Israeli constitutional law is a sphere of many contradictions and traditions. Growing out of British law absorbed by the legal system of Mandate Palestine, Israeli constitutional law has followed the path of constitutional law based on unwritten constitutional principles. This book evaluates the development of the Israeli constitution from an unwritten British-style body of law to the declaration of the Basic Laws as the de facto Israeli constitution by the supreme court and on through the present day.The book is divided into a chronological history, devoted to a description of the process of establishing a constitution; and a thematic one, devoted to the review and evaluation of major constitutional issues that are also the subject of discussion and research in other countries, with emphasis on the unique characteristics of the Israeli case.

Abstract:
This book explores the untold story of how three influential garment unions worked with the American Federation of Labor (AFL) and Congress of Industrial Organizations (CIO) in support of a new Jewish state. It reveals a coalition at work on multiple fronts. Sustained efforts convinced the AFL and CIO to support Jewish development in Palestine through land purchases for Jewish workers and encouraged the construction of trade schools and cultural centers. Other activists, meanwhile, directed massive economic aid to Histadrut, the General Federation of Jewish Workers in Palestine, or pressured the British and American governments to support the Jews in Palestine and later, recognize Israel’s independence. Ultimately, these efforts led American labor to forge its own foreign policy--and reshape both the postwar world and Jewish history.

Abstract:
Nasser’s decision to completely withdraw from Yemen was brought about by Egypt’s defeat in the June 1967 war with Israel. Egyptian military officials have often blamed their 1967 defeat on Yemen, citing spurious statistics on troop numbers abroad and Field Marshal Abdel Hakim Amer’s misdirected attention from the Sinai border with Israel. While most of these assertions lack credibility, there was in fact a direct connection between Yemen and June 1967. British mercenaries organized a clandestine group of Israel Air Force pilots and navigators to airlift weapons and supplies to royalist tribal armies behind enemy lines. Israeli decision makers were given front-row seats to Egypt’s expanding air power and weapons capabilities—the use of poison gas in particular—providing further encouragement to preemptively strike Egypt’s air force and avoid the same fate as the northern highlands of Yemen.

Abstract:
This chapter examines how the dissonant treatment of Korematsu plays out in still intensely competing jurisprudential views of the court’s role in high profile security and liberty disputes. It describes and critiques the underpinnings for the exceedingly deferential all the laws but one approach rooted in the government’s broad national security and war powers. And it develops the contrasting call to vigilance with roots in the Supreme Court’s seminal embrace of watchful care over fundamental liberties in its Civil War case Ex Parte Milligan. The chapter then offers a jurisprudentially nuanced conception of judicial independence, discussing works by prominent American, British, and Israeli jurists and scholars. The chapter closes by highlighting Justice Sonia Sotomayor’s observation that in recent years courts have made a “modicum of progress” in generating a better balance of security and liberty, while acknowledging Professor Own Fiss’s spotlight on the judicial penchant for backsliding.
