Full textMontesquieu offers a particularly rich ground for studies for whoever is interested in the reception of an author in teaching, in his presence in the syllabus and the handbooks of the end of the 18th century, in the way he belongs in the 18th century and in his work, which is difficult to categorize in pre-established categories. An author does not exist by himself in these handbooks. He goes through various filters, which often disfigure him. The first of those filters is the conception of the teaching of litterature. From 1800 to 1880, Montesquieu is above all a model of writing. From 1880 to 1980, he is studied according to his more or less great adequacy with the movement of The Enlightenment, and from 1980 on, the study of the speech is added to this aspect. But an author is also read through another filter which is the conception the handbooks have of the 18th century, analyzed comparatively with the 17th century. This conception makes the 18th century a one of a kind charachter endowed with strong characteristics so that authors are analyzed according to their representativeness. Montesquieu is read both like the continuator of traditional aesthetics and like the foreteller of the writing of The Enlightenment, through his biography more than through his writings. As a consequence, the work as such is not the starting point of handbooks analysis, but the resultant of these various filters. Montesquieu's works are thus analysed starting from the more general speech on the novel kind, the historical kind, and the literature of the 18th century, which would stick to less literary, more social, political and scientific issues

Abstract: When Montesquieu and Rousseau are laid side by side as political thinkers, it is usual to oppose them as if the first had just studied laws as they existed in order to explain them according to the real situations in which they were generated, and the second had only looked for what laws should be in order to fulfill human needs. One would have, therefore, on the one side, a Montesquieu too concerned with the historicity of human institutions to be able to elaborate a true theory on the foundations of political right, and, on the other, a Rousseau hostile to history and dedicated to ideal formulations about politics. There are, however, good reasons to question that opposition, which can be done by applying a comparative methodology to Montesquieu's and Rousseau's reflections on history and politics, paying attention to the sometimes open, but often implicit, dialogue undertook by the Geneva's philosopher with the current of political thought whose central problems and propositions are laid out in the work of Montesquieu. Thus, the aim of this research is to analyze Rousseau's work in the wake of Montesquieu's legacy, in order to show that it is wrong to interpret it narrowly in terms of a mere opposition to the kind of approach characteristic of the author of The Spirit of Laws. More specifically, what is sought here is to understand how the system of causality ascribed by the French philosopher to history was somehow incorporated by Rousseau into his own reflections, which are here investigated in order to show that they make use of a interpretative and discursive model that allows to build representations of interconnected events in a coherent way. Moreover, it will be shown how the theory of the forms of government presented in Rousseau's work, his conception of the institutions that promote civil freedom, as well as his understanding of the reasons that lead to moral and political corruption throughout the history of States, owe something to the reading of baron of La Brède's texts. The objective, in short, is to show that there are much more points in common between the ideas of Montesquieu and Rousseau than it is usually recognized

Full textThe purpose of this research is to depict the events that unfolded within the scenario that provoked Montesquieu to search for a scientific pattern in order to explain the social and political phenomena that he carefully observed in his time. Drawing on the variations of Montesquieu’s doctrines, The work aims to explore the basic conceptual argument of federation as well as the classic idea of separation of powers. Thereafter, It intends to examine the roles of state leadership in a republic whose foundation lies upon the federative model and the separation of powers in a presidentialist system of government. Based on this, the study is going to consider the alignment of the Brazilian model to those institutional propositions that initially provoked Montesquieu’s mind.

Full textIn the perspective of researchers developing a science, the foundation is presented as the imaginary solution to four enigmas regarding the unity and progress of their work: 1- Its foundation is the stable source of the principles of a science that remain throughout its development. 2- It provides a common finality of the individual developments of its research. 3- It contrasts from previous schools of thought by defining the project of an original and more desirable one. 4- It introduces the distinctive characteristics of a research, emphasizing that the knowledge it brings is worth it. In sociology, there is general agreement about sociology having a beginning, only no one agrees on the works that make it, nor the time it all started. By comparing the works of Auguste Comte and Emile Durkheim with other works since Aristotle, we explore those four enigmas and even a fifth one that is specific to sociology: 5- The foundation of sociology initiates an organisation of research that is incompatible with the kuhnian model of normal science.

Full textDesirous of clarifying a confused legal system and of resulting in human bliss, in L'Esprit des lois published in 1748, Montesquieu makes the distinction between political and civil laws. Identifying Civil law with Private law, he calls political law public and likens laws and law. To achieve his aim - the good of individuals and of society- the legal system must lean on public law since it comes from natural rights. Hence the primacy of political laws over civil laws. Given a rough handling by the critics, sometimes even disparaged, the distinction which was consolidated by the members of parliament, l'Ecole du droit naturel, and les Maximes du droit public français becomes the rule thanks to the philosophers of the Enlightenment. The notion of constitution, the politization of civil laws under the Revolution and the civil code reassert the primacy of political laws. Anticipating the relations between public law and private law which were established by the drafters of the civil code, the distinction between civil and political laws constitutes an intermediate stage in the setting of the important classifications of law. However, from the second half of the 19th century, the division line between political and civil laws, and between public and private laws becoming vaguer and vaguer its route has been in need of being drawn a new

Full textThe present work intends to study the phenomenon of federalism from the tridimensional perspective of Law. Firstly, a picture of federalism from a factful perspective shall be drawn, as the first and most natural form of association. Later, the perceived value of federalism, which is, the intervention of a rational process in the course of federalism’s natural association, shall be analyzed. The perceived value of federalism is exemplified from Montesquieu’s contractual theory, which develops a real organizational scheme for the territorial extension of the States, applicable to both large monarchies and small republics: federative republic. At last, the model of factful federalism shall be put to practice, associating its values to the normative field of the classic constitutional law models: the American and the German federalism.

Full textEver since Emerson the United-States have been expecting the great national masterpiece that would not only celebrate the unique destiny of this young democracy but would also free American language and literature from the European model. However, it did not seem that it was for the epic poem to accomplish this task given that it appeared not only ill-suited to describe the modern world but also incompatible with the demands of a poetic modernity predicated on lyrical intensity. Hence, the planned obsolescence of this “form” has made it all the more difficult to explain the spectacular rebirth of the “American long poem” in the 19th and 20th centuries. It has appeared all the more problematic since, after having been associated to Walt Whitman’s democratic lyricism, the “long poem” was appropriated by T.S. Eliot and Ezra Pound making it the symbol of the authoritarian, elitist and systematic tendencies of “high modernism”. It will thus come as no surprise that the critical community has tended to view the “long poem” negatively confirming in a way its illegibility: the “long poem” could only be viewed as a short lyric sequence, an impossible masterpiece or a parody of systematic thought and American exceptionalism. In undertaking this study of Louis Zukofsky’s “A”, William Carlos William’s Paterson and Charles Olson’s Maximus Poems I wish to demonstrate that it is possible to read the “long poem” as such without having to resort to generic categories and to the modern/postmodern dichotomy. I also hope to show that, in these three works, poetry is understood as a kind of ongoing activity which modestly attempts to articulate the poem to the world, time and reading

Full textIn the XVIIIth century, the first-person novel becomes the main form of fiction. We study the signs of an author in novels which tends to conceal this presence, as long as they pretend to be just transcribed memoirs or a genuine correspondence. Whereas the peritext of the first-person novels plays down any reference to the actual process of writing, we study in the first part the hints offered by the author concerning the real status of the text. Whereas the enunciation precludes any direct intervention from the author and the characters are in charge of telling their own story and giving sense to it, we study in the second part how the author manages to control the interpretation of what is told. In the third part, we are concerned with the stylistic aspects of the presence of an author who is supposed to transfer the art of writing to unprofessional writers

Although the media routinely portray the man as being "anti-european", facts clmearly show that he was the one who actually built europe, particularly between 1958 and 1969. In 1958, contrary to all expectations, general de gaulle chose to implement the treaty of rome, which he had neither negociated nor even signed. He then proved to be the best of europeans, complying with the timetable of the treaty of rome and wrangling the common agricultural policy at the price of a crisi in 1962. De gaulle bravely fought those whom he considered to be "enemies of europe". Twice he opposed britain's entry into the european community ; he creted the fra co-german axis to counter the london-washington axis, and he decided to pull france out of nato (the north atlantic treaty organization). And yet, general de gaulle merely produced a franco-german europe although his dream was to build it from the atlantic to the urals. Today, general de gaulle's concept of the europe of nations remains au inspiration to many european leaders

Full textRelations between France & Latin America were already well established when de Gaulle became President. In those troubled times of colonial conflict, European economic expansion, cold war and the emergence of underdeveloped countries, there appeared an innovative French foreign policy based on an independent stance as regards world superpowers, & a policy of decolonisation & initiatives aimed at the Third World. What had shaped France's Latin American policy & what had been the driving force behind its diplomatic activity up until the first official tour throughout Latin America of a French President in 1964 ? And, above all, how did Latin America's intelligentsia & politicians perceive these innovations at a time when economic crisis was rampant, when periods of inaction (Alliance for Progress) were followed by armed intervention (Dominican Republic), when military dictatorships appeared and when the Cuban conflict proved that Latin America had henceforth integrated into the East-West conflict. What led France to elaborate a Latin American policy & according to what criteria did Latin America either reject or welcome France's international policy offers ?

Full textBishop Dupanloup was one of the leading figures of the liberal Catholicism in France in the 19th century. From the private correspondence of the priest of Savoy, the objective is to highlight the networks which were set up and structured by the priest of Savoy to defend the interests of the Catholic Church in a context of revolutionary tensions.Under the Second Republic, from 1848 to 1851, Dupanloup and his networks particularly focused on the struggle for freedom of education and from 1849 on the struggle for the vote of the Falloux bill, a bill aimed to completely reorganize public and private education. Around Dupanloup an ensemble aggregated, made of parties, networks and personalities of various origins, lay and ecclesiastical, religious and political, who were known as the "Dupanloup party". This "party" relied above all on the "duo" Dupanloup-Montalembert, who turned into a "trio" when Alfred de Falloux became minister of public education and worship with the primary objective of obtaining the freedom for the Secondary education and to support the temporal authority of the pope. Strategies appear in the correspondence and private writings of Dupanloup that form the backdrop of the public action of the pedagogical priest. These epistolary exchanges form a tight grid between individuals sharing more or less the same convictions and objectives and aiming to tilt the revolutionary process in their favor. It is in the private space of correspondence that Dupanloup already built his public action. Studying the networks and the battles of the party of Dupanloup under the Second Republic makes it possible to go back more precisely to a part of history which is quite unknown. The conflicts which agitated the political, social and religious life of the Second Republic were indeed revealing of the ideological, political, social and religious bubbling turmoil of the mid-nineteenth century. It crystallized public debates that still animated the Europe of the 21st century, notably on the question of secularism or the secularization of society. The evolution of Dupanloup's thinking during this period reveals the tensions and dissensions which agitated liberal Catholics themselves but also their relationship with the clergy and with society. It seems relevant to understand how a group of conservative Catholics, a minority itself within the liberal Catholic movement, managed to rise to the top of republican institutions, whereas from 1848 to 1851 revolutionary days multiplied and radicalized. Can we conclude with a victory of the "Dupanloup party"? Was the Social Revolution which aborted in June 1848 a Counter-Revolution or paradoxically a Catholic Revolution ?

Applying an electric field under heating, makes it possible nevertheless to create a second-order non-linear susceptibility of about 1 pm/v. This was explain by the creation of an internal electric field due to cationic species migration. This thesis deals with alternative poling processes, for which the internal electric field results from the migration of electronic species (electrons and/or holes). We, firstly, describe the effect of an e-beam irradiation an a sample and the measurement of the secondary electron emission yield (seey). We discuss the influence of various experimental parameters on the value and the evolution of seey and show that such a measurements is a usefull tool to evaluate the insulating properties of various glasses and thus test their ability to store a poling induced space charge. Then, we explain the basis of e-beam and x-ray poling and detail our work on the optimization of the various irradiation parameters and their effect on the non-linear optical properties. Finally, we report our attempt to modelize the space charge induced during an e-beam or x-ray irradiation model, once completed, such a model, could give us a better understanding of the seey curves as well as the optimized poling conditions

Full textIn the second half of 19th century, specific bonds are forged between art and medicine: the modern medicine turns towards artworks and discovers there a clinic. In return, some painters and writers feed themselves on new knowledges to revitalize their practices. But as physiology takes art as its object, analyzes artworks, creation and reception, art can be praised, or conversely condemned. Thus, the figures of the artist and of the physician tend to join or to oppose themselves. Our work deals with what make this union and these conflicts possible. We address the idea of visibility, common to art and clinic, the concept of pathology, and the problem of norm. Thus, it appears that the figure of the abnormal artist, the “sick artist’’, is a legacy of the traditional melancholy: its value, positive or negative, is always understood in a specific context and changes according to a set of transfers. As we analyse discourses and some representative artworks, we intend not only to give an account of physiology of art as it appears in France at this time, but also to show that it is a privileged prism to understand a certain kind of artwork

Full textOverwhelming evidence for the existence of Dark Matter (DM), in the form of an unknownparticle filling the galactic halos, originates from many observations in astrophysics and cosmology: its gravitational effects are apparent on galactic rotations, in galaxy clusters and in shaping the large scale structure of the Universe. On the other hand, a non-gravitational manifestation of its presence is yet to be unveiled. One of the most promising techniques is the one of indirect detection, aimed at identifying excesses in cosmic ray fluxes which could possibly be produced by DM annihilations or decays in the Milky Way halo. The current experimental efforts mainly focus in the GeV to TeV energy range, which is also where signals from WIMPs (Weakly Interacting Massive Particles) are expected. Focussing on charged cosmic rays, in particular antiprotons, electrons and positrons, as well as their secondary emissions, an analysis of current and forseen cosmic ray measurements and improvements on astrophysical models are presented. Antiproton data from PAMELA imposes contraints on annihilating and decaying DM which are similar to (or even slightly stronger than) the most stringent bounds from gamma ray experiments, even when kinetic energies below 10 GeV are discarded. However, choosing different sets of astrophysical parameters, in the form of propagation models and halo profiles, allows the contraints to span over one or two orders of magnitude. In order to exploit fully the power of antiprotons to constrain or discover DM, effects which were previously perceived as subleading turn out to be relevant especially for the analysis of the newly released AMS-02 data. In fact, including energy losses, diffusive reaccelleration and solar modulation can somewhat modify the current bounds, even at large DM masses. A wrong interpretation of the data may arise if they are not taken into account. Finally, using the updated proton and helium fluxes just released by the AMS-02 experiment, the astrophysical antiproton to proton ratio and its uncertainties are reevaluated and compared to the preliminarly reported AMS-02 measurements. No unambiguous evidence for a significant excess with respect to expectations is found. Yet, some preference for thicker halos and a flatter energy dependence of the diffusion coefficient starts to emerge. New stringed constraints on DM annihilation and decay are derived. Secondary emissions from electrons and positrons can also be used to constrain DM annihilation or decay in the galactic halo. The radio signal due to synchrotron radiation of electrons and positrons on the galactic magnetic field, gamma rays from bremsstrahlung processes on the galactic gas densities and from Inverse Compton scattering processes on the interstellar radiation field are considered. With several magnetic field configurations, propagation scenarios and improved gas density maps and interstellar radiation field, state-of-art tools allowing the computaion of synchrotron and bremssttrahlung radiation for any WIMP DM model are provided. All numerical results for DM are incorporated in the release of the Poor Particle Physicist Coookbook for DM Indirect Detection (PPPC4DMID). Finally, the possible GeV gamma-ray excess identified in the Fermi-LAT data from the Galactic Center in terms of DM annihilation, either in hadronic or leptonic channels is studied. In order to test this tantalizing interprestation, a multi-messenger approach is used: first, the computation of secondary emisison from DM with respect to previous works confirms it to be relevant for determining the DM spectrum in leptonic channels. Second, limits from antiprotons severely constrain the DM interpretation of the excess in the hadronic channel, for standard assumptions on the Galactic propagation parameters and solar modulation. However, they considerably relax if more conservative choices are adopted

Full textIn the france of the 17th and the 18th century some prominent writers like corneille, bossuet, montesquieu and rousseau, simple essayists like saint-evremond, and revolutionaries like marat and robespierre did not adhere to the admiration of ancient rome that had become traditional in europe since the renaissance. The author makes this point by a detailed study of the works of these writers who, in spite of texts written with certain precautions of style, denounce the excessive cult of rome of modern europeans, its aspiration to universal domination, its institutions and the corruption which takes over after several centuries of existence. These studies are accompanied by analyses which link these critical opinions of rome to the political views which are implicit or explicit in each work. Full textFor many years, state institutions have undergone major organizational changes (relocation, restructuring). In their operation mode, they had to integrate the theory of "new public management" (NGP), a pragmatic approach to the division of labor, to improve the management the cost effectiveness of their services. These changes have compelled some agents to reorganize their career path. Besides, other agents are in a dynamic not constrained, but voluntary choice of orientation. This thesis endeavors to investigate the identity dynamics and the processes developed by the agent in the accomplishment of his reorganization project, which expose him to the risks associated with his choice and function in the reconstruction of his professional identity, and allow him to invest in his work and to acquire skills, professionalism and recognition. It aims at contributing to the understanding how the CPRP engage in this new function and the obstacles that hinder the identity reconstruction of these agents. The collected and processed data are uprooted on a questionnaire of thirty staff members followed by fifteen in-depth interviews. The analysis focuses on the risk taking in the commitment related to the function, and in the case of the performance of this function, the encountered difficulties and the set-up strategies, the risk management, and the identity reconstruction. It has made it possible to characterize the different identity configurations. In the report, we have represented these configurations from six monographs among the most significant developed ones.We thus show that the initial choice is a choice that can be made by default, the awareness takes place when the CPRP is confronted to the reality of the activity and that the function of "advisor" includes a risk taking that can prevent the process establishment of building professional identity and self-reconstruction, inseparable from the realization of missions

Full textThe paper investigates possible ways of optimizing the cold-start and warm-up performance of gasoline engines with secondary air injection. Due to its size, weight, performance capability, and especially its simple, thermodynamic operation the innovative secondary air injection system used for the investigations and featuring a secondary air charger has the potential to replace the secondary air pump used to date. The experimental investigations are preceded by the development of exhaust emission legislation and a theoretical analysis of the process leading to exhaust emissions. A simulation model is used to illustrate the dependencies of the secondary air charger on boundary engine conditions. Consequently it is possible to make a preselection for the air mass conducting properties of the secondary air charger in various fields of application. The results obtained by measurement in starting, warm-up, and in load changes, were used to analyze the emission improvement processes. The level of raw emissions is affected enormously by the time of injection of secondary air and the acceleration performance of the secondary air system. A comparison of all the measured variants with the secondary air pump and secondary air charger indicates that the secondary air charger system has a distinct emission advantage. In addition, by relieving the vehicle power supply the secondary air charger brings about a reduction in engine load, improved response, and higher secondary air mass flow. The result is a 20% to 30% reduction in raw HC emissions. The significant advantages over the secondary air pump are rounded off by benefits in terms of weight and bulk volume and a reduction in the amount of wiring. Tests conducted at low temperature (-7°C) and under high altitude conditions have also indicated advantages over the secondary air pump
