Carmody, Louise. "To what extent has the Convention on the Rights of the Child acted as a lens for the refocus of refugee protection mechanisms, to affect improved protection measures and adherence to human rights standards for child refugees?" Master's thesis, University of Cape Town, 2014. http://hdl.handle.net/11427/4685.

Abstract:
It is the intention of this paper to examine the extent to which the Convention on the Rights of the Child (CRC) has acted, (and, has the potential to act), as a lens for the refocus of refugee protection to better include children. To this extent, the paper will discuss the integral relationship between human right and refugee law. It is suggested that the CRC has affected greater recognition of how fundamental human rights, protected within the CRC, have influenced the evolution of State interpretations of the Refugee Convention to enhance protection for children. It is not the aim of the di

Abstract:
Doctor Legum - LLD<br>The issue of child motherhood remains a key challenge, especially in developing countries such as Zimbabwe. Despite bearing the worst of its effects, Zimbabwe looks largely to have fallen short of answers to solve this problem. The focus has been on legal solutions to prevent and ban child marriages, which leaves the plight of child mothers and/or motherhood often forgotten. Interestingly, the 2016 landmark case of Mudzuru and another v Minister of Justice, Legal and Parliamentary Affairs which declared child marriages illegal serves as an eye opener to the challenges of

Ogunde, Oluwafifehan O. "Entrenching child rights protection in Nigeria : the problem of constitution and culture." Thesis, University of Nottingham, 2018. http://eprints.nottingham.ac.uk/52231/.

Full text
Abstract:
The thesis examines child rights protection in Nigeria particularly in the context of problems created by the constitution and culture in establishing an effective child rights framework. Its central argument is that the peculiar constitutional arrangement hinders the effective implementation of the Nigerian Child Rights Act (CRA) 2003. It also argues that cultural perceptions with respect to children also serve as formidable opposition to the recognition of children as rights holders. Having argued along these lines, the thesis proposes certain reform measures that may be adopted in resolving

The purpose of this research is to look for a legal basis which a parent whose child has been abducted can retrieve his child. The Hague Convention deals with the question of parents who abduct their own children and take them to foreign countries. Discusses to what extent the African Human Rights System can complement the mechanism provided by the Hague Convention. Abstract:
The principle 'best interests of the child' has been expanded by the legal community in recent years to apply to any matter involving children in family law proceedings. The weight ascribed to this principle, however, has been diluted. In custody, access and child protection cases, evidence of which custodial arrangements are in a child's interests are often presented by adult parties in prolonged and costly proceedings. The judge makes an order which is intended to meet the child's "best interests", in the child's absence. This paper first examines the historical and theoretical justification

Abstract:
The thesis defends a critical theological engagement with rights and autonomy as the basis for protecting children. It was prompted by child protection cases encountered as a lawyer involving families from minority religious communities. The cases raised questions about cross-cultural norms for child protection. The need for such norms, emphasised in the Laming report into Victoria Climbie's death through exorcism, is further highlighted by phenomena like forced marriage and 'honour' killing. Government documents and judicial decisions assume that such norms are found in children's rights and
