Malacarne, Cassiano. "Decretales d. Gregorii papae IX (Liber Extra). Decretais de Gregório IX (livro 5, títulos 1-2). Tradução com notas e introdução." reponame:Biblioteca Digital de Teses e Dissertações da UFRGS, 2016. http://hdl.handle.net/10183/140341.

Full text
Abstract:
The Decretals of Gregory IX (Decretales or Liber Extra) is a compilation of Canon Law published in 1234, which had been in charge of the canonist Raymond of Penyafort and from which there is still no translation in Portuguese and in other languages spoken today. Born in the classical Canon Law period and the so-called ius novum or ius decretalium, it includes mainly (not only) papal decretals of that period, namely both statements made by the Roman curia council – or without its participation – on legal matters upon a provocatio of the lower hierarchy, or court rulings, when they reached the Roman curia, as well as on other papal manifestations given to private affairs. Despite having a particular character, they became universal even before being included in the Decretals. The compilation is divided into five books, which are divided into titles and chapters, covering various types of regulations, which are, in sum: The canonical process or ordo iudiciarius (ecclesiastical civil procedural and criminal proceedings), discipline of secular and regular clergy, the ecclesiastical administration, rules about marriage, determination of the various types of crimes, punishment predictions, liturgical rules, among others. The translation was carried out on the first two titles of book 5, dealing with three canonical procedural modes (accusation, denunciation and inquisition) – that exerted and still exert a decisive influence on the laws of countries in Europe and America – and penalties applied to calumniators during the course of these procedural modes. Translation was further carried out on part of the Ordinary Gloss, only when it was understood that it was essential to doctrinally complete the norms or where essential for the understanding of certain passages. This gloss follows the same order of the Latin text, but it is presented in the form of endnotes, which are interpretative notes and make concomitant use of other types of bibliographic resources. The introduction is divided into two parts. The first addresses the nature of the translated source, the elements, the editorial work of Raimundo Penyafort from previous collections of decretals, and discusses the printed edition of the Corpus Juris Canonici used for the translation. The second part deals with the understanding of the complexity of the material contained in the translation, whose reading alone makes it difficult to understand the matter. The Brazilian society and the societies of many Western countries are organized based on laws whose development occurred many centuries ago. Although mainly focused on the ecclesiastical structure, canon law strongly affected the Christian lay (secular) society, whose effects can still be perceived today. Just like the Brazilian contemporary law, canon law, although laid on a firm original structure, was constantly improving and was appropriate to its time, which included criminal procedural rules when impunity and constancy in the practice of crimes were perceived, despite both types of law are characterized by a mitigation in the enforcement of legal judgments, except for certain crimes considered serious offences in their times.

Abstract:
The compositional technique of cross partitioning is one of Luigi Dallapiccola's most used twelve-tone devices. Through a detailed analysis of three contrapuntal canonic movements from Dallapiccola's Quaderno Musicale di Annalibera, I examine his use of cross partitioning as a motivic tool and as a referential collection. The development of the BACH motive and the derivation of tone-row statements reflects on Dallapiccola's extensive use of cross partitioning and his compositional principles used to achieve a sense of polarity. Upon a preliminary analysis based on set-theory analysis set out by Joseph Straus I draw an interpretive analysis through Alegant's cross partitioning model as well as develop my own set of parameters for interpretation in regards to polarity which is based on intervallic stability.

Connolly, Patrick J. "The nature of marriage as proposed in the codex iuris canonici and in the codex canonum ecclesiarum orientalium." Thesis, University of Ottawa (Canada), 1995. http://hdl.handle.net/10393/10293.

Full text
Abstract:
When one quickly glances at the new 1990 Oriental Code, one gets the impression that the marriage legislation is substantially the same as that found in the 1983 Latin Code. This cannot be surprising since the canon law on Christian marriage concerns a sacrament of the Church and therefore one would expect that it should be much the same throughout the Catholic Church, in the Western and in the Eastern Churches. However, because of the diversity of traditions, there are differences in theological approach and matters of discipline in respect of marriage. One such difference concerns the description of the nature of marriage in each Code. This comparative study addresses a number of questions regarding the nature of marriage as proposed in the two legislations. What are the common elements in both Codes' descriptions of marriage's nature? Do both legislations fully reflect the teaching of Vatican II's Gaudium et spes? What precisely are the differences between the two Codes? What is the origin and significance of these differences? Is the Oriental legislation faithful to the tradition of the Eastern Churches? The dissertation begins by attempting a synthesis of the historical and theological background of the Church's thinking on marriage in East and West, which will help explain the different approaches found in the two Codes, and which will also assist in assessing to what extent the new Oriental Code is indeed faithful to authentic Eastern traditions. The thesis goes to thoroughly elucidate the contribution of the Second Vatican Council and to survey the post-conciliar magisterial documents and the jurisprudence of the Roman Rota. This is essential in order to evaluate the ways that the two new legislations reflect the teaching of the Council. There is then a detailed examination of the two Code Commissions' work in drafting the Church's new legislations on marriage, to try to ascertain the reasoning behind their choices of formulations. All of this enables the final part of the work to investigate the common and different approaches by the two Codes in describing marriage's nature; this involves an in-depth comparison and analysis of the relevant canons.

Jones, Carys Wyn. "Is there a canon of rock? : canonical values, terms and mechanisms in the reception of rock albums." Thesis, Cardiff University, 2006. http://orca.cf.ac.uk/55613/.

Full text
Abstract:
This thesis addresses the issue of canon formation in the popular reception of rock music. The canon is the collection of works or artists that have been widely accepted as the greatest in their field. It is considered to be an inherently elitist concept however, this study explores symptomatic reflections of canonical values, terms and mechanisms from the canons of literature and classical music in the reception of rock music. The thesis is divided into three parts: the first explores the concept of the canon as theorised by Harold Bloom, John Guillory, Charles Altieri, William Weber and Marcia Citron, among others in the fields of literary criticism and musicology. Part 2 searches for these canonical ideas and ideals in the reception of rock music as represented by ten albums: Bob Dylan's Highway 61 Revisited, The Beach Boys' Pet Sounds, The Beatles' Revolver, The Velvet Underground's The Velvet Underground & Nico, Van Morrison's Astral Weeks, Marvin Gaye's What's Going On, The Rolling Stones' Exile on Main St., Patti Smith's Horses, The Sex Pistols' Never Mind the Bollocks: Here's the Sex Pistols, and Nirvana's Nevermind. Part 3 explores the resulting questions raised by the presence of canonical facets in the reception of rock music by stating a case for and against a canon in rock music. The thesis concludes that in the reception of popular music we are not simply trying to organise the past but mediate the present, and any canon of rock music must now negotiate a far more pluralized culture, and possibly accept a greater degree of change, than has been evident in the canons of classical music and literature in the last two centuries.

Sharbel, Poll Margaret. "The reparation of harm: A canonical analysis of canon 128 with reference to its common law parallels." Thesis, University of Ottawa (Canada), 2002. http://hdl.handle.net/10393/6094.

Full text
Abstract:
In 1983, a maxim of the natural law was concretized into a canonical obligation requiring one remedy the harm that one inflicts. In addition to canon 128's providing legal encouragement for one voluntarily to remedy the harm that one inflicts, if the person does not act voluntarily, c.128 provides a legal foundation for persons who have been harmed to exercise their right to vindicate and defend their rights in an ecclesiastical forum. It also provides a foundation from which the Church can act to enforce this principle and compel a person to remedy the harm that he or she inflicts. The primary purpose of this work is to explain the meaning of c. 128 and the nature, procedures, and methods of the remedy of harm in canon law. In addition, this work compares canonical concepts with similar concepts found in common law, and distinguishes those concepts that may be foreign to the common law tradition. This work seeks to show that c. 128 has been under-used as a basis for petitioning a canonical forum to remedy unlawfully inflicted harm. It demonstrates that c. 128 can be used as a foundational canon having its own broad applications rather that simply being a philosophical and canonical support for other juridic principles. Furthermore, this work endeavors to contribute to the canonical discussion on how justice is viewed and administered in the Church. Finally, it is hoped that this work will supply a common law perspective to the remedy of harm in canon law, and provide concrete examples from the common law that can aid judges and administrators in assigning fair and equitable remedies to persons that have been harmed.

Abstract:

McDonald, Richard F. (Richard Frederic). "Canonic Variations for Percussion and Orchestra." Thesis, University of North Texas, 1992. https://digital.library.unt.edu/ark:/67531/metadc935717/.

Full text
Abstract:
This work in three movements is written for piccolo, flute, alto flute in G, oboe, English horn in F, clarinet in Bb, bass clarinet in Bb, contrabass clarinet in Bb, bassoon, soprano saxophone in Bb, alto saxophine in Bb, horn in F, trumpet in Bb, six percussion, violins, violas, and violoncellos. The approximate duration is thirteen minutes. The rhythm of the piece is notated metrically and spatially. Movements I and III employ both types of notation, while movement II is strictly metric. Most of the percussion instruments used in the first movement are capable of sustaining very lengthy notes. Upon the release of these notes they have equally long, if not longer, decay times. As the aural residue of the envelopes dissipates, the strings and winds are used to extend the decay times. At the same time, the varying timbres provide subtle shifts in color, so that the overall effect is one of a very large instrument able to undergo a kin of internal, timbral metamorphosis. In diametrical contrast, the envelopes of movements II and III are compressed to the point of short, individual attacks.

Abstract:
Controversies invoking the concept of canonicity tend not merely to jump the gun - they assume that there is actually something to debate or discuss, that there are canons or canonical objects which can be deconstructed or preserved, analysed or appreciated. This thesis offers an approach to canonicity which rejects this assumption, but without abandoning the concept. It reconceives the basis of canonicity, through an analysis of the idea of incommensurability and of the hermeneutic or interpretive ideal of openness, by locating the concept and its applications within a semantics of interpretation and recovery which dismisses the very idea of shared structures of canonical meaning. In this way the approach follows Donald Davidson's well-known efforts to avoid a reification of linguistic meaning. The reconception of canonicity offered, however, owes perhaps more to the hermeneutic theories of Hans-Georg Gadamer and to Friedrich Nietzsche's conception of self-transformation. Drawing on all three philosophers it makes canonicity a function of the application of openness within certain kinds of incommensurable discourses, ones which are shaped by and reshape a subject's historical ground; in addition it suggests a resolution to a problem of openness and incommensurability which fundamentally reconceives both concepts.

Full text
Abstract:
The AMP-activated protein kinase (AMPK) is a sensor of cellular energy stress that, once activated, promotes ATP-producing process while it switches off ATP-consuming pathways, in order to restore the cellular energetic balance under conditions of stress. Activation of AMPK is dependent on the phosphorylation of the residue Thr172 in its α subunit. This phosphorylation is generally mediated by the known tumour suppressor LKB1, but also CaMKKβ has been shown to phosphorylate AMPK. As its name suggests, AMPK is also activated by the binding of AMP to its γ subunit. This binding causes a >10 fold allosteric stimulation, promotes phosphorylation of Thr172 by upstream kinases and protects AMPK from dephosphorylation of Thr172 by protein phosphatase(s). In 2010 it was reported that oxidative stress mediated by H2O2 activated AMPK by increasing the cellular AMP:ATP and ADP:ATP ratios (Hawley et al, 2010). However, the same year another work suggested that the mechanism of activation of AMPK by H2O2 was direct, independent of AMP and involved the oxidation of two cysteine residues in the α subunit of AMPK (Zmijewski et al, 2010). Given this discrepancy, here we provided evidence that H2O2, generated by addition of glucose oxidase in the cell medium, activates AMPK mostly through an increase of AMP:ATP and ADP:ATP ratios, as previously suggested in our laboratory. However, it seems that there might be a second, minor mechanism of activation that is independent of the changes in cellular nucleotides. This second mechanism was not identified in our previous work because we were not aware of how rapidly a single bolus of H2O2 can be metabolized by the antioxidant defences of the cell. We could not identify the alternative mechanism of activation by H2O2 but showed that H2O2 could protect Thr172 from dephosphorylation, which might suggest a direct effect of H2O2 on the phosphatase(s) dephosphorylating AMPK. However, since the identity of this phosphatase(s) remains unclear, we could not rule out the possibility that the protection from dephosphorylation that we observed could still be mediated by the increase in AMP:ATP and ADP:ATP ratios. Moreover, it remains still possible that a direct effect of H2O2 on AMPK might be responsible for the small but significant activation we detected in cell expressing a nucleotides-insensitive mutant of AMPK. Recently, a new crystal structure of AMPK obtained by Xiao et al (2013) provided new insights about AMPK structure and regulation. In particular, the authors identified a new binding pocket located at the interface between the N-lobe of the α-kinase domain and the β-CBM of AMPK, which appeared to be the binding site for two direct activators of AMPK: A769662 and 991. Here we confirm that this novel binding pocket is indeed the binding site for both A769662 and 991, and provide evidence that another direct activator of AMPK, MT63-78, also binds at the same site. Mutation of two important residues in this pocket (Lys29 and Lys31 of the α2 subunit) abolished the allosteric stimulation of AMPK by A769662, 991 and MT63-78 while it had no effect on allosteric stimulation by AMP. However, we also showed that the same mutation abolished protection against Thr172 dephosphorylation not only by A769662, 991 and MT63-78, but also by phenformin and H2O2, which are known to activate AMPK by increasing the AMP:ATP and ADP:ATP ratios. These data show that the integrity of this pocket is important for the effect of AMP to protect against Thr172 dephosphorylation, but not for its ability to cause allosteric stimulation. Moreover, in HEK-293 cell stably expressing an α2 subunit carrying the mutation of both Lys29 and Lys31, the basal activity of AMPK due to Thr172 phosphorylation was almost 6-fold less than in cells expressing wild-type α2. This result pointed out for the first time that there might be a natural ligand binding in the newly discovered binding pocket that is not able to bind to the double mutant, explaining the difference in activity observed. However the identity of this possible natural ligand remains unclear and more studies will be necessary to uncover it.
