Abstract:
The point of departure for this article is the principle of the separation of powers, formulated long ago by the Frenchman Charles-Louis de Secondat Montesquieu. It is argued that this principle is important for the governance of universities, entailing a balance between university boards, university presidents and university senates. To this end, the article presents evidence about the governance structure of two highly-ranked US universities, UC Berkeley (UCB) and Stanford University. It reports on board compositions, the selection of presidents and the role of academic senates. The conclusion is that the principle of the balance of powers (‘shared governance’ as it is called at UCB) has served the two universities well. Therefore, despite differences in other conditions, such as their endowments, other universities might benefit from the evidence reported.

Nadie puede dudar de la importancia de la doctrina de la división de poderes, en la formulación realizada por Montesquieu, para el moderno Estado Constitucional. Sin embargo, también pocos desconocerán que la virtualidad para explicar las relaciones de poder en los Estados actuales, caracterizados como «Estados de Partidos» (Triepel) ha venido siendo puesta en duda, en el marco de una más amplia crisis de las Democracias representativas. Este trabajo sostiene que, dado que los partidos políticos resultan elementos indispensables de nuestro sistema democrático, la clásica distinción entre poder legislativo, ejecutivo y judicial enunciada por el Barón de la Brède ha de comprenderse conjuntamente con el juego de pesos y contrapesos (vetos) que se produce en las relaciones entre Gobierno y Oposición.No one can doubt the importance of the doctrine of division of powers, in the formulation made by Montesquieu, for the modern Constitutional State. However, few also will ignore that the virtuallity to explain the power relations in the current States, characterized as «State of Parties» (Triepel) has been questioned, in the context of a broader crisis of representative Democracies. This paper argues that, inasmuch as political parties are indispensable elements of our democratic system, the classic distinction between legislative, executive and judicial power enunciated by the Baron de la Brède must be understood together with the set of checks and balances (vetoes) that it occurs in relations between government and opposition.

AbstractWhen Woodrow Wilson, in the course of his campaign for the Presidency in 1912, attacked Thomas Jefferson and Charles-Louis de Secondat, baron de La Brède et de Montesquieu, he knew what he was about—for the constitutionalism articulated by the latter and embraced, in turn, by the Framers of the American Constitution was a systematic attempt to put into practice something very much like the first principles spelled out in the Declaration of Independence. Montesquieu was not a doctrinaire. He feared that, in his own country and elsewhere, revolution would eventuate in the establishment of a despotism, and so he gently, quietly promoted unobtrusive reform. But the cautious, prudential political science that he outlined in his Spirit of Laws was anything but value-free. If the American framers found his legislative science of use, it was because the hatred of despotism and love for liberty animating its author was grounded in an account of natural right closely akin to the one, espoused in John Locke’s Two Treatises of Government, that had inspired their revolution.

El filósofo y político francés Charles Louis de Secondat (más conocido como Montesquieu), plantea en su obra El espíritu de las leyes la teoría de la separación de poderes que - indudablemente- tiene un papel preponderante en el desarrollo de la modernidad política,extremo que garantiza particularmente la independencia en la administración de justicia, concepto de vínculo necesario con la función judicial como garantía real de la democracia. Para lograr la función judicial de administrar justicia, se debe acudir inicialmente a la vocación, entendida como aquel llamado interno para elegir determinada actividad (que en el caso concreto es la carrera de derecho), para luego lograr la licenciatura y ejercer de ese modo una de las sub-vocaciones que nos plantea el autor como son el abogado, juez, docente universitario o notario. En la eventualidad de seguir la función judicial de operador de justicia, debe tomarse en cuenta su conceptualización desde la perspectiva de la Filosófica del Derecho, luego centrarnos en la autoridad jurisdiccional; el mismo -para el cumplimiento de sus fines conciente- debe estar de sus deberes funcionales y legales y, finalmente, concretarse en las facultades que hacen del Juez a un ciudadano con múltiples virtudes al servicio de la comunidad.

Pesquisa objetivando descrever os principais aspectos do pensamento do Barão de Montesquieu, o nobre francês Charles-Louis de Secondat, que foi inserido entre os grandes liberais com a publicação do Espírito das Leis, em 1748. O autor é estudado em sua vida, contexto social, educacional e compreensão sobre o agir humano, que envolvia um nexo direto com as leis e a cultura, mas também com o clima, a geografia, o funcionamento do corpo humano. Depois do seu pensamento, é mostrado o seu ideal de funcionamento estatal por meio do conceito de Governo Moderado, algo que, graças ao seu pessimismo sobre as possibilidades de o homem possuir poder sem abusar dele, só poderia ser alcançado caso as leis moldassem instituições que dividissem eficazmente o poder e contivessem os abusos. Após ver como deveria ser a divisão de poderes e como a Inglaterra era o governo inspirador dessa ideia, serão vistos aspectos específicos sobre a federação, o clima e passagens do autor que envolvem a colonização das américas e, por consequência, a situação brasileira. Por fim, são apresentadas as repercussões do livro imediatamente após seu lançamento na Europa, a segunda fase de sua importância, após o seu amplo uso pelos constituintes dos Estados Unidos em 1787 e, por fim, breves apontamentos sobre influxos dele no Brasil.

Abstract:
Independence is a must in a state of law (rechtstaat) as stated in article 1 paragraph (1) of the 1945 Constitution of the Republic of Indonesia. The independence is inseparable from the theory of separation of powers. The separation of powers theory was developed by Charles Louis de Secondat Baron Montesquieu or better known as the trias politica theory which divides power into three, namely executive power, legislative power, and judicial power. The 1945 Constitution does not explicitly explain the existence of the prosecutor's office, but in Law no. 16 of 2004 which regulates the Attorney General's Office of the Republic of Indonesia places this institution as a "government institution" so that the position of the prosecutor in the Indonesian constitutional system is part of the executive power. This may causes the prosecutor's office to be independent and carry out its duties and functions. This study is a qualitative research, while the research approach used is the legal approach and the conceptual approach. Both the primary and secondary data was collected. The data was obtained through the 1945 Constitution, Law no. 16 of 2004, journals and books related to topic of research. The theoretical framework was applied to examine the concept of the independence of the Indonesian Attorney General Office by using the theory of The New Separation of Powers, which was initiated by Bruce Ackerman. In his theory, Ackerman divides powers into five, one of which is Independent Agencies. The result of this study showed that the position of the prosecutor's office is institutionally under executive power as stated in the prosecutor's law and regarding the ideal concept of prosecutor's independence in the Indonesian constitutional system which is analyzed through the theory of The New Separation of Power, namely by placing the prosecutor's office as an independent state institution that free from executive influence, broadly speaking, the placement of independent state institutions (Independent Agencies) is a separate branch of power out of the trias politica concept.

Abstract:
This study provides an in-depth account of the practices of the Bordeaux parlement for the years 1714-26 as a background and prelude for an understanding of Montesquieu's political theory. The first chapter demonstrates that the discipline of jurisprudence in early eighteenth century France was in a state of transition and was to a large degree unreflective of new political realities. The discipline did not offer the intellectual resources needed to construct a compelling account of contemporary developments in the growth of the state and of its tools. In contrast, it is shown in chapters two and three that the magistrates of the Bordeaux parlement rejected standard principles of Roman law, constitutionalism and patriarchalism and fashioned their own particular form of political argument. This new form of argument, called 'associational discourse' by the author, has significant resonance in the work of Montesquieu. Chapter four shows how this theoretical disposition was developed more fully in Montesquieu's early writings. Chapter five in turn shows how this was articulated in its fullest form in his major work, L'Esprit des lois (1748). Chapters six and seven show how this new form of political thinking was to have an important effect on Montesquieu's comprehensive theory of criminal justice. In conclusion, it is suggested that this early-modern form of associationalist thinking points to an alternative to liberalist and communitarian positions, by the consideration that governments should be concerned for the moral strength of subordinate associations in their communities, while not being fully responsible for the exact content of the beliefs fostered within them.

Les références à la physique utilisées dans L'Esprit des lois servent à justifier l'idée que Montesquieu chercherait à appliquer les schémas de la science moderne sur un nouvel objet, la réalité sociale, et serait un précurseur de la sociologie. On s'est d'abord penché sur les textes se rapportant à la physique, textes peu lus mais qui révèlent que Montesquieu a une vision d'ensemble des sciences de son temps, et qu'il s'est essayé à l'observation. Il apparaît que L'Esprit des lois ne déploie pas le projet d'une physique sociale ; les métaphores physiciennes interrogent essentiellement le devenir de la monarchie et son rapport au despotisme. Ainsi, l'image de la machine sert moins à réduire la réalité sociale en un objet scientifique, qu'à exercer le regard du législateur qui doit modérer les puissances. L'image renvoie aussi au domaine du vivant. La physiologie de Montesquieu repose sur un modèle fibrillaire qui lui permet d'appréhender le vivant et les phénomènes de reproduction en "cartésien rigide". Ces connaissances sont aussi mobilisées dans L'Esprit des lois. Montesquieu aborde les lois positives avec un regard sur le tout des rapports, ce qui définit son objet, l'esprit des lois, et en s'attachant à découvrir les convenances ou les désaccords qui peuvent exister. Le principe de totalité et le principe de convenance ordonnent le regard du législateur qui doit prendre la mesure des situations historiques. Il ne faut pas alors opposer les sciences aux arts : on trouve aussi des métaphores artistiques dans L'Esprit des lois qui manifestent une volonté de bien exercer un certain regard. Le génie artiste, qui sait composer son œuvre, éclaire le sens de l'œuvre législatrice, et aussi le dessein de Montesquieu. Le plan de L'Esprit des lois se comprend si on le regarde comme un "tout ensemble". La forme de l'ouvrage se veut formatrice du regard, qui est le sens de l'esprit.

Ce mémoire tente d'exposer les politiques de Montesquieu et Rousseau, qui sont généralement opposées l'une à l'autre par les commentateurs et qui ont encore beaucoup d'influence aujourd'hui. Sans s'attarder aux traditions qu'elles incarneraient, selon plusieurs d'entre eux, nous nous proposons de retourner dans les textes de ces deux auteurs des Lumières pour voir en quoi leurs pensées se ressemblent et se distinguent. Puisqu'elles sont le fruit d'une vision de la Modernité et d'une anthropologie, nous consacrons deux chapitres à ces questions, avant d'étudier leurs politiques à proprement parler, telles qu'elles figurent dans l'Esprit des lois et le Contrat social, mais aussi dans l'ensemble de l'œuvre de ces deux penseurs.

Abstract:
An experimental investigation was conducted to determine the secondary breakup morphology of electrically charged drops. Movies of drop breakup in a high speed air stream were recorded for drops charged between 0 and 60% of the Rayleigh charge limit. The conventional Weber number was found to be insufficient to classify the breakup morphology of charged drops. Rather an electrostatic Weber number was defined to account for the presence of the electrostatic surface stress. When the electrostatic Weber number was used in place of the classical Weber number, the observed breakup morphology was found to be similar to that proposed by previous researchers for uncharged drops. It is therefore concluded that secondary breakup of electrically charged drops can be characterized using the wealth of available literature on uncharged Newtonian drops, provided the electrostatic Weber number is used, and that the charge relaxation time is much smaller than the breakup time.

Abstract:
We have shown [1] that asymmetric injection of electric charge into polymer-dye blends can induce second order nonlinear optical effects which are distinct from the more conventional mechanism of using electric fields to align the dye molecules. Using an “in-plane” geometry [1], charges can be injected into polymer-dye films causing symmetry breakage both parallel and perpendicular to the external field. The symmetry breakage perpendicular to the field results from the setting-up of a macroscopic charge gradient, while nonlinearity parallel to the field results from conventional dipolar alignment. Using high voltages but only moderate fields (2000 V across 2mm) charge injection effects can be stronger than dipolar alignment. It is believed that charged dimers and quadrupolar nonlinearities are responsible for the nonlinearity in a charge gradient [2].

The Lithium secondary battery system needs very high capacity with high effectiveness because the industrial applications have been increased to include a hybrid car, airplanes, and the other aerospace fields, etc. Battery control system will switch off the charging current if one cell has reached full charge for stabilization; this happens due to serial connection and old status of battery cells in order to prevent being over charged and to increase the efficiency of them by keeping the rest of cells from being fully charged. It is a quite important to estimate impedance for state of charge in characteristics of battery cells to set the time to charge the each cell of the battery pack. This paper suggests the method of predicting battery impedance because of aging effects by using numerical simulations, which are verified with the experimental laboratory works. This paper also develops an Intelligent fuzzy control algorithm to maximize the efficiency of the battery cells by keeping the time to charge or discharge each cell of battery pack be more uniform.

Corona discharge is widely known as an effective method for improving the characteristics of the flow field and enhancing heat transfer. Distribution of charge density and electric field form a Coulomb body force which acts on the charged particles within the fluid and generates a secondary flow field. The thermal enhancing effects of corona wind are normally dominant in low Reynolds numbers or free convection problems. Although the governing differential equations of corona discharge are relatively simple, solving these equations by conventional computational methods does not yield a smooth solution for charge density and electric field. In particular, the results obtained from finite-volume method suffer from dispersion errors and fluctuations which lead to distorted values of electric body force, and consequently a distorted secondary flow. In this study, the corona discharge in a circular tube with the electrode positioned at the tube centerline is considered. An exact solution for charge density, electric field, and potential distribution along the radius of the tube has been derived analytically using a Lagrangian formulation for the charge density and the Method of Characteristics. It was found that the results of this method do not show any fluctuations or dispersion effects on charge density and electric field. The solution of the electric field provided a body force which was used in the Navier-Stokes equations to obtain the secondary flow in the cross section of the tube. In this paper, the electric and fluid flow fields are presented. The results are compared with those obtained by other computational methods and the differences are discussed.

We examine our earlier finding that AC electrospray cone can preferentially entrain and concentrate low-mobility ions generated at the cone tip [Chetwani, Maheshwari and Chang, Phys Rev Lett., 101, 204501 (2008)]. Instead of tip ionization, we scrutinize entrainment effects on dispersed ionic species in the spray solution. Fluorescence images of ejected ionic species, including anionic oxide ions, organic dyes, charged nano-particles, and stained DNA from AC electrospray cone generated with a 4–5 kV source. Negatively charged species such as anionic dyes concentrate at the tip of AC spray cone before ejection. Cationic dyes are more homogeneously distributed in the cone during ejection. Larger particles with negative charges, including fluorescence dye-tagged nano-particles (about 50 nm) and dye-stained DNA, have similar spatio-temporal evolutions of anioic dyes within the cone before ejection. These observations extend our previous entrainment and concentration effect to AC spray without ionization. The images will be correlated with tandem Mass Spectrometry and will be used to selectively gate either cationic (protein) or anionic polymers (DNA).

Abstract Many reservoirs experience separate gas and oil charges that can lead to a variety of different outcomes of fluid type and distribution. There has been fundamental uncertainty even as to which charge fluid can arrive first, let alone what fluid dynamic processes can result over geologic time. For high-pressure basins such as the Gulf of Mexico, this mixture can lead to increased solution gas, large GOR gradients and sometimes cause formation of viscous oil and tar at the oil-water contact, impacting aquifer support. In some reservoirs, the present-day outcome of oil and gas mixing over geologic time is clearly established by detailed chemical evaluation of reservoir fluids from many reservoir locations. Our objective is to understand the dynamics of the gas and oil mixing processes. Chemical measurements show that the extent of mixing includes thermodynamic equilibration in young reservoirs by 1) FHZ equation of state (EoS) asphaltene gradients and cubic EoS modeling of solution gas for reservoir fluids, 2) analysis of liquid-phase geochemical biomarkers, and 3) methane carbon isotope analysis. Specifically, in the common charge of primary biogenic gas and oil into reservoirs, methane isotope analysis is unequivocal. We employ reservoir simulation of a point gas charge into oil with various geometries and charge rates to establish parametric conditions which lead to excellent mixing vs those conditions that lead to large, disequilibrium gradients. The roles of compositional diffusion vs. momentum diffusion induced by forced convection are explored both in simulation and overall fluid mechanics analysis, which helps both to validate the results and extend the range of applicable parameters. Modeling results and simple fluid mechanics estimates also establish that there is no possibility that these reservoirs could have a gas charge followed by an oil charge; in the selected reservoirs, oil must have arrived first, followed by a biogenic gas charge. Seismic images of gas chimneys offer guidance regarding how the latter process can take place. Second, modeling results clearly establish a surprisingly wide range of charge conditions that can lead to excellent mixing and equilibration even for a point gas charge. Modeling results also show that for a very fast charge, results are consistent with those expected for CO2 injection and sequestration. The evaluation of geodynamic processes of separate biogenic gas and oil charges into reservoirs has rarely been accomplished. Even the result that biogenic gas charge must occur after oil charge challenges widely-held conventional thinking. In addition, the rapid and thorough mixing (less than 2 million years) of gas and oil charges is unexpected yet readily reproduced by reservoir simulation. The ability to connect CO2 sequestration to a wide range of reservoir studies is a novel way to constrain CCS modeling.

Ionic self-assembled monolayers (ISAMs) are a recently developed [1], revolutionary class of materials that allows detailed structural control at the molecular level combined with ease of manufacturing and low cost. The ISAM method involves the alternate dipping of a charged substrate into an aqueous solution of a cation followed by dipping in an aqueous solution of an anion at room temperature. Since the adsorption is based on the electrostatic attraction of interlayer charges, each layer is self-limiting in thickness and uniform at the molecular level. We have recently demonstrated through second harmonic generation (SHG) measurements with fundamental wavelengths of 1064 and 1200 nm that the ISAM technique can produce a noncentrosymmetric arrangement of NLO chromophores to yield thin films with χ(2) values comparable to that of quartz. The development of ISAM χ(2) thin films provides significant advantages over the production of organic χ(2) thin films by alternative methods. For example, ISAM films can exhibit long-term stability of χ(2) in contrast to electric field poling of glassy polymers[2], can provide thicker films (upwards of 10 μm) than the Langmuir-Blodgett technique, and can be fabricated much more rapidly than covalent self-assembly[3] methods.
