Abstract:

For most of the past century, the positive outcome of grief in the West was characterized as the relinquishment of the bond to the deceased. Phrases such as "let go", "move on", and "get over it" were, and continue to be, common to the language of this pursuit. This 'breaking bonds' perspective does not take into account other means of grief resolution, nor does it consider historical or cultural findings. Consequently, reports of bereaved parents who indicate resolution of grief yet maintain a continued relationship with their deceased child were not given much attention until the 1990s. This research employed a Durkheimian approach, taking the social bond as the starting point of inquiry and examined continuing bonds of parents to their murdered children. How these bonds were related to the parents' attitudes of re-investing in life and their level of grief was measured. The relationship between the parents' level of grief and their life attitudes was also assessed. The sample consisted of 46 parents living in North Texas whose child had been murdered three or more years ago. A triangulated methodology was utilized and the data were collected by means of participant observation, unstructured interviews, and a mailed questionnaire which obtained information on continuing bonds, level of grief, life attitudes and demographic variables. Multiple regression techniques were utilized to analyze the quantitative data. Parents on the Continuing Bonds Scale reported high levels of bonds with their deceased child. Contrary to expectation, the level of continuing bonds parents maintained with their children was found to be independent of other variables in the study. The relationship between parents' level of grief and their life attitudes was inverse in that higher levels of grief were associated with lower levels of re-investing in life. The finding of the independence of the Continuing Bonds Scale indicates the parent's level of grief and life attitudes are not related to continuing bonds; the bonds exist regardless. The relationship between level of grief and life attitudes points to a crisis of meaning.

Abstract:

Previous studies have found a relationship between attributions of blame and traumatic events such as crime, illness, and accidents/disasters, albeit inconclusive as to the benefits or detriments of self- and other-blame on adjustment outcome (e.g., Janoff-Bulman, 1979; Joseph, Brewin, Yule & Williams, 1991,1993; Derry & McLachlan, 1995; Frazier & Schauben, 1994). The effects of attributions of blame on the adjustment outcome of family members bereaved through murder has been neglected. Therefore, little is known about such benefits to adjustment in this population. In addition, no longitudinal research has been conducted so little is known about this process of adjustment. A retrospective longitudinal study investigated emotional state and event-related impact, attributions of blame, control and just world cognitions, revenge and disabling distress. Thirty-four family members, recruited from "Families of Murdered Children", were interviewed and completed four psychological measures. They were followed up six and twelve months later. On all three occasions, subjects showed high levels of negative emotional state and event-related impact, especially older, female and support seeking subjects. Self-blame and feelings of revenge were linked to higher levels of negative emotional state and event-related impact, especially in female subjects. Control and just world cognitions were not related to emotional state and event-related impact. Negative emotional state at Time 1 was predictive of poor overall adjustment at Time 2 and Time 3, while gender was predictive of poor overall adjustment at Time 2. Subjects suffering from distress that interfered with their daily lives at Time 3 had higher negative emotional state and event-related impact at Time 1, Time 2 and Time 3. In order to further investigate the effects of blame attributions on mood, a randomised between-subjects laboratory study was conducted. Eighty-seven undergraduates were assigned to one of three writing conditions (self-blame, other-blame and no blame/control) with mood being assessed before and after writing. Results showed that negative mood had been cognitively induced, however, no condition effects occurred. The mood effect was greater for women than men. Implications for theory, practice and future research in relation to the main findings are discussed.

Abstract:

This study was undertaken in an effort to contribute to the limited knowledge of women who commit murder. Women account for approximately 10% of the total Australian homicides and according to Mouzos (2000), 20% of these female perpetrated homicides result in murder convictions. In her extensive study of female homicide offending in England, Brookman (2005) asserts that nearly two thirds of the victims of women who kill are intimates, to include violent partners and their own children. The other third of the victims consist largely of acquaintances and to lesser degree strangers (Brookman, 2005). This study strives to introduce further knowledge regarding women convicted of murder; the smaller subgroup of female homicide offenders of which less is known. It is comprised of women who killed intimates and non-intimates to include acquaintances. The study engages the narratives of seven women, all of whom were convicted of murder and serving lengthy sentences at the Dame Phyllis Frost Centre, a medium and maximum security prison that is located on the outskirts of Melbourne, Australia. The seven women fall largely outside of the characteristics of female homicide offenders as revealed in the studies from Australia’s National Homicide Monitoring Program (NHMP, 2007), from Canada by Hoffmann, Lavigne, and Dickie (1998) and research from the United States by Scott and Davies (2002). In this study there were no Indigenous women represented. Only one of the women had a previous criminal charge. The women were older on average than the prevailing demographics from western nations. Two of the women had substance abuse and co-occurring mental illness, which reflects a significant lower rate than the literature suggests. This study expands the current understanding of the phenomenon of women who murder. It communicates the narratives of seven women charged and convicted of murder as they attempt to understand their lives and identities. It moves the dialogue beyond the preponderance of feminist criminological research that examines motive and the relationship the woman has with her victim to the social discourses which dominate in her identity formation. This research found that in their attempt to create a favourable identity the women needed to engage with the master script of normative femininity through the feminisation of victimisation, motherhood and domesticity.

Abstract:

Children belong to one of the most vulnerable population groups to crime. Child victims of crime have to overcome the difficulties emerging from their victimization as well as those resulting from their participation in the adversarial criminal justice process. Child victims are typically treated by legal systems as either mere witnesses -- prosecutorial instruments -- or as objects of protection. Children's human rights and their needs beyond immediate protection are typically ignored. ¶ This thesis combines an examination of children's human rights (articulated largely in the UN Convention on the Rights of the Child) with a review of psycho-social literature on children's needs. It integrates the two disciplines thus creating a `needs-rights' model regarding child victims. This model is then used to evaluate the criminal justice process and its successes (and failures) in meeting the needs and rights of child victims. Such an integrated needs-rights evaluation identifies not only the difficulties associated with testifying in court and being interviewed multiple times. It goes beyond these topical issues, and uncovers other shortcomings of the current legal system such as the lack of true participation of child victims in the decision-making process, the neglect of rehabilitative and developmental interests of victimized children, and the inherent inability of the adversarial process to seek proactively the best interests of child victims. ¶ The thesis further explores an alternative to the criminal justice process -- that of restorative justice -- and examines its applicability to child victims. Unlike the criminal justice paradigm, restorative justice fosters the equal participation of the stakeholders (in particular victims, offenders and their communities), and focuses on their emotional and social rehabilitation while respecting their human rights. To explore the suitability of restorative justice for child victims, five restorative justice schemes from New Zealand, Australia and Canada and their evaluation studies are reviewed. Each of these schemes has included child victims, and most of them have dealt with either sexual assaults of children or family violence and abuse. Yet each of the evaluated schemes illuminates different concerns and proposes varying strategies for meeting the needs-rights of child victims. ¶ While these schemes demonstrate the significant potential of restorative justice to better address the full scope of the needs and rights of child victims, they uncover emerging concerns as well. Therefore, in the last part of the thesis, the needs-rights model is used once again to derive subsidiary principles for action, to maximize the benefits of restorative justice for child victims and minimize the related risks. A complex set of needs and rights is managed by a method of grouping them into needs-rights clusters and deriving from them simple heuristics for practitioners to follow. This clustering method of needs-rights-heuristics is a methodological contribution of the research to the psychology of law.

Abstract:

This thesis is concerned with the way in which child murderers have been viewed in the past. Not the killing of children by adults, but the more unusual occurrence of children killing other children. Focusing on the earliest recorded cases in medieval society, up to and including Mary Bell, it will be argued that English societies of the past were as much preoccupied as the contemporary world with the vexing issue of where childhood ended and adulthood began. The genesis of a child's status in law evolved, in part, through connection with these crimes. The religious source of a child's moral discernment was formative in early legal discussions on the age of criminal responsibility. The state of a child's soul was relevant to the judgements that could be made of him, not only in a narrow legal sense, but also in wider cultural ways. In the eighteenth century, the opinion individuals and communities held about child killers were inseparable from the sensibilities of that period and the conflicting imperatives of mercy and retribution. The perceived content of a child's moral knowledge changed in line with shifting debates about childhood. The ideas of Rationalism and Romanticism were placed under considerable tension when viewed through the example of the child killer. In the first half of the nineteenth century, discussion on criminals, especially murdering children, became in effect, a commentary on different political visions of humankind. In later scientific narratives of morality, the example of child killers furnished medical categories of mental disease. The issue of moral responsibility in law was increasingly challenged by the developing psychology of human behaviour. Freud's innovative understandings of childhood raised the problem of how to attribute guilt to developing capacities. Later clinicians used his legacy in their attempts to make sense of the disturbed child, and late twentieth century examples of child murder reveal the fragility of these understandings. The contention is that children who commit these crimes become the repository of projected adult anxieties about childhood. Furthermore, such crimes, by virtue of their exceptional nature, lead to political and moral judgements whose origins can be seen in the fundamental moral ideas of the past.

Abstract:

The non-victimized siblings in incestuous families have often been ignored in research, literature, and treatment. This study explored these siblings' 1) relationship to the victim, 2) attribution of blame, and 3) adjustment. Participants were 30 non-victimized siblings of incest victims, between the ages of 8 and 14. They completed the Sibling Relationship Questionnaire, the Revised Children's Manifest Anxiety Scale, the Self-perception Profile for Children, the Children's Depression Inventory, and a questionnaire developed for this research. Participants' scores were compared with the normative sample scores on several measures. Siblings perceived little warmth and closeness in their relationships to their victimized sisters. Rivalry and conflict were within normal limits. Siblings blamed victims and other family members less than expected, with the greatest amount of blame attributed to perpetrators. Adjustment was impaired. Males demonstrated less athletic competence, less global self-worth, more worry and oversensitivity than normative samples. Females showed a tendency toward less global self-worth and heightened general anxiety. Siblings' overall level of emotional distress was higher than most of the normative samples.

Abstract:

There are an estimated 200,000 children of prisoners in the UK. However, research into their needs is limited, especially studies including their voice. An in-depth, small-scale explorative approach was undertaken, focusing on these children's resilience and their emotional and psychological needs. The aim of the research was to investigate how children with a parent in prison experience and understand their lives in order to support professional practice. The research involved five young people, aged 8-13, who were interviewed separately on two occasions each, using semi-structured interviews and Personal Construct Psychology resources. Transcripts were analysed using Interpretative Phenomenological Analysis. The young people showed many signs of resilience and being able to use support from family, friends, school and the community, along with their own creative coping strategies. Maintaining contact with a parent in prison was strongly valued by four of the children, although contact often carried constraints. All had additional stressors to cope with such as supporting their mother's well-being, and were frustrated by a lack of control over their own lives. Difficulties in trusting others and feeling trusted were identified as important themes. I discuss the implications from the findings within the thesis. These include how children with a parent in prison need to feel listened to, especially in light of the new Code of Practice (2014) focusing on empowering young people. The role of the EP in this under-represented area of professional practice is discussed.

Abstract:

Violence-exposed children are unintended victims, often an unseen and overlooked victim group in society. It is a societal responsibility that all victims are realized and supported. Through describing the perspective of professionals meeting these children, their status and opportunities in society and legal system can be investigated. To study professionals’ experiences, conceptions, and knowledge about violence-exposed children, a questionnaire was distributed to 63 professionals, representing police, prosecutors, social- and treatment personnel. Qualitative questions about experiences and knowledge were analysed thematically. Additional quantitative statements of held conceptions were analysed with t-tests and regression methods. Findings revealed these children are still overlooked; psychological knowledge about their symptoms, testimonies, and perspective is lacking; professional routines/guidelines are missing; and problems such as children’s legal status as non-victims are hindering effective work to guarantee these children’s care. Results provide information facilitating necessary changes to ensure this group of psychologically abused victims’ recovery and societal rights.

ENGLISH ABSTRACT: In 2002 the South African Law Commission published a report in which amendments to the existing rules of criminal procedure and evidence were proposed. A number of these recommendations have since been included in a Bill that was tabled before Parliament in 2003. The proposed amendments largely reflect values which underlie the "Victims' Rights" movement. The aim of this thesis is to consider the possible influence of these amendments on the constitutionally guaranteed fair trial rights of the accused. The study focuses on those amendments that play a role in the prosecution of alleged sexual offences against children, and shows that although the recognition of victims' rights is important, it should not be done at the expense of a fair trial. Dangers inherent to the proposed amendments are therefore highlighted. The rights of the accused are used to test the desirability or not of the proposed amendments. Foreign authority is used to support the argument made in the thesis.
AFRIKAANSE OPSOMMING: In 2002 het die Suid-Afrikaanse Regskommissie 'n verslag gepubliseer waann veranderings aan die huidige strafprosesreg- en bewysregreëls voorgestel word. 'n Aantal van hierdie voorgestelde wysigings is intussen opgeneem in 'n Wetsontwerp wat in Augustus 2003 voor die Parlement gedien het. Die voorgestelde wysigings reflekteer tot 'n groot mate waardes wat die "Victims' rights" beweging onderlê. Die doel van hierdie tesis is om die moontlike invloed van hierdie wysigings op die grondwetlik verskanste billike verhoor regte van die beskuldigde te ondersoek. Die ondersoek fokus op daardie veranderinge wat 'n rol speel in die vervolging van beweerde geslagsmisdade teen kinders. Daar word aangetoon dat alhoewel die erkenning van regte vir slagoffers belangrik is, dit nie ten koste van 'n regverdige verhoor gedoen kan word nie. Gevare verbonde aan die voorgestelde wysigings word dus uitgewys. Die regte van die beskuldigde word deurgaans gebruik om die wenslikheid al dan nie van die voorgestelde wysigings aan te toon. Buitelandse gesag word aangewend om die betoog te ondersteun.

Abstract:

This study scrutinises, from a critical perspective, how Swedish mainstream news media depict children and youths categorised as unaccompanied after the identified discursive shift in the late autumn of 2015, where a more hostile and negative reporting on refugees became even more prominent. In addition, it explores what different power structures that are made visible in the news reporting. This is made possible by scrutinising 40 articles from the major national newspapers in Sweden that have daily releases, the so called mainstream media. The critical discourse analysis is used as a method and theory in order to find a focus that is critical and questioning towards existing power structures. Additionally, it contains a focus on how borders and differences are created between certain groups of people by using theoretical perspectives on otherness and postcolonial theory. The study shows an ambivalent media picture and clearly makes unequal and hierarchical power structures visible through the use of different assumptions, accepted truths and journalistic techniques.

Abstract:

Bullying in American schools has increased to what some have considered an epidemic and is a major problem among youth. Bullied youth experience poorer mental health and lower school performance, in comparison to those who are not bullied, and the growth of bullying has raised concerns from parents, schools, policy makers, and human-services professionals interested in prevention and intervention of bullying behaviors. The purpose of this study was to explore how parents whose children experienced school bullying perceived school administrators, teachers, antibullying school policies or programs, and their family's dynamics, to better understand the parents' internal experiences. The theoretical framework for this study was the symbolic interactionism theory, which posits that individuals develop subject meanings of themselves and their world, based on their experiences. A phenomenological study design was employed, using purposeful semistructured interviews of 7 parents of different schools, all of whom had witnessed bullying in their children's lives. Data were open coded and analyzed for emergent themes. The study showed that these 7 parents were not satisfied with their respective school's approach to handling bullying, especially when their home environments were adversely impacted. One recommendation that stemmed from these findings was to establish sanctions for schools failing to adhere to bullying policies. This study may provoke positive social change in the area of school safety and in areas concerning improved understanding and communication among parents, teachers, school administrators, and other professionals. Along with this notion, students may have the opportunity to thrive in a more secure atmosphere, which may lead to positive social and emotional achievements that may promote higher societal achievements.

Abstract:

Examination of previous empirical literature illustrates how researchers have concentrated on documenting the impact of childhood sexual abuse (CSA) on the later psychological functioning of survivors, through comparisons with those who have not had such a history. Only more recently has there been a focus on assessing the relationship between aspects of the abuse and specific psychological difficulties. This thesis investigated the relationships between CSA characteristics and womens later psychological adjustment. The role of attributions, coping methods, parenting competency and marital satisfaction were also investigated. Qualitative data on perception of benefit and general reflections of participants were used to explore participants self-esteem, locus of control, decisions relating to parenting, disclosure experiences, and attributions in relation to their abuse, including the search for meaning. Recruitment through newspapers and counselling services led to 118 women volunteering to complete a questionnaire evaluating the characteristics of their CSA and their current psychological adjustment. Of this group, 33 subsequently volunteered to participate in a telephone interview that explored in greater depth issues related to the long-term impact of their CSA. Both quantitative and qualitative analyses were conducted on the data. The women reported a high prevalence of dysfunction in their families of origin. Abuse had generally commenced by middle childhood, and lasted for a number of years and often involved a number of perpetrators. Perpetrators were most likely to be intrafamilial, with stepfathers being over-represented. Sexual activities generally involved physical contact, with participation often induced by the use of coercion. Participants demonstrated significant difficulties in psychological adjustment, but attributions regarding the abuse improved over time. Some concerns were expressed regarding parenting competency, and avoidant coping methods were favoured. In general, participants were satisfied with their current marital relationship. Significant associations were found between coping methods, attributional style, beliefs and various psychological adjustment measures. Participants, in general, demonstrated low self-esteem and displayed an external locus of control. As a consequence of their experience of CSA, many participants reported they had decided not to have children. For those who did have children, CSA was almost universally seen as having had an impact on their parenting. Disclosure of CSA was usually delayed for a number of years, with poor outcomes generally resulting from disclosure when it occurred. Women with current partners rated them as very caring and not controlling. Participants were generally still searching for meaning in their abuse, despite many having accepted it. Survivors outlined an extensive range of long-term effects of CSA, and nominated a number of strategies that would assist in reducing these effects. The results of the study indicated that there are a number of characteristics associated with CSA which signal a higher risk of difficulties in psychological adjustment. Concerns of survivors regarding parenting were confirmed according to those who undertook this role. Unfortunately, concerns expressed by survivors that disclosure of their CSA would have had negative consequences was usually the case when they did finally disclose. However, the accessing of social and family support appeared to have an important role in changing the attributions of survivors regarding their CSA. Furthermore, change of attributions in relation to abuse may provide the key to resilience in survivors against the negative impact of CSA on later psychological adjustment.

Abstract:

The world of journalism is becoming increasingly dangerous, as figures published by international media organisations demonstrate. But the Western news media suggests, that particularly Western foreign correspondents are facing incredibly high risks and cases of abducted, tortured and murdered foreign correspondents are reported regularly. The question arises “Have they become targets?” Foreign correspondence has been a dangerous occupation since it first emerged during the Crimean War, when the first consistent war reporting was established. Ever since then, foreign correspondents have had to face opposition, criticism and harsh realities. However, they have also always been highly valued journalists and well-respected for their courage to travel overseas, often into conflict-riddled areas, to report important news to their audiences back home. Sometimes they have even lost their lives in the pursuit of truth. Daniel Pearl, Christian Struwe and Karen Fischer or Trent Keegan are just a few examples of the many correspondents and journalists who have died as martyrs for their profession. As the actual data published by international media organisations, such as Reporters Without Borders, the Committee to Protect Journalists or Freedom House, suggests, it has rapidly become worse for all journalists in the last 20 years and there is worse to come. It appears as if the factors leading to their deaths are increasing and will be contributing to even higher death tolls in the future. The thesis will consider such questions as: Who is there to protect journalists and foreign correspondents? Independent media organisations are trying their best. The international press is bemoaning the many deaths and governments have promulgated laws to protect their reporters, but does that actually help? Will those attempts make it better in future? And can the Western news media apparatus itself be held partly responsible for some of the deaths?
