Full textDet föreligger oundvikligen spänningar mellan intresset av att skydda miljön och intresset av varors fria rörlighet på den inre marknaden. Då harmoniserande gemenskapslagstiftning saknas bedöms vanligen frågan huruvida nationella miljöskyddsåtgärder skall tillåtas eller ej efter de restriktioner sådana åtgärder eventuellt kan medföra för den fria varurörligheten. Nationella handelshindrande miljöskyddsåtgärder kan under vissa förutsättningar medges undantag enligt artikel 30 EG- fördraget och/eller Cassis-doktrinen. Då harmoniserande gemenskapsbestämmelser saknas är nationella miljöskyddsåtgärder förenliga med Cassis-doktrinen förutsatt att åtgärderna är tillämpiga utan åtskillnad, proportionella, vilket innebär att det inte får finnas någonalternativ åtgärd genom vilken man på ett lika effektivt sätt kan uppnå samma miljömål, men som inte begränsar den fria varurörligheten i samma utsträckning, och nödvändiga. Miljöåtgärder som inte tillämpas utan åtskillnad kan endast berättigas av intresset av att skydda människors och djurs hälsa och liv samt bevarandet av växtarter, enligt artikel 30 EG-fördraget.

Full textGeographical indications designate products which have a specific geographical origin, which can either be national, regional or local. The subject is complicated since geographical indications arises a large number of questions There are EC regulations which regulate the protection of geographical indications, but since the field has not yet been exhaustively harmonized, the existence of national rules of protection is therefore still possible, which can lead to trade barriers between the member states. Consequently, one problem consists in whether it may be legitimate to restrict the free movement of goods by article 28 in the EC Treaty by referring to national rules of protection and to what extent such measures may be justified by article 30 or by the Cassis doctrine. An additional question consists in how the line between geographical indications and generic terms is to be established appropriately. Further, geographical indications are exposed to improper use by other dishonest commercial operators and therefore the possibilities of protection against unfair competition and misleading are also discussed in the thesis. Since there are several questions which are unanswered regarding geographical indications, the purpose of this essay is to analyze what kind of intellectual property right geographical indications constitute and how they are protected.

Full textThe subject of this thesis is the destiny at the Byzantine epoch of the “Roman History” by the Roman historian of Greek language, Cassius Dio (about 163 – after 230), which traced the historical events from the beginning of Rome till 229 A. D. Two thirds of his book have come down to us in different Byzantine sources, and we are faced with the problem of their reliability for a modern historical reconstruction. The three main sources examined in this thesis are the “Excerpta” of Constantin VII (Xth century), the “abbreviation” of Cassius Dio by Xiphilin (XIth century), and the “Chronicle” of Zonaras (XIIth century). They have been compared for the period of Julio-Claudians with the original text of the “Roman History” according to three aspects : fidelity to text, choice of content, and religious matters. The research reveals their similarities and differences and allows to trace the evolution of the attitude towards the roman history at different periods of the Byzantine era and to determine the historical context of the transformation of Dio’s work to meet his Byzantine public’s requirements

Full textThe aim of the present study is to translate into french and comment the historical material of Cassius Dio's roman history, books 45 to 47 (from Octavian's return to Rome after Caesar's death april 44 b. C. To the battle of philippi october 42). Such dense events and specially the political debuts of Augustus give this part of Dio's work some special features. Beyond a mere systematical analysis of dio's sources, which of course cannot be neglected in such a study, we will try to understand how the severian historian picks his topics out the available data, and we mean to provide Dio's reader an introduction : the chaotic, painful and inescapable way monarchy sets in and republic expires proved fascinating for a historian who felt his own era trembling. Caesar's heir is not apologized for all that, even if a global influence of augustean tradition can be perceived. By giving the account of the end of the roman republic and of the future emperor's first political steps, and by denouncing the chaos of 44-42 b. C. , Dio emphasizes how necessary a moderate, senate-supported, both order an peace maintaining monarchy can be.

Full textThis thesis is a translated edition of Books 52 and 53 of Cassius Dio’s Roman History with a commentary. The last French edition of Cassius Dio’s Roman History is now obsolete. Moreover there is no modern translation of this text. For a few years an up-to-date edition, with a translation, has been in progress, which includes our work. In Books 52 and 53, the author, a Greek historian and a Severian senator, describes the evolution of the Roman institutions between Republic and Principate. His analyses are based on his own political knowledge, his official duties and on his study of his Greek predecessors (such as Polybius or Dionysius of Halicarnassus). His point of view is most of the time original. In books 52 and 53, he focuses on the monarchic transition and the changes that affected the constitution and the institutions. The most important actors of the “revolution” (Augustus, Agrippa and Maecenas) are delivering probably fictive speeches that illustrate this change. There is also in these books an interesting literary work. Dio is to be considered as an heir of two traditions: the debate over the best constitution (as old as Herodotus at least) and the rhetoric declamation. Both of them are at work in the speeches of books 52 and 53. The well-known debate between Maecenas and Agrippa (Book 52) has thoroughly been studied but rarely in connection with the other speeches of the Augustan books. Besides, the literary part of these texts has been, most of the time, used to criticize them. This work lays stress on two (in our opinion) linked questions: how valuable is the historical testimony of Cassius Dio on this key period? And what do the speeches bring (besides the rhetorical display) to Dio’s historiographical project?

Full textCassius Dio's Roman History is a text of major importance regarding two complex questions: the mutation of the roman political system and the nature of the power exercised by Caesar at the end of his carrier. On the 80 books which composed this comprehensive survey of roman history, a first lecture shows that the space alloted to the caesarian period is largely overdevelloped. This fact reveal the importance that this time has for the historian, because this period of transition gives Dio the room to bring out the various elements which formed the nature of the political systems and to show that, according to him, the roman world can only be successfully managed by a monarchia, originally invented by Caesar himself, and forged on the honorific measures granted to him by the Senate. Nevertheless, Dio's History has long been kept in a kind of disdain by some of the modern studies, which saw it as an unreliable source of informations. This was mostly due to the organisation of the text and to its structure. Indeed, the text reveals contradictions, omissions, repetitions and shortcuts which were usually read as errors, commited by Dion when he was gathering his own sources. This modern a priori shows the limits of the Quellenforschung, as applied to Dio's account. This study wishes to be a part of the revival of the moderne works on Cassius Dio. By analazing the particularities of the text, mostly in the caesarian books, this study wishes to bring out the errors committed and to enlighten the principles of composition and the organisation of the historical facts which gives Dio's text its original structure, and which ultimately validate its content

Full textThis text provides comparative analysis of the EC provisions, establishing the terms of the free movement of goods and freedom to provide services, as well as of jurisprudence of the European Court of Justice and doctrine of EC law, revealing the differences and similarities of the legal content of the relevant freedoms. The first chapter of the text describes the nature, aim and legal content of the free movement of goods and freedom to provide services followed by the examples from the case-law, which illustrate the distinction of the freedoms considered. The second chapter introduces the comparative analysis concerning the conditions of the territorial scope of the EC Treaty provisions on the free movement of goods (Article 28) and freedom to provide services (Article 49) as well as persons bound by the latter rules. The third chapter deals with the topical issues in respect of the restrictions of the relevant freedoms, in particular the nature and scope of the barriers, adopted by the Member States. The fourth chapter of the text focuses on the justification of the freedoms, in particular on the EC Treaty exceptions, judicially created exceptions as well as the principle of proportionality and the application mechanism of the latter in the comparative manner of the freedoms. Full textThis thesis is aimed at establishing the text of the Flavian books of the Roman History of Cassius Dio, at translating it and at giving an historical commentary of it. As this part of the Roman History has been lost, the critical edition of these books only relies on the indirect tradition. Four works have been selected to make the corpus of the text, since they were faithful to the formulation and to the contents of Dio’s History they used as a source: the Constantinian excerpts of Cassius Dio and Petrus Patricius, the Epitomes of Xiphilinus and Zonaras. The Excerpta from John of Antioch and the Suda, among others, are pushed into the background within the Testimonia. The manuscript tradition of the four main works was entirely reconsidered and this permitted to modify the text of the editio maior (made by U. Ph. Boissevain in 1895-1901) in many places. Moreover, our layout of the page is innovative: the similar extracts are shown together, in order to figure out how their common source was originally formulated. Compared with the previous editions, the inner classification of the fragments was changed several times. Once it was issued, the text was translated into French. The composition of these books is marked by an intermingling of annalistic and biographical techniques which, in our opinion, is aimed at painting the antithetical pictures of Vespasian and Titus on the one hand, and of Domitian on the other hand. Dio’s point of view may have been influenced by the similarities of the events which occurred between 68 and 96 (from Nero’s death to Domitian’s) and between 192 and 217 (from Commode’s death to Caracalla’s), since he lived at the end of the 2nd Century- beginning of the 3rd. However, the study of the historical events lets us think that the break between the reign of Domitian and his predecessors was not as sharp as the Severan historian claimed. Indeed, Domitian’s accession to power had been prepared by his father and his brother, and his politics fitted into their scheme
