Abstract:
The genesis of the Russian pre-trial proceedings in a criminal case is considered and the reasons that predetermined its modern system are analyzed.
 The purpose of pre-trial proceedings is highlighted; the procedural status of subjects authorized to initiate and preliminary investigation of criminal cases is disclosed.
 The essence is characterized and the legal conditions for the implementation of pre-trial stages of criminal proceedings are considered. The article describes in detail the criminal procedural mechanisms included in the content of pre-trial proceedings:
 investigative actions, forensic examinations, "technical" methods of collecting evidence, measures of criminal procedural coercion, the procedure for bringing as an accused and the end of the preliminary investigation.
 For students and students of universities who master the educational programs of the master's degree in legal orientation. The textbook may be useful for students, cadets and trainees studying under bachelor's and specialty programs, researchers and practitioners, teachers, graduate students (adjuncts).

This chapter discusses the meaning of hearsay in criminal proceedings and the categories of hearsay admissible by statute in such proceedings. It considers the relationship between the hearsay provisions of the Criminal Justice Act 2003 (the 2003 Act) and Article 6 of the European Convention on Human Rights as it relates to hearsay; the definition of hearsay and its admissibility under the 2003 Act, including admissibility under an inclusionary discretion (section 114(1)(d); and safeguards including provisions relating to the capability and credibility of absent witnesses the power to stop a case and the discretion to exclude. Also considered in this chapter are: expert reports; written statements under section 9 of the Criminal Justice Act 1967; and depositions of children and young persons under section 43 of the Children and Young Persons Act 1933.

Abstract:
This chapter focuses on the rights of dependent children when their parents are sentenced for criminal offences. It provides an introduction to the harms which children suffer as a consequence of the imprisonment of their parents. The chapter considers whether sentencers take into account the impacts of a custodial sentence on those children. It examines the application of the United Nations Convention on the Rights of the Child 1989 (UNCRC) to children whose parents are facing imprisonment due to criminal convictions. The way in which the rights of a child as specified in the UNCRC are given consideration in adult sentencing proceedings is examined and is contrasted with the treatment of children separated from their parents by the state. The chapter concludes with a discussion of the implications of disregarding the rights of children rather than adopting an approach which upholds their rights.
