The Federal Assembly of the Russian Federation is actively working to improve domestic legislation. As a result of this activity, the composition and powers of state authorities have significantly changed, a number of which are endowed with new powers. In this regard, the mutual influence and the degree of independence of the branches of state power have significantly changed in Russia.The article presents an approach to assessing the degree of independence of the branches of state power, and the authors also propose a possible way to distribute the plurality of federal state bodies of the Russian Federation between the three existing branches of state power. For example, the justification that the Central Election Commission of the Russian Federation belongs to the executive branch of state power.

Abstract:
This article provides a historical and legal analysis of the US Constitution adopted in 1787. Particular attention is paid to the consideration of the principle of powers’ separation in the constitutional mechanism of the United States, which assumes clear organizational independence of the legislative, executive and judicial branches. According to J. Hart’s precised definition, «if all roads lead to Rome, then sooner or later all issues of American governance come down to the separation of powers» [8, p. 34]. The main feature of the rule of law is the delimitation of functions between the government branches. The basis of internal relations in the American state throughout its history is the principle of powers separation and, complementary to it, the principle of «checks and balances». Each of the government branches are characterized. Their role and place in the state system have been studied. It is emphasized that the US Constitution is a valid and universal legal document. It is concluded that the form of the state itself, the nature, and the entire content of its activities depend on the correlation, interaction and opposition of the executive, legislative and judicial branches of power. Abstract:
One of the main characteristics of any political regime is the power correlation between the legislative and executive branches of state power. In a democratic environment, it should reflect a certain balance of branches of power.The Constitution of Ukraine has defined the principle of separation of power into legislative, executive and judicial (art. 6), each of them is independent from the other one and acts within its competence. Theoretically fixed in the Constitution principles of power separation aim between legislative and executive branches. However in the conditions of social-economic crisis, in which the country has been acting since 1990s, between multi-vectored political forces and striving of executive power for widening of its authorities, that is fixed in the Constitution, the presidential-parliamentary form of administration very often has led not only to constitutional cooperation of powers but to the competition between the President and executive power on the one hand, and Verhovna Rada, on the other hand. So, today the need for reconsideration of both the correlation of authorities and cooperation between branches of power in Ukraine has become obvious.

Abstract:
The structure of the device for diagnostics of technical condition of power transmission lines is considered in the work and its functional scheme is offered. The article describes the principle of operation of the diagnostic device according to the functional diagram. The scheme of power lines with three branches and timestamps from known places with inhomogeneities in the sounding of the main diagnostic device and the scheme of power lines with three branches and timestamps from known places that have inhomogeneities in the sounding of auxiliary sounding are considered. The proposed device for diagnosing the technical condition of power distribution networks is based on the method of processing a radar signal with frequency modulation of a continuous wave. Unlike existing devices, this device allows you to detect faults in certain areas of branched transmission lines; has low output power. The use of a software-tuned radio station in the development and production of a diagnostic device significantly reduces material costs. it is necessary to diagnose high-voltage power lines with a large number of branches, as well as to study areas of inhomogeneity with small amplitudes of reflected signals. This paper substantiates the structure and principle of operation of the location sensing device for assessing the technical condition of electrical distribution networks in ice. The novelty is the use of special broadband signals for sounding and their optimal processing, in determining the location of damage (heterogeneity) in the branched overhead power lines, which are the basis of the diagnostic device of the transmission line. The diagnostic device can become a basis for the creation of the modern all-Ukrainian dispatching point of the analysis of a technical condition and management of the equipment of electric networks by power supply lines.

Abstract:
Interaction between the institutions of state power ensures normal performing of their duties as entire state mechanism. It does not enable any of the branches of power. It is for this purpose that the founder of the division of power created a system of restraints and counter balances. To ensure their independence of one branch of government from another, it is necessary that each one has a real opportunity to influence another. Through the division of powers, the rule of law is organized and operates by legal means.
 At the same time, the principle of distribution of power is not so much a rigid division of functions and competences as the mechanism of their close interaction to solve problems of state formation.
 The interaction of the institutions of state power as the principle of the Constitutional system of Ukraine is currently a very topical problem, since our state is only at the prime of developing such institutions as an institution for the distribution and interaction of the branches of state power, and, therefore, needs the best possible solution to urgent problems.

The paper deals with the position of administration within power-sharing. As democratic states follow the principle of tripartite division of powers on the legislative, executive and judiciary, the paper analysis in detail the relationship between the administration and those three branches of government. In this sense, article explores, whether an administrative activities can be referred to as a separate branch of power, or it is located on the area of executive power.

Abstract:
The paper analyzes the technical and operational characteristics of power transformers with а higher voltage of 6-10 kV, operated in 20 branches of the power grid companies of РJSС “Rosseti Center” and РJSС “Rosseti Center and Privolzhye”. To conduct the study, data from the Department of Technological Development and Digitalization on the characteristics of transformers as of 2022 were used. It was revealed that only 20 branches have 194921 power transformers with a high voltage of 6-10 kV. The largest number of 6-10 kV power transformers in the amount of 92089 units have been in operation for 25-50 years, which is 47% of the total. Data on the distributions of power transformers by design and rated power have also been studied. The arithmetic mean value of power transformers 6-10 kV for branches is 192 kVA. The most widespread are outdated power transformers of the TM and TMG types, which account for 62% and 19% of the total fleet. The total share of power transformers of these designs in branches is within 85% -98%.

Abstract:
Branch Prediction is a key task in the operation of a high performance processor. An inaccurate branch predictor results in increased program run-time and a rise in energy consumption. The drive towards processors with limited die-space and tighter energy requirements will continue to intensify over the coming years, as will the shift towards increasingly multicore processors. Both trends make it increasingly important and increasingly difficult to find effective and efficient branch predictor designs. This thesis presents savings in energy and die-space through the use of more efficient cooperative branch predictors achieved through novel branch prediction designs. The first contribution is a new take on the problem of a hybrid dynamic-static branch predictor allocating branches to be predicted by one of its sub-predictors. A new bias parameter is introduced as a mechanism for trading off a small amount of performance for savings in die-space and energy. This is achieved by predicting more branches with the static predictor, ensuring that only the branches that will most benefit from the dynamic predictor’s resources are predicted dynamically. This reduces pressure on the dynamic predictor’s resources allowing for a smaller predictor to achieve very high accuracy. An improvement in run-time of 7-8% over the baseline BTFN predictor is observed at a cost of a branch predictor bits budget of much less than 1KB. Next, a novel approach to branch prediction for multicore data-parallel applications is presented. The Peloton branch prediction scheme uses a pack of cyclists as an illustration of how a group of processors running similar tasks can share branch predictions to improve accuracy and reduce runtime. The results show that sharing updates for conditional branches across the existing interconnect for I-cache and D-cache updates results in a reduction of mispredictions of up to 25% and a reduction in run-time of up to 6%. McPAT is used to present an energy model that suggests the savings are achieved at little to no increase in energy required. The technique is then extended to architectures where the size of the branch predictors may differ between cores. The results show that such heterogeneity can dramatically reduce the die-space required for an accurate branch predictor while having little impact on performance and up to 9% energy savings. The approach can be combined with the Peloton branch prediction scheme for reduction in branch mispredictions of up to 5%.

Tese de Doutoramento em Ciências Sociais Especialidade de História dos Factos Sociais<br>Neste trabalho, propõe-se um modelo teórico de interpretação do sistema de relações raciais em São Filipe, ilha do Fogo, Cabo Verde, na primeira metade de Novecentos. Trata-se de uma linha de pesquisa focada nas dinâmicas da percepção e construção da raça e nas determinantes não raciais na explicação da dominação de exterioridade racial. O cruzamento das identificações raciais com outras variáveis (cultura, classe, poder) constitui um quadro de análise permitido pela existência de vasta documentação escrita e iconográfica e pela longevidade de parte considerável da população insular. A metodologia de investigação assenta, pois, na pesquisa documental e na entrevista a informantes qualificados. Os conceitos compósitos de branco e não-branco condensam o essencial da argumentação: ser branco, no Fogo, fazia parte de uma referencialidade simbólica alargada que integrava, para além da biológica, as dimensões cultural e linhagística. Assimetrias profundas e continuadas entre os dois grupos de povoadores – livre europeu e escravo africano – conformaram uma racialidade forte. A rarefacção do capital económico dos brancos, obstando à reprodução simbólica do grupo, e a crescente capitalização material e escolar dos não-brancos diminuiram a importância relativa da raça e do nascimento entre as dimensões significantes da estratificação e heterogeneizaram a composição sócio-racial da elite local.<br>This work proposes a theoretical interpretation of the racial relationship in Sao Filipe, Fogo, Cape Verde, in the first half of the twentieth century. This is a line of research focused on the dynamics of perception and construction of racial and non-racial determinants in the explanation of racial exteriority domination. The miscegenation of racial identifications with other variables (culture, class, power) is a framework of analysis allowed by the existence of extensive iconographic and written records and by the longevity of part of the islander population. The research methodology is based on documentary research and interviews to qualified informants. The heterogeneous concepts of white and non-white condense the essential of the controversy: being white, in Fogo, was part of a wider symbolic referentiality which included, in addition to biological, cultural and linguistic dimensions. Deep and continuing asymmetries between the two groups of settlers – Europeans and African slaves – conformed strong racial issues. The diminishing of the economic resources of whites, preventing the symbolic reproduction of the group, and the growth of material and scholar capitalization of the non-whites, decreased the relative importance of race and birth amongst the significant dimensions of stratification and heterogenized the socio-racial composition of the local elite

Oförmåga att minska utsläppen av växthusgaser i tillräckligt takt för att undvika en alltför kraftig global uppvärmning har motiverat framtagandet av tekniker med potential att minska mängden koldioxid i atmosfären. En av dessa tekniker är bioenergi med koldioxidlagring (Bio-energy with carbon capture and storage, BECCS), där koldioxid avskiljs från punktkällor med biogena utsläpp och lagras i geologiska strukturer. Även biokol tillsatt till jordbruksmark har potential att bidra till negativa utsläpp. Både svenska och internationella strategier inkluderar negativa utsläpp för att uppfylla förpliktelserna i Parisavtalet. För att säkerhetsställa att teknikerna lever upp till potentialen krävs ett livscykelperspektiv där klimatpåverkan beräknas på systemnivå. En livscykelanalys utfördes, där klimatpåverkan vid utnyttjande av grenar och toppar (GROT) från den svenska skogsindustrin beräknades för teknikerna BECCS och biokol tillsatt till jordbruksmark. Teknikerna jämfördes med ett referensscenario där GROT förbränns i ett kraftvärmeverk för att producera el och fjärrvärme utan omhändertagande av koldioxid som bildas vid förbränning. Resultaten visar att BECCS har potentialen att bidra med negativa utsläpp på mellan -168 och -666 kg CO2-ekvivalenter/ ton GROT torrsubstans (TS). Då GROT-skörden ökar till 80% av den årliga avverkade arealen skog i Sverige och kombineras med gallring, resulterar 666 kg CO2-ekvivalenter/ ton GROT TS, i 4,4 miljoner ton CO2-ekvivalenter per år. Detta motsvarar 25,8 % av klimatpåverkan från inrikestransporter i Sverige år 2016. Nettoutsläppen från biokol tillsatt till jordbruksmarker, varierar mellan 934 och -344 kg CO2-ekvivalenter/ ton GROT TS. Då GROT-skörden ökar till 80% av den avverkade arealen skog i Sverige och kombineras med gallring, resulterar 344 kg CO2-ekvivalenter/ton GROT TS i 2,2 miljoner ton CO2-ekvivalenter. Detta motsvarar 13,3 % av klimatpåverkan från inrikes transporter i Sverige år 2016. Båda teknikerna har potential att åstadkomma nettonegativa växthusgasutsläpp, men resultaten är beroende av klimatpåverkan från ersättande el- och fjärrvärmeproduktion.<br>The inability to achieve sufficient reduction of greenhouse gas emissions has led to the development of techniques with potential to achieve negative greenhouse gas emissions. One of these techniques is called Bio-energy with carbon capture and storage (BECCS), where carbon dioxide is captured from biogenic point sources with biogenic emissions and stored underground. Biochar applied to farmland is another technique with potential to achieve negative greenhouse gas emissions. Both Swedish and international strategies, to meet the obligations in the Paris Agreement, include negative greenhouse gas emissions. A life cycle approach is required to ensure that the techniques deliver on the promise of negative emissions. A Life cycle assessment was conducted where the global warming potential was calculated for BECCS and biochar added to farmland in two different scenarios where tops and branches (GROT) from the Swedish forest industry were used as feedstock. The techniques were compared to a reference scenario where GROT were used in a combined heat and power plant (CHP-plant). The results show that BECCS has the potential to achieve net negative emissions of between -168 and -666 kg CO2-equivalents/ tonne GROT dry matter (DM). When GROT is harvested from 80% of the yearly final felling areas in Sweden and combined with thinning, 666 kg CO2-equivalents/ Mg GROT DM is equivalent to in 4,4 million ton CO2-equivalents per year. This corresponds to 25,8 % of Sweden's greenhouse gas emissions from domestic transportation in 2016. The results of greenhouse gas emissions from biochar applied to farmland varied between 934 to -344 CO2-equivalents/ Mg GROT DM. When GROT is harvested from 80% of final felling areas in Sweden and combined with thinning, -344 CO2-equivalents/ Mg GROT DM is equivalent to 2,2 million ton CO2- equivalents per year. This corresponds to 13,3 % of Sweden's greenhouse gas emissions from domestic transportation in 2016. Both techniques have the potential to achieve net negative greenhouse gas emissions. A new concept of current sensor reduction technique called multi-branch current sensing technique (MCST) is proposed in this dissertation. In the proposed current sensing method, one more branch currents are simultaneously measured several times in a single switching cycle by using a single current sensor. After that, the current reconstruction algorithm is applied to obtain all phase currents information. Compared to traditional single current sensor techniques (SCSTs), the proposed method samples the output of the current sensor regularly, and the current sensing dead-zone is dramatically reduced. Since the current sampling is performed periodically, its implementation using a digital controller is extremely simple. Moreover, the periodical dead-zone and the dead-zone near the origin of the voltage vector space which have been a big problem in the existing methods can be completely eliminated. Accordingly, there is no need to have a complicated vector reconfiguration or current estimation algorithm. The proposed MCST also takes the advantages of a SCST such as reduced cost and elimination of the sensor gain discrepancy problem in the multiple current sensor method. The fundamental concept, implementation issues, and limitation of the proposed MCST are described based on three-phase systems first. After that, the proposed MCST is adopted to two-phase inverters and multi-phase dc-dc converters with little modifications. Computer simulations and hardware experiments have been conducted for a three-phase boost converter, a three-phase motor drive system, a two-phase two-leg inverter, a two-phase four-leg inverter with bipolar modulation, a two-phase four-leg inverter with unipolar modulation, and a four-phase dc-dc converter applications. From the simulations and the experimental results, the feasibilities of the proposed method mentioned above are fully verified.<br>Ph. D.

Nos Estados republicanos modernos, o sistema de freios e contrapesos é um dos modelos institucionais responsável por assegurar o equilíbrio entre os Poderes e prevenir abusos por parte dos governantes. Dois questionamentos podem ser encontrados na literatura brasileira sobre o tema e fundamentam esta Dissertação: um geral sobre o suposto poder excessivo que o nosso sistema político confere ao Poder Executivo e outro, específico, de que nesse contexto, o veto teria um papel central na supremacia do presidente da república sobre o Congresso Nacional no âmbito do processo legislativo. Partindo dessas premissas, a pesquisa avalia se essas características estão condizentes com as expectativas e o desenho institucional proposto para o Estado brasileiro pela Assembleia Nacional Constituinte ANC de 1987. Com base nos anais da ANC e em referências históricas, conclui-se que, ao menos no tocante ao instituto do veto presidencial, o modelo de preponderância do Poder Executivo observado no processo legislativo decorreu de uma opção deliberada e reafirmada pela elite política em 1988, quando da promulgação da Constituição.<br>In modern republican states, the system of checks and balances is one of the institutional models responsible for ensuring the balance between powers and preventing abuses by rulers. Two issues can be found in the Brazilian academic literature on the matter that underlie this Dissertation: one concerning the alleged excessive power that our political system grant to the executive branch, and another one more specific that, in this context, the veto would have a main role in the supremacy of the President of the Republic over Congress in the legislative process. Beginning with these assumptions, this research evaluates whether these characteristics are consistent with the expectations and the institutional design proposed for the Brazilian State by the National Constituent Assembly (ANC) of 1987. Based on the ANC records and historical references, it concluded that, at least in regard to the presidential veto institute, the preponderance of the executive branch model observed in the legislative process derived from a deliberate and reaffirmed choice made by the political elite in 1988, at the promulgation of the Constitution.

A new coding scheme called "turbo coding" has generated tremendous interest in channel coding of digital communication systems due to its high error correcting capability. Two key innovations in turbo coding are parallel concatenated encoding and iterative decoding. A soft-in soft-out component decoder can be implemented using the maximum a posteriori (MAP) or the maximum likelihood (ML) decoding algorithm. While the MAP algorithm offers better performance than the ML algorithm, the computation is complex and not suitable for hardware implementation. The log-MAP algorithm, which performs necessary computations in the logarithm domain, greatly reduces hardware complexity. With the proliferation of the battery powered devices, power dissipation, along with speed and area, is a major concern in VLSI design. In this thesis, we investigated a low-power design of a turbo decoder based on the log-MAP algorithm. Our turbo decoder has two component log-MAP decoders, which perform the decoding process alternatively. Two major ideas for low-power design are employment of a variable number of iterations during the decoding process and shutdown of inactive component decoders. The number of iterations during decoding is determined dynamically according to the channel condition to save power. When a component decoder is inactive, the clocks and spurious inputs to the decoder are blocked to reduce power dissipation. We followed the standard cell design approach to design the proposed turbo decoder. The decoder was described in VHDL, and then synthesized to measure the performance of the circuit in area, speed and power. Our decoder achieves good performance in terms of bit error rate. The two proposed methods significantly reduce power dissipation and energy consumption.<br>Master of Science

The distribution of power between the executive branch and the legislative branch in the realm of foreign policy is a delicate balance and one that has been debated since the Founding Fathers met in Philadelphia in the summer of 1787. The debate has gotten no less intense and no less crucial in the modern, nuclear age, and it remains unresolved. The Reagan administration's foray into Nicaragua during the 1980's and its confrontations with Congress during that time period illuminate the complexities of the power-sharing arrangement in foreign policy and offer the ideal case study of executive-legislative war power. The lessons to be drawn from America's involvement in Nicaragua are that the expanded Presidential power in the realm of foreign policy are necessary for the safety of the country in today's world, but dangerous without the vigorous oversight and ultimate check by Congress.

Asymptotic Giant Branch (AGB) stars are stars with low- to intermediate mass in a late stage in their stellar evolution. An important feature of stellar evolution is the ongoing nucleosynthesis, the creation of heavier elements. Unlike main sequence stars, the AGB stars have a thick convective envelope which makes it possible to dredge-up the heavier fused elements from the stellar core to its surface. AGB stars are also pulsating variable stars, meaning the interior expands and contracts, causing the brightness to fluctuate. These pulsations will also play a major role in the mass loss observed in these stars. The mass loss is caused by stellar winds that accelerate gas and dust from the surface of these stars and thereby chemical enrich the interstellar medium. It is important to understand the properties of these pulsations since they play a key role in how stellar winds are produced and then enrich the galaxy with heavier synthesized elements. These pulsation periods can be observed with their corresponding Light-Curves, where the periodic motion of the brightness can be clearly seen. The main goal with this project is to calculate these pulsation periods for different AGB stars and compare these values with the periods listed in the General Catalogue of Variable Stars (GCVS). The comparison between these values gives a better understanding of methods of determining these periods and the uncertainties that follow.<br>Asymptotiska jättegrenen är en del av slutstadiet för låg- till medelmassiva stjärnor (AGB stjärnor). Ett viktigt kännetecken hos stjärnutvecklingen är den pågående nukleosyntesen, sammanslagningen av tyngre ämnen i stjärnans inre. Till skillnad mot stjärnor på huvudserien har AGB stjärnor ett tjockt konvektivt lager som gör det möjligt att dra upp dessa nybildade ämnen till stjärnans yta. AGB stjärnor är pulserande variabla stjärnor där variationer i stjärnans radie gör att ljusstyrkan varierar. Dessa pulsationer kommer även att spela en viktig roll för den massförlust som observeras hos dessa stjärnor. Massförlusten orsakas av stjärnvindar som accelererar gas och stoft från stjärnans yta och därmed kemiskt berikar det interstellära mediet. Det är viktigt att förstå dessa pulsationer eftersom de är en viktig komponent för hur stjärnvindar uppstår och sedan berikar galaxer med tyngre ämnen. Dessa pulsationsperioder kan studeras genom att observera stjärnornas ljuskurvor, där man tydligt ser det periodiska beteendet hos ljusstyrkan. Det huvudsakliga målet med detta projekt är att beräkna dessa perioder för olika AGB stjärnor och att sedan jämföra dem med värden från General Catalogue of Variable Stars (GCVS). Jämförelsen mellan dessa värden ger en bättre förståelse för metoderna som används för att bestämma dessa perioder och hur osäkra dessa värden är.

<p>This thesis describes the synthesis and characterization ofbranched semi-crystalline polymers. Included in this work isthe SEC characterization of a series of dendrimers. Thebranched semi-crystalline polymers were synthesized in order toinvestigate the concept of their use as powder coatings resins.This concept being that the use of branched semi-crystallinepolymers in a UV-cured powder coating system may offer a lowertemperature alternative thus allowing the use of heat sensitivesubstrates and the added benefit of a reduced viscositycompared to linear polymers.</p><p>A series of branched poly(ε-caprolactone)’s (PCL)(degree of polymerization: 5-200) initiated from hydroxylfunctional initiators were synthesized. The final architectureswere controlled by the choice of initiator structure;specifically the dendritic initiators yielded starbranchedPCL’s while the linear initiator yielded comb-branchedPCL’s. The dendritic initiators utilized were: (1) a3rd-generation Boltorn H-30, commercially availablehyperbranched polyester with approximately 32 hydroxyl groups,(2) a 3rd-generation dendrimer with 24 hydroxyl groups, and (3)a 3rd-generation dendron with 8 hydroxyl groups. Linear PCL wassynthesized for comparison. All dendritic initiators are basedon 2,2- bis(methylol) propionic acid. The comb-branchedpolymers were initiated from a modified peroxide functionalpolyacrylate. The resins were end-capped withmethylmethacrylate in order to produce a cross-linkable system.The polymers and films were characterized using 1H NMR, 13CNMR, SEC, DMTA, DSC, FT-IR, FT-Raman, rheometry and a rheometercoupled to a UV-lamp to measure cure behavior.</p><p>The star-branched PCL’s exhibited considerably lowerviscosities than their linear counterparts with the samemolecular weight for the molecular region investigated (2-550kg mol-1). It was also found that the zero shear viscosityincreased roughly exponentially with M.</p><p>The PCL star-branched resins are semi-crystalline and theirmelting points (Tm) range from 34-50°C; films can beformed and cured below 80°C. The viscoelastic behaviourduring the cure showed that the time to reach the gel point, afew seconds, increased linearly with molecular weight. Thecrossover of G’and G’’was used as the gelpoint. Measurement of mechanical properties of films showedthat the low molecular weight polymers were amorphous whilethose with high molecular weight were crystalline after cure.The polymerization of 5,5-dimethyl-1,3-dioxane-2-one (NPC) fromoligo- and multifunctional initiators was evaluated utilizingcoordination and cationic polymerization. Two tin basedcatalysts, stannous(II) 2-ethylhexanoate and stannous(II)trifluoromethane sulfonate, were compared with fumaric acid.Fumaric acid under bulk conditions resulted in lowerpolydispersity and less chance of gelling. The synthesis ofstar-branched polymers was confirmed by SEC data. The starpolymers exhibited a Tg at 20-30°C and a Tm at about100°C.</p><p>All semi-crystalline resins exhibited a fast decrease inviscosity at Tm. Abstract:
Polarisation diversity is a technique to improve the quality of mobile communications, but its reliability is suboptimal because it depends on the mobile channel and the antenna orientations at both ends of the mobile link. A method to optimise the reliability is established by minimising the dependency on antenna orientations. While the mobile base station can have fixed antenna orientation, the mobile terminal is typically a handheld device with random orientations. This means orientation invariance needs to be established at the receiver in the downlink, and at the transmitter in the uplink. This research presents separate solutions for both cases, and is based on the transmission of an elliptically polarised signal synthesised from the channel statistics. Complete receiver orientation invariance is achieved in the downlink. Effects of the transmitter orientation are minimised in the uplink.

AbstractIn the summer of 1787, New Yorkers were about to ratify a constitution for the US. In a series of 85 essays written by Alexander Hamilton, John Jay, and James Madison between October 1787 and May 1788 urged New Yorkers to ratify the proposed United States Constitution, which was drafted in Philadelphia in the summer of 1787. The essays (commonly referred to as the Federalist Papers) were published anonymously, under the pen name “Publius,” in various New York state newspapers of the time. On May 28, 1788, Alexander Hamilton published Federalist 78, titled “The Judicial Department.” In this famous essay, he offered a powerful defense of judicial review. Hamilton argued that only a federal judge could guarantee constitutional rights and provide an effective check on state power. At the same time, Hamilton had to convince his political opponents that the unelected judiciary would never dominate the other branches of government. Drawing on the ideas of Montesquieu, he deliberately portrayed the judiciary as “the least dangerous branch of government”. A branch that is inherently weak because it can control neither the country’s financial resources nor the army.

What were the roles and responsibilities of the various branches in exercising the government’s authority? ‘Balance of powers’ explains that no single event resolved these questions. Each branch has made large claims of power; each has experienced stinging rebuffs to those claims. The struggle involving the balance of power is described, including the Supreme Court and the President seizing opportunities to define their own constitutional powers as equal to Congress. Today’s hyper-partisanship has weakened Congress, although both division and inaction serves as an informal set of checks and balances.

This chapter looks at the separation of powers. The separation of powers is a doctrine requiring that executive, legislative, and judicial powers within a state should be clearly divided and allocated to separate institutions; the aim is to prevent the concentration of power in any one branch and reduce the potential for arbitrary or oppressive exercise of power. Although the degree of separation between the three branches varies between states, codified constitutions will regulate those spheres of power by allocating specific roles and functions to each branch and will allow checks or controls to operate between them to ensure accountability. The separation of powers in the UK is weakest between the legislative and executive, and strongest and most distinct between the judiciary and the other two branches. Indeed, the Constitutional Reform Act 2005 has brought stronger separation between the judiciary and the executive, making the judiciary more autonomous.

A regulated hybrid-electric power sharing architecture was developed and tested for VTOL applications. In this architecture, there are two power supply branches and one load. The first branch draws power from an engine-generator, and it has additional components of an AC-DC rectifier, a DC-DC buck converter, and a power diode. The second branch draws power from a battery, and it has additional components of a solid-state relay, a DC-DC boost converter, and a power diode. Any specified ratio of battery-to-engine power can be achieved with this architecture. Testing on the full range of power share ratios was conducted at a low load power of 300W. The key conclusions are that: (1) regulated power sharing is feasible between an AC supply and a DC battery, including the extremes of all engine and no battery to all battery and no engine, (2) a specified power share ratio can be achieved both in steady-state and transient conditions, and (3) there is a delay in achieving a specified power share ratio, caused not by the power plant, but rather by the change in RPM of the rotor.

Abstract Acoustic-induced vibration in piping system and other devices leads to premature wear and failure. Especially, in nuclear power plants, very high velocity and temperature gas flows inside pipe systems. Moreover, if a frequency due to the vibration in the piping system is overlapped with a natural frequency of the stud pipe, the magnitude of the amplitude will be increased resulting in severe failure. For example, damage can be considered as flow-induced acoustic resonance at the branch pipes of the safety relief valve in the main steam lines. Specially, the pipe system not only has multi-branches but also includes the elbow that the resonance could occurs making pressure oscillation stronger than that of a single branch because of the interaction between the branches and the elbow. This study has investigated a Computational Fluid Dynamics (CFD) analysis methodology to predict and quantify the vortex shedding frequencies and the pressure pulsation magnitude in the dead-end pipe. The influence of the pressure fluctuation amplitude between each branch, number of branch, and elbow is also investigated.

Digital particle image velocimetry is employed to investigate acoustically-coupled flow past a coaxial deep cavity (side branch) resonator mounted in a duct. The emphasis is on the effect of the separation between the coaxial side branches on the interaction between separated shear layers that form across the side branch openings. Various resonator geometries are characterized in terms of patterns of instantaneous and time-averaged flow velocity, vorticity, and streamline topology at several phases of the acoustic cycle. In addition, phase-averaged images of the flow in conjunction with unsteady pressure measurements are evaluated in order to provide insight into the mechanisms of acoustic power generation. Generally speaking, the acoustic source undergoes a significant transformation as the distance between the coaxial side branches changes. When the side branches are located relatively far away from each other, each of them forms an independent acoustic source. As the distance between the side branches decreases, interaction between the associated oscillating shear layers results in formation of a single acoustic source of complex spatial structure.

The concept of impeachment has its origins in the history of political and legal thought as a constitutional mechanism to remove public officials for serious violations of the law or abuse of power. Originating from England, it has influenced the constitutions of the United States and the countries of Latin America. In addition to concrete grounds for impeachment, constitutions also allow for impeachment based on abstract grounds, designed for cases where no specific offence can be proven, but the abuse of power is so obvious that the people must be guaranteed the right to recall their elected leader. In Latin America, military coups have been replaced by so-called “soft coups”, which abuse various legal instruments. The abstract nature of the grounds for impeachment contributes to the potential misuse of this mechanism as a tool of lawfare, as many cases demonstrate. During the past decade, Peru has experienced a series of impeachments, with three presidents facing removal from office due to political conflicts between the legislative and executive branches. These cases highlight the use of impeachment as a tool of lawfare, undermining democratic stability and raising concerns about the transparency and impartiality of the process, as well as the erosion of democratic principles.

Policymaking in Peru over the last 25 years has been largely dominated by the Executive, and has been influenced by a variety of structural and political factors as well as by the personal ambitions of presidents and the public perception of crisis. With few exceptions, neither the Congress nor the other branches and levels of government have played effective roles in defining the national policy agenda, promoting inter-temporal cooperation and providing checks and balances on executive power. Although this situation has been partially modified since 2001, it is not clear that the general pattern has changed. While certain arenas of decision-making have been reformed in recent years, in many spheres policymaking remains an arbitrary and unpredictable process, resulting in policies that are of low quality, poorly enforced and easily reversed. Although reforming aspects of the political and electoral systems could contribute to improving this outcome, the instability of the political regime per se has been a deterrent to longer-term institutional development.

Merit-based selection of bureaucrats is central to state capacity building, yet rare in developing countries. Most executives instead favor patronage -political discretion- in public employment. This paper proposes and tests an original theory to explain when executives forsake patronage for merit. The theory exploits exogenous variation in the institutional design of patronage states. In some, constitutions and budget laws monopolize patronage powers in the executive; in others, patronage benefits accrue to the legislature and public employees. When institutions fragment patronage powers and challengers control other government branches, merit becomes more incentive-compatible: it enables executives to deprive challengers of patronage while enhancing public goods provision to court electoral support. Drawing on 130 face-to-face elite interviews, a comparison of reforms in Paraguay, the Dominican Republic and the United States validates the theory. How patronage states are institutionally designed thus shapes their reform prospects: fragmented control over bad government can incentivize good government reforms.

In the past decade, parliaments have shown increasing activism in the budget process by demanding more information about the government's performance in managing public resources. Nevertheless, in Latin America and the Caribbean (LAC), parliaments face important challenges, taking an effective part in the budget process and in fiscal policy management. Their capacity to influence budgetary matters and more generally fiscal policy and public financial management is hindered not only by the centralized nature of the budget process, but also by the lack of technical and institutional capacity of parliaments themselves to exercise their budgetary powers. This policy brief argues that the creation of parliamentary budget offices (PBOs) can help strengthen their effectiveness and accountability in budget processes. Several countries in the region have created or are considering creating this type of mechanism. These offices can help strengthen the parliament as a competent and constructive partner with the finance ministries and compensate for the legislature's limited technical capacity and credibility in budget matters through a series of effects, including reducing asymmetries in fiscal information; simplifying fiscal information and improving the quality of budget analysis; enabling a more constructive budget debate, and improving the alignment of incentives among government branches. This paper analyzes the conditions for creating and maintaining these offices, evaluates the effectiveness of such institutional changes, and weighs the lessons learned from recent experiences in various countries of the region. The conclusion is that parliaments can strengthen their impact on the budgeting process not necessarily by increasing their budgetary powers, but by improving their institutional capacity to exercise those powers more effectively and responsibly.

According to an influential theoretical argument, presidential systems tend to present smaller governments because the separation between those who decide the size of the fiscal purse and those who allocate it creates incentives for lower public expenditures. In practice, forms of government vary greatly, and budget institutions -the rules according to which budgets are drafted, approved, and implemented- are one (of many) drivers of such variation. This paper argues that under more hierarchical budget rules, presidential and parliamentary systems generate a similar incentive structure for the executive branch in shaping the size of government. This hypothesis is tested on a broad cross-section of countries, presidentialism is found to have a negative impact on government size only when executive discretion in the budget process is low (that is, in a context of separation of powers). However, the negative effect of presidentialism on expenditures vanishes or is even reversed when the executive`s discretion over the budget process is higher. Hence, budget institutions that impose restrictions on the legislature`s ability to amend budget proposals can make political regimes look more alike in terms of fiscal outcomes.

As the main research and development organization for the US Army Corps of Engineers (USACE), the Engineer Research and Development Center (ERDC) helps solve our nation’s most challenging problems. With seven laboratories under the ERDC umbrella, ERDC expertise spans a wide range of disciplines. This provides researchers an amazing network of collaborators both within labs and across them. Many of the publications produced by ERDC through the Information Technology Laboratory’s Information Science and Knowledge Management Branch (ISKM), the publishing authority for ERDC, are a testament to the power of these partnerships. Therefore, in this issue of The Forefront, we wanted to highlight some of those collaborations, across ERDC and beyond. Colored flags at the top of each page indicate the laboratories involved in each report (see the end of this issue for a full list of the laboratories and their lab colors), in addition to USACE red for district collaborators and gray for others. Over the last decade, every Paraguayan administration has faced greater political challenges and financial pressures than its predecessor. The result has been a chronic fiscal deficit since 1995. This study disentangles the budget-making process in Paraguay by studying the key players influencing the budget cycle (preparation, approval, execution, and control), their powers, and their incentives. The document discusses how the incentives for cooperation affect the conditions for the sustainability of public expenditures, the efficient allocation of resources, and the representative quality of the spending. First the general theoretical framework based on both a transaction cost theory of the policymaking process and the public expenditure management literature is introduced. The authors emphasize the interactions between historical legacies, the overall institutional design, and budgetary procedures as factors that shape politicians' incentives to display cooperative behavior in the elaboration of the budget. Then, Paraguay's historical background, its current institutional framework, and the emerging features of the policymaking process are described. The formal and informal rules that guide the budget policy-making process are also addressed. The analysis is based on the formal instruments (the constitution and related laws) and on in-depth interviews with several policymakers in the executive branch and in Congress. Finally, it is discussed how the generally low incentives for cooperation have created negative conditions for the sustainability of public expenditures, the efficient allocation of resources, and the representative quality ofthe spending.
