AbstractThis chapter introduces the concept of differentiated integration and discusses its explanatory value in view of the EU–Turkey relationship. The major aim is to elaborate whether variable geometries as a form of differentiation constituting different and sometimes even overlapping forms of association and integration with different member and non-member states can provide a soft-landing from the fallout of Turkey’s EU accession process. The chapter sets out the many faces of differentiation and examines how the conceptual approach is perceived in the European and Turkish debates. The analysis also provides a concise overview on how differentiated integration is embedded in the logics of the main European integration theories. This conceptual discussion is complemented by a detailed outline of the variable geometries that already exist in EU–Turkey relations resulting from the three distinct forms of bilateral dialogue: accession process, functional cooperation, and cooperation in international organizations. The chapter concludes by linking the empirical findings back to the conceptual analysis, thereby discussing the limits of the explanatory value of the concept as well as highlighting the modernization of the Customs Union as a potential starting point for a differentiated future of EU–Turkey relations.

AbstractIndia has a segmented social protection system. About 92% of workers in India are in unorganised sector, deprived of formal social security provisions. Those who are in formal sector receive very generous social protection arrangements close to that of welfare states in Europe, primarily influenced by the colonial legacy. Those in the informal sector primarily meet their social security needs from their disposable income. With expansive private welfare providers, the rich segment in the informal segment is able to afford this. Indian unskilled migrants, mainly in the Gulf region, have a range of benefits that are primarily to meet the civil rights, rather than social rights. Compared to this, Indian migrants in Western Europe and the Americas mainly benefit from the social security system in those countries. On the other hand, foreigners coming to India have limited social security arrangements. AbstractThis chapter explores how far the potential of the 2030 Agenda, a global framework for the Sustainable Development Goals (SDGs), is being utilised to address multidimensional older age exclusion. The available evidence shows that, without a major shift in the coming decade, the pledge that the 2030 Agenda should be met for “all nations, peoples … and segments of society” will not be achieved in the case of older people, and the risks of failure are highest for older people in low- and middle-income countries. Across dimensions of framing, implementation, monitoring and reporting, recognition of ageing and older people is limited in the SDGs. Where recognition is explicit, it relates to the framing of older people as a vulnerable group rather than as rights holders on an equal footing with people of other ages. The major shift required in this context is the recognition of older people as rights holders, of States as duty bearers and the extension of a rights-based approach to policy design and implementation to counteract multidimensional social exclusion. Failure is not inevitable. Political commitment from key stakeholders, coupled with support from bilateral and multilateral donors, could result in better outcomes from Agenda 2030 on older-age exclusion.

AbstractInvestment treaty law and EU law began to develop in the same era and share some important philosophical and axiological foundations. The pressure on the CEE countries to enter into numerous bilateral investment treaties in late 80s and early 90s, in the context of the EU accession aspirations of the former communist countries, was likely to result, eventually, in a conflict between EU law and investment treaty law. The conflict could have been managed in three different ways, yet the CJEU decided in Achmea to declare an undefined volume of intra-EU arbitrations to be incompatible with EU law. This important judgment, which delivered an outcome desired by the European Commission and a number of Member States, is based on questionable legal reasoning that creates high uncertainty in this area of law. The doubts include the scope of application of Achmea, which is now a highly debatable issue. The CJEU itself saw it necessary to limit the scope of Achmea by declaring in Opinion 1/17 (CETA) that the legal reasoning of Achmea did not apply to investment protection treaties with third countries. The Member States of the EU remain politically divided in their views as to whether Achmea applies to the Energy Charter Treaty. And while the problems with the rule of law and independence of the judiciary in certain Member States continue to grow, Achmea has left an important gap for which there is no substitute in the current architecture of the EU legal system.

Any discussion of the thaw in U.S.-Cuban relations must address China’s key role in Cuba’s political and economic structure. Today, China is not only a longtime supporter of the regime but also Cuba’s largest trading partner. Perhaps more importantly, the thaw in Sino-U.S. relations and subsequent shift in Chinese economic policy offers a potential model to the Cuban communist regime, a “moral inspiration” that encourages openness to the international economy, while maintaining internal control. This chapter examines the ways China’s direct economic and political interactions with the Cuban government facilitate further economic opening, while maintaining state control over key political and economic sectors. The chapter also examines the limits of the Chinese model and its implications for Cuba’s future.

This chapter investigates the daunting policy challenges that face the United States and Cuba in their effort to advance their bilateral diplomatic and economic affairs, owing largely to the draconian conditionality codified in the Cuban Liberty and Democratic Solidarity (Libertad) Act of 1996 (Helms–Burton Act). Given the highly partisan and divided nature of executive and legislative branches of the U.S. government, it remains uncertain as to whether Congress will allow progress in the normalization process to move beyond the limits of executive action. The chapter identifies and details the concrete steps that must be undertaken by the Congress to dismantle Helms-Burton, and under what conditions that might occur.
