So how have the courts grappled with these two competing aspects of public policy? The tension between these two competing aspects of public policy forms the subject matter of this article.

Abstract:
This dissertation comprises three parts, setting forth the thesis that Karl Barth’s mature doctrine of election, though avowedly supralapsarian, is in fact basically the opposite. I trace the development of Barth’s lapsarian thinking from its inception in 1920 (Romans II) to its maturation in 1936-42 (Gottes Gnadenwahl to CD II/2), and further developments up to 1953 (CD IV/1). The thesis of my dissertation comprises two aspects, one concerning what lapsarian position, Christological and predestinarian, underlies the Christocentric doctrine of election Barth developed in 1936-42, and the other concerning how he came to develop this lapsarian view. Part I examines the lapsarian position of Barth’s mature doctrine of election set forth in CD II/2 against the background of the Lapsarian Controversy in seventeenth-century Reformed orthodoxy, arguing that he has misunderstood some seventeenth-century terms and that his position is in fact basically in line with infralapsarianism in that for him both election and the incarnation presuppose humankind’s fallenness. Part II traces the development of Barth’s lapsarian position from its inception in 1920 to its Christological reorientation in 1936-42. In a nutshell, my thesis in Part II is that Christology and predestination started out as two loosely related doctrines in Barth’s theology, but as predestination, which was inconsistently supralapsarian during the first phase of the development, was drawn closer to Christology, which carried infralapsarian tendencies at first and became infralapsarian in the 1920s, Barth’s doctrine of predestination became more and more infralapsarian, and then in 1936-42 the two doctrines merged and became inseparable, and he became basically infralapsarian in both Christology and predestination. Part III comprises two chapters exploring doctrinal implications and further developments of Barth’s Christological-predestinarian infralapsarianism up to 1953 (CD IV/1). I argue that in developing what I suggest we call his “purified infralapsarianism” in a deeply historical-actualistic direction, the basically infralapsarian character of Barth’s understanding of election in Christ becomes more radical in that he leaves no room for the possibility of homo nondum lapsus as the obiectum praedestinationis.

Abstract:
There is a popular misconception in the world that Jehovah is too severe on occasion while Jesus Christ is always kind and merciful. The Latter-day Saint belief that Jehovah and Jesus are the same person presents a supposed conflict. There has not been much written on this subject by either non-Latter-day Saints or Latter-day Saints, thus, this thesis represents a unique contribution to a common perception prevalent in many Christian circles. The research of this thesis shows that the misconception is based on three problems: first, a misinterpretation of biblical stories in both the Old and New Testament; second, a lack of understanding biblical context and culture; and third, a lack of applying modern revelation to this subject. The research of this thesis focuses on these three areas in an effort to resolve this false perception. This thesis takes a deeper look into the acts of Jehovah and Jesus Christ as found in the Old and New Testaments respectively. Next, it looks as several doctrines related to this subject that have been revealed through latter-day prophets and incorporates them into the Old Testament. This analysis paints a broader picture of the Lord and illustrates that He was, indeed, merciful in the Old Testament but, at times, severe in the New Testament. Lastly, this thesis takes four of the most difficult Old Testament stories that seem to represent Jehovah as harsh, capricious, and unyielding, and puts them in their cultural setting. Though not every act can be completely explained, there is a high degree of similarity between Jehovah and Jesus. The study concludes, therefore, that much of the problem lies with perception and not with reality.

MIT SchMUSE (pronounced "shmooz") is a concurrent, distributed, delegation-based object-oriented interactive environment with persistent storage. It is designed to run in a "capricious" network environment, where servers can migrate from site to site and can regularly become unavailable. Our design introduces a new form of unique identifiers called "globally unique tickets" that provide globally unique time/space stamps for objects and classes without being location specific. Object location is achieved by a distributed hierarchical lazy lookup mechanism that we call "realm resolution." We also introduce a novel mechanism called "message deferral" for enhanced reliability in the face of remote delegation. We conclude with a comparison to related work and a projection of future work on MIT SchMUSE.

Abstract:
Value-added models are complex statistical formulas that aim to isolate the effect a teacher has on student learning. States and districts across the nation are adopting laws and policies that will evaluate teachers, in part, using the results provided by value-added models. In many states and districts, these evaluations will be used to inform high-stakes decisions about teacher salary and retention. However, value-added models are imperfect tools for assessing teacher effectiveness, and many scholars have argued that they are not appropriate for use in high-stakes decisions. This Article provides a brief history of the use of value-added models in public education and summarizes the major criticisms of using value-added models. In this context, the Article analyzes and evaluates the extent to which substantive due process claims brought by teachers adversely affected by the results of value-added models will be successful. The Article concludes that while the system as a whole is rationally related to the objective of improving the overall effectiveness of the teaching workforce, in certain cases, individual teachers will be able to successfully claim that the results of their value-added model led to a termination that was arbitrary and capricious. Finally, the paper offers some recommendations to states and school districts on how to implement an evaluation system using value-added models to avoid substantive due process violations.

“ Self ” to one person is the most vital existence. However, not everyone can precisely have their characteristics in hand. If one sees himself/herself subjectively due to the narrow distance to himself / herself, it could lead to the defect of being unable to dominate one’s self characteristics. Art of creation, to oneself, is actually one way to express and release emotions. The creation this time is based on “the perspective of self inner creation,” which is used to explore oneself and take the reflection from life experience and comprehension to self-analyze and find the inner peace through animation creation. Also, by using metaphor and intentional creation approach to express inner-self, the artwork is extended to the care for nature environment. After 921 Earthquake and Morakot Floods, suddenly, heaven turned into hell. Will disasters eventually end one day? Or it will only be much more miserable? It is one issue we, small human beings, should ponder on. Should we draw a lesson from the bitter experience and think thoroughly to understand the objective truth? The more we try to learn about this immense universe, the more mysterious it is. Is it telling us that “human beings are insignificantly small”? The production of this animation 「Spring Comes to The Withered Tree」, is a life-changing process to me. It changed my thoughts to reality, my attitude to work and my appreciation to people. During the production, I’ve gain so much inspiration from researching and interacting with others, which gave me the strength to complete the work step by step. The animation probes into the fact that we often try to look for mental support when we are depressed or lost. Surprisingly, the soothing power of a fortune poem from a temple is unbelievably affective. One sentence as “spring comes to a withered tree” could be elaborated into so many meanings. Therefore, I used my imagination and comprehension of the fortune poem to create this production. By a close-up of the seemingly wilted bark of a withered tree, I use patchwork of cotton prints and rags to transform it into a lively vital force. By and large, it takes effort to see more than meets the eye. From the beginning of visual and story planning, combining the use of media to express feelings and reflect life phenomena, to guiding the reader’s emotions with poetic reflections, I try to let my imagination go wild to feel what is within and gain more inspiration in life. In addition, from reviewing the process of self-development, I also learned to value the importance of life existence and turned it into the motivation of my creation. Learning with streaming data has received extensive attention during the past few years. Existing approaches assume the feature space is fixed or changes by following explicit regularities, limiting their applicability in dynamic environments where the data streams are described by an arbitrarily varying feature space. To handle such capricious data streams, we in this paper develop a novel algorithm, named OCDS (Online learning from Capricious Data Streams), which does not make any assumption on feature space dynamics. OCDS trains a learner on a universal feature space that establishes relationships between old and new features, so that the patterns learned in the old feature space can be used in the new feature space. Specifically, the universal feature space is constructed by leveraging the relatednesses among features. We propose a generative graphical model to model the construction process, and show that learning from the universal feature space can effectively improve performance with theoretical analysis. The experimental results demonstrate that OCDS achieves conspicuous performance on synthetic and real datasets.

The tribology of cam-roller follower conjunction is highly dependent on the engine type and working conditions. The interface experiences transient conditions due to variations in contact geometry and kinematics, as well as loading. These lead to instantaneous and capricious behavior of the lubricant through the contact, which determines the regime of lubrication. The resulting frictional characteristics are affected by the shear of the lubricant film and the interaction of rough surfaces themselves. Thus, specific analysis is required for any intended new engine configuration. Therefore, a tribo-dynamic model, combining valve train dynamics, contact kinematics and tribological analysis is required. An important issue is to develop a simple yet reliable and representative model to address the above mentioned pertinent issues. This would make for rapid scenario-building simulations which are critical in industrial design time-scales. The current model has been developed in response to the above mentioned requirements. A multi-body dynamic model for the valve train system based on the key design parameters is developed and integrated with an EHL tribological model for the cam-follower contact. To keep the model simple and easy to use and to avoid time-consuming computations, the analytical EHL model makes use of Grubin’s oil film thickness equation. Viscous and boundary contributions to friction are obtained as these account for the losses which adversely affect the engine fuel efficiency.

Одной из главных задач технологии выращивания томата является организация эффективного минерального питания и высокоэффективного использования системы освещения. Успешность выращивания томата обусловлена многими факторами, и температурный режим является одним из важнейших для их правильного развития. Томат довольно капризная культура, для его успешного выращивания необходимо определенное сочетание тепла и влажности, при этом требования к температурному режиму на разных этапах развития томатных кустов отличаются: прорастание семян томатов происходит при t° +20-25° C. Предотвратит вытягивание всходов, позволив им сформировать крепкую корневую систему, снижение t° до +12-15° C днем и +6-10° C ночью сроком на 1 неделю. Хорошее развитие кустам обеспечит поддержание температурного режима в дневное время на уровне t° +20-26° C и в ночное - t° +16-18° C.One of the main tasks of tomato growing technology is the organization of effective mineral nutrition and highly efficient use of the lighting system. The success of tomato cultivation is due to many factors, and the temperature regime is one of the most important for their proper development. Abstract:
This paper presents both criticism and suggested changes to boiler efficiency standards associated with fossil-fired steam generators. These standards include the widely used ASME PTC 4.1, PTC 4 and DIN 1942, and others. The chief criticism is inconsistent application of thermodynamic principles. Specifically, conceptual errors are made with application of reference temperatures and the treatment of shaft powers. When using computed fuel flow as a touchstone, it becomes obvious that arbitrary use of reference temperatures and/or use of capricious energy credits cannot dictate a system’s computed fuel flow. Efficiency, calorific value and fuel flow must have fixed definitions concomitant with a system’s useful energy flow. Thermodynamics is not an arbitrary discipline, the computed fuel needs of a system must describe the actual. Boiler efficiency requires the same treatment, as an absolute value, as actual fuel feed and emission flow. Boiler efficiencies and associated calorific values have obvious standing when judging contractual obligations, for thermal performance monitoring, and for confirming carbon emissions. Note that a 0.5 to 1% change in efficiency may well have significant financial consequences when testing a new unit, or the on-going costs associated with fuel and carbon taxes. This paper demonstrates that errors greater than 2% are entirely possible if following the current standards. This paper appeals to the resolution of efficiency at the 0.1% level. The power plant engineer is encouraged to read the Introduction and Summary & Recommendations sections while the thermodynamicist is requested to throughly review and critique the mid-sections. The author hopes such reviews will advocate for improvement of these important industrial standards.

Abstract:
It has become axiomatic that a social license is a critical success factor for Canadian pipelines. Regulators may permit a pipeline, but on-the-ground consent for a project is a function of communities. Social license is an intangible quality outside of formal regulation, occupying the gap between community expectations and existing laws. Increasingly, gaining social license is seen as an important aspect of managing environmental and social risks, and the presence or absence of social license affects project budgets, timelines, corporate reputation and even project outcomes. There are regulatory risks to not demonstrating social license; and even with regulatory approval social license may be the difference between legal challenges and none. Social license is not easy to find, is difficult to measure, and is capricious and dynamic in nature. It is an inherently vague and changeable standard that means different things to different people. Simply defining social license can be a futile enterprise: as with US Supreme Court Justice Stewart’s famous 1964 judgment, we can’t neatly define social license, but we know it when we see it. The emergence of social media has meant that communities are better engaged, informed, and networked than ever before. Gaining social license happens when trust is built, earned and maintained with communities: it can take a long time to build that trust, and today’s digital citizen expects engagement across many platforms in order for that trust to be maintained. Though there is no ‘one-size-fits-all’ approach to gaining social license, the approach of this paper is to lay out a case-study roadmap for navigating towards it by building relationships, countering misinformation, and mobilizing existing support. The paper will also recognize potential wrong turns such as inattention to social media, lack of transparency or a clear message, and the mistaken belief that regulatory approval is the only approval necessary.

Abstract:
The problem of capricious log response is one that has persistently troubled formation evaluation experts since the Schlumberger brothers ran their first log in Pechelbronn, France. Since the advent of 6FF40 induction logs in the 1950’s, subtle differences have been noted between laterolog and induction response. As field resistivity measurements have evolved to array induction and array laterolog tools, resultant resistivity variability has increased. (Gianzero, 1999) This paper examines how the resistivity discrepancies between laterolog and induction response in an electrically anisotropic rock can greatly affect calculated water saturations (Sw), and ultimately oil in place. Further, several possible solutions are posited to resolve the riddle of resistivity. The root cause of the differences between the two measurement techniques is in how each tool measures the vertical resistivity (Rv) and horizontal resistivity (Rh) in addition to dielectric effects. In isotropic formations, the difference between Rv and Rh is miniscule. However most organic shales and many laminated low porosity formations are anisotropic. (Klein et al., 1997) In anisotropic formations, the ratio of Rv/Rh is not constant over the possible range of resistivities. This ratio has been observed to be as high as 5 at less than 1 ohmm of Rh, and approaches unity at infinite resistivity. Due to the high Rv/Rh ratio, at low resistivities, differences between laterolog response (Rh + fraction of Rv) and induction response (Rh) has a dramatic impact on resultant water saturation values. Laterolog array measurements exhibit a systematically higher resistivity than array induction measurements in the same formation. Variances in Sw as high as 30% has been observed. Since most North American unconventional fields have a mix of historical laterolog and induction data from different eras, it is imperative to address this apparent contradiction in values. Further confounding the issue, the mud salinity required to run both tools at peak performance is nearly mutually exclusive. This complicates efforts to resolve the conundrum because the tools cannot be run simultaneously. The closest measurements on the same rock come from sidetracked wells where one has a laterolog and the other induction. The next best possible measurement is the tri-axial resistivity which can be used to model the Rv and Rh. The issue with tri-axial tools, is that the laterolog apparent resistivity does not conform to either end member of the Rv or Rh. Since the detailed field measurements have been lost to time and only the measured resistivities are available in public LAS data sets, several practical solutions have been devised by the authors to untangle this mess. First, sets of proximal wells (<1000 ft apart) with either tool were depth-shifted and oriented for analysis. Wells with tri-axial resistivity modeled Rv and Rh supplemented the data set. Once the data was collected, the authors utilized simple x-y regression, multilinear regression, artificial neural net, and random forest regression to predict true Rh. The results of each predictor algorithm is discussed, as the optimal solution is situationally dependent.
