Abstract:
This chapter examines the jurisdiction of the English court and the choice of law process in proceedings for divorce, judicial separation, and annulment of marriage, and the extent to which the decrees of foreign courts in such matrimonial cases are recognised in England. It discusses similar rules which have been introduced in relation to same-sex marriage and civil partnership. Finally, the chapter considers the powers of the English court to grant financial relief and to recognise foreign maintenance orders. The Domicile and Matrimonial Proceedings Act 1973 introduced new uniform grounds of jurisdiction for matrimonial proceedings. These grounds were based on the policy that at least one of the parties, whether husband or wife, applicant or respondent, should have a sufficient connection with England to make it reasonable for the English court to deal with the case and likely that the divorce would be recognised in other countries. The Brussels II bis Regulation imposes uniform jurisdictional rules throughout the European Union (except Denmark, which did not participate in the adoption of the Regulation) and provides for almost automatic recognition of divorces, annulments, and separations granted by the courts of the Member States.

This chapter examines the rules governing matrimonial and related causes, which generally include petitions for divorce, nullity of marriage, judicial separation, and presumption of death and dissolution of marriage, as well as similar foreign proceedings which may fall for recognition in England. It first considers whether an English court will assume jurisdiction to grant matrimonial relief in the case of a polygamous marriage, focusing on the relevant provisions of common law and Section 47 of the Matrimonial Causes Act 1973. It then discusses the rules relating to the jurisdiction of the courts, choice of law and recognition of foreign divorces, annulments, and judicial separations as well as presumption of death and dissolution of marriage. It also analyses conflict rules concerning the dissolution, nullity, and separation of civil partnerships and same sex marriage.

Scotus’ estimate of the female gender is shaped by his view that Mary is pre-eminent among merely human saints. Because Mary must be a real mother, he rejects the Aristotelian view that mothers are merely passive causes in reproduction. Christ’s most perfect saving act preserves Mary for immaculate conception, freedom from original sin, not just from birth but from the moment of foetal animation. Gender-justice is important in the marriage contract, even though God never dispenses from life-long indissoluble monogamy to allow polyandry or to permit women to divorce. The Franciscan distinction between dominion and use allows Mary and Joseph to be really married even though both vowed chastity. Gender-justice means that right reason would never permit merely human institutions from restricting ordination to men. The command must come from Christ himself.

During the 1960s, Elaine lived in a succession of New York lofts, where she painted, wrote, and entertained large groups of friends—including artists, writers, and athletes. She became caught up in the Death Row case of Caryl Chessman, one of several causes she vigorously pursued. Feminism was not among them. She was equally hostile to Pop Art, scorning it as simply “a way of making money.” The mid-sixties were a troubled time for Elaine: her mother died; Bill tried to divorce her. Her drinking escalated, leading to several car accidents and embarrassing scenes. (She stopped drinking in the mid-seventies.) Elaine spent summers in Paris as a teacher at the New York Studio School, bringing a family member or student along for city excursions. A Jules Dalou sculpture in the Jardin du Luxembourg prompted her Bacchus painting series, which captured the play of dappled light and foliage on the bronze figures.

When Tammy Wynette sang "D-I-V-O-R-C-E," she famously said she "spelled out the hurtin' words" to spare her child the pain of family breakup. In this innovative work, Ted Ownby considers how a wide range of writers, thinkers, activists, and others defined family problems in the twentieth-century American South. Ownby shows that it was common for both African Americans and whites to discuss family life in terms of crisis, but they reached very different conclusions about causes and solutions. In the civil rights period, many embraced an ideal of Christian brotherhood as a way of transcending divisions. Opponents of civil rights denounced "brotherhoodism" as a movement that undercut parental and religious authority. Others, especially in the African American community, rejected the idea of family crisis altogether, working to redefine family adaptability as a source of strength. Rather than attempting to define the experience of an archetypal "southern family," Ownby looks broadly at contexts such as political and religious debates about divorce and family values, southern rock music, autobiographies, and more to reveal how people in the South used the concept of the family as a proxy for imagining a better future or happier past.

This chapter examines the continuities, development, and diversity found among evangelical Christians as they explore different patterns of evangelical response to new and challenging questions relating to sexuality and gender. Evangelicals have generally accepted contraception although there has been some recent opposition. Understandings and responses to divorce and remarriage vary from prohibition to generous accommodation with general acceptance of diverse genuinely evangelical views. Issues of gender and women in church leadership have, however, caused tensions and divisions between more restrictive ‘headship’ views and more egalitarian understandings, raising issues related to biblical inspiration and authority as well as hermeneutics. In contrast to diversity in these areas, most evangelicals remain committed to a sexual ethic focused on marriage and abstinence for the unmarried, and thus opposed to any approval of homosexual partnerships. Although some evangelicals are questioning this, most see change here as unbiblical and going beyond evangelicalism.

The enduring controversy about the nature of parliament informs nearly all debates about the momentous religious, political and governmental changes in early modern England – most significantly, the character of the Reformation and the causes of the Revolution. Meanwhile, scholars of ideas have emphasised the historicist turn that shaped the period’s political culture. Religious and intellectual imperatives from the sixteenth century onwards evoked a new interest in the evolution of parliament, shaping the ways that contemporaries interpreted, legitimised and contested Church, state and political hierarchies. For much of the last century, scholarship on parliament focused on its role in high politics, or adopted an administrative perspective. The major exception was J. G. A. Pocock’s brilliant The Ancient Constitution and the Feudal Law (1957), which argued that competing conceptions about the antiquity of England’s parliamentary constitution – particularly its common law – were a defining element of early Stuart political mentalities and set in motion a continuing debate about the role of historical thought in early seventeenth-century England. The purpose of this volume is to explore contemporary views of parliament’s history/histories over a broader canvas. Historical culture is defined widely to encompass the study of chronicles, more overtly ‘literary’ texts, antiquarian scholarship, religious polemic, political pamphlets, and of the intricate processes that forge memory and tradition. Over half of the essays explore Tudor historical thought, showing that Stuart debates about parliament cannot be divorced from their sixteenth-century prelude. The volume restates the crucial role of institutions for the study of political culture and thought.
