Abstract:
Mühimme Defterlerinde sıklıkla görülen kürek cezası, nitelikli hapis cezası şeklinde görülen tazir cezasıdır. Kural olarak asli ceza olarak kullanılan ceza, bedeli ve nadiren de olsa tekmili ceza olarak uygulanmıştır. Tatbik yerine göre değerlendirildiğinde, kürek cezasının bedeni ve hürriyet kısıtlayıcı ceza olduğunu belirtebiliriz. Mezkûr cezanın şiddet seviyesi çok yüksektir; bu cezanın idam cezasından sonra en şiddetli ceza olduğunu söyleyebiliriz. Prensip itibariyle kanunilik ilkesine uygun bir şekilde uygulanan kürek cezası, kadınlar ve köleler dışında toplumunun tüm kesimleri için hükme bağlanabilmiştir. Şahsilik ilkesi de kürek cezası açısından kural olarak uygulanmıştır. Ancak "nefse" kefalet müessesesi, kürek cezasının şahsilik ilkesine istisna oluşturmaktadır. Kürek cezası, cezanın amacını açıklamaya çalışan neticeci teoriye ve umumi caydırıcılık teorisine uygun olarak kullanılmıştır. Bu ceza Divan-ı Hümayun ve/veya padişah emri ile hükmedilen bir cezadır. Padişahın bu konudaki yetkisi, cezanın affı konusunda da kendisini göstermektedir. Klasik dönemde uygulanan kürek cezasının mahkûma kamu hizmeti gördürme niteliği, bu cezadan öğrenilen bilgi, edinilen tecrübe olmuştur.

Abstract:
Devlet gücünün en çarpıcı yönü olan “cezalandırma hakkı” ve bu doğrultudaki “ceza” kavramıdır. Cezada ölçü, suçlunun kasıt ve kusur derecesi ile işlenen suçun ağırlığıdır. Psikiyatrinin ceza hukukuna yardımcı olduğu nokta ise suçun manevi öğesinin gerçekleşip gerçekleşmediğidir. “Cezai Sorumluluk” kavramı bir ruh sağlığı uzmanı için açık ve belirgindir. Akut ya da kronik bir zihinsel hastalık hukuki anlamda da ispat edilebilir bir tanıdır. Ancak buradaki soru tanısal orijin de değildir. Hukuki ya da cezai sorumlulukta fonksiyonel azalmayı tespit etmektir. Adli psikiyatri uygulamalarına bakıldığında -belli başlı akıl hastalıklarından farklı olarak- kişilik bozuklukları, genel olarak cezai sorumluluğu ortadan kaldıran bir fenomen olarak görülmemektedir. Elbette suç davranışları sadece kişilik bozukluğu nedeniyle meydana gelmemektedir. Araştırma bulguları, kişilik bozukluklarının genetik yatkınlıkla beraber çevresel koşullar ve olumsuz yaşam deneyimlerinin etkileşimi ile meydana geldiğine işaret etmektedir. Peki bu genetik –ya da- diğer faktörler bir insanın cezai sorumluluğunu azaltmakta mıdır? Burada tartışılması gereken, kişilik bozukluğuna sahip şüphelilerin cezai sorumlulukları ile ilgili ruhsal değerlendirme sürecinde kullanılan ölçütlerin işlevselliğidir. Adli sürece bakıldığında tanı koyma işlemi için psikiyatrın elindeki en önemli enstrüman sınıflamadır. DSM IV tarafından tanımlanmış olsa da kişilik bozuklukları kriterlerinin hepsinin birden bugüne kadar tam olarak oturtulamadığı da görülmektedir. DSM sistemi kısmi hastalıkların yarattığı fonksiyonel işlev kayıpları ile ilgili olarak bilgi vermez dolayısıyla buradaki ilgili tanılar hukuki zeminde adli sorunları çözemez. Böyle bir durumda, kişilik bozukluklarının yol açtığı, sosyal normlara uyma yeteneğindeki azalmaya nasıl karar verilecektir?

Artykuł omawia łaciński monastycym żeński w Galii krzewiony przez św. Cezarego z Arles i jego kontynuatorów. W 506 r. Cezary rozpoczął budowę klasz­toru żeńskiego św. Jana, która została ukończona w 512 r. Pierwszą jego ksienią została siostra św. Cezarego – św. Cezaria. Do klasztoru wstąpiło wiele dziewic i wdów. Cezary napisał dla nich regułę w 534 r. Następczynią św. Cezarii została inna Cezaria, zwana Młodszą. Mniszek w klasztorze było wówczas aż dwieście. Następną ksienią została św. Liliola, a później św. Rustykuła. Przed śmiercią Cezary chciał uczestniczyć w liturgii mniszek w klasztorze św. Jana i skierował do wspólnoty zachętę, by pozostała wierna regule. Wpływ Cezarego na monastycyzm galijski był wielki, choć „Reguła” odegrała większą rolę jedynie w Prowansji. Nie znamy dokładnie dziejów klasztoru św. Andrzeja z Villeneuve koło Awi­nionu. Jedna z kronik mówi, iż w 586 r. zmarła w nim niejaka św. Cezaria. Je­śli chodzi o inne klasztory żeńskie w Galii, to mamy na ich temat jeszcze bar­dziej skąpe wiadomości. Zachował się list Cezarego wysłany do pewnej ksieni, z którego można wnosić, iż była ona jego duchową córką i kierowała założoną przez niego wspólnotą mniszek. Według tradycji także klasztor św. Piotra du Puy w Orange został założony przez św. Cezarego na górze Eutropiusza. W VI w. powstały także „Reguły” św. Aureliana: Regula ad monachos i Regula ad virgines. Założył on w Arles dwa klasztory: żeński św. Marii i męski świętych Piotra i Pawła.

Abstract:
Amaç: Suçla mücadelede en önemli unsurlardan biri ceza politikalarıdır. Bu araştırmanın amacı madde kullanımı açısından ceza yaptırımlarının ne anlama geldiğini saptamaya çalışmak ve cezalandırmanın bireylerin suç işlemelerindeki etkisini, cezaların caydırıcı olup olmadığını ortaya koymaktır. Gereç ve Yöntem: Bu araştırmanın örneklemi üniversitelerde öğrenim görmekte olan öğrencilerden oluşmaktadır. Araştırmanın anket yoluyla bilgi toplama aşamasına toplam 277 üniversite öğrencisi katılmıştır. Bulgular: Katılımcıların %17,9’u esrarı, %3,4’ü eroini, %4,5’i kokaini, %2,6’sı LSD’yi, %4,5’i ecstasyi, %3’ü bonzaiyi en az bir kez kullandıklarını bildirmişlerdir Öğrencilerin %41,4’ünün okul idaresinin madde kullanan öğrencileri fark etme olasılığının düşük olduğunu, %71,6’sının madde kullanımının yasal olarak suç olduğunu bildiği, %44,2’sinin madde kullanımına verilen cezaların caydırıcı olmadığını düşündüğü görülmektedir. Madde kullanan öğrencilerin %54,9’u, kullanmayan öğrencilerin ise %24,1’i madde kullanımından dolayı bir kişinin yakalanma olasılığını düşük bulmaktadır. Öğrencilere anket çalışmasında madde kullanmama nedenleri sorulduğunda %64’ünün sağlığıma zararlı olacağını düşündüğüm için yanıtı verdiği görülmüştür. Yakalanma risk algısına bağlı olarak ceza almaktan ve yakalanmaktan korktuğum için yanıtını verenlerin oranının ise toplamda %9 olduğu görülmüştür. Sonuç: Araştırmanın sonuçlarına göre katılımcıların madde kullanımına verilen cezalar ile ilgili net bir bilgi sahibi olmadıkları ve cezai yaptırımlar konusunda özellikle kesinlik ve şiddetlilik prensiplerine olan inançlarının düşük olduğu görülmüştür.

Seksüel oryantasyonları nedeniyle reddedilen ya da kötü şaka ve yorumlara maruz kalan transseksüeller, öfke ve saldırganlık başta olmak üzere birçok psikolojik ve sosyal sorunlar yaşamaktadırlar. Ceza infaz kurumlarında kalıyor olmanın verdiği stres de yaşadıkları bu sorunları şiddetlendirmektedir. Yaşadıkları bu stres unsurları transseksüel bireylerde suç davranışlarına varan olumsuz psikososyal sonuçlara neden olmaktadır. Bu bilgiler ışığında bu grup çalışmanın amacı, ceza infaz kurumunda kalan erkek transseksüellerin öfkelerini kontrol etmelerini sağlamak, olumlu duygu ve davranış örüntüleri kazanmalarına aynı zamanda maladaptif davranışlarını minimize etmelerine yardımcı olmaktır. Bu amaç doğrultusunda grup çalışması programı olarak Avrupa Konseyi’ nce desteklenen Yargının Modernizasyonu ve Cezaevi Reformu Projesi kapsamında Adalet Bakanlığı Ceza Tevkifevleri Genel Müdürlüğü’nce geliştirilmiş olan Bilişsel Davranışçı Terapi odaklı Öfke Kontrol Programı kullanılmıştır. Grup çalışması 31.10.2011-31.12.2011 tarihleri arasında Ankara Ceza İnfaz Kurumları Kampüsü' nde kalmakta olan üç transseksüel hükümlüyle yürütülmüştür. Bu makalede BDT odaklı Öfke Kontrol Programının uygulanması, grup süreci ve değerlendirmelerine ilişkin bilgiler verilmiştir. Grup çalışmasının uygulanması sonucunda Öfke Kontrol Programı’ nın etkili bir program olduğu, transseksüel bireylerin öfke ve öfkeye neden olan olaylara ilişkin temel inançlarının değiştiği ve olumlu davranış değişikliğine gittikleri gözlenmiştir.

Abstract:
Most of the necropolis investigated in the Lower Danube basin have been generally dated between the 12th and 14th centuries. However, the grave finds indicate that there are significant differences between certain necropolis and against that background it is apparent that they could not date from the same time period. The main characteristic of the necropolis in Korbovo Vajuga and Prahovo are numerous bracelets and various variants of the earrings with biconical pendants. There were also found the earrings with granulated nodules, hoops with coils of wire on their lower segment and earring with spherical pendant decorated with the pseudo granulation. The necropolis at the sites Svetinja in Stari Kostolac and the cemeteries at Mala Vrbica, Klicevac and Coka Arte are also chronologically close to the above mentioned necropolis. Another group includes the necropolis at which the mentioned finds are entirely lacking. These are the necropolis Kod Groblja in Stari Kostolaca as well as the cemeteries at Cezava, Manastir, Boljetin Ravna, Hajducka Vodenica, Usce Porecke reke, Ljubicevac and Mihajlovac. Between these two groups of clearly distinguished necropolis are the cemeteries at Ribnica and Brza Palanka characterized by the mixed finds known from both groups of the necropolis. The beginning of interment in the cemeteries at Korbovo, Prahovo and Svetinja could be dated not before the second half of the 12th century, while at Vajuga it is more precisely dated in the end of that century. The question is how long these cemeteries could have been in use. The coin finds confirm without doubt that they had been in use during the first decades of the 13th century and the cessation of burying could be related to the Mongolian invasion, which affected these regions in the beginning of the fifth decade of the 13th century at the latest. The gradual disappearance of the earlier jewelry could be observed through the rare finds in the 13th century cemeteries, while they are entirely lacking in the later burials. The changes in the inventory of the necropolis relate also to the appearance of new decorative objects including the jewelry made of small ornamental plates or the earrings shaped as question mark. Generally speaking, these cemeteries are characterized by smaller quantity of grave goods and among them are much more frequent the elements of clothing (buckles, buttons, clasps), which are almost entirely lacking in the earlier cemeteries. It could not be precisely established how long these cemeteries had been in use only on the basis of the grave finds but the cessation of burying could be indirectly related to the Turkish conquest of this part of the Danube valley.

Abstract:
Gajuszowi Juliuszowi Cezarowi poświęcono niezliczoną liczbę prac. Wszystkie aspekty życia wodza budziły zainteresowanie badaczy. Informacje na temat stanu zdrowia słynnego polityka przekazali m.in. Swetoniusz, Pliniusz Starszy, Appian z Aleksandrii, Plutarch z Cheronei czy Kasjusz Dion. Zachowane relacje są mocno fragmentaryczne, a ich autorzy nie byli medykami, co znacząco wpływa na jakość przekazu. Niemniej opisane przez antycznych pisarzy objawy jasno wskazują na problemy zdrowotne, z którymi musiał się borykać Cezar. Fragmentaryczność opisów oraz brak materiału kostnego uniemożliwiają jednoznaczne określenie, na jaką chorobę cierpiał słynny polityk. Z tego powodu powstał szereg hipotez dotyczących przyczyn opisywanych w źródłach ataków. Wśród najpopularniejszych wymieniano epilepsję, chorobę Meniera, guz mózgu, neurosyfilis, zakażenie pasożytami czy chorobę Hartnupów. W ostatnich latach wspominano także o celiakii. Ze względu na brak możliwości przebadania „pacjenta” wszystkie pozostają w sferze hipotez niemniej obecnie. Biorąc pod uwagę objawy zaobserwowane u Cezara, najbardziej prawdopodobną chorobą wydaje się guz mózgu lub seria mikroudarów. Niezwykle ciekawą i prawdopodobną opcją wydaje się choroba Hartnupów, ale ze względu na jej dziedziczny charakter problem należy przebadać i omówić szerzej, uwzględniając cały ród Juliuszów.

Esta dissertação analisa os primeiros passos da vacinação contra a varíola (método desenvolvido pelo médico e naturalista inglês Edward Jenner em 1798) na freguesia Madre de Deus de Porto Alegre no início do século XIX (1800-1835), levando em consideração o contexto local e aspectos voltados para a saúde pública. Para isso, primeiramente, apresento, através dos registros paroquiais de óbito, um panorama das enfermidades que afetaram a população porto-alegrense neste período e identificando as principais doenças, seus sintomas e causas com o auxílio de manuais e dicionários de medicina de época. A partir disso, busco, nas Atas da Câmara Municipal de Porto Alegre informações ou sobre medidas tomadas em prol da saúde pública e do bem-estar dos indivíduos, nas quais, além de providências em prol da vacinação, há solicitações para a melhoria de espaços públicos. Foram utilizados ainda jornais do mesmo período e referencial bibliográfico que permitisse compreender a importância desta medida e mesmo trazer apontamentos sobre como esta técnica foi levada adiante em outros locais. Para que esta pesquisa fosse possível e pudesse ser concluída, foi fundamental a coleta de documentos e outros dados do doutor Julio Cezar Muzzi, que, além de ter desempenhado seu papel como prático de cura, ter sido figura ativa na sociedade e no âmbito legislativo, foi o principal responsável pela introdução da vacina em Porto Alegre.
The current dissertation analyzes the first steps of smallpox vaccination (method developed by the English physician and naturalist Edward Jenner in 1798) in Madre de Deus parish of Porto Alegre in the early 1800's, considering the local context and aspects related to public health. For that, I present, through the parish death registers, an overview of the diseases that affected Porto Alegre's population during this period, and identifying the main diseases, their symptoms and causes with the help of manuals and dictionaries of medicine of the time. From that, I search information or actions taken in favor of public health and the well-being of individuals in the Municipal Council of Porto Alegre, where, in addition to measures for vaccination, there are requests for improvement of public spaces. Newspapers from the same period were also used, as well as a bibliographic reference that allowed us to understand the importance of this measure and even to provide notes on how this technique was carried out in other places. In order for this research to be possible and completed, it was fundamental to collect documents and other data from Dr. Julio Cezar Muzzi, who, in addition to having played his role as a healing practitioner, was an active figure in society and in the legislative sphere and the main responsible for the introduction of the vaccine in Porto Alegre.

Understanding what were the forms of representation used by Arthur Cezar Ferreira Reis on sertanistas, missionaries and indigenous people in a relationship that would lead to the colonization and therefore civilization was the north that gave base this work. Thus, it was necessary to go in search of theoretical and methodological support of the author the now essentially for his relationship with Brazilian intellectuals that served as a reference. Through the analysis of passive connections the author and his work História do Amazonas concluded that the representations showed in his first work was closely linked to his relationship with the Historical Institute, and particularly some of its members, as Francisco Adolfo de Varnhagem represented the IHGB and Álvaro Maia under Amazon.
Compreender quais foram as formas de representação utilizadas por Arthur Cezar Ferreira Reis sobre os sertanistas, missionários e indígenas numa relação que levaria à colonização e, por conseguinte à civilização foi o norte que deu sustentáculo a este trabalho. Para tanto, fez-se necessário ir à busca dos suportes teóricos-metodológicos do autor, o que passou indispensavelmente pela sua relação com os intelectuais brasileiros que lhe serviram como referência. Primary agriculture is an essential activity that ensures a supply of raw food material. This research study examined small-scale agricultural projects and their role in poverty reduction with particular reference to Cezwana area in Jozini, South Africa. Small-scale agriculture plays an important role in development in this area, not only in terms of income generation, but overall regional economic growth. The agricultural sector has significant potential to transform the Jozini economy. The study examined the possibilities for small-scale agricultural development in Cezwana area and drew on the relevant literature as a framework to understand the agricultural sector in relation to the strategies employed by the government to develop smallholder farms. While it is acknowledged that policies have been adopted to promote food security by ensuring a steady supply of raw food materials to the manufacturing sector, and to create jobs and income, the sector’s potential has yet to be realized. In order to assess the status-quo of small-scale agriculture in Cezwana area and its effect on poverty reduction, data were obtained from Cezwana Youth Cooperative Limited, Zamani Gardening, Isiqalosethu Gardening, and the Department of Agriculture (DoA) in Jozini Local Municipality. The study identified the major factors that constrain the development of small-scale farming and indeed the overall agricultural sector in Jozini such as the neglect of agriculture arising from dispersed zones, inadequate infrastructural facilities and extension services, a shortage of labour, a decline in the quality of land due to climate change, a lack of project management, and policy inconsistency, etc. It recommends the provision of supportive facilities to farmers, as well as transparent extension services, price stabilization and prioritizing and building small-scale agriculture to ensure that this sector takes its rightful place in South Africa’s economy and contributes to poverty reduction.

The second chapter examines psychological transnationalism in novels by Michelle Cliff and Margaret Cezair-Thompson. As the works illustrate, psychological exile is an essential part of the migratory experience; growing up with divided allegiances, each cognizant of their difference at every turn, the protagonists, Jean and Clare, are primed for flight. The authors highlight the effects of personal violence and advance alternative histories that have been lost in contemporary Jamaica. In Abeng and The True History of Paradise, migration is provoked by circumstances that render the homeland unsafe or unbearable; violence and interpersonal conflict operate as precursors to the female characters’ immigration. Together, the works query the degree to which one can fully “depart” one’s homeland.

Jednorożec, największa wieś kurpiowska na zachodnim skraju dawnej Pusz‑czy Zielonej, w 1915 roku został całkowicie zniszczony wskutek działań wojsk rosyjskich i niemieckich. I wojna światowa to również ważna cezura w historii Kościoła w tej miejscowości – rok 1916 to początek funkcjonowania osobnej parafii. Przechodzący tamtędy front rozproszył mieszkańców Jednorożca – część uciekła do okolicznych miejscowości, część udała się w bieżeństwo. Spłonął wzniesiony w 1862 roku kościół, który po ustaniu działań wojennych trzeba było odbudować. Wokół nowo wzniesionej świątyni zaczęło koncentrować się życie społeczne i religijne mieszkańców. Ogromna rola Kościoła w Jednorożcu, przede wszystkim zaangażowanie miejscowych duszpasterzy w niwelowanie różnic społecznych i zażegnywanie konfliktów pomiędzy mieszkańcami (Kurpie i potomkowie szlachty) w okresie I wojny światowej i latach późniejszych, uchwytna jest we wspomnieniach spisanych przez autochtonów.

Abstract:
Transformacja ustrojowa w Polsce sprzyjała rozwojowi formalnych inicjatyw społecznych. Na tym polu dostrzegalne były również zinstytucjonalizowane działania kobiet. Już 4 października 1989 r. zarejestrowano Polskie Stowarzyszenie Feministyczne. Rozpoczął się proces rozbudzania „solidarności płci”, konstytuowania polskiego ruchu feministycznego i formalizacji działań organizacji nawiązujących do idei równouprawnienia płci. Asumptem do legalizacji działań środowisk kobiecych był projekt ustawy penalizującej aborcję, ale też nieobsadzenie urzędu pełnomocnika do spraw kobiet. W tym kontekście można było spodziewać się wzrostu liczby materiałów prasowych dotyczących zorganizowanej działalności kobiet. Celem badań była rekonstrukcja medialnego obrazu organizacji kobiecych, który był prezentowany w najpopularniejszych polskich pismach dedykowanych kobietom („Kobieta i Życie”, „Przyjaciółka”, „Zwierciadło”) w latach 1989- 1992. Cezura badawcza odpowiadała pierwszej fazie transformacji systemowej w Polsce. Inicjował ją rok, w którym odbyły się Obrady Okrągłego Stołu, a kończył rok uchwalenia tzw. małej konstytucji w 1992 r.

Indiscreta y avasallada por las nuevas tecnologías, además de brindar riqueza visual y multiculturalidad, la imagen controvierte y excede el imaginario colectivo. El problema, explica Fontcuberta en La cámara de Pandora (2010), es que «de tanto ver, ya no vemos nada: el exceso de visión, conduce a la ceguera por saturación». La desproporción visual puede efectivamente enturbiar la visibilidad y el entorno, pero lo más relevante y significativo es la manera en cómo la gestionamos. En el convencimiento de que en el contexto actual hace falta más sentido del humor y risas, este artículo nos acerca a la sátira del escenario cotidiano a través del arte. Así, tomando como punto de partida una de las figuras que más representa, dice y desdice del factor humano, el payaso, nos proponemos trazar los probables y posibles de lo que parece convertirse en una nueva estrategia discursiva: el gag visual. Entre la payasada y el silencio de sus pantomimas, los teatros personales del artista polaco Cezary Bodzianowsky nos inducen a reflexionar lo acostumbrado. Consciente de que el imaginario popular mueve y conmueve, concluye, burla y perturba el circo contextual contemporáneo, la travesura visual de Bodzianowsky nos invita a parar, a detener el tiempo y los sentidos. Mientras el exceso nos excede y abruma, en el análisis de su obra descubrimos la síntesis performativa y descaro de un personaje universal que devora el desatino cotidiano. Comprometido con el desarraigo y cultura objetual contemporánea, Bodzianowsky gestiona la absurdidad del comportamiento social. Hábil estratega de todas esas relaciones humanas y materiales que la obra burlesca utiliza como moneda de cambio, lo concreto y la pausa más que el exceso y la prisa, nos invitan en su discurso a especular el entorno de manera más comprometida.

Basının dördüncü güç olduğu paradigması; demokrasilerde halkın özgür olduğu ve kendilerini yönetecekleri seçme hakkı gereği, ekonomik ve siyasal güçlerin kamuoyundan gizleyerek bir menfaat çerçevesinde hareket ettiklerini ortaya koymak gerekliliğinden doğmaktadır. Toplumsal sorumluluk kuramı gereği; gerektiğinde ölüm, itibarsızlaştırma, işini kaybetme, hapis cezası gibi yaptırımlarla karşılaşan ancak kamuoyu menfaatine gerçeğin peşinde koşan skandal haberciliği de denilen bu habercilik türü; uzun soluklu, belgelere dayanan, kamuoyundan gizlenen ancak kamuoyu için önem teşkil eden haberlere ve daha çok “Neden” sorusuna odaklanır.Yeni teknolojilerin rolü özellikle araştırmacı gazetecilikte önem kazanmış; ilk kez Wikileaks, ardından Panama belgeleri ile farklı bir boyuta ulaşmıştır. Uluslararası gazetecilerden oluşan “Uluslararası Araştırmacı Gazeteciler Konsorsiyumu” ICIJ (International Consortium of Investigative Journalists) organizasyonuyla veri sızıntısı araştırılmış; iş adamlarının, liderlerin, bürokratların vergi kaçırma ve kara para aklama operasyonları; eş zamanlı, küresel ölçekte kamuoyuyla paylaşılmıştır. Bu minvalde gazeteciliğin en prestijli ödüllerinden Pulitzer 2017 yılında bu gazetecilere verilmiştir. 80’den fazla ülkede 100 medya organizasyonu ve 400 gazeteciden oluşan bu konsorsiyum gazetecilik faaliyetinin yerelden küresele bir forma büründüğünün önemli bir kanıtını oluşturmaktadır Bu çalışmada dijital çağda araştırmacı gazeteciliğin değişen yüzü ve gazetecilikte eklenen yeni roller araştırmacı gazetecilerle yapılan derinlemesine mülakatlar çerçevesinde ele alınmaktadır.
