Resumo: A Educação para estudantes com dotação e talento vem sendo discutida em diversas pesquisas, em sua maioria, no campo da Psicologia e da Pedagogia, voltadas principalmente para a legislação, para definições de terminologia e para a identificação e intervenção pedagógica. Mesmo com essa evolução, são poucas as pesquisas no âmbito de avaliação de programas, e observa-se que esse conhecimento não tem atingido o seu objetivo primordial, que é chegar às escolas. No entanto, existe no Brasil a metodologia Caminhos para Desenvolver Potencial e Talento - CEDET, que oferece construtos bem definidos para identificação, bases teóricas validadas por procedimentos científicos, trabalho em corresponsabilidade com os sistemas de ensino, percentual significativo de estudantes em intervenção educativa. Diante dessa constatação, a presente pesquisa objetivou verificar os resultados da metodologia do CEDET. A hipótese do estudo foi a de que a intervenção educativa do CEDET auxilia no desenvolvimento das potencialidades desses estudantes. A metodologia utilizada foi a descritivo-analítica, com uso de análise documental e questionários. Teve como participantes dezoito estudantes egressos do Centro. Abstract: Education for students with giftedness and talent has been discussed in several studies, mostly in the field of Psychology and Pedagogy, focused mainly on the legislation, for terminology and definitions for identifying and pedagogical intervention. Even with this development, there is little research in the evaluation of programs, and it is observed that this knowledge has not achieved its primary goal, which is to reach the schools However, there is in Brazil, Paths to Develop Potential and Talent - CEDET methodology; which offers well-defined constructs for identification, theoretical bases validated by scientific procedures, work in corresponsibility with the educational systems, a significant percentage of students in educational intervention. Due to this, the present study aimed to verify the results of CEDET methodology. The study hypothesis was that CEDET educational intervention assists in developing the potential of these students. The methodology used was descriptive-analytic, using document analysis and questionnaires. It was attended by eighteen graduate students of the Center. It was adopted the humanistic perspective as theoretical basis, and the content analysis by piece of meanings strategy. The results evidenced the existence of feasible theoretical knowledge for the identification and educational intervention for students with giftedness and talent; the distance between the precepts contained in the legal documents and how this process is organized in schools routine; the importance of integrating theoretical and practical knowledge in teacher formation. It concludes that the Center for Developing Potential and Talent achieves its purpose in promoting the development of the potential of its students by providing the expansion of worldview, interaction and acquaintanceship, and a high academic self-concept, physical and social. Resumen: La educación de los estudiantes con la dotación y talento se ha discutido en varios estudios, sobre todo en el campo de la Psicología y Pedagogía, centrado principalmente en la legislación, de terminología y definiciones para la identificación y la intervención pedagógica. Incluso con este desarrollo, hay poca investigación dentro de los programas de evaluación, y se observa que este conocimiento no ha conseguido su objetivo principal, que es llegar a las escuelas. Sin embargo, existe en la metodología Brasil Caminos para desarrollar el potencial y el talento - CEDET ofreciendo construcciones bien definidos para identificar, bases teóricas validados por procedimientos científicos, que trabajan en corresponsabilidad con los sistemas de educación, un porcentaje significativo de los estudiantes en la intervención educativa. Teniendo en cuenta esta conclusión, el presente estudio tiene por objetivo verificar los resultados de la metodología CEDET. La hipótesis del estudio fue que la intervención asistencias CEDET educativas en el desarrollo del potencial de estos estudiantes. La metodología utilizada fue de tipo descriptivo-analítico, utilizando el análisis de documentos y cuestionarios. A ella asistieron dieciocho graduados de los centros de estudiantes. O campus como base física de suporte aos sistemas de educação superior de massa adotado de forma globalizada a partir dos anos 1950 e sua contextualização histórica e projetual no âmbito brasileiro encontra um número muito reduzido de estudos. A exemplo da Europa e dos Estados Unidos, sob as pressões demográficas ocorridas após a Segunda Guerra Mundial e como imperativo de desenvolvimento econômico, inúmeros campi brasileiros foram implantados. Porém, já em 1975, os Anais do I Seminário Nacional sobre Planejamento de Campi Universitários retratavam inadequações dos novos campi das universidades federais que as incapacitavam de atender às demandas da Reforma Universitária de 1968. Sucessivos acordos de empréstimo foram assinados com o Banco Interamericano de Desenvolvimento para a reestruturação física desses espaços. O último deles, o Programa MEC/BID III, firmado nos anos 1980, destinou 105 milhões de dólares a nove universidades federais, visando expansões, preenchimento de lacunas e solução de deficiências físicas remanescentes da implantação desses campi nas décadas de 1960 e 1970. Como objetivo geral, este trabalho aborda um tema da maior importância para o planejamento físico do espaço universitário: a consolidação do campus como tendência internacional mesmo em países como a França, onde, até os anos 1950, ele não era sequer uma realidade a ser copiada, e o Brasil, onde até os anos 1960 predominavam faculdades isoladas. Como objetivo específico destaca-se a investigação dos aspectos históricos e arquitetônicos relacionados aos campi federais brasileiros na década de 1980, na esteira das ações de reestruturação e expansão física das universidades, no âmbito do Programa MEC/BID III, coordenado pelo Centro de Desenvolvimento e Apoio Técnico à Educação (CEDATE). A metodologia utilizada se relaciona com o campo dos estudos historiográficos na Arquitetura e no Urbanismo. A busca das fontes secundárias conduziu a pesquisa à Biblioteca da FAU/USP, onde foram coletados 42 artigos nacionais oferecidos pelo Índice de Arquitetura Brasileira e 90 títulos de artigos internacionais dos mais tradicionais periódicos. Conduziu também à UFF, onde foi coletada literatura específica sobre campus universitário e sobre o Programa MEC/BID III. Constituiu também importante fonte secundária a literatura internacional oferecida por Muthesius (2000), Chapman (2006), Turner (1984), De Carlo (2005) e outros do cenário nacional, como Alberto (2003), Cunha (2007) e Rodrigues (2001). As fontes primárias foram privilegiadas por meio de entrevistas com profissionais oriundos do CEDATE, bem como com arquitetos, engenheiros e gestores do processo de implantação do campus da UFJF na década de 1970 e outros atuantes em sua consolidação, na década de 1980. Para a materialização da abordagem, este trabalho apresenta um estudo de caso da Universidade Federal de Juiz de Fora, um campus típico oriundo das grandes implantações dos anos 1960 e consolidado posteriormente, nos anos 1980, por meio do Programa MEC/BID III. Os resultados encontrados ao longo do estudo evidenciam uma profunda identidade e convergência dos processos experimentados na Europa com a experiência vivida no ensino superior brasileiro a partir de meados do século XX.
The campus as a physical support base for mass higher education systems, which was adopted globally from the 1950s, and its historical and conceptual context from the Brazilian point of view have been subjected to very few studies. Following the example of Europe and the United States, due to demographic pressures after World War II and the need for economic development, numerous Brazilian campuses were implemented. In 1975, however, the Proceedings of the First National Seminar on the University Campus Planning already revealed the shortcomings of the new campuses of federal universities, which made it impossible for them to meet the demands of the 1968 University Reform Act. Successive agreements were signed with the International Development Bank for the restructuring of these physical spaces. The last of these, the MEC/IDB III program signed in 1980, allocated USD 105 million to nine federal universities in order for them to expand, fill in the gaps and find solutions for the shortcomings that remained after the establishment of these campuses in the 1960s and 70s. The general objective of this paper is to delve into an issue of major importance for the physical planning of the university space: the consolidation of the campus as international trend even in countries like France, where they didn’t even exist until the 1950s, and Brazil, where until the 1960s the isolated College prevailed. Among the specific objectives stands the inquiry of historic and architectural aspects related to campuses of federal universities due to restructuring and physical expansion activities that occurred within the scope of the MEC/IDB III program in the 1980s, through the actions of CEDATE - Centre for Development and Technical Support in Education. The methodology used is related to the field of historiographical studies in Architecture and Urbanism. The search for secondary sources led the research to the FAU-USP library, which provided 42 national articles offered by the Brazilian Architecture Index and 90 titles of international articles from the most traditional international journals. It also led to the UFF, where specific literature was gathered on university campuses and the MEC/IDB III program. Also were important as secondary sources the international literature offered by Muthesius (2000), Chapman (2006), Turner (1984), De Carlo (2005) and other national publications from such authors as Alberto (2003), Cunha (2007) and Rodrigues (2001). Furthermore, the primary sources were prioritized in this study. Interviews were conducted with professionals from CEDATE as well as with architects, engineers and managers involved in the implementation process of the UFJF campus in the 1970s, and others who worked on its 1980’s consolidation. To put this approach into practice, this paper presents a case study of the Federal University of Juiz de Fora, which is a typical Brazilian campus from the large 1960’s implementations, which was later consolidated in the 1980s through the MEC/IDB III program. The results found during the study show a profound identification and convergence of the processes experienced in Europe with the Brazilian higher education experience since the mid -twentieth century.

Abstract:
The main objective of the study was to analyze the thermal comfort of a naturally ventilated building in Kampala – Uganda. CEDAT building in Makerere University was selected as the case study representing an educational center which is a naturally ventilated building. DesignBuilderEnergyPlus simulation program was used to model and perform simulations. Simulations for thermal comfort were done on the baseline model with a WWR of 30 % to attain the baseline model comfort data based on Simple ASHRAE 55-2004 throughout the year. Simulations for different natural ventilation improvement strategies were then done through parametric analysis. The strategies simulated for improving occupancy thermal comfort were lighting control, mechanical ventilation without cooling (fans), mechanical ventilation with cooling and variation of window to wall ratio from 0% to 100% to establish its effect on the thermal comfort of the building occupants.   Results for predicted thermal comfort sensation of occupants revealed that baseline thermal comfort sensation was between hot and slightly warm with 35.15% discomfort hours against 64.85% comfort throughout the year. Lighting control thermal comfort sensation improved to between hot and neutral with 0.55% improvement in baseline occupancy thermal comfort hours.  Mechanical ventilation without cooling registered a negligible improvement in occupancy thermal comfort while on application of scheduled cooling thermal comfort improved between slightly warm and slightly cool with a 12% improvement in comfort hours. Variation of WWR revealed that thermal comfort generally increased negligible with increase in WWR.    It can be concluded that mechanical ventilation with cooling combined with lighting control can be great strategies and opportunity for improving the case study thermal comfort.

On 1 January 2014 the new Civil Code no. 89/2012 Coll., which affected many areas, came into force. This thesis deals with the changes that have an impact on real estate activities. To the change of the Civil Code no. 40/1964 Coll. an introduction of new Cadastral law no. 256/2013 Coll. is closely related. Influence of this Cadastral law on a real estate practice is also described in this work. The conclusion summary of this work is a mapping of changes and an assessment of the extent to which they affect a real estate practice.

Abstract:
The objective of this thesis is to theoretically and empirically investigate how the changing political and economic institutional environment in Malaysia influences the quantity (CEDQty) and quality (CEDQ) of corporate environmental disclosure in both annual and sustainability reports (ARs and SRs) of Malaysian publicly-listed companies in environmentally-sensitive industries (ESI). It also examines how the explanatory variables modify the relationship between the institutional environment factors and reporting practices. This thesis developed a research instrument (i.e., Corporate Environmental Disclosure Index) based on the international and Malaysian guidelines to analyse the CEDQty and CEDQ of 411 reports by 135 companies in Malaysia for the reporting years of 2006, 2008 and 2014, an important period when substantial institutional changes occurred at both the international and the national levels. Based on institutional theory, and supported by Islamic accountability and resource-based theories, the theoretical framework developed in this thesis conceptually explained factors that drive companies’ responses to institutional pressures resulting from institutional changes, and how those institutional changes have influenced the CEDQty and CEDQ practices by Malaysian companies over time. The theoretical framework of this thesis was then empirically tested using a mixed qualitative and quantitative method. The empirical models applied the Generalised Estimating Equation (GEE) approach in recognition that panel data is used. Depending upon whether it was CEDQty or CEDQ and whether it was aggregated or individual reporting items analysed, a multivariate linear regression, binary or ordinal logistic regressions technique was used. The model developed incorporated multi-levels of institutional analysis comprising the international and Malaysian environment, along with company-specific characteristics of Islamic influence, corporate governance, financial performance and other control variables. The findings reveal that institutional changes, the non-government institutional ownership and women on boards are strong drivers for CEDQty, whereas institutional changes, female Chairperson, the non- government institutional ownership and women on boards are strong drivers for CEDQ in the Malaysian context. This thesis has multiple implications. Firstly, it offers insights into CEDQty and CEDQ practices over time in both ARs and SRs in a developing economy by focusing on Malaysia using panel data analysis. Secondly, it adds support to an application of institutional and resource-based theories, and limited support for Islamic accountability as a valid theoretical framework for the Malaysian context. Thirdly, this thesis introduces new variables of Islamic influence and corporate governance within the CED research. Finally, the findings of this thesis should be useful to the Malaysian ESI companies, regulators, accounting professions and other institutions in understanding current CEDQty and CEDQ practices so as to further increase these practices in the future.

Superficies solo cedit The topic of the presented diploma thesis is the principle of superficies viewed from its historic development and its place in current law. The principle stipulates that whatever is found on a land or has arisen from it, becomes parts of it. The superficies principle has been in employment since ancient Rome and has been reintroduced in our legal system after the recodification of private law in 2012 The thesis begins with the historical development of the superficies principle not only in Roman law, but also in the Czech lands, especially with its 1811 AD codification in AGBG. The historical development is followed by a brief description of the departure from the superficies principle following political and societal changes in post-war Czechoslovakia. This principle is gowerning the ownership of the land and is closely linked to the legal institutes as component parts, immovables, the right of superficies.. According to this principle, buldings and plants form part of the main legal object, which is land the superficies solo cedit principle leads us to the ancient Rome, which has been giving complex legal base to the current continental system of law untill nowadays. Therefore I dedicate my first chapter to the origin of the principle in roman law. Second chapter is dedicated to the ABGB Code, which is basicly inspired by roman law and as itself is the main source of the new Civil Code Nr. 89/2012 Sb. New civil code is the core of this thesis. Above all because it reestablished the superficies solo cedit principle and after many years brought it to life. Reestablishment of the principle has uncountable consequences not only in the area of private law. PRINCIPLE OF SUPERFICIES SOLO CEDIT This thesis focuses on the superficies solo cedit principle, which can be translated as "the surface yields to the ground". The principle originated in Roman law and is projected into legal systems of most of the European democratic countries until today. According to this principle, everything firmly attached to the ground or grown on the land is component part of the land. Therefore, plants and structures are considered as typical component parts of the tract of land. The owner of the tract of land simultaneously and automatically owns its component parts. All dispositions regarding the tract of land must include the component parts, as component parts are not separate objects of law. This thesis deals with the evolution and regulation of the superficies solo cedit principle in Roman law, as well as in legal orders valid on the Czech territory until now. This diploma thesis deals with the principle of superficies solo cedit, whose roots go back to Roman law. The principle, which can be translated as "the surface gives way to the ground", expresses the rule according to which the land includes everything that arises on it, whether in a natural or artificial way. In the history of the Czech lands, the principle was applied under the General Civil Code from 1811 until the adoption of the Civil Code of 1950. On the contrary, this Code applied the opposite principle and thus introduced separate ownership of land and buildings. The principle returned to our legal system with the adoption of Act No. 89/2012 Coll., The Civil Code. The aim of this thesis is to present the principle in a historical context, to give an explanation of its current form and to specify the problems that arose with the adoption of the principle of superficies. This thesis is focused on the superficies solo cedit principle which was already known in Roman law and which expresses the rule that the surface yields to the ground. As a result of this rule, everything that is built on the land and that grows up naturally there belongs to the owner of the land. The aim of the thesis is to describe origin and historical development of the superficies solo cedit principle, subsequently to present its current expression in the legal order of the Czech Republic and to identify its problems, and, finally, to point out the effects of the restoration of the superficies solo cedit on the Czech legal system. The thesis is divided into seven separate chapters. Chapter One describes the expression and development of the superficies solo cedit principle in the Roman law. Chapter Two particularly deals with the ABGB Code from 1811 which was valid in the area of today's Czech Republic until 1950 and which significantly influenced the current Czech Civil Code. This chapter also includes analysis of provisions dealing with superficies solo principle and other relating terms, some of which were an inspiration for current Czech legislation. The aim of the thesis is to describe the concept of the superficial principle in the valid legal regulation and its influence on land law relations. As a result of the reintroduction of the superficial principle into the legal order of the Czech Republic by Act No. 89/2012 Coll., The Civil Code, all that is associated with the earth's surface becomes part of the given land. The thesis is divided into five structured chapters. The first chapter is devoted to land law as an interdisciplinary law system. The aim of second chapter is to explain the key importance of the superficial principle within the context of land law. The third chapter deals with the historical background of the development of legal relations to immovables in the territory of the Czech lands, also including the introduction of the Roman settlement as the basis of the superficial principle. The next part of the thesis contains the interpretation of the most important legal institutes related to the superficial principle in the context of the valid law. The chapter further describes exceptions to the principle. The fifth part of the thesis is focused on the analysis of selected land law relations influenced by the superficial principle.

The topic of this thesis is the return of the legal principle of superficies solo cedit into the Czech legal order. The thesis aims at the comprehensive overview and the analysis of the issue of this principle based on its inclusion both in the historical and contemporary context. Another objective of this thesis is to look at the registration of the principle, including related institutes, into the public register - the cadastre of real estates. This thesis is divided into three parts. The first part of this thesis follows the development of the superficial principle across the history, including the comparison of its use in given legal orders. This section begins with a glance at Roman private law and its selected institutes which have been incorporated into modern Czech private law by the reception of Roman law. The room will be also given to the law of the Habsburg monarchy and the provisions of the ABGB, civil code that has been valid on our territory until the 1950. The topic of the diploma thesis is the legal principle superficies solo cedit and its return into the Czech law. The main aim of this thesis was to give a comprehensive view of this issue, especially how the return of the principle has changed land law relations. The first part of the thesis describe the division of the law to private law and public law. The first part is followed by the historical excursion which describes how the principle originated and how and whether it was part of the legal order in the past. The next chapters of the thesis are the main part of the work and describes the principle in todays law. Firstly the incorporation of the principle into the Civil Code is described and then individual paragraphs governing the principle follows. The definition of the basic terms as land, construction and temporary construction which are used by Civil Code but not described in it are the topic of next chapter. Renewable and alternative energy technologies have become increasingly popular in Ontario over the last few years. Part of this increase has been from the Feed-In-Tariff incentive that pays Ontarians an amount per kWh generated by some of these technologies onto the central electricity grid. Between residential, commercial and agricultural settings, agriculture operations and locations offer an abundance of resources that make renewable energy systems attractive. The big question being asked by Ontario farmers is what renewable or alternative energy technology is best or most economical for their particular location and operation? The solution to that question is the Complimentary Energy Decision Support Tool (CEDST). This application combines Solar Photovoltaic, Wind Turbine, Geothermal, Anaerobic Digester, Solar Thermal and Energy Conservation calculators into one tool that compares the feasibility of each technology. This thesis specifically presents the development of the CEDST platform which is used as the delivery method for each of the individual calculators, the creation of the Solar Photovoltaic calculator and methodology behind determining if a solar photovoltaic system is a feasible solution, as well as, the integration of all the other individual calculators developed by the rest of the CESDT team into the CEDST platform.

Comparison of building legislation according to current and new Civil Code In my master's thesis I focus on building legislation according to the Civil Code. The building, either as a separate thing or part of other things, is mainly the subject of ownership, but also of other civil relations. Therefore it is very widely used and discussed concept. The main goal of the thesis is to describe in detail concept of building in the current Civil Code, with focus on shortcomings and the most problematic areas, and confront it with changes in the new Civil Code. The purpose is also to provide summary of building issues and possible advantages or disadvantages its enactment in the new Civil Code. I mainly concentrate on different division of things and problems with definition of the term building, which apply to specific examples. O presente relatório de estágio, realizado no âmbito do Mestrado em Ciências da Comunicação – área de especialização em Publicidade e Relações Públicas, reflete o estágio curricular desenvolvido no Centro de Excelência em Desmaterialização de Transações (CEDT), uma associação sem fins lucrativos, constituída por Empresas, Universidades e Centros de Investigação e Desenvolvimento Tecnológico e que se identifica como uma rede de competências com atuação no domínio da desmaterialização de transações. Neste seguimento, afigurou-se pertinente refletir de forma crítica e sustentada sobre as redes de cooperação interorganizacionais e no papel que a comunicação, em particular a comunicação estratégica, ocupa na gestão destas redes, com base no estudo de caso do CEDT. De facto, as redes de cooperação entre organizações, no decorrer das constantes e aceleradas transformações económico-sociais, encontram-se em franca proliferação por todo o mundo. Fazer parte de uma rede de cooperação reflete-se não só em ganhos para as organizações (que dela fazem parte), como também para o território onde se inscreve. De todo o modo, o assunto encerra complexidades. Acresce que é inegável a importância da comunicação para as organizações, na medida em que como organismos vivos é-lhes impossível não comunicar. Contudo, nem todas pensam a comunicação como uma ferramenta estratégica, capaz de possibilitar respostas ágeis e resultados organizacionais surpreendentes. Ora, para as redes de cooperação interorganizacionais, que são compostas por diferentes e variadas organizações, cada uma das quais com estratégias, códigos, símbolos e culturas próprias e distintas, o papel da comunicação, em particular o da comunicação estratégica, adivinha-se ainda mais essencial. Aliás, a própria noção de rede de cooperação está intimamente ligada à comunicação, pois é através dela que os membros da rede se ligam entre si. Assim, partindo da experiência de estágio procura-se compreender o papel da comunicação estratégica na gestão das redes de cooperação interorganizacionais, com incidência no caso do CEDT. Pelo que é realizado um estudo empírico com o intuito de perceber a importância e o papel que os membros organizacionais, desta rede, atribuem à comunicação.
This present internship report conducted within the Master’s in Communication Sciences - specialization in Advertising and Public Relations - reflects the curricular internship developed at the Center of Excellence for Dematerialization of Transactions (CEDT), a non-profit organization formed by Companies, Universities and Centers of Research and Technological Development which identifies itself as a network of expertise in dematerialization of transactions. In this follow up it was thought pertinent to reflect in a critical and sustained matter on interorganizational cooperation networks and on the role that communication, in particular strategic communication, plays in the management of these networks, based on the case study of CEDT. Indeed, cooperation networks between organizations in the course of the constant and accelerated economic and social transformations are in open proliferation worldwide. Being part of a cooperation network is reflected not only in gains for the organizations (which are part of it), but also for the territory in which it is based. In any case the issue is not as simple as one might think from the outset. In any case, the matter involves several complexities. Moreover, it is undeniable the importance of communication for the organizations, in the extent that as living organisms it is impossible for them not to communicate. However, not all think that communication is a strategic tool, capable of providing rapid responses and amazing organizational outcomes. Nevertheless, for interorganizational cooperation networks that are composed of organizations with strategies, codes, symbols and own distinctive cultures, the role of communication, in particular the strategic communication is even more essential. In fact the very notion of cooperation network is closely linked to communication, because it is through the network that the members are bound together. As a result of the experience acquired during the internship, we seek to understand the role of strategic communication in the management of interorganizational cooperation networks with focus on the CEDT case. And so an empirical study was carried out in order to understand the importance and the role that organizational members, of this network give to communication.

Abstract:
The Complimentary Energy Decision Support Tool (CEDST) was conceived to be a renewable energy calculator designed specifically for rural sites and agricultural operations in Ontario, though could easily assess urban sites as well, and equipped with the ability to compare the feasibility of different technologies. The Wind Energy Calculator (WEC) component of the CEDST project was the focus of this thesis and was developed since research revealed no current wind prediction tools that met CEDST needs. Verification of WEC predictions found prediction accuracy to have bounds of +/- 60% on actual turbine energy production and was equivalent to the actual generation for 21% of cases. The discrepancy could have resulted from unusual annual wind speeds, which had no significant impact on project economics when analysed. Many cases revealed that 10 kW turbines are not feasible projects under the Feed-in Tariff program and that turbines begin to become economical around 35 kW.

The topic of this thesis is the superficiary right of building (and other possibilities of building on the land belonging to a third party, though the focus is primarily on the institution of the superficiary right of building). The principle "superficies solo cedit" was reintroduced in Czech legislation when the new Civil Code (Act No. 89/2012, Coll.) came into force. Along with this principle, the institution known as superficiary right of building has also returned to Czech law after a hiatus of more than 50 years. This thesis seeks to provide a comprehensive interpretation of the superficiary right of building, to explain the individual rights and obligations arising from the superficiary right of building, and to compare the institution of superficiary right of building to other possibilities of erecting a building on land which belongs to someone else. The first chapter defines some of the basic concepts which facilitate the explanation of individual issues and the understanding of certain connections in the following chapters. Hierdie proefskrif handel oor aspekte van inaedificatio (bebouing) in die Suid-Afrikaanse, Engelse en Nederlandse reg. Die klem val op die maatstawwe wat aangewend word om te bepaal of aanhegting van ‘n roerende saak aan ‘n onroerende saak plaasgevind het. Die maatstawwe in die drie stelsels toon ooreenkomste en verskille. Een ooreenkoms is dat die graad en wyse van aanhegting in die Suid-Afrikaanse reg oorweeg word, terwyl daar in die Engelse reg slegs na die graad van aanhegting gekyk word. In die Nederlandse reg word ’n duursame verbinding vereis om te bepaal of bestanddeelvorming plaasgevind het, en word gevra of verwydering van die saak sonder beskadiging kan plaasvind. In die Suid-Afrikaanse reg word die doel van die aangehegte saak oorweeg, hoewel Innes HR dit nie in MacDonald Ltd v Radin NO & The Potchefstroom Dairies & Industries Co Ltd so formuleer nie. Die aard van die roerende saak word in die Suid-Afrikaanse reg oorweeg, terwyl die aard en ontwerp van die roerende saak in die Nederlandse reg oorweeg word. In die Engelse reg word die doel waarvoor die aanhegting gemaak is oorweeg om die bedoeling met die aanhegting te bepaal. Die vraag is of die saak vir die permanente en substansiële verbetering van die gebou (grond) aangeheg is, of vir ’n tydelike doel of vir die beter benutting van die chattel. Die Nederlandse reg beklemtoon die bestemming van die aanhegting. Die opvallendste verskil tussen die Suid-Afrikaanse reg en die ander twee stelsels is die belang van die subjektiewe bedoeling van een of ander betrokkene. Die regsposisie van huurders wat sake aanheg verskil van dié van ander aanhegters. In al drie regstelsels kan huurders voor afloop van die huurtermyn sommige aangehegte sake verwyder, mits die huurgrond in dieselfde toestand gelaat word as waarin dit was voor die aanhegting. Die drie stelsels vertoon verskille soos dat onsekerheid bestaan oor wie die eienaar van die aangehegte sake is voor verwydering. In die Engelse reg heg bedryfsaanhegtings en ornamentele aanhegtings, nie aan nie. Ingevolge die Nederlandse reg is die verhuurder gedurende die huurtermyn eienaar van die aanhegtings, aangesien aanhegting plaasvind sodra die roerende sake aan die huurgrond heg. Die Suid-Afrikaanse reg hieroor is onduidelik.
This thesis deals with aspects of inaedificatio (building) in South African, English and Dutch law. The emphasis falls on the criteria that are applied to determine whether attachment of a movable to an immovable thing occurred. The criteria in the three systems show similarities and differences. One similarity is that in South African law the degree and manner of attachment are considered, while in English law only the degree of attachment is considered. To determine whether one thing became a component part of another thing (bestanddeelvorming) a durable connection is required In Dutch law. The question is whether removal can take place without causing damage. The purpose of the attached thing is considered in South African law, although Innes CJ did not formulate this criterion in this manner in MacDonald Ltd v Radin NO & The Potchefstroom Dairies & Industries Co Ltd. The nature of the movable thing is relevant, while the nature and design of the movable thing are considered in Dutch law. In English law the purpose of the attachment is considered to determine the intention with the attachment. The question is whether the thing was attached for the permanent and substantial improvement of the building (land) or for a temporary purpose or for the better use of the chattel. The destination (bestemming) of the attachment is considered in Dutch law. The most significant difference between South African law and the other two systems is the importance of the subjective intention of some person involved in the situation. The legal position of lessees who attach movales differs from that of other persons who make such attachments. In all three legal systems lessees may remove certain attached movables before the expiry of the term of lease as long as the leased land is left in the same condition that it was in before the attachment. The three systems also differs for example it is not certain who the owner of the attached things is before removal of the attachments. In English law trade and ornamental fixtures do not attach. In Dutch law the lessor is the owner of the attachments during the term of lease, because attachment takes place when the movable things are fixed to the leased land. The position in South African law on this is unclear.
