Abstract:
This work is engaged with dependence of the Czech economy on the development of the German economy. At first, it describes the theoretical basis for the balance of payments, its elements and factors affecting the balance of payments. The practical part consists of a comparative analysis of Czech and German balance of payments, which is followed by a regression analysis, which purpose is to determine the dependence of the Czech economy to German one. The work also deals with the dependence of individual sectors of these economies to each other and outlines the resultant benefits and risks.

Život existuje ve změnách. Buď se vše pozitivně vyvíjí nebo pro neschopnost realizace změny zaniká. Proto je změna podnětem pro vznik nových cest, nově realizovaných projektů v podnikové oblasti. Podniky hledající nové a efektivnější způsoby řízení, jejichž výsledky přinesou subjektu vyšší zisky, se zaměřují na inovaci zejména podnikových procesů a portfolia výrobků. Jedním z nejzásadnějších, ale zároveň nejnáročnějších úkolů managementu podniku, je změna způsobu práce zaměstnanců podniku a jejich přístupu k projektům s cílem zvýšit výkonnost podniku jako celku. Výsledky práce lidí jsou ovlivněny mnohokráte potvrzeným rčením Tomáše Bati: ?Největší zlepšení v produktivitě není dosaženo změnou technologie a organizace. Skutečné skoky v produktivitě je možné dosáhnout jen v hlavách a srdcích lidí?

Abstract:
The thesis compares national legal regulations in area of E-Commerce in Austria, Germany and the Czech Republic. The comparison has been made from several points of view. The first section of the thesis focuses on the area of incorporation of three European directives (93/13/ES on unfair terms in consumer contracts, 97/7/ES on the protection of consumers in respect of distance contracts and 2000/31/EU on electronic commerce), which frame consumer protection on the European level in respect of e commerce contracts. In the next section basic principles of contract law are compared in each of the surveyed legal systems. Each of the contract related conditions are compared step by step to their partner conditions in the other two countries (general terms and conditions, information duty of entrepreneur, consumer's right of withdrawal). The very last section covers an international civil law, and its effects on consumer protection as analyzed in compared nations. The comparison has proved my primary assumption that all three legal systems in the area of E Commerce almost identical, aside from the major difference in the definition of the term consumer itself.

This diploma thesis aims to compare the enactments of German GmbH and Czech s.r.o. (i.e. limited liability companies or private companies limited by shares). The introduction describes the historical evolution till today and defines the main differences in the Czech and German legal interpretations of the place of business, statutory body, registered capital, company shares, etc. Furthermore accounting principles and essential requirements of financial statements are discussed. The reader can find mandatory forms of financial balance sheets and profit and loss reports according to the German Commercial Law and the Czech ministerial regulation No. 500/2002 in the thesis appendix. The last part mentions basic tax liabilities of GmbH and s.r.o.

Abstract:
The Czechs and Germans have been neighbours in the Central Europe since centuries. Due to the course of history, some discrepancies might be still present in the mutual Czech-German relations. To solve these historical issues, a "Czech-German declaration" was signed in 1997. The main task of this thesis is to analyse the Czech-German relations after the signature of the declaration. The German point of view is stressed while dealing with the topic. The first chapter explains the development of the Czech-German relations since founding of the Czechoslovakia in 1918 until the signature of the Czech-German declaration. The second chapter deals with the declaration itself. The third chapter refers to the detailed analysis of the Czech-German relations on both -- the bilateral and multilateral levels. On bilateral level, the political, business, cultural relations and other forms of mutual cooperation are being discussed. The cooperation between Czech Republic and Germany in the international organisations, specifically the European Union and NATO, is the main subject of the multilateral dimension of the Czech-German relations that this paper deals with.

The thesis deals with the issue of public diplomacy at the level of bilateral relations between the Czech Republic and Germany. The thesis defines the importance of public diplomacy; it introduces a fundamental concept of both Czech and German public diplomacy with a focus on cultural diplomacy. Historical part outlines the contribution and influence of both countries to the public of the other, and the example of the Czech Centre in Munich shows the Czech practice of cultural diplomacy as an important tool of public diplomacy and the form of the image presented by the Czech Republic in Germany.

The thesis deals with a classic fairy tale of the 19th century, in particular with the comparison of chosen categories of motifs (animal motifs, food motifs, power conflicts, generation conflicts, gender motifs) in selected fairy tales written by brothers Grimm, Božena Němcová and Karel Jaromír Erben. The original text is the German one, which is consequently compared to the Czech one. The thesis deals with the fairy tales Die weiße Schlange (compared to Karel Jaromír Erben's fairy tale Zlatovláska) and Frau Holle (compared to the text written by Božena Němcová O dvanácti měsíčkách). The goal of the thesis is to ascertain to what extent the depiction of the chosen motifs differ in German and Czech variants, or to what extent they correspond. The used methods are comparison, analogy and analysis, followed by synthesis of discovered knowledge.

The topic of my diploma thesis involves comparison between the largest Czech right-wing political party, the Civic Democratic Party (ODS), and the largest German conservative general political party, the Christian Democratic Union (CDU) which, together with the Christian Social Union (CSU) comprises a faction (CDU/CSU) at the federal level. The major objective of the thesis is an analysis of development and programmatics of both political parties and subsequent comparison thereof, I.e. identification of any common, similar and different characteristic features. The thesis is divided into four chapters. Chapter One deals with the theory of political parties, more strictly with the very concept of political party and its formation, its definitions, how it is divided, what roles it plays and what types of political parties there exist. Chapter Two is devoted to the Civic Democratic Party. I describe its formation, subsequent development and, finally, its programmatics. The individual objectives or principles are clearly shown on specific items of the political programme of 1995 and the current election programme "Jointly for Beller Life" of 2006. v anglickém jazyce The aim of the thesis is to compare legal regulations of testament in the Czech and German legislation. A maiori ad minus methodical procedure is used in the thesis. After general characteristics of testament, the work is focused on the regulation of testament in Roman law, which significantly influenced the current legislation in the Czech and German law. Furthermore, the attention is paid to the regulation of testament on the Czech territory during 20th century, especially to the Czech Civil Code 40/1964. Subsequently, the thesis characterizes the current legal regulation of testament in the Czech Civil Code 89/2012 in detail. This analysis is mainly based on legislation, expert commentaries and literature, judgment and internet resources. After processing the Czech regulation of testament, the thesis changes its area of interest to the regulation of the German legislation of testament. At this chapter similar methodological procedure and legal resources were used. This thesis focuses on fairytales from exotic countries (and continents), specifically African, American, Australian, Japanese, Chinese, Indian and Inuit. Selected fairytales are introduced, analyzed and compared between each other. This work also focuses on finding similarities between these exotic fairytales and Czech fairytale background. General theoretical information about fairytales can also be found in the first part of this work. One of the goals of this thesis is also to get acquainted with new sources. The empirical part of this work examins the knowledge of sixth grade basic school pupils of international fairytales. Part of this research is also a survey about Czech language teachers from selected schools, focusing specifically on finding out practical use of fairytales during school lessons.

Abstract, key words Title of the thesis: Shared residence in Czech and German law The aim of this thesis is to compare the approach to shared residence in the legal order of the Czech Republic and the Federal Republic of Germany, i.e. to find out to what extent the approaches of these countries to shared residence differ. This is examined in relation to selected issues which courts had to deal with when deciding on the shared residence, i.e. the influence of the child's wishes, the parents' will, their ability to communicate and long distance between the parents' households on the suitability of shared residence. Special attention is paid to the presumption of shared residence, or shared residence as a rule. The thesis focuses on the effective regulations. The thesis is divided into three parts. The first part deals with the Czech regulation of the shared residence. Private law issues relating to domestic violence (a comparison of Czech and German regulation) The subject of this thesis is private law issues relating to domestic violence. The domestic violence is a repeated phenomenon which is hidden in privacy of homes, including physical, psychological or sexual violence among close persons; the intensity of the attacks is escalating. The thesis is focused on violence among adults, especially partners. The domestic violence has been occurring in a society for a long time, nevertheless in the recent years has no longer been considered as a private matter and nowadays is being even solved by a virtue of the law. The Czech Republic and Federal Republic of Germany have recently adopted special acts for protection against the domestic violence. I have chosen the given topic for its recency and also because of lack of the Czech legal literature. The thesis compares the private law instruments of protection against the domestic violence in Germany and in the Czech Republic. The aim of the thesis is to find out which options the legal systems offer, whether they are sufficient, what are the fundamental differences between the both legal regulations and finally to propose some legislative measures. Testamentary succession in the Czech and German legal systems This thesis compares the testamentary succession in the Czech and German legal system. Testamentary inheritance sequence forms a significant part of the inheritance law in both countries and testament represents the most important heritage title. Czech Civil Code deals with regulation of inheritance law sections significantly less than the German Civil Code. While studying both legal systems I discovered many differences, especially in the organization of the possible contents of the testament. In Germany, as opposed to the Czech Republic, the testator in the testament can validly give such condition, order or the reference. Forms of regulation of testament are also different, German peculiarity is so called common testament of spouses. In general, the German legislature honors principle of autonomy of the will of the testator, his test freedom, much more than the Czech. Prepared codification of the new Czech Civil Code is inspired by our German neighbors and is returning to traditional institutes of inheritance rights, autonomy of the testator significantly is strengthened. As a result, the extent of the new legal regulation of succession is substantially larger than in the current Civil Code.

This diploma thesis focuses on Werich?s fairy tales. The first section deals with fairy tales which are influenced by their authors against the background of folkloric fairy tale. The second section monitors the development of this type of fairy tale from 1870?s to 1960?s by reason of Fimfárum?s first publication. The third part deals with interpretations of single fairy tales from Fimfárum. On the basis of these interpretations the genre constants and author innovations are studied. The fourth section handles with film version of these fairy tales. The last section introduces Deoduši. This book has been recently published and contains less known texts from Werich which were not collectively published by this time.

Abstract:
This diploma work is focused on the relationship between Czech and German folk culture in the Northern Pilsen region. In the first part we treat with inhabitation and structurizing of space in general paying special attention to one' s living in cultural landscape. In the second part we follow history of german settlement in Czechia, Moravia and Silesia. We highlight the most important events in this history presenting the milestones to the czech and german national interaction. Third part deals with history of Northern Pilsen region and also with history of both Czech and German nation in this region. In the fifth chapter we introduce the brief history of the folk costume, explain what it is and the we pay our attention to the Czech a German folk costume in the Northern Pilsen region separatelly. Next part describes folk architecture in the landscape close to the town of Plasy, Kralovice and Manětín. The final chapter of this diploma work is about small village chapels, sacellums, crosses and other diminutive relics of folk architecture in the region.

The topic of my thesis is An Employment Notice, comparing Czech and German regulation. The purpose of the thesis is to describe and to analyse an employment notice according to Czech Labour Codex and German Labour statutes. First chapter presents legal principals. Second chapter is to consider the role of international organisations and the European Union within in the context of an employment notice. In next one types of employment termination are introduced, for instance an agreement on employment termination, the institute of an employment notice, termination due to employee's death and an employment termination of fixed period. Following chapter is crucial one for the aim of my thesis. It is divided into several parts which deal with reasons of employment termination by an employer, types of an employment notice, delivery, grounds of employment notice, notice periods, and a protection against an employment notice. That chapter also contains comparison of Czech and German law. Next part of my thesis is to be concerned with collective dismissal in Czech and German regulation. In my conclusion I summarize essential differences between both national regulations and try to outline suitable regulation legal arrangement of an employment notice "de lege ferenda".

This paper focuses on literary representations of the transfer of Germans from Czechoslovakia. The central point of the analysis is representation of multilingualism, mainly in the form of its presence, evocation and deformation, and often also in the form of elimination. Various aspects of multilingualism are important means of characterization of the narrative settings and milieu. The use of multilingualism has the potential to illustrate the social and political changes of the Czech society in the last seventy years. However, it is not the only possible way to do so. Different languages are evaluated and considered individually, which offers a possibility to depict the complexity of the transfer of Germans. The most important aspect of the multilingualism is the emphasis on the incomprehensibility of the communication not only at the level of basic speech understanding but also at the higher level, which reflects the failure of interpersonal communication.

Das Ziel deiser Diplomarbeit ist mit den Einzelansprüchen den Schadensersatz bei Körperverletzung und Tötung in der tschechischen und deutschen Rechtsordnung zu beschreiben. Die Diplomarbeit ist in vier Kapitel eingeteilt. Das erste Kapitel beschäftigt sich mit den Grundlagen des Gesundheitsschutzes aus der Sicht des tschechischen und deutschen Staatsrecht und deren Verankerung in den internationalen Menschenrechtsabkommen. Die Aufmerksamkeit ist auch auf die Verankerung der Grundprinzipien in dem tschechischen und deutschen bürgerlichen Recht gelegt. Das Kapitel beschäftigt sich weiter mit dem Gesundheitsschutz durch das bürgerliche Recht. Das zwite Kapitel beschäftigt sich mit der Haftung, besonders mit den theoretischen Ausgangspunkte der Haftung und Voraussetzungen für die bürgerliche Haftungsbeziehung in der tschechischen und deutschen Rechtsordnung. Die Aufmerksamkeit ist besonders auf die Rechtswidrigkeit, die Kausalität, der Schaden, das Verschulden geleget und die Unterschiede zwischen den beiden Rechtsordungen. - Compensation for damage to health: a comparison of Czech and German legislation This diploma Thesis deals with the theme of compensation for damage to health in Czech and German legislation, which was one of the inspirations during the creation of the Czech Civil Code. The aim of this study is to explore the issue of civil compensation for damage to health (and in the case of death) with an emphasis on medical-legal relations arising from the provision of health care, in both these legal systems. This study is divided into three parts. In the first is examined the legislation of Czech Republic, in the second the German one. The third section briefly summarizes the differences and the congruent aspects of both legislations, supplemented by suggestions for possible changes and improvements of the Czech law de lege ferenda. The thesis is divided into four basic chapters, in which there is described the history of divorce, then there is explained the term of divorce itself followed by definition of different matrimonial property regimes in the Czech republic and in Germany. In the end the thesis concerns settlement of property between spouses after the divorce. The thesis profits from both analytical and comparative methods of approach. Contractual acquisition of ownership of movable things: comparison of Czech and German legal regulation The aim of this thesis is to introduce and compare three main approaches towards acquisition of ownership of movable things, which are currently present on the European continent. For this purpose, three different civil codes are outlined, whereas each of them represents one possible approach. The question, which of these systems works the best, has already been thoroughly discussed at the European level. However, the Czech civil code of 2012 has decided not to follow the conclusion of these discussions and opted for a different approach. Since the Czech lawmaker does not provide a duly reasoned explanation as to why he has decided to adopt a different rule, this thesis aims to take a closer look at the reasons, which might have played a decisive role. This master's thesis deals with the institute of agreement process that originates in anglo-american plea bargain, which has been implemented in many criminal proceedings within the countries of continental Europe. Civil law based countries are using agreements in different forms during their criminal proceedings as an alternative to common trials. Its purpose is to make them faster and more simple. Every agreement is different from each other, but one common element is that accused person pleads guilty of crimes he/she is being prosecuted for and also that the authorities involved in given criminal proceeding are willing to make concession in punishment of the prosecuted. Even though this type of solution to overburdened authorities active in criminal proceedings seems to be quite positive, there are some critics that find this method in conflict with some basic principals of continental criminal proceeding. Abstract Presented work deals with the current theme, language of advertisements. All collected materiál was published in the period since 14th January until 25th May 2009 in the Czech press (Lidové noviny, Aha, Blesk) and the German print media (Súddeutsche Zeitung, Dresdner Morgen Post and Bild Dresden). Selected advertisements are classified with respect to the orientation of the press, then they are divided into several areas according to their specialization and they are sorted by the abundance of the group. The work is divided into two main parts. The theoretical part, which is focused on defíning and clarifying key concepts that relate to this topic and a practical part which will deal with specific media and is no longer stand alone analysis of the collected material. Prior to the actual analysis, there is a closer introduction o f each media and advertising cycle within, which are the actual ads classified. The aim of the practical part of this work is to compare the language phenomena in Czech and German print media, and to draw conclusions about similarities or dissimilarities of the devices that are currently used in the creation of marketing Communications. LEGAL COMPARISON OF REPRESENTATION GRANTED BY THE PRINCIPAL UNDER THE CZECH AND GERMAN CIVIL CODE WITH REGARD TO THE PROPOSAL OF A NEW CZECH CIVIL CODE Legal representation (agency) belongs to the most important legal institutes within the private autonomy of each person. Acting on behalf of the principal, the representative (agent) has the authority to affect directly the legal position of the principal. The valid Czech Civil Code of 1964 regulates this legal institute in only a few provisions, the commentaries on this Act and civil law books deal only with the basic information and there is not a single Czech monograph on this topic. It may invoke that this institute is not the complicated one but this would be fully wrong. There are many questions regarding the relationship between the principal and the representative or between the representative and the third party. A lot of problems are traditionally caused by the legal authority, its scope and ending. In order to create a modern private law in the Czech Republic, which should put an end to the legal development of the past decades influenced by socialism, a new Civil Code should be created. The purpose of my thesis is to analyse private law limitations of freedom of expression in media with respect to case-law. The study focuses on the limitations of freedom of expression in relation to natural persons. Since the aim of the study is to compare the Czech and German legal regulation, particular emphasis is put on the comparative method. The thesis deals with legal regulations of income taxation of business companies in the Czech Republic and the Federal Republic of Germany. The main objective of the thesis is to analyze relevant Czech and German legal provisions and to compare the law through the structure of the thesis and a brief summary. The thesis is divided into an introduction, a conclusion and six chapters. The first chapter is concerned with an income tax in the Czech Republic, the second one with an international double taxation and the next three chapters with an income taxation of business companies in Germany. The last one summarizes some of the differences between the legal regulations and offers a tax calculation according to German law. The systems of income taxation of business companies in the Czech Republic and the Federal Republic of Germany show both differences and similarities.
