This contribution examines the procedural aspects of the enforcement of arbitral awards that were set aside in the jurisdiction where they were rendered. It focuses on recent cases in the United States and the Netherlands, which adopted a different line of reasoning than the approach taken by French judiciary many years ago. According to the latter, an arbitral award set aside in the ‘country of origin’ may be enforced in France in reliance on national law. Namely, French law on enforcement is more favourable than the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbit

This article examines the enforcement of foreign awards in Australia. It identifies and explains the difference between a “foreign award” and “international arbitration award,” observing it is a somewhat surprising but potentially significant distinction. The article then moves to consider the consequences of the distinction with particular reference to the Australian arbitral landscape. Australia has dual arbitration regimes operating at the state and federal level. Particular attention is given to the still controversial Queensland Supreme Court of Appeal decision in Australian Granites Ltd.

The extent to which courts are allowed to review arbitral awards for public policy violations in annulment or enforcement proceedings is a controversial topic. Recently, the German Federal Supreme Court (BGH) conducted an exhaustive judicial review of an award (referred to as a ‘Révision au fond’), assessing its potential breach of competition law within the framework of Germany’s public policy. This marks the first time in more than five decades that Germany’s highest civil court has taken an unambiguous stance in the ongoing discourse. Abstract:
In this work we present two general techniques to deal with multi-stage optimization problems under uncertainty, featuring off-line and on-line decisions. The methods are applicable when: 1) the uncertainty is exogenous; 2) there exists a heuristic for the on-line phase that can be modeled as a parametric convex optimization problem. The first technique replaces the on-line heuristics with an anticipatory solver, obtained through a systematic procedure. The second technique consists in making the off-line solver aware of the on-line heuristic, and capable of controlling its parameters so as to

This paper examines the influence on modern architecture of the R.S. Reynolds Memorial Prize, which bestowed $25,000 and an original work of aluminum sculpture to an architect from 1957 to 1993. Established by Reynolds Metals, once the second largest aluminum producer in the United States, the purpose of the prize was stated publicly: “The Award is conferred annually on an architect who, in the judgement of his profession, has designed a significant work of architecture, in the creation of which aluminum has been an important contributing factor.” Investigating the prize in the context of the

Abstract:
This working paper seeks to explore the different ways that community-based initiatives adopt to support women living in underprivileged colonies in New Delhi, access economic, educational, physical and mental well-being. This research examined three collectivising initiatives – a nongovernmental organisation, a voluntary project, and a livelihood program supported by a philanthropic grant to work with women from marginalised communities. In doing so, it mapped the role of the initiatives in raising critical consciousness among women about their socio-economic position, self-esteem, agency and

Objectives: (1) Evaluate Immunocompetence-OTL-containing Chromosomal Regions (ICRs), marked by microsatellites or candidate genes, for magnitude of direct effect and for contribution to relationships among multiple immunocompetence, disease-resistance, and growth traits, in order to estimate epistatic and pleiotropic effects and to predict the potential breeding applications of such markers. (2) Evaluate the interaction of the ICRs with genetic backgrounds from multiple sources and of multiple levels of genetic variation, in order to predict the general applicability of molecular genetic marke

Abstract:
Entrepreneurship is crucial to advancing the economy of Cambodia and fostering the development of society. The Royal Government of Cambodia has recognised the importance of entrepreneurship and included the promotion and entrepreneurship education in multiple policies and strategy. Universities and higher education institutes have been more active in providing entrepreneurship education (EE) as well as services and facilities to support startups in recent years. However, to date, there is very limited research on how young people in Cambodia perceive and prepare for entrepreneurial careers. Th
