As Professor Wade rightly reminds us : « The powerful engines of authority must be prevented from running amok ». The control of the legality of administrative action by the ordinary courts prevents such action being arbitrary or unreasonable. But in sitting in judgment upon the administration, does not the judge risk usurping the role of the administrator ? This is a real misgiving which many authors share : they complain of « Government by judges ». The present article (based upon a public lecture delivered at Laval University in October 1983) considers this aspect of judicial control, especially in relation to certain recent decisions of the English superior courts.

Résumé Bien qu’elle ait été élevée au rang de stratégie militaire par les chefs d’État lors de la Première Guerre mondiale et qu’elle ait été l’une des premières mesures instaurées par les autorités canadiennes lors du déclenchement des hostilités, la censure de la presse demeure pourtant peu étudiée. De 1914 à 1918, les journalistes canadiens sont aux prises avec les exigences, les récriminations et les sanctions du censeur. L’article qui suit examine spécifiquement les réactions des journalistes canadiens-français face à l’application d’une mesure visant à réduire leur droit de s’exprimer librement. La censure s’intensifiant au fur et à mesure que l’effort de guerre canadien est remis en question, les journalistes d’expression française réagissent de manière parfois contradictoire et oscillent entre la collaboration volontaire et la résistance active.

Cependant, entre les années vingt et les années soixante, des mutations formidables amènent le clergé à composer avec l'État, un partenaire qui s'attaque entre autres au cinéma et aux Comic books, tandis que s'affirme progressivement un pouvoir laïc qui s'opposera résolument au contrôle de la pensée. Or, avant la Révolution tranquille, quelles ont été les phases de l'effritement du pouvoir ecclésiastique? Peut-on identifier l'émergence d'un nouveau discours, d'un nouvel ordre des choses? Mais surtout, où trouver un témoin fiable de la période entre 1920 et I960? C'est au moyen de l'étude de quelque 300 articles touchant la censure dans le journal Le Devoir que cet article tente de répondre à ces questions et, surtout, de proposer un cadre d'interprétation de cette période, fondé sur deux grands paradigmes, dogmatique et promotionnel.

La censure sur laquelle se penche cette dissertation prit corps dans une institution fondée en 1768, la Real Mesa Censôria, qui mit fin aux droits de la censure de l'inquisition et des évêques, abolit la juridiction au Portugal de l'Index Romain des livres interdits et expurgés, et chargea un groupe restreint de censeurs sous contrat et payés par l'état d'examiner tous les textes en papier manuscrits et imprimés. Ces censeurs, que nous suivrons jusqu'à la fin du règne de José I et du mandat de Pombal comme ministre du roi en 1777, clôturaient le plus souvent leurs rapports avec la démonstration que le texte en analyse était « digne » ou « indigne de la lumière publique ». Il s'agit d'une expression extrêmement révélatrice ; elle porte en elle une charge historique importante, qui met enjeu ce trinôme "dignité", "lumières" et "publique" si paradoxale dans la plume d'un censeur, en utilisant des mots les plus significatifs que le XVIIIème siècle ait légué à la postérité. Ce qui nous pose une question plutôt dérangeante : nous avons pris l'habitude de penser les censeurs comme étant les grands ennemis des Lumières et voilà que nous les rencontrons comme ses co-bâtisseurs ? L'histoire de la censure est aussi l'histoire des régimes de pouvoir et de connaissance. La censure dépend, en grande mesure, non seulement du pouvoir, mais aussi de la connaissance ; elle partage avec le savoir de son époque des informations, des concepts, des formes mentales, des pratiques intellectuelles ; serait-il alors possible que la censure du XVIIIème siècle partage avec les Lumières des éléments tellement centraux que l'on pourrait la considérer davantage comme une censure éclairée que comme une censure anti-Lumières ?
The kind of censorship that is the focus of this dissertation took shape in an institution founded in 1768 in Portugal, the Real Mesa censoria, with which the rights of censorship of the Inquisition and the bishops were abolished and the jurisdiction of the Roman Index of banned and purged books terminated. A small group of censors, hired and paid by the state, was charged to examine ail the texts either manuscript or printed, in the kingdom and its dominions. These censors, whom we will follow until the end of the reign of José I and the of the mandate of the Marquis de Pomba as minister of the king in 1777, usually finished their reports with a démonstration of whether the text in analysis was "worthy" [digno] or "unworthy of the public Light". This is an extremely revealing expression as it carries an important historié signifîcance, which involves the triad "dignity", "Enlightenment" and "public", so paradoxical in the pen of a censor, using the more significant words that the eighteenth century bequeathed to posterity. Which warrants a rather disturbing question: we have become accustomed to think that the censors were the greatest enemies of the Enlightenment and now we meet them also as its builders ? The history of censorship is also the history of régimes of power and knowledge. Censorship dépends to a large extent, not only on power, but also on knowledge, sharing with the knowledge of its time information, concepts, mental forms and intellectual practices. Would it be possible that the censorship of the eighteenth century has shared with the Enlightenment so many key elements that it could be regarded more as an enlightened censorship than as an anti-Enlightenment censorship ?

Au Gabon, le Censeur de vie scolaire (CVS) est nommé en Conseil de Ministres. C’est une fonction qui suscite un certain nombre de préoccupations au regard de l’environnement entropique dans lequel elle s’exerce, de sa méconnaissance et incompréhension par les différents acteurs et surtout à cause de l’inexistence d’un cadre institutionnel et fonctionnel clairement défini. L’environnement entropique pose la question des valeurs dont l’élève est imprégné et celle du pragmatisme éthique du CVS, vu qu’il a la responsabilité de donner aux élèves la capacité de « s’élever » eux-mêmes sur les plans physique, intellectuel, moral, mental et pourquoi pas spirituel. Par une approche de l’étendue du mouvement profond de l’éthique, de la responsabilité vocationnel, par des valeurs caractéristiques, il a été possible de comprendre, à travers l’analyse du contenu des entretiens avec les sujets, l’éthique des sujets. C’est une éthique aux variations et vibrations fréquentielles faibles, propres à chaque sujet. Elle présente aussi des convergences vers une transversalité à tous les sujets. A cette éthique, nous proposons une amélioration de l’environnement de travail des sujets tout comme une croissance et un dépli de leur ipséité professionnelle. Nous entrevoyons de mettre l’instabilité et la faiblesse des interactions des sujets au profit d’un mouvement réenchanteur de leur réalité, par l’action non intentionnelle. Les sujets pourraient se défaire du moi observateur pour accepter l’instabilité qu’occasionne le changement constant de ce moi
In Gabon, the deputy Head master in charge of life and discipline reaches that function after a nomination decided in a council of ministers. This function raises some concern related to the entropic environment in which the activity is practiced.The entropic setting with reference to the learner raises the question of the values the latter is marked with. As for the function of deputy headmaster in charge of school life and discipline, the concern is that of his/her ethical pragmatism, given that he/she has the duty to conduct the training of the pupils while giving them the opportunity to “arise” physically, intellectually, morally and if possible, spiritually. As for the approaches in this dissertation, we dealt with the complexity of the deep movement of ethics, the responsibility at vocational and meta-levels and that of specific and contextual values that have been identified through the analysis of the interviews the pupils have been submitted to and which are recorded as ethics of the target audience. It is an ethics whose variations and weak frequencial variations are specific to each person.At the individual level, every deputy headmaster in charge of school life and discipline should reach a growth and a depli of his/her professional ipseity. Beyond the individual ethics, our aim in proposing an improvement of the working environment is to use the instability and the weakness of the subjects’ interactions as unintentionally favoring elements of their reality. The subjects can therefore get rid of the consciousness of their observing ego, to adopt the instability caused by a constant change of standpoint

A la déclaration de guerre en septembre 1939, la censure est rétablie sous le contrôle des militaires pour empêcher les critiques de la politique du gouvernement et encadrer les informations militaires. Les bureaux de la censure s'installent à Pau et contrôlent la presse départementale. Après l'armistice, la censure passe aux mains des civils et se structure dans le cadre d'une organisation régionale, dépendant d'une censure centrale à Vichy. En novembre 1941, la nomination à Pau d'Henri Peyre durcit le contrôle de presse. Les conflits se multiplient avec les trois quotidiens : Le Patriote, l'Indépendant et France Pyrénées. Le censeur transforme ses services en une officine de propagande et de délation. Il surveille de très près la vie publique et culturelle avec beaucoup de zèle. A la Libération, les journaux palois passent en jugement et disparaissent, le censeur est condamné à dix ans de travaux forcés
Following the declaration of war in September 1939, censorship is reestablished under the control of military forces to prevent people from criticizing the government’s policy and to regulate the communication of military information. Censorship offices settle down in Pau and check the departmental press. After the armistice is signed, censorship falls into the hands of civilians and forms itself under a regional organization which depends on the central censorship office in Vichy. In November 1941, when Henri Peyre is nominated in Pau, measures to monitor the press are strengthened. There are increasing numbers of conflicts involving the three daily newspapers: Le Patriote, l'Indépendant and France Pyrénées. The censor transforms his services into a propaganda and informing outlet. He closely monitors the public and cultural life with great zeal. After the liberation, newspapers in Pau stand trial and disappear. The censor, in turn, is sentenced to ten years of forced labour

Abstract:
The aim of this bachelor’s thesis is to examine parents’ and librarians’ views on censorship in children’s library. Similarities and differences between the opinion of librarians, and parents with children in the age of 0 to 12 years, have been examined. To analyse the result Jürgen Habermas’ theory of lifeworld and system has been used, together with research, mostly from USA, about censorship of children’s library. There is not much research available on censorship at children's libraries in Sweden, instead newspaper articles on controversial children's literature have been used in this paper to shed light upon the current Swedish views on censorship in children's libraries. Qualitative interviews with two librarians, working in the children’s library, and two parents, with children who visit the children's library regularly, were made. In summary, the research shows that there are actually not many differences in opinion of censorship in children’s library between the parents and librarians. A new question arises: why do we have a discussion in media about censorship of children’s library, when the respondents of this research think the controversial books should not be moved. And is it coincidental that all our respondents shared the same view on censorship of children's literature, or is it the common opinion among children's librarians and parents of younger children in Sweden?

A presente tese se insere no esforço teórico recente de reconceituar a censura, para além dos modernos estreitamento semântico e conotação negativa associados à palavra. Para tanto, partindo da premissa metodológica benjaminiana de que o saber exige uma integração de áreas, a pesquisa aqui apresentada se deu em múltiplos fronts: os casos de censura durante a ditadura militar brasileira e o discurso oficial que a fundamentava; a formulação da censura pela teoria política moderna; o caso clássico do banimento dos poetas da República de Platão; a reivindicação da função censora por artistas e jornalistas; a magistratura do Censor da Roma antiga; o conceito psicanalítico de censura; a relação entre censura e direitos autorais, etc. A investigação produziu como resultados tanto uma visão sincrônica da censura, em que esta aparece como suplemento constitutivo da lei que age sobre os costumes, com-formando os sujeitos (no duplo sentido) a uma hierarquia do sensível, quanto um olhar diacrônico a respeito dela, em que o atual processo de eufemização da linguagem apresentou-se como a estratégia censória de um tempo que prescinde de órgãos censores propriamente ditos.
In the past decades, a theoretical effort has been made in order to re-conceptualize "censorship", avoiding the semantic narrowing and negative connotation that modern views have associated to the word. This thesis takes part of that initiative, subscribing Walter Benjamin's methodological project, according to which knowledge demands an integration of research fields. Therefore, multiple fronts are taken into account: censorship in recent Brazilian dictatorship and the official discourse that supported it; conceptualization of censorship in modern political theory; the classic topos of Plato's banishment of poets in his ideal Republic; demands of censorship made by artists and journalists; the functions and roles of antique Roman's Censor magistrate; psychoanalytic conception of censorship; the relationship between censorship and copyright; etc. According to the results of our research, censorship can be conceived synchronically, as a constitutive supplement of law, which acts upon customs, con-forming subjects to a hierarchy of the sensible, as well as diachronically, consisting nowadays in a broad process that euphemizes language, a censorial strategy of a time that pretends to prescind from formal censorship institutions.

Reuniram-se para esta edição quatro textos, a saber: A Chegada de Lampião no inferno, Antônio, meu santo, Felismina engole-brasa e Quem não morre num vê Deus, a partir de três critérios: textos adaptados da literatura de cordel, com mais de um testemunho, produzidos no período da ditadura militar na Bahia, e, portanto, submetidos ao exame da Censura. Apoiando-se nos pressupostos teórico-metodológicos da Crítica Textual, procedeu-se ao estudo e a edição dos textos teatrais selecionados. Abordaram-se aspectos relacionados ao autor, João Augusto, e à sua produção literária dramática. Para tratamento do tema escolhido, adotouse o método filológico empregado para a edição dos textos, através do cumprimento das etapas que se seguem: recensio, collatio, emendatio, stemma codicum, constitutio textus. The research focused on the issue of censorship on Facebook, verify the existence of this censorship and its nature, how this censorship is made and justified to users, how the American social network treats the content published by its users, censorship cases were searched on the EFF website (Eletronic Frontier Foundiation, an American civil rights organization such as freedom of expression on the internet, the survey touched on important Internet issues such as privacy, mass surveillance by governments and the private sector. censorship found range from activists of black movements censored by the denunciation of racist messages they receive, journalists who have been censored for reasons ranging from the disclosure of documents on political scandals or war crimes, research using the terms in their version of the year of 2015, every user entering a social network on the internet had to agree with the terms and privacy policy, the terms under which conditions a publication may be withdrawn
A pesquisa se debruçou sobre a questão da censura no Facebook e sobre a verificação da existência dessa censura e sua natureza, além de como essa censura é feita e justificada aos usuários. Houve um questionamento de como a rede social americana trata o conteúdo publicado pelos seus usuários. As consultas sobre os casos de censura foram realizadas no site da EFF (Eletronic Frontier Foundiation), organização americana que milita pelos direitos civis como a liberdade de expressão na internet. A pesquisa percorreu questões importantes para a internet como a privacidade, vigilância em massa feita pelos governos e pelo setor privado. Os casos de censura encontrados variam desde ativistas dos movimentos negros censurados pela denúncia de mensagens racistas que recebem e jornalistas que foram censurados por motivos que vão desde a divulgação de documentos sobre escândalos políticos ou crimes de guerra. A pesquisa concordou com a utilização dos termos em sua versão do ano de 2015 tendo em vista que os termos atuais foram divulgados na fase de finalização desta pesquisa, portanto não seria possível analisá-los. Todo usuário ao entrar em uma rede social na internet teve concordar com os termos e a politica de privacidade, os termos colocam em quais condições uma publicação pode ser retirada

Abstract:
In what French philosopher Gilles Deleuze labelled Control Societies, mechanisms reminiscent of censorship – that is, restriction of information that administrators of power wish to regulate the spreading of – are present in the concept of copyright. This kind of censorship has theadvantage of not being scrutinized by public eyes in the way that the work of institutionalized censorship agencies such as the Swedish Statens Biografbyrå was. It is not unlikely that expanded possibilities for punishing anyone who spreads copyrighted material will result in larger and larger areas that may not be accessed, as the avoiding of conflict and repressive actions will emphasize the behaviour to take detours around information that is deemed taboo and therefore suspicious and dangerous. The ACTA trade agreement is one proposed tool for such extended possibilities for punishment. This essay does not however claim that copyright and censorship are the same – but rather that the institutional execution of power that was previously a matter of state censorship has a lot of similarities with current and prognosticated application of copyright laws by corporations. While claiming to protect the individual, the disciplinary power executed actually aims to protect the one executing it; the purpose of the power structure is to replicate itself.

Abstract:
This paper is a research review in the realm of censorship systems andfiltering systems. It applies ethical considerations to the creation of censorshipsystems bringing forward discussion on the ethics of technology with thepurpose of limiting access to information.There is active research being done in the area of automatic content filteringand censorship systems. These are systems that can filter out undesiredmaterial, typically from the Internet, automatically. Used in some nations,many schools and even mandated in some libraries there are many ethicalquestions raised concerning censorship and access to information.Part of the review concerns the level of accuracy of these systems presentedby researchers in the field and the different approaches used. Reviewedarticles centre around automatic content classification and filtering ofpotentially harmful materials with regards to minors while some relate tocensorship technology in a wider sense.Results show a general lack of discussion concerning the ethics of thetechnology in the research reviewed. Most of the filtering systems underdiscussion are concerned with pornographic material. The existence of somekind of moral guidelines are often implied but hardly explored explicitly ordefined. The most common techniques are intelligent content filters in theforms of textual or visual analysis and increasingly both combined. Resultsindicate a high reliability for filtering pornography and significantly lowerresults for other domains.

Abstract:
Controlled Query Evaluation (CQE) is a confidentiality-preserving framework in which private information is protected through a policy, and a (optimal) censor guarantees that answers to queries are maximized without violating the policy. CQE has been recently studied in the context of ontologies, where the focus has been mainly on the problem of the existence of an optimal censor. In this paper we instead consider query answering over all possible optimal censors. We study data complexity of this problem for ontologies specified in the Description Logics DL-LiteR and EL_bottom and for variants of the censor language, which is the language used by the censor to enforce the policy. In our investigation we also analyze the relationship between CQE and the problem of Consistent Query Answering (CQA). Some of the complexity results we provide are indeed obtained through mutual reduction between CQE and CQA.

Abstract:
This report describes publicly available data sets and quantitative analysis that local communities can use to evaluate environmental justice concerns associated with pipeline projects. We applied these data and analytical methods to two counties in North Carolina (Northampton and Robeson counties) that would be affected by the proposed Atlantic Coast Pipeline (ACP). We compared demographic and vulnerability characteristics of census blocks, census block groups, and census tracts that lie within 1 mile of the proposed pipeline route with corresponding census geographies that lie outside of the 1-mile zone. Finally, we present results of a county-level analysis of race and ethnicity data for the entire North Carolina segment of the proposed ACP route. Statistical analyses of race and ethnicity data (US Census Bureau) and Social Vulnerability Index scores (University of South Carolina’s Hazards & Vulnerability Research Institute) yielded evidence of significant differences between the areas crossed by the pipeline and reference geographies. No significant differences were found in our analyses of household income and cancer risk data.
