Abstract The Budapest Convention and the General Data Protection Regulation (GDPR)—two Legal Frameworks designed to curb cybercrime. While the Convention on Cybercrime of the Council of Europe, the Budapest Convention, is the only binding international instrument on this issue, the GDPR is globally setting standards in data protection Law. How are the two policies working to curb cybercrime? Cybercrime concerns every person, every company, every authority and every public institution. The fact that the origin as well as the target of the criminal act can be located virtually everywhere around the globe sets a new challenge for lawmakers in their efforts to protect society. The increasing use and importance of the Internet of Things will create new conveniences for the public to enjoy and at the same time provide countless new entry points for hackers to gain access to devices, networks and valuable data, all of which might be abused for criminal intents. The Budapest Convention on Cybercrime plays a crucial role in the fight against cybercrime by setting state of the art principle based criminal law standards and important procedural rules with regard to the provisional storage of data to be potentially used as evidence in prosecuting criminal acts. GDPR is blazing the trail for the appropriate handling of data, and is thereby—albeit from a different starting point—significantly contributing to an improved data security framework and thus efficiently curbing cybercrime.

Cybercrime is a serious crime in the era of globalization. This crime employs sophisticated technology and anonymity. It is fast, crosses states’ borders, and has a wide impact. Cybercrime causes both material and immaterial losses. It even threatens world peace and security. The legal issue in this research is to discuss the international response to cybercrime, the substance of the Convention on Cybercrime, Budapest, 23.XI.2001, and Indonesia's position in the Convention on Cybercrime. The international response to cybercrime is done by holding international meetings at the United Nations Congress to discuss efforts to prevent cybercrime. Convention on Cybercrime, is the first provision for regulating cybercrime. The substance of the Convention on Cybercrime consists of material criminal law, procedural law, corporate responsibility, international cooperation and so on. Indonesia's position in the Indonesia Convention on Cybercrime is not to ratify the Convention on Cybercrime, but adopts the provisions of the Convention on Cybercrime on the Law Number 11 of 2008 on Information and Electronic Transactions and the Law Number 19 of 2016 on the Amendment of the Law Number 11 of 2008 on Information and Electronic Transactions. The criminal acts provided for in the Information and Electronic Transaction Law in Indonesia are wider than those stipulated in the Convention on Cybercrime.

Summary The goal of this article is to analyse the Slovak legislation of preservation and rendition of computer data in accordance with section 90 of the Criminal Procedure Code, which was implemented in the Slovak legal order under the Convention on Cybercrime, Budapest, 23. 11. 2001. In particular, article 16 of the Convention on Cybercrime obliges the member states to adopt necessary legislative and other measures as may be necessary to enable its competent authorities to order or similarly obtain the expeditious preservation of specified computer data, including traffic data, that has been stored by means of a computer system, in particular where there are grounds to believe that the computer data is particularly vulnerable to loss or modify. In addition, the article examines the effects of the legislation adopted in practice, including the correlation problems that the legislator has not deal with and also brings up-to-date results of the fight against cybercrime.

Abstract:
The authors analyze versatile manifestations of globalization, the internationalization of the global community development in the modern technogenic conditions, and conclude that these processes lead not only to positive, but, unfortunately, also to negative consequences. Specifically, they focus on the qualitative and quantitative changes in the heterogeneous structure of the so-called transnational organized crime. It is claimed that the most dangerous of them are cybercrimes, drug-related crimes, and human trafficking, which became the object of theoretical and empirical research. The study of international and national materials made it possible to apply a multi-aspect approach to the analysis of the normative basis and statistical data in this sphere. The authors identify the trends and regularities in the development of modern drug-related crimes in the plain of global and local socio-political, economic and legal phenomena; they also identify the priorities for the work of government bodies, including law enforcement agencies, aimed at counteracting these crimes. For cybercrimes, the authors outline the scope of the most dangerous types of illegal activities against national and economic security of states, against the rights and freedoms of their citizens; primarily, they single out the spread of terrorist threats, fraud related to financial and commercial information, personal data, etc. They analyze the clauses of the basic international normative legal act on counteracting cybercrime - the Budapest Convention of the Council of Europe - and pay special attention to the differentiation of crimes while taking into account this type of illegal activity, as well as the enforcement of the Convention in modern conditions. The essence of international terrorism is determined based on the statistical data and their correlation in one or another state; ideologically radical worldviews, separatism, personal ambitions of modern elites are recognized to be key prerequisites for this work. It is claimed that, as a type of transnational crime, global human trafficking is rather dangerous for modern society because of its considerable latency; its manifestations are described, it is also noted that a complex of preventive measures should be implemented at the international and national levels. The authors conclude that transnational crime is an urbanized deeply interconnected phenomenon that does not exist in a pure form and requires highly coordinated large-scale actions from the global and the national communities, as well as adequate professional training of law enforcement employees.

Posteriormente, far-se-á uma análise dentro do direito internacional, bem como da Convenção de Budapeste que visa solucionar as questões quanto ao mau uso da internet. Justifica-se o presente estudo através do avanço tecnológico do mundo moderno, que por sua vez contribuiu para a criação de novéis hábitos nas “novíssimas” formas de comunicação, que passaram a se valer de meios inovadores capazes de promover diálogo com as pessoas em tempo real e em qualquer lugar do mundo. Entretanto, não só no Brasil, mas emtodos os países em geral o mau uso da internet tem gerado muitos confrontos que ultrapassam as barreiras fronteiriças, como a prática de atos que violam direitos da personalidade, direito de propriedade intelectual e outros delitos criminais. Desta feita, os problemas que envolvem a internet, geralmente, têm suas repercussões extrapolando a legislação interna de cada Estado, que muitas vezes é insuficiente para resolver tal questão. Acredita-se ser, não só oportuna, mas necessária a utilização do Direito Internacional como opção catalisadora para o combate aos males que envolvem a rede mundial dos computadores. Para isso, será utilizada uma metodologia de pesquisa baseada em estudo bibliográfico de natureza qualitativa, pura em relação ao seu resultado, e descritivo-exploratória quanto aos seus objetivos. Abstract: The main objective of this work is to analyze the progress of Brazilian legislation, especially laws 12,737 / 2012 (Carolina Dieckmann Law) and 12,965 / 2014 (Internet Civil Law Law), regarding innovations in approaches to cyber crimes (cybercrimes). Subsequently, an analysis will be made under international law, as well as the Budapest Convention, which will address the issues of misuse of the internet. The present study is justified by the technological advance of the modern world, which in turn has contributed to the creation of new habits in the "newest" forms of communication, which have come to use innovative means capable of promoting dialogue with people in time real and anywhere in the world. However, not only in Brazil, but in all countries in general, the misuse of the Internet has generated many confrontations that go beyond border barriers, such as the practice of acts that violate personality rights, intellectual property rights and other criminal offenses. This time around, the problems involving the Internet generally have their repercussions, extrapolating the internal legislation of each State, which is often insufficient to resolve this issue. It is believed to be not only timely but necessary to use International Law as a catalyst for combating the evils that surround the global computer network. For this, a research methodology based on a bibliographic study of a qualitative nature, pure in relation to its result, and descriptive-exploratory in terms of its objectives will be used. This thesis examines the Council of Europe's Cybercrime Convention and suggests there is a structural imbalance: while improving the procedures for investigating cybercrimes, it has failed to address the prosecutorial complexities and disputes resulting from multijurisdictional cybercrimes, by following the usual trend of 'suppression' conventions. This trend is to expand the procedural mechanisms through which States can acquire evidence in relation to the 'suppressed' offences, while suggesting that State Parties adopt broad rules in relation to criminal jurisdiction. These procedural powers have provided powerful tools for policing cybercrime, and the Convention has been innovative by developing mechanisms for facilitating networking interactions between law enforcement, and on most interpretations, even providing for directly contacting foreign service providers for data. The traditional limitations of enforcement jurisdiction are gradually being transformed, but the resulting difficulties for jurisdictional concurrency are not appreciated. Given the malleability of the concept of 'territoriality', and the flexibility afforded in international law in its interpretation, seizures of jurisdiction over many cybercrimes have sometimes been on the most tenuous of grounds. This results in a problem of concurrent jurisdiction on a scale previously unseen in the context of other transnational offences. It is often assumed that once substantive criminal harmonisation occurs, jurisdictional conflict between States dissipates, but I highlight three areas where concurrency is beginning to generate difficulties: investigatory and prosecutorial negotiations, cybercrime extraditions, and the law relating to ne bis in idem. I argue that these problems are only going to be exacerbated given the inroads that are being made in investigative powers and enforcement jurisdiction, coupled with the global reach of cybercrime which brings more and more States into play. I provide both the theoretical and practical case for more refined approaches towards the concept of territoriality, and consider some of the potential mechanisms for dealing with these uneasy bedfellows in the Cybercrime Convention.

Abstract:
The thesis deals with the topic of computer crime. Foremost, it demonstrates on an example of the operation of a medical image information processing system some selected aspects of this issue. It shows that it is always necessary to monitor the current state of the technical knowledge at the time, but also the need of addressing the issue within the corresponding legal limits. The thesis presents criminal law reality as a complex system. The links between different parts of the system are examined, and possible shortcomings are considered. The legal instruments and legal limits of the procedures that can be used against cybercrime are evaluated. The thesis focuses especially on the issue of obtaining evidence under the Czech Criminal Procedure Code. It presents a proposal on how to understand individual procedural legal institutes and for what purposes and how to use them. Consequently it suggests legal procedures for specific selected practical situations.

This diploma thesis deals with European Union and current security threats, concretely with Cyberterrorism. Cyberspace and internet became essential parts of our living over the last decades due to rapid development of information and communication technology. The increased dependency on cyberspace is visible in all governmental operations, public-private sector, financial and business operations, as well as communications between individuals and groups. As a result our society is facing new threats. On one hand cyberspace is a place for economic growth and innovation, on the other hand criminals, spies and terrorist use cyberspace as a place for their activities. Our society should be aware of these negative impacts as well. Cyberterrorism by its nature is considered to be a very dynamic phenomenon. Regarding this fact this thesis provides a dynamic way how to define Cyberterrorism and reveals main perspectives of Cyberterrorism. Tracking the European Unions Convention on Cybercrime and main means to fight Cyberterrorism, this thesis analysis whether European Union disposes of appropriate means to engulf the dynamic nature of this phenomenon.

A informática é o ramo da tecnologia que se ocupa do estudo do tratamento automático da informação. Desenvolveu-se rapidamente a partir da segunda metade do século XX com o surgimento da Internet. O uso das tecnologias de informação e comunicação produziram mudanças no modo de vida de todas as sociedades, criando uma dependência de tal envergadura que tornou as pessoas praticamente incapacitadas de viver sem elas. De forma dupla, este avanço da tecnologia informática teve um forte impacto no Direito Penal. Por um lado, veio facilitar o cometimento de certos crimes tradicionais. Por outro lado, os ataques cibernéticos e as técnicas de engenharia social possibilitaram o surgimento de diversas novas atividades que devem ser consideradas ilícitas por atentarem contra bens jurídicos indispensáveis à própria conservação e progresso da sociedade. Em Angola, até ao ano de 2018, os crimes informáticos ainda não se encontravam legalmente previstos, o que de certa forma embaraçava o poder punitivo do Estado. Porém, no dia 23 de Janeiro de 2019 foi aprovado o Anteprojeto de Lei do Código Penal que prevê pela primeira vez o tratamento da criminalidade informática e o faz mediante a introdução de novos tipos criminais. Dentre os crimes informáticos previstos neste anteprojeto temos os cometidos contra a confidencialidade, integridade e disponibilidade de dados e sistemas informáticos (devassa por meio de informática, violação de telecomunicações e dano informático), os que atentam contra os computadores (falsidade informática e burla informática e nas telecomunicações) e os relacionados com os conteúdos (pornografia infantil). A Convenção de Budapeste sobre o Cibercrime de 23 de Novembro de 2001 é o mais revelante tratado internacional sobre esta temática, por isso a generalidade das legislações têm acompanhado o seu espírito e sentido. A nível da União Africana existe uma convenção que aborda a cibersegurança e, pela pertinência da matéria que acolhe, no dia 3 de Março de 2020 Angola a aprovou para ratificação. Neste trabalho pretendemos analisar como é que o anteprojeto angolano trata os crimes informáticos, examinar se este tratamento está ou não em consonância com a Convenção de Budapeste, estudar os aspetos relevantes da convenção da união africana sobre a cibersegurança e proteção de dados pessoais e, por fim, investigar a implementação das TICs e a verificação de ataques cibernéticos no contexto angolano.
Computer science is the branch of technology that deals with the study of automatic processing of information. It developed rapidly from the second half of the twentieth century with the emergence of the Internet. The use of information and communication technologies produces changes in the lifestyle of all societies, creating a dependency on such a scale that they have become almost incapable of living without them. Doubly, this advancement of computer technology has had a strong impact on criminal law. On the one hand, it facilitated the commission of certain traditional crimes. On the other hand, cyberattacks and social engineering techniques made possible the emergence of several new activities that should be considered illicit because they undermine legal assets indispensable to the very conservation and progress of society. In Angola, until 2018, cybercrimes were not yet legally foreseen, which somewhat embarrassed the punitive power of the state. However, on January 23, 2019, the Penal Code Bill was approved, providing for the first time the treatment of cybercrime and doing so by introducing new criminal types. Among the cyber offences contained in this bill we have those against the confidentiality, integrity and availability of computer data and systems (intrusion through information system, breach of telecommunications and computer damage), computer-related offences (computer-related forgery and computer and telecommunications fraud) and content-related offences (child pornography). The Budapest Convention on Cybercrime of 23 November 2001 is the most revealing international treaty on cybercrime, so the majority of laws have followed its mood and feeling. In African Union there is a convention that deals with cybersecurity, due to the pertinence of the matter, on March 3, 2020 Angola approved it for ratification. So, in this dissertation we intend to analyze how the Angolan Penal Code Bill deals with cybercrime, to examine whether or not this bill is in accordance with the Budapest Convention, to study the relevant aspects of the African Union Convention on cybersecurity and personal data protection and, finally, to investigate the implementation of ICTs and the verification of cybercriminal attacks in the Angolan's reality.

O cibercrime deixou há muito de ser uma palavra desconhecida para a generalidade da população mundial, sendo cada vez mais comum a execução dos mesmos por parte de indivíduos ou mesmo nações. Como tal, reveste-se de elevada importância a existência de uma resposta jurídica adequada às novas ameaças potenciadas pelo ciberespaço, a nível nacional e internacional. A evolução tecnológica levou à criação de novos elementos estratégicos, como os conceitos estratégicos de cibersegurança, e legislativos, com o objetivo de fazer face à especificidade da temática, tendo a União Europeia elaborado a Convenção de Budapeste sobre o Cibercrime de 23 de Novembro de 2001, e Portugal promulgado a Lei nº109/2009 de 15 de Setembro de 2009, a chamada Lei do Cibercrime. Apesar da existência da atual legislação, a ameaça pendente dos ciberataques tornou-se cada vez mais uma preocupação de todos os países, tendo em conta que um ataque no ciberespaço pode pôr em causa a sua segurança e soberania. Tendo estes factos em consideração, importa analisar qual o possível impacto dos ataques cibernéticos a nível nacional e das relações internacionais.
Cybercrime has long since ceased to be an unknown word for most of the world’s population, it is increasingly common the execution of them by individuals or nations. As such, it is of the utmost importance the creation of adequate legislation to face this new threats in cyberspace, enhanced at national and international level. The technological evolution led to the creation of new strategic elements, such as the strategic concepts of cyber security, and legislative ones, in order to address the specific nature of the subject, as such the European Union created the Budapest Convention on Cybercrime of 23 November 2001 and Portugal drafted the Cybercrime Law, nº 109/2009 of 15 September 2009. Despite the existence of the current legislation, the pending threat of cyberattacks has increasingly become a concern to all countries, taking into account that an attack in cyberspace may jeopardize its security and sovereignty. Taking these facts into consideration, it is important to analyze what is the potential impact of cyber-attacks on a national level and concerning its international relations.

Abstract:
Die Arbeit gliedert sich in 6 Kapitel. Das 1. behandelt die Anwendbarkeit des deutschen Strafrechts im Rahmen der Internetkriminalität, insbesondere bei § 184 StGB. Hier wird besonders eingegangen auf das Territorialitäts- und das Weltrechtsprinzip und die Frage des Erfolges von abstrakten Gefährdungsdelikten aufgegriffen. Im 2. Kapitel wird § 184 näher betrachtet, d.h. der Schutzzweck wird erörtert und eine Normananlyse durchgeführt. Kapitel 3 behandelt die strafrechtliche Verantwortlichkeit der am Kommunikationsprozess beteiligten Personen (User, Provider). Dabei wird auch ein Blick auf das TDG und EGG geworfen. Anschließend geht es in Kap. 4 und die Stafverfolgung im Internet, d.h. um prozessrechtliche Probleme. Schließlich beschäftigt sich Kap. 5 mit der Cybercrimeconvention und Kap. 6 liefert eine Zusammenfassung

AbstractThis study does not claim to exhaust all the abundant comparative legal issues. Therefore, it has been limited to discussing the penal provisions of eight European countries, without going into detailed considerations on issues related to e.g. form of offences committed or the liability of legal persons. The overarching intention was to present as diverse regulations as possible.All countries whose regulations were discussed have signed and ratified the Convention on Cybercrime and are members (except United Kingdom) of the European Union, which resulted in their obligation to implement Framework Decision 2005/222 on attacks against information systems, and the need to adapt their regulations to the provisions of Directive 2013/40, which has replaced this decision.

AbstractThere is no doubt that, due to the global nature of modern ICT networks, international cooperation plays a key role in ensuring cybersecurity, including in the fight against cybercrime.This chapter describes initiatives taken within international organizations to ensure cybersecurity and the prevention of cybercrime. The presentation will start with the initiatives of the OECD and the Council of Europe. This is due not only to some kind of “Eurocentrism” but above all to the fact that these two organisations were the first to address cybersecurity and cybercrime issues. In addition, the Council of Europe Convention 185 on CyberCrime of November the 23rd, 2001, an international agreement concluded in the Council of Europe, is a milestone in the prevention of computer crime, remaining the only binding act of international law to combat it. Its importance is best demonstrated by the constantly growing number of signatories (and countries that model without signatures after the provisions, e.g. Pakistan) and the fact that international organisations, or recommend that their members accept (UN, G7/G8, European Union) or “copy” provisions, creating their own model legal acts (e.g. Commonwealth).
