research, recognize part of the Latin American iconography through the work of Antonio Berni, an Argentinian artist that in his artistic discourse emphasizes to the discourse on social inequality in Argentina and leads to reflection and analysis of historical, social and political processes the countries of Latin America. Semiotics, the science that takes into account the study and full comprehension of the language through the signs, assists in the connection of the hypotheses for this study. It creates paths of analysis and synthesis for understanding complex systems of languages, cultures and societies. It is through Peirce's semiotics, which aims to analyse and expose the aspects of Berni`s works, establishing relations between art, culture, history, society and politics and considering cultural and human aspects in their uniqueness and singularity. Through this work, it is expected to indicate the relevance of aesthetic shaping, that assists in the cultural and social expansion and comprehension in an artistic process. And, that provides the elements of meaningfulness for the individual, clarifying about their skills and capabilities through knowledge of its origins
A Arte, em suas diversas linguagens, torna-se elemento integrador, libertador e de oportunidade de compreensão a povos e indivíduos. Por meio dela, consegue-se encurtar distâncias e alicerçar paradigmas. A presente pesquisa tem como objeto reconhecer parte da iconografia latino- americana através da obra de Antonio Berni, artista argentino que, em seu discurso plástico, salienta a desigualdade social na Argentina e conduz à reflexão e à análise dos processos históricos, sociais e políticos nos países da América Latina. A Semiótica, ciência que leva em consideração o estudo e a compreensão integral das linguagens através dos signos, auxilia na conexão das hipóteses levantadas para este estudo, criando meios de análise e síntese para compreensão de sistemas complexos de linguagens, culturas e sociedades. É através da Semiótica peirceana que pretende-se analisar e expor as facetas da obra de Berni, estabelecendo relações entre arte, cultura, história, sociedade e política, ponderando aspectos culturais e humanos, únicos e singulares. Abstract:
Through a detailed analysis of a selection of works produced between 1999 and 2003 by the South African artist Berni Searle, this thesis explores the need to theorise a corporeal viewer in the process of interpreting art works. Such an approach is particularly necessary when dealing with an artist such as Searle because her work, which deals predominantly with the theme of identity, appeals not only to conceptual but also to experiential and corporeal understandings of identity. Searle incorporates the viewer into an experience of her own identity through a physical identification that the viewer feels in relation to her work. For viewers this means that they are made aware of how their own identity in the moment of interpretation is contingent on visual, mental and physical components. In order to develop this argument the work of psychoanalyst Jacques Lacan and the phenomenologist Maurice Merleau-Ponty is drawn on. These two theorists are very useful for an argument of this nature because both interpret identity as a construction involving an enfolding between the mind and, via the act of vision, the body of the subject. Through an inclusion of the corporeal element in interpretation, this thesis also offers a critique of interpretive theories that would reduce analysis to an interaction between eye and mind by analyzing how the viewer's body participates in the act of looking.

Je montre comment le "montage" d'un tableau avec une sculpture et avec un lieu architecto nique sert de support a une forme specifique de contemplation. J'envisage la question du "montage" des arts de deux points de vue: celui de sa composition par l'artiste et celui de sa reception par le spectateur croyant. L'assemblage parti culier de chaque "composto" induit en effet une operation de recomposition "imaginaire" dans la contemplation du fidele. Pour le bernin l'integration de la peinture de l'architecture et de la sculpture dans un ensemble coherent n'est pas uniquement un probleme d'ordre plastique; l'occasion lui est offerte de jouer avec les articulations et les "sauts" entre systemes de representation et registres expressifs divers pour mettre en scene un processus de transformation spirituelle. Le travail de recomposition des composantes du "composto" est prepare par des formes differentes d'exercices spirituels. L'etude des pratiques carmelites et jesuites me permet de decrire le "montage" devotionnel de l'observateur du "composto"
The thesis concerns three wholes, three "composti" of gian lorenzo bernini in rome; the fonseca (1664-1675) and albertoni (1665-1674) chapels, and the s. Andrea al quirinale main altar. I show how the "editing" of a painting with a sculpture and with an architectural structure support a specific form of contemplation. The question of "editing" three arts is seen from two points of view : the composition by the artist and the reception by the devote observer. The specific assemblage of every "composto" provoke an immaginary recomposition in the believer's contemplation. The problem of the integration of painting, architecture and sculpture in a coherent whole is not only a plastic one; the occasion is offered to bernini to play with the articulati ons and the "jumps" between differents systems of representation in order to show a process of spiritual transformation. The work of recomposition of the components of the "composto" is prepared by different kind of spritual exercices. The study of jesuits and carmelites practices allow me to describe the devotional "editing" of the devote in the "composto"

This study explores the articulation of a popular political identity by the US Senator Bernie Sanders and the political coalition he communicates. The analysis part is conducted on two levels: the construction of the populist signifier ‘the people’ and the construction of the antagonist in Sanders’ political communication. The theoretical part is mostly driven by Ernesto Laclau and Chantal Mouffe’s perspective in radical democracy, identity construction, collectiveness and the chain of equivalence. By deploying theoretically unprejudiced approach, the thesis shows how a popular identity, namely ‘the People’, emerges, how it is communicated in order to put forward an alternative reading of populism which is hotly-debated subject among scholars and political scientists. Furthermore, the thesis elaborates how the theoretical discussion proposes a way of understanding the collective subject of ‘the People’ which appears as an identifiable and contra- conjectural category. The analysis ascertains that ‘the people’, as a populist subject, emerges as collective citizens demanding equal rights and taking the larger issues of inequality at stake based on inclusive values and positions, rather than as undemocratic, authoritarian, ethnically and culturally homogenizer subjects. Consequently, any subject causing ‘injustice’ becomes the antagonized other who obliges ‘the People’ to experience misery, oppression, and discrimination. The research tackles how Senator Sanders’ political communication brings disperse identities along with the chain of equivalence, how his movement articulates the political front of ‘the People’, and how it signifies the outsider through dichotomizing the political space. The study concludes that Sanders popular articulation provides a critical perspective for us to read populist zeitgeist of the twenty-first century.

The present thesis uses methods of Critical Discourse Analysis to examine 16 front-page newspaper articles, from The New York Times and The Washington Post, covering progressive presidential candidate Bernie Sanders during the 2015 “invisible primary”. In particular, this thesis investigates how Sanders and his supporters were represented, linguistically and visually, and whether these representations – formulated as “interpretive frames” – appear more legitimizing or delegitimizing. In the crucial prevoting period of the invisible primary, the media largely have the power to construct the identity of relatively unknown candidates, such as Sanders, in the minds of the national public. The 2015/16 election season occurred against the backdrop of extreme levels of economic inequality and related societal ills, which have arguably arisen from four decades of neoliberal policies implemented by successive American presidents from both major political parties.The findings of the analysis appear to confirm a concerning pattern of largely delegitimizing US media coverage (or omission) of progressive political candidates and social movements going back several decades. In the articles analysed, Sanders was represented using interpretive frames casting him as an extreme leftist, angry and impersonal, or marginal and old. Only one major interpretive frame – representing him as a skilful, pragmatic politician – appeared legitimizing. Similarly, Sanders’ supporters were largely framed as activists, excitable fans, or divided into narrow identity categories (e.g. “white liberals”) that appear delegitimizing when considered opposite the shared economic struggles that many of them likely face. Given the liberal reputation of The New York Times and moderate image of The Washington Post, the results raise further doubts about the ideological diversity of the mainstream American public sphere.

Les grottes ornées paléolithiques de Combarelles, Font-de-Gaume, Bernifal et Rouffignac appartiennent au bassin versant de la Vézère, et se trouvent dans un rayon de quelques kilomètres autour du village des Eyzies (24, France). Leurs découvertes anciennes (de 1901 à 1956) sont à l'origine de nombreuses études ciblées qui ont souvent mis en évidence telle ou telle similitude, sans pour autant proposer une vision plus globale de ces sites majeurs de l'art magdalénien ouest-européen. Cette étude essaie donc de combler cette lacune et s'articule autour de 2 axes complémentaires de recherche. 1°- La méconnaissance de l'âge des œuvres et leur position chronologique relative nécessitent une révision des données issues du contexte archéologique des cavités. Cette approche conduit à mieux cerner les différentes fréquentations animales et humaines depuis le Pléistocène. Mais les résultats d'un site à l'autre demeurent contrastés. A Rouffignac et Bernifal, les vestiges attribuables au Paléolithique supérieur sont rares alors qu'ils sont plus nombreux aux Combarelles, mais restent difficiles à corréler avec l'art pariétal. A Font-de-Gaume, leur disparité compliquent les interprétations. Pour ce site, la découverte d'une exploitation de l'Ours (Ursus spaeleus) par l'Homme est un résultat notable. 2°- L'art de ces sites offre des points communs thématiques et stylistiques (notamment des figurations de mammouths et des signes tectiformes) qui justifient une étude comparative. La création d'un référentiel archéologique à partir de panneaux dont l'analyse externe garantit l'unité de composition, permet de découvrir que certaines variables morphologiques des figurations de mammouths et de bisons, sont plus aptes que d'autres à mettre en lumière le degré de parenté entre les dispositifs pariétaux. Une étude statistique des caractères morphologiques des figurations et l'analyse du bestiaire figuré permettent de compléter l'argumentation.

Due to the current high levels of urbanisation and the lingering effects of Apartheid, South African municipalities have experienced difficulties in planning for sustainability and more specifically sustainable community development. Sustainable community development is needed in order to achieve more integrated and sustainable towns and cities with an improved urban environment and a higher quality of life. Due to this sustainable community development is of particular relevance to South Africa. Although policies and legislation exist at international, national and local level, there is a lack of suitable planning instruments to guide sustainable community development. Tlokwe Local Municipality is researched as study area to test and develop planning instruments for sustainable community development. An assessment matrix of sustainability indicators is linked to Multi-criteria analysis (MCA) and applied to identify the themes and sub-themes applicable to sustainability in which intervention is required to improve the sustainability rating of the municipality. A Goal Assessment Matrix (GAM) approach is used to score and prioritise municipal projects, plans and strategies according to sustainable community development fundamentals. The top scoring projects are indicative of the achievement of sustainable community development goals and objectives. The result of the sustainability assessment is that the Tlokwe Local Municipality is considered to be relatively sustainable, performing overall better than the three spheres of government against which it was measured. Subsequent to the GAM assessment a lack of alignment between the sectoral plans was identified as well as the duplication of projects. The projects, plans and strategies of the municipality are found to not have been formulated with sustainable community development framework as a guiding goal. It is recommended that municipalities use the assessment matrix methods to determine its level of sustainability when developing respective sectoral plans (SDFs, ITPs, EMFs and IDPs). Areas in which there is a lack of sustainability are highlighted and can consequently be addressed through intervention strategies. Prioritising municipal projects, plans and strategies through the use of GAM identifies crucial projects that need special attention to ensure their successful implementation as this will largely aid sustainable community development. Both the assessment matrix method and the GAM approach are valuable planning instruments with which to achieve sustainable community development.

Background. The study was aimed at showing the prevalence, clinical and demographic characteristics of HIV positive adolescents attending the Wellness clinic of the Bernice Samuel Hospital in Delmas. Design. The study was a retrospective, cross-sectional study. Methods. A non-probability sampling (criterion sampling) was used. All patients between the ages of 11 years to 19 years who are registered at the Wellness clinic of Bernice Samuel Hospital in Delmas for the period 1 January 2009 to 31 December 2009 were taken. The variables studied included Prevalence, Demographic variables (gender, age group, population group, marital and employment status as well as Proximity to ART site) and Clinical variables(Viralload at presentation, CD4 count, Hemoglobin, associated sexually transmitted disease, associated health problems pre and post HAART, antiretroviral regimen, WHO staging). Results. The study showed a great disparity between the total number of adolescents picked up by VCT in the community and those registered for follow up care at the Hospital's Wellness clinic (Clinic prevalence 2.3% versus community prevalence 3.8%). Most of the patients were females, evenly distributed in early and late adolescence, were scholars presenting at an advanced stage of the disease despite an easy access to health care. Common health problems encountered in these patients were oral Candidiasis, malnutrition, pneumonia, and diarrheal illness. The commonest adverse reactions to HAAR T were gastrointestinal symptoms and hepatotoxicity. Retention on the ARV treatment program was good but there was an unacceptable delay in initiating HAART. Death was the commonest cause of loss to follow up. Conclusion. Adolescent HIV / AIDS remains a problem in the Delmas municipality even though prevalence appears to be low. The cause of late presentation in the wellness clinic despite good access will need to be investigated and rectified.
