Full text
Abstract:
The Ku Klux Klan has been active in North America for 139 years and organizations like the Klan have existed in North America since before the United States and Canada became independent nations. The white supremacy advocated by the Klan mimics the justifications used by colonial powers, and though the United States and Canada have espoused egalitarian ideals for quite some time, the Klan continues to attract members. Mircea Eliade and Claude Levi-Strauss have argued that history and myth share many characteristics, and that sometimes history can act as myth. Understanding how North American h

Abstract:
The legend of the Underground Railroad and the ideal of Canada as a promised land for African-American fugitive slaves have been pervasive in the Canadian imagination. In the mid-nineteenth century, myths describing British Canada West as a moral exemplar and guarantor of equal rights to all provided a sense of transcendent meaning and orientation to citizens of British and African heritage. British-Canadian school promoters hoped to lay the foundations of an ideal British society in the emerging public school system. The main proponent of this system, Egerton Ryerson, boasted of the merits of

Abstract:
Sensitive marine clay in Ottawa is a challenging soil for geotechnical engineers. This type of clay behaves differently than other soils in Canada or other parts of the world. They also have different engineering characteristic values in comparison to other clays. Cone penetration testing in sensitive marine clays is also different from that carried out in other soils. The misestimation of engineering characteristics from cone penetration testing can result. Abstract:
The 1980s witnessed a judicial “rights revolution” in Canada characterized by the Supreme Court of Canada striking down both federal and provincial legislation which violated the rights guaranteed by the 1982 Charter of Rights. The lack of a similar judicial “rights revolution” in the wake of the 1960 Canadian Bill of Rights has largely been attributed to the structural difference between the two instruments with the latter – as a “mere” statute of the federal parliament – providing little more than a canon of construction and (unlike the Charter) not empowering the courts to engage in judici

Nichols, Joshua Ben David. "Reconciliation and the foundations of aboriginal law in Canada." Thesis, 2017. http://hdl.handle.net/1828/7920.

Full text
Abstract:
The current framework for reconciliation is based on the Court’s accepted the Crown’s assertion of sovereignty, legislative power and underlying title. The basis of this is their interpretation of Section 91(24), which reads it as a plenary grant of power over Indians and their lands. This has led them to simply bypass the question of the inherent right of self-government and to generate a constitutional framework that amounts to little more than a proportionality check on the exercise of Crown sovereignty. I argue that if we are to find a meaningful reconciliation—and not simply one that is a

Abstract:
The Canada Millennium Scholarship Foundation was created by the Government of Canada to provide ten years’ worth of student aid in celebration of the new millennium. While often cited as an example of the federal ability to spend in areas of provincial jurisdiction, the CMSF relied on provincial government direction to establish the parameters of its program and administer its scholarships. Using a case study approach, the thesis demonstrates how the CMSF’s approach to policymaking, through a method known as collaborative federalism, ensured positive outcomes for the students who benefited fro

Abstract:
What actions constitute reasonable correction (or reasonable corporal punishment) of children pursuant to section 43 of the Criminal Code has been the subject of much legal debate in recent years. In this thesis, I argue that the Supreme Court of Canada’s analysis of section 43 in Canadian Foundation for Children, Youth and the Law v. Canada (Attorney General) (2004) failed to sufficiently delineate the justification, as demonstrated by the fact that the Court’s ruling has subsequently been manipulated and misinterpreted by lower courts across Canada. Abstract:
Despite certain episodes of Canadian influences on science education, the last six decades of science education in Canada has been a decidedly American experience – particularly from the standpoints of: 1) the foundational policy documents that have provided explicit impetus to periodic science curriculum reform in Canada; 2) the principal theoretical foundations, guiding assumptions, and goals of science education, and; 3) the development of curricular frameworks in Canadian provincial jurisdictions. Though contested, it will be argued here and supported by the research that the Canadian syst

The 'Kyoto Protocol', signed by the parties to the United Nations Framework Convention on Climate Change (UNFCCC) in 1997, allows countries to use carbon sequestered in forests as a means to meet internationally binding Greenhouse Gas reduction targets. This carbon can potentially be traded, thereby providing a non-timber revenue to forest growers. Forests managed for carbon storage achieve a range of additional forest management objectives such as biodiversity management, land aesthetics and water quality protection. Full text
Abstract:
Ideas that are migrating from Canada are already guiding advocates who seek greater judicial and constitutional recognition of Aboriginal and Torres Strait Islander peoples. However, there is a need for a conceptual framework through which to approach the lessons that can be learned from Canada in this area. Inspired by The Migration of Constitutional Ideas, an edited work by Sujit Choudhry, in this thesis I argue that by thinking about the migration and transplantation of foundational ideas and by differentiating between four ‘modes’ of migration (arguments of counsel, judicial determinations
