Abstract:
This is the second of a short series on the federal budget process. Here, we will focus on how the science budget is set inside the Executive Office of the President. The main players here are the Office of Management and Budget (OMB) and the Office of Science and Technology Policy (OSTP).The budget process for a given fiscal year starts in the agencies. For example, the fiscal year 1991 budget request to Congress was put together by the agencies during the winter, spring and summer of 1989. In the Department of Energy (DOE) for example, budget requests are obtained from the field offices. Typically, these requests are an exercise in optimism, founded on the time-honored notion that you are certain to get nothing if you don't at least ask.In any event, DOE headquarters staff, after receiving these requests, pare down the totals in a process not unlike that followed within the OMB. This can resuit in weeping and gnashing of teeth at the field offices even at this early stage. While not generally appreciated, OMB staff can often do much of their budget cutting work before even receiving the formal budget request by a judicious combination of friendly advice, jawboning or more extreme measures which this writer will not go into. (On a more positive note, previous administration guidance—e.g., a planned doubling of the National Science Foundation (NSF) budget in five years, or a commitment to a given schedule for space probes, satellites, etc., in the case of NASA—can largely “hard wire” the budget process before the budget submission to OMB).

The Lee Hancock Collection of materials on the Branch Davidian case, located at the Loyola University New Orleans archive, contains an impressive set of internal memos, interview reports, and expert reports from the Federal Bureau of Investigation, the Bureau of Alcohol, Tobacco, and Firearms, and the Texas Rangers, in addition to numerous government reports and documents relating to the criminal and civil trials. It also contains an array of news articles. The Hancock Collection provides important source materials relevant to research on the events in 1993 involving federal agents and the Branch Davidians, the subsequent trials and investigations, as well as media depictions. The federal documents in the Hancock Collection are particularly important in light of the withholding and destruction of source materials on the Branch Davidian case by United States agents and agencies.

Abstract:
This thesis explores how the advent of the Indian Gaming Regulatory Act of 1988 caused Native American identities to become hyper-politicized and manipulated by the Bureau of Indian Affairs' (BIA) Federal Acknowledgment Process (FAP). I use the Ramapough Lenape Nation of New York and New Jersey's 1990's attempt at federal recognition as an example of gaming's pervasiveness in identity debates. I demonstrate that despite the consistent understanding of the Ramapough's Lenni-Lenape ancestry through direct and indirect references since the eighteenth century, the risk of Ramapough gaming in New Jersey caused proponents of Atlantic City, New Jersey's gaming economy to secure an unjust denial of Ramapough sovereignty through interference in FAP proceedings.

Abstract:
The purpose of this study is to establish whether or not Open Federalism contributed to the rise in the Conservative party's vote share in Quebec in the 2006 Canadian federal election. Open Federalism represented a fresh, constructive approach to Quebec-Ottawa relations, which had soured considerably since the 1960s. Given the importance of national unity and intergovernmental relations in Quebec politics, there is reason to believe that this campaign proposal motivated many Quebecers to support the Conservatives in 2006. Using data from the Canadian Election Study and the Observatory on Media and Public Policy, this study provides empirical tests of the effects of Open Federalism on voting behaviour in Quebec. It is demonstrated that the proposal did in fact contribute to the Conservative vote share among Quebecers, even once other relevant factors such as the sponsorship scandal, conservative values, and strategic voting are taken into account.<br>L'objectif de cette étude est de déterminer si le fédéralisme d'ouverture a contribué à l'augmentation des appuis obtenus par le parti Conservateur à l'élection fédérale canadienne de 2006. Le fédéralisme d'ouverture symbolisait une approche nouvelle et constructive du rapport entre Québec et Ottawa, qui a dégénéré de manière notable depuis les années soixante. Étant donné l'importance des enjeux de l'unité nationale et des relations intergouvernementales en politique québécoise, il est raisonnable de croire que cette promesse électorale à poussé un certain nombre de Québécois à appuyer le parti Conservateur en 2006. En utilisant les données de l'Étude électorale canadienne et de l'Observatoire sur les médias et les politiques publiques, il est démontré que la proposition de fédéralisme d'ouverture a influencé le vote des Québécois en faveur du parti Conservateur, par-delà l'effet d'autres facteurs importants tel que le scandale des commandites, les valeurs conservatrices et le vote stratégique.

The objective is to analyze the constitutive bases of intragovernmental coordination and how they operate within the Brazilian Federal Executive. Three policies are examined, according to the criteria for varying forms of coordination in the period between 2007 and 2014. The conclusions point to new coordination arrangements, institutionalization of federal agencies and high capacity of public bureaucracies to promote coordination given its characteristics of stability and incentives for the occupation of management positions together with the development of political capacities.<br>O tema de coordenação intragovernamental tem emergido nos últimos anos a partir de tentativas de análise das estruturas e mecanismos de funcionamento do Executivo com a preocupação fundamental de dar sustentação, coerência e eficácia à ação estatal. O enfoque central de coordenação intragovernamental para a tese é observá-la mobilizada em políticas públicas. Seria, pois, a atividade, essencial ao funcionamento governamental, de alinhar estruturas e ações, além de acomodar conflitos e interesses entre as partes componentes do Executivo, com o intuito de reduzir sobreposições, duplicações ou evitar paralisias, garantindo que os objetivos não sejam frustrados pela atuação das unidades. Busca-se superar algumas das lacunas dos estudos, em geral ligadas a seguinte dicotomia: fortemente formais, apresentando baixa profundidade analítica ou construídos a partir de estudo de caso único, com baixo esforço de diálogo com outros casos ou estudos. O objetivo é analisar as bases constitutivas da coordenação intragovernamental e como funcionam no interior do Executivo federal brasileiro. São examinadas três políticas públicas, segundo critério de variação de formas de coordenação e com o recorte temporal centrado no período entre 2007 e 2014. A política de administração tributária, é o contra-caso, ou seja, o caso de ausência de coordenação, onde explorar-se-á as características e situações em que a coordenação é repelida (não engendram coordenação). Os dois outros, que possuem fortes mecanismos de coordenação, são: a política de comércio exterior no âmbito do Mercosul, calcada em estruturas dinâmicas de coordenação e o Programa Bolsa Família, em estruturas estáticas de coordenação. As conclusões permitem-nos contrapor algumas das dinâmicas e traços dos arranjos de coordenação descritos pela literatura de burocracia e política no Brasil, sobretudo no período do governo militar com os estudos de caso do período recente. O referencial daquele período apontava para organizações frágeis, com burocracias pouco estáveis onde predominavam mecanismos não formalizados, levando a padrões de coordenação relativamente singulares e “adhocráticos”. As redes tecidas pelas burocracias estatais no período eram mais orientadas para parcerias e interação com atores privados do que com atores intragovernamentais. Além disso, havia alguns lóci de políticas públicas fortemente marcados pela dinâmica de insulamento burocrático. Há no período recente algumas nuances e reversões destes padrões. Embora haja diversas políticas implementadas segundo lógicas delimitadas de insulamento burocrático, é possível analisar-se a política de administração tributária através do conceito de autonomia inserida, aprofundando a análise sobre insulamento burocrático. Os outros casos estudados, apontam para padrões marcados pela institucionalização de órgãos, consolidação de políticas e estruturação de múltiplos recursos formais e informais de coordenação e de liderança política sobre as burocracias. Há, pois, políticas públicas com mecanismos de coordenação intragovernamental substancialmente construído por burocracias públicas com alta estabilidade e capacidade de circulação entre os órgãos estatais, o que confere às redes informais de coordenação tecidas por burocratas um caráter essencialmente intragovernamental.

Si la science politique et l’histoire ont su montrer les effets de l’expansion de la bureaucratie sur la présidence et le Congrès en assez grands détails, la vision du pouvoir judiciaire dans sa relation avec l’État américain moderne reste singulièrement appauvrie. Un examen de l’historiographie de l’État et du pouvoir judiciaire montre que la question de l’impact du fait administratif sur le fonctionnement de ce dernier n’a finalement jamais été clairement posée. Cette thèse entend démontrer que les relations entre le judiciaire et l’État fédéral se sont jouées non sur un conflit de principe quand au rôle et à la place de la bureaucratie fédérale dans le schéma constitutionnel américain mais plutôt dans le cadre du processus de reconstruction du judiciaire fédéral initié à la fin du dix- neuvième siècle avec le Evarts Act de 1891<br>Even though political scientists and historians have been able to make sense of the impact of bureaucracy on the Congress and the Presidency, the question of the relation of the federal judiciary with the federal state remains largely untouched, as if the constitutional confrontation of 1937 had settled the issue once and for all, with the traditional narrative of judicial restraint and executive triumph firmly in place. This work aims to suggest and explore another avenue for research, by underlining the importance of earlier, turn-of-the-century developments regarding the institutional evolution of the federal judiciary itself and the development of early administrative law. By shifting the focus of attention away from the New Deal crisis, we show that the complicated relation between the federal judiciary and the federal state did not primarily concern the place of administrative power in the constitutional structure, but rather the institutional identity of a federal judiciary which underwent profound changes before the New Deal. In other words, the federal judiciary has a history, and this has to count for something

This is because in previous normative situation not dispensed to public health due attention, leaving to the discretion of public officials the implementation of health policies they deemed relevant. Thus, in most of Brazilian history, they are circumscribed to the supply of a poor service, especially for the large portion of the population that was not affiliated to the social security system and also does not have the financial resources to pay for private care. However, the constitutionalization of the right to full and universal health care in the 1988 Constitution brought important challenges in implementing this right, mainly due to the significant amount of financial resources necessary for satisfactory service. Within a context of limited budget resources and growing aspirations of people around the realization of the right to health, the Judiciary has assumed an increasingly participatory role, granting, in place of individual demands, deliverables involving the right to health. But the growing interference of the Judicial Branch in managing public health policies has caused some difficulties in managing the budget portion allocated to the financing of health care, interfering in the planning of public health policies outlined by managers. In this context, the present work is sought by the adoption of a methodological basis backed by literature searches and evaluation of jurisprudential and doctrinal context related to the theme, analyzing how research problem is the interference of the judiciary - which has been increasing to over time and leaning to recognize the right to health as a supply of absolute nature, to have an intimate relationship with the right to life - is legitimate and if it brings or no benefits for the realization of the right in question, starting from the assumption, that the end is confirmed, that it is actually more an instrument that deepens inequalities, far making the constitutional objective of ensuring everyone access to public health care universal and equitable manner.<br>A inclusão do direito à assistência universal e integral à saúde no texto da Constituição Federal de 1988 inovou em relação aos sistemas constitucionais que vigoraram no Brasil anteriormente. Isso porque, na conjuntura normativa antecedente, não se dispensava à saúde pública a devida atenção, deixando ao critério dos gestores públicos a implementação das políticas sanitárias que julgassem relevantes. Com isso, na maior parte da história brasileira, essas políticas se circunscreveram à dispensa de um atendimento precário, em especial para a grande parcela da população que não se encontrava filiada ao sistema previdenciário e também não dispunha de recursos financeiros para custear o atendimento privado. No entanto, a constitucionalização do direito à assistência integral e universal à saúde na Carta de 1988 trouxe importantes desafios na implementação desse direito, principalmente em decorrência do importante volume de recursos financeiros necessário para um atendimento satisfatório. Dentro de um contexto de recursos orçamentários limitados e anseios crescentes da população em torno da concretização do direito à saúde, o Poder Judiciário vem assumindo um papel cada vez mais participativo, outorgando, em sede de demandas individuais, prestações concretas envolvendo o direito à saúde. Mas, a crescente interferência do Poder Judiciário no gerenciamento de políticas públicas de saúde tem provocado algumas dificuldades na gestão da parcela orçamentária destinada ao custeio da assistência sanitária, interferindo no planejamento das políticas públicas de saúde delineadas pelos gestores. Diante desse contexto, no presente trabalho se busca, mediante a adoção de uma base metodológica lastreada em pesquisas bibliográficas e na avaliação da conjuntura jurisprudencial e doutrinária relacionada ao tema, analisar como problema de pesquisa se a interferência do Poder Judiciário - que vem se acentuando ao longo do tempo e se inclinando a reconhecer o direito à saúde como uma prestação de natureza absoluta, por ter uma íntima relação com o direito à vida - é legítima e se ela traz ou não benefícios para a concretização do direito em análise, partindo-se da hipótese, que ao final se confirma, de que ela se constitui, na verdade, em mais um instrumento que aprofunda iniquidades, tornando distante o objetivo constitucional de assegurar a todos um acesso à saúde pública de forma universal e igualitária.

Ao longo do século XX, o Direito do Trabalho esteve associado a um arranjo político e social cujos sentidos estavam vinculados, entre outros aspectos, à civilização das relações de classe e à reprodução do capitalismo com democracia, no âmbito dos Estados nacionais. O propósito desta pesquisa é investigar como ocorreu o processo de deslocamento e reinterpretação desses sentidos (equivalente à codificação da razão do mais forte), no contexto da forte hegemonia política da coalizão de centro-direita que governou o país entre 1995 e 2002. Nesse período, o Poder Executivo Federal, as principais organizações patronais, setores importantes da mídia impressa e a Força Sindical estiveram empenhados na promoção de profunda alteração dos traços centrais do modelo brasileiro de relações de trabalho, no qual a lei é mais importante na definição dos direitos substantivos do trabalho do que os contratos coletivos. Para justificar politicamente essas alterações, o Poder Executivo e seus apoiadores apontaram a responsabilidade do modelo legislado pelos elevados custos do emprego formal, a perda de competitividade da indústria, o aumento da informalidade e do desemprego durante o governo FHC. Por meio da leitura das justificativas dos projetos encaminhados ao Congresso Nacional pelo Poder Executivo, das manifestações de suas principais lideranças e dos apoiadores na mídia e no meio sindical, a pesquisa busca interpretar o sentido político dessa leitura, apresentada como se fosse solução técnica e modernizante para uma legislação que estaria ultrapassada. Consideramos que a reforma trabalhista tinha claros propósitos políticos pois, além de repassar aos trabalhadores os custos do ajuste econômico nos anos 90, permitiu justificar na cena pública a retração do papel do Estado, bem como fortalecer o apoio de setores importantes do patronato a esse projeto político.<br>Throughout the twentieth century, labor law has been associated with a political and social arrangement that, within the national states, reproduced capitalism and civilized class relations. The research aims to analyze the shift in the interpretation and meaning of labor law, in the context of strong political hegemony of the center-right coalition that governed Brazil from 1995 to 2002. Throughout this period, the Federal Executive branch, the main employer organizations, important sectors of press and unions had been engaged in a battle to change the Brazilian model of work relations, in which labor law is more important than collective contracts, with regard to the definition of labor rights. In order to justify those changes, the Federal Executive branch and its supporters have considered the burden of the Brazilian model for the formal employment high costs, the competitiveness loss of local industries, the unemployment and informal sector growth during the Cardoso administration. The research analyzes the justifications of legislative initiatives sent to National Congress by Federal Executive branch, the speeches of its political leaders and supporters in the media press and among unions with the purpose of interpret the political meaning of this project, sold to public as a technical and modern solution to a legislation that, presumably, was old-fashioned. The research evidences allow us to affirm that the labor reform had clear political purposes: besides transferring to the workers the economic costs of the neoliberal reforms during the nineties, it had also been useful to justify the retreat of state from the economy and to gain the political support of the main employer organizations.

O tema desta dissertação é a relação entre Supremo Tribunal Federal e executivo militar no período de institucionalização do regime militar brasileiro (1964-1969). O trabalho examina (i) o papel desempenhado pelo Supremo durante tal período, (ii) as causas e os mecanismos pelos quais o tribunal foi enquadrado no espírito da Revolução, e (iii) como o regime militar de 1964 interferiu no exercício pela corte de suas funções de poder político e protetor dos direitos e garantias individuais. A pesquisa foca os acórdãos proferidos pelo Supremo entre 1964 e 1969. A dissertação está dividida em duas grandes partes. A primeira parte tem por objetivo contextualizar o leitor, descrevendo, entre outros tópicos, (i) o impacto da doutrina da segurança nacional no direito e no ordenamento jurídico, e (ii) a importância do bacharéis da UDN para história da corte durante tal período. A segunda parte do trabalho é o coração da dissertação. O capítulo 2 explica o novo direito constitucional brasileiro criado pelo preâmbulo do Ato Institucional nº 1. O capítulo 3 analisa dezenas de decisões proferidas pelo Supremo entre o Ato Institucional nº 1 (9.4.1964) e o Ato Institucional nº 2 (27.10.1965). Demonstra como a jurisprudência do Supremo evoluiu da incompetência declarada pela própria corte para julgar os habeas corpus ajuizados pelos inimigos da Revolução à concessão de dezenas desses habeas corpus, mesmo contra os interesses do executivo militar. Os militares responderam editando o Ato Institucional nº 2, pelo qual o número de ministros foi aumentado de 11 para 16 e a competência da justiça comum para julgar habeas corpus relativos a crimes políticos foi transferida para a justiça militar. O capítulo 4 explica as conseqüências do Ato Institucional nº 2 para a jurisprudência do STF, revelando que, mesmo com a nomeação de novos ministros pelos presidentes militares, dezenas de habeas corpus continuaram a ser concedidos em favor dos adversários do regime. Em resposta, o presidente Costa e Silva editou o Ato Institucional nº 5, aposentando à força três ministros e proibindo a concessão pelo judiciário de novos habeas corpus em casos de crimes políticos. Em 1969, o número de ministros foi reduzido pelos militares de 16 para 11. Em conclusão, a dissertação comprova que o processo de enquadramento do Supremo executado pelos militares foi finalmente concluído em 1969.<br>This paper addresses the relationship between the Brazilian Supreme Court (Supremo Tribunal Federal) and the executive branch during the organization of the Brazilian military regime (1964-1969). It examines (i) the role played by Supremo during such period, (ii) the causes and mechanisms whereby the court was framed in the spirit of the Revolution, and (iii) how the military regime of 1964 interfered in the exercise by the court of its functions of police maker and protector of personal rights and guarantees. The research focus on the rulings rendered by Supremo between 1964 and 1969. This paper is divided in two main parts. The first one contextualizes the reader, describing, among other matters, (i) the impact of the national security doctrine (doutrina da segurança nacional) in Law and in the legal system, and (ii) the significant role played by the UDN bachelors of Law for the history of the court during such period. The second part is the heart of the paper. Chapter 2 explains the new Brazilian Constitutional Law created by the prologue of Ato Institucional nº 1. Chapter 3 analyses tens of Supremo rulings rendered between Ato Institucional nº 1 (4.9.1964) and Ato Institucional nº 2 (10.27.1965). It addresses how Supremos case law shifted from denying its own jurisdiction to rule on the writs of habeas corpus filed by the enemies of the Revolution to granting tens of such habeas corpus, even against the will of the military regime. The military responded enacting Ato Institucional nº 2, whereby the number of justices was increased from 11 to 16 and the jurisdiction of the civil courts to rule on habeas corpus regarding political offenses was transferred to the military courts. Chapter 4 explains the consequences of Ato Institucional nº 2 to Supremos case law, revealing that, despite the appointment of new justices by the military presidents, tens of habeas corpus continued to be granted in benefit of the political opponents of the regime. President Costa e Silva responded enacting Ato Institucional nº 5, forcing the retirement of three justices and forbidding the granting by the judiciary of new habeas corpus regarding political offenses. In 1969, the number of justices was reduced by the military from 16 to 11. In conclusion, this paper proves that the framing of Supremo Tribunal Federal carried out by the military regime was finally accomplished in 1969.

O objetivo da tese é desconstruir esse imaginário, demonstrando que não existe um vínculo pressuposto (natural) entre supremacia judicial e controle de constitucionalidade. Para alcançar tal objetivo, observa-se que a supremacia judicial do STF é fruto de um contexto político, que emerge da incorporação da leitura que é feita no Brasil sobre o papel do judiciário em duas tradições: do constitucionalismo norte-americano (em especial, da dimensão política da atuação da Suprema Corte dos Estados Unidos) e da experiência constitucional alemã (que atribui ao Tribunal Constitucional Federal o dever de concretização de direitos). Conjugando esses dois elementos, observa-se que a supremacia judicial se manifesta no contexto brasileiro através da concessão de três autoridades ao STF – interpretativa, política e simbólica –, o que está ligado à criação dos seguintes pressupostos: de que o Tribunal possui a última palavra na construção do direito, de que sua atuação sobrepõe-se a das instâncias majoritárias e de que ele é o poder mais habilitado (capaz) de traduzir os anseios sociais. A tese contesta a possibilidade de dar amparo constitucional a esse tríplice modo de visualizar a o exercício da jurisdição constitucional, problematizando a relação entre os poderes do estado sob os aportes da relação direito e política, o que significa a imersão na diferença existente entre a esfera jurídica e o campo político, na análise da interação entre os três poderes do estado, bem como na distinção entre decisão judicial e escolha política. Chega-se, assim, à conclusão da existência de uma supremacia judicial consentida (não decorrente do texto constitucional), isto é, construída teoricamente (através do reconhecimento da supremacia judicial pelos juristas) e institucionalmente (pelos incentivos dos poderes eleitos ou pela auto-investidura do STF). A tese foi desenvolvida através do método hermenêutico-fenomenológico, estando inserida no eixo temático que a Crítica Hermenêutica do Direito de Lenio Streck proporcionou ao direito.<br>From the last tens years on, a theoretical hypothesis that naturalises judicial supremacy began to be disseminated in Brazil, or, that it is something inherent to the functional prerogatives of the Federal Supreme Court – a specific way of understanding its role, which is extracted from a constitutional argument (that is claimed to be provided by the Constitution). The purpose of the thesis is to deconstruct this idea, demonstrating that there is no presupposed (natural) relationship between judicial supremacy and constitutionality control. In order to do so, it has been observed that the judicial supremacy of the STF is the result of a political context, which emerges from the incorporation of the reading made in Brazil on the role of the judiciary from two traditions: American constitutionalism (in particular, the political dimension of the role of the Supreme Court of the United States) and the constitutional experience of Germany (which gives the Federal Constitutional Court the duty to enforce rights). Combining these two elements, it has been observed that the judicial supremacy manifests itself in the Brazilian context through the granting of three authorities to the STF – interpretative, political and symbolic –, which is then linked to the creation of the following assumptions: that the Court has the last word on the construction of law, that its duty overlaps with those of the majority bodies, and that it is the most enabled (able) branch to translate social desires. The thesis disputes the possibility of granting constitutional protection to this triple way of visualising the exercise of constitutional jurisdiction, problematising the relationship between the branches of government under the contributions of the relationships between law and politics, which means an immersion in the existing difference between the legal sphere and the political field in the analysis of the interaction between the three branches of government, as well as in the distinction between judicial decision and political choice. This leads to the conclusion of the existence of a consented judicial supremacy (not derived from the constitutional text), that is, theoretically (through the recognition of the judicial supremacy by lawyers) and institutionally (by the incentives of elected officials or self- investiture of the STF) constructed. The thesis was developed through the hermeneutic-phenomenological method, being inserted in the thematic axis that Lenio Streck's Hermeneutic Critique of Law provided to Law.

The study analyzes the performance of the Permanent Commissions of Archival Appraisal of the Brazilian Federal Executive Branch, between 2004 and 2012. It presents the context in the Information Science and in the Archival Science of the concept of information. It identifies the characteristics of the public information and of the governmental information. It presents the concept of records management and the principles for the archival appraisal. It highlights in the archival theory the intellectual origins of knowledge about appraisal process, from the classic origins to the postmodernism ones. It adopts a conceptual vision on the State as an informational field and on the archival public policy. It presents the legal benchmarks on archives and information access in Brazil. It describes the institutional benchmarks of the Federal Government's archival public policy. It analyzes the performance of the Arquivo Nacional of Brazil in the technical orientation to the agencies of Federal Executive Branch. The chapter examines the how and why of the events that led to a fifty-one day siege and ended with the deaths of over seventy Branch Davidians in April 1993. The primary sources demonstrate how the Branch Davidians were constructed as a dangerous “cult,” the ways federal law enforcement relied on this stereotype, the resulting misunderstandings that occurred in the negotiations as a result of this stereotype, and the deadly consequences. The primary sources, including media portrayals, FBI negotiation transcripts, and Koresh’s writings, provide readers with opportunities to explore the tragic results of utilizing the “cult” stereotype. The chapter ends with various perspectives on why Waco happened.

Under classic accounts, a single, overarching and all-inclusive legislative mandate or organic statute grants executive agencies the authority to act in a specified field of action, and delineates the contours of their action by setting limits and conditions. However, as any practitioner can attest, the legislative mandate, when it exists, is never the sole source of executive authority, and is always supported by other legal rules. There will usually be other legal rules that have no direct link to the legislative mandate, when it exists: other statutes, executive orders, and other unilateral measures, and, in a Federal system, state law, when and as far as it pertains to any aspect of a Federal arrangement. The chapter analyses two patterns of patchwork legislation, piling-up and dispersion. Using examples from the UK and the US in the fields of emergency and air pollution law, the chapter claims that the existence of multiple rules fuzzies-up the law. Varying in intensity and form, patchwork law commonly features in these four examples of domestic authorizations to act under, and beyond, formal law.

Julius Henry Cohen, the principal drafter of the Federal Arbitration Act (FAA), together with Kenneth Dayton, another lawyer who worked at Cohen’s firm, published a landmark article announcing the FAA’s enactment in February 1926, one month after the FAA’s effective date. An interesting history surrounds the writing of the article, which stands as a milestone in the field of arbitration law for several reasons, including: its introduction and justification of a statute that has had a far-reaching impact on America’s civil justice system; its contextualization of the FAA; its acknowledgment of concerns regarding the FAA; and its recognition that private parties should promote arbitration. The article is significant for celebrating the birth of a landmark statute and capturing a small snapshot of the rich legal history of the FAA. Also, in retrospect, the article has taken on a new meaning and serves as a reminder that the FAA, now almost one hundred years old, needs reform....

Scholars, politicians, and prosecutors themselves have repeatedly maintained that federal prosecutors have vast independence when carrying out their jobs. Despite this, we argue that federal prosecutors are constrained by the federal and local political environments in which they serve. U.S. Attorneys, the chief federal prosecutors for the 93 federal judicial districts around the country, are selected through a politically driven appointment process and operate within the purview of the Department of Justice, an executive branch agency. Federal prosecutors are led by the U.S. Attorney General, a presidential appointee and high-ranking member of the president’s cabinet. And U.S. Attorneys are invested members of their local community and are likely to be mindful of those preferences when making prosecutorial decisions. As a result, we should expect to find political influence at every stage of a U.S. Attorney’s service. The chapter closes with a preview of the full book.

Thereat it is necessary to look for new material for breeding. Conduction of ecological and geographical trials allowed finding the most productive and large-seeded samples from the VIR’s collection. The trial results also showed the significant impact of reproduction place on economically valuable traits. Thus, ripening rate is higher in Cis-caspian Agrarian Federal Scientific Center of the Russian Academy of Sciences (PAFNTs RAN) compared to the Kuban experimental station – a branch of N.I. Vavilov All-Russian Institute of Plant Genetic Resources (KOS VIR).

Abstract:
Electrical research in geology is used quite widely and with great efficiency. The use of ready-made signal recorders for these purposes is possible, but not effective enough, since in any case, they need to be modified to provide additional functions. Such functions include the synchronization of measurements with signals from positioning systems GPS or GLONASS. This synchronization is necessary in order for the measurement results to be linked to actual space and time coordinates as accurately as possible. The same measurements taken at different times may give different results due to changes in the orientation of the Earth relative to the Sun and Moon, as well as for other uncontrollable reasons. The need to accurately determine the coordinates of the measurement is obvious. The creative team of the commonwealth of organizations, the key of which is the Siberian Branch of the Federal State Budgetary Institution of Science of the Federal Research Center “Unified Geophysical Service of the Russian Academy of Sciences”, carried out the development and initial testing of a specialized signal recorder for electrical research. The additional modification was required to eliminate the identified deficiencies. This paper reports the main technical solutions when creating this recorder, describes the modification ,and gives an example of using this recorder for field measurements.

Based on the analysis of statistical yearbooks "state of contamination of soils and objects of the natural environment of the Russian Federation with pesticides and toxicants of industrial origin", analysis of the incidence of workers and the population from exposure to residual pesticides and heavy metals, the need to assess soil contamination for organic farming purposes in accordance with the requirements of article 9 of the Federal law of 03.08.2018 No. 280-FZ "on organic products and amendments to certain legislative acts of the Russian Federation"is justified. For evaluation, a digital technology is proposed in the management of environmental safety and labor protection in agriculture, developed by scientists of the ITOSH-branch of the FGBNU FNAC VIM. It is proposed to solve the problems of detoxification of soils contaminated with heavy metals and residual pesticides identified during the assessment using the available domestic and foreign experience by various methods: physical, physical-chemical, and biological.

Abstract Uranium was initially mined in Canada as a strategic mineral, primarily for export to the United States. Currently, uranium is produced for the global energy market and Saskatchewan is the sole producing province in Canada. Uranium development in Saskatchewan dates from 1953 and in 2000 accounted for 31% of global mine production. In the 1990’s the Saskatchewan Government Environmental Assessment Branch reviewed a new generation of uranium mines with large reserves and extremely high average grades. Technically, the development of these mines has required the development of innovative technologies to manage the environmental and occupational health and safety issues associated with the mining of high-grade uranium ores. While the development of these innovative technologies posed a challenge to science and engineering, the potential environmental impacts and level of public concern associated with the development of the high grade uranium deposits equally challenged the ability of the Province of Saskatchewan’s environmental assessment process to evaluate the acceptability of the proposed mines. During the assessment process a major technical, and public, issue was the decommissioning and long-term management of uranium tailings containing high levels of radionuclide and metal contaminants. While technically decommissioning and reclamation are phases of mining that are considered at the end of mine life, scrutiny of these issues during the assessment process contributed significantly to the public and technical acceptability of the proposed mine developments. The design, construction, operation, decommissioning and reclamation of uranium tailings management facilities for the proposed high-grade mines were subject to critical analysis during the technical and public review phases of the environmental assessment processes. Advances in tailings management design, incorporating innovative in-pit disposal methods capable of isolating decommissioned tailings from local groundwater regimes, presented a technical solution to concerns about long-term tailings containment after decommissioning. Public awareness and acceptance of the proposed mine developments was enhanced by the creation of an independent, public inquiry which ran concurrently with the existing federal and provincial assessment processes. The public inquiry was a critical factor, providing an independent forum where the technical acceptability of the proposed long-term tailings management methodologies was discussed. In retrospect the development of the new mines reflects the successful application of an assessment and review process in that the projects met the tests of technical and public acceptability in a process that was seen to be fair, timely, rigorous and public.

Muito conteúdo em forma de palestras e defesas de orientados de pesquisadores ativos e referencias em modelagem da informação da construção ficam dispersos ou são consumidos presencialmente somente por aqueles presentes nos eventos específicos onde as apresentações ocorrem. O conhecimento apresentado por pesquisadores ativos em BIM em palestras de disseminação da temática ou em defesas de pesquisas científicas carregam uma visão holística e ao mesmo tempo específica baseada no rigor acadêmico e científico, assim se diferenciando de palestras meramente com objetivos mercadológicos. Outro diferencial é a antecipação de resolução de problemas e respostas à lacuna do conhecimento norteador da pesquisa científica. Esse material é rico em conhecimento e se centralizado e tornado persistente pode apoiar atividades educacionais, de capacitação e de disseminação do BIM no Brasil. Esse resumo apresenta um esforço de resgate e disponibilização gratuita na licença de Creative Commons de palestras e defesas proferidas na temática de Modelagem de Informação da Construção realizadas pela pesquisadora Regina C. Ruschel (RUSCHEL, 2021). A proposta é dar suporte ao ensino de BIM por meio da metodologia ativa de sala de aula invertida. A sala de aula invertida consiste em inverter ações que ocorrem em sala de aula e fora dela. A transmissão dos conhecimentos, que no modelo tradicional, ocorre na sala de aula passa a ocorrer fora dela antes da aula em si. O material de estudo deve ser disponibilizado com antecedência para ser lido, assistido ou pesquisado pelo estudante. Na aula são realizados debates, projetos, simulações, trabalhos em grupos e obtidas solução de problemas tendo o aluno como protagonizador central, enquanto o professor é o mediador do processo de aprendizagem (VALENTE, 2014). Segundo Schneiders (2018, p. 67) o professor prepara os conteúdos e o compartilha, os alunos acessam o conteúdo, o professor acompanha esse acesso, em sala de aula os alunos apresentam suas dúvidas, o professor as esclarece, realiza-se uma atividade conjunta e após a aula revisa-se os conteúdos e se planeja um novo tópico. Nesse contexto, antes da aula desenvolvem-se as habilidade cognitivas de recordação e compreensão. Durante a aula o enfoque está em aplicar, analisar, avaliar e criar, analisar. Após a aula retoma-se todas as habilidades cognitivas desenvolvidas. Foi realizado um esforço de resgate e disponibilização gratuída, na licença de Creative Commons, de palestras e defesas proferidas na temática de Modelagem de Informação da Construção realizadas pela pesquisadora Regina C. Ruschel. A pesquisadora levantou em seu acervo pessoal um total de 59 palestras sobre a temática de BIM. Essas palestras ocorreram entre 2011 e 2021 sendo em eventos acadêmicos e não acadêmicos. Na grande maioria as palestras abordam o significado do BIM, estratégias de ensino e capacitação, desenvolvimento de usos específicos e tendências. Foi realizada uma classificação e priorização e iniciada a regravação das palestras que variam em duração de trinta minutos a uma hora. Foram criadas playlist no canal do YouTube associada à conta pessoal da pesquisadora. Essa opção, em contraposição a um canal institucional foi adotada visto que o vínculo da pesquisadora como professora colaboradora é instável, podendo resultar em descontinuidade. Na regravação das palestras participa apenas a pesquisadora. No entanto, na regravação das defesas participam o orientado e a pesquisadora. Orientamos nesse resumo como aplicar dois vídeos de palestras que abordam: competências BIM, processo de implantação BIM em projetos, usos do BIM, tecnologias BIM e a avaliação de desempenho em processo de concepção arquitetônica. Observa-se a riqueza de temas abrangidos em apenas duas palestras. O vídeo da palestra regravada do III ENCONTRO DE USUÁRIOS BIM DA BAHIA promovido pela Universidade Federal da Bahia e NÚCLEO BIM apresenta o conceito de competências BIM e quais competências são necessárias no processo de implantação do BIM em projeto. Também aborda-se as competências BIM possíveis de serem fomentadas em cursos de graduação de Engenharia Civil e Arquitetura e Urbanismo. Esse vídeo pode ser utilizado como preparação de aulas para o desenvolvimento de Planos de Execução BIM (PEB). Em sala de aula o professor pode promover atividades de aplicação simulada, criação ou analise de PEB para uma empresa fictícia ou uma empresa representada pela competência dos alunos envolvidos. Pode-se discutir instrumentos de diagnóstico de competências existentes para a tomada de decisão de treinamentos requeridos dado um PEB desejado. As referências apresentadas na descrição do vídeo também são indicativos de leitura para o material da sala de aula invertida. O vídeo “Avaliação em BIM na concepção de projeto: integração entre múltiplos desempenhos“ é a regravação da palestra proferida em 02/2021 no evento da ASHRAE abordando os impactos da modelagem da informação da construção em projetos de construção civiL promovido pelo Student Branch ArchTech-Labaut SP realizado pela Faculdade de Arquitetura e Urbanismo da Universidade de São Paulo. A palestra associou os conceitos de processo de projeto da metodologia de projeto arquitetônico com os processos e tecnologias BIM. Entre análise, síntese a avaliação, da concepção de projeto, foi dado o enfoque na avaliação. Foi apresentada a problemática da integração de múltiplos desempenhos ambientais na concepção de projeto e como BIM media esse processo. Esse vídeo é rico em conteúdo e pode ser utilizado na preparação de aulas invertidas que abordam o desenho de mapas de processo, a associação de tecnologias ao usos e os usos do BIM como a coordenação 3D ou detecção de interferências e avaliações de desempenho ambiental. Em sala de aula o professor pode promover atividades de desenhos de mapas de processo específicos ou a macro integração de mapas de processos. As referências apresentadas na descrição do vídeo é extensa e amplia com pesquisas internacionais e nacionais, principalmente, a leitura para preparação da sala de aula invertida. Essa plataforma de conteúdo tem grande potencial de transformação do conhecimento científico de BIM em material didático que fomenta o aprendizado e ensino continuado. Abstract:
The increased level of modern sport development increases the demands claimed on different aspects of the training process with further rehabilitation organization and realization. That is why we still have the problem of an adequate and effective integral system creation. The mentioned direction has a direct connection with the activity of scientists, coaches- practitioners and sports clubs. They have to work within one mechanism of interaction. Materials. Studying the level of working capacity influence stimulation and organism rehabilitation means on an organism of basketball players from higher educational establishments on the basis of a wildgrowing plant root “snowdon rose” (Rhodiola rosea), classical massage with special oils and contrast shower application. Research methods. The following methods were used in the experiment: scientific-methodical sources analysis concerning the level of working capacity and athletes’ functional rehabilitation increase; functional tests; the received video material with the indices analysis; mathematical statistics. The research realization was on the basis of N.F. Katanov State University, Khakassia and Khakassia Technical Institute (branch) of Siberian Federal University in Abakan. Results. During the research work we stated qualitative and quantitative indices of athletes’ coordinating endurance with the help of video together with other mentioned above rehabilitation means; the received results were handled and we revealed positive changes in the studied information values of basketball players’ motor sphere and respiratory system. Conclusion. The results analysis, received after the research, helped to come to the following conclusion: out of the presented components the biological factor in a form of a wild-growing plant root “snowdon rose” (Rhodiola rosea) has the main influence on the working capacity and functional rehabilitation of basketball players’ organisms.
