Lo que se busca es destacar las principales fortalezas y debilidades de la regulación chilena en relación a la normativa contenida en la Ley 19/2013 y con ello establecer algunas bases mínimas que permita abordar ambas legislaciones en forma comparada, procurando destacar los aspectos mejor logrados en cada una de ellas.

Abstract:
El objetivo de este trabajo es evaluar un proyecto fotovoltaico como fuente de energía alternativa en el sector de salud primaria como estudio de caso, desde la perspectiva económica y social. La evaluación se basó en variables técnicas y económicas bajo los criterios de Valor Actual Neto (VAN) y Tasa interna de retorno (TIR), valorizando las reducciones de carbono (CO2) y utilizando la tasa de descuento social del Ministerio de Desarrollo Social. Los resultados son favorables y sugieren la ejecución de este proyecto como iniciativa de política pública. Sin embargo, queda en evidencia que en periodos de invierno no se cubre las necesidades energéticas, haciendo imprescindible diversificar la matriz con fuentes tradicionales. Abstract:
En este trabajo se analizó el nivel de percepción de los estudiantes sobre la calidad del servicio los centros universitarios. Para ello participaron 684 estudiantes de pregrado de un programa de estudios elegidos aleatoriamente, a quienes se les aplicó una escala que intenta calcular lo que se espera del servicio educativo. Se encontró que el nivel de percepción es aceptable con tendencia a ser buena sobre la calidad del servicio que presta la universidad, no se encontraron diferencias estadísticamente significativas según la ocupación del estudiante, sin embargo, si se hallaron diferencias según género y centro de estudios evaluados. Por lo tanto, la calidad del servicio aceptado por el estudiante de la universidad se ve reflejada en el aspecto físico, la modernización y el equipamiento, precisando que el personal administrativo debe capacitarse mejor para brindar una adecuada atención al usuario. Abstract:
Este caso relata la crisis financiera de AD Retail, un holding que operaba en el sector del retail chileno. El holding AD Retail ha mostrado un deterioro en sus indicadores financieros desde finales del 2015, pero la situación se agudizó entre el 2017 y el 2018. Las consecuencias del estallido social que se detonó en octubre del 2019 en Chile intensificaron los problemas financieros de la compañía. El estallido social afectó los márgenes de la empresa y generó menores niveles de recaudación, lo que se tradujo en una liquidez insuficiente para cumplir con sus obligaciones de pago. Esto llevó al Directorio, el 24 de diciembre del 2019, a tomar la decisión de someterse de forma voluntaria a la ley de quiebras e iniciar una reestructuración de sus pasivos y activos, lo que permitiera la viabilidad de la compañía. Tras esta decisión, Pablo Turner, presidente del Directorio de AD Retail, percibía que acogerse a la ley de quiebras cambiaría el plan estratégico 2020-2022 que había sido aprobado en septiembre del 2019 y cuyo objetivo era volver a tener utilidades en el 2020. En particular, Turner se preguntaba, ¿por qué Dijon no había generado el valor corporativo esperado tras su adquisición en el 2013?, ¿por qué el holding no pudo hacer frente a los efectos causados por el estallido social?, ¿era el plan estratégico 2020-2022 acorde a la situación que estaba atravesando la compañía?, ¿qué alternativas tenía AD Retail para salir de la crisis financiera? Aunque su mayor preocupación era si el estallido social se extendería durante el 2020 y sus posibles consecuencias para la economía chilena, lo que llevó a preguntarse a Turner: ¿es la hora del cierre definitivo de AD Retail?.

490 Background: LEN has demonstrated the efficacy and safety in pts with aHCC as first-line treatment in the pivotal REFLECT trial. Further evaluation in real-world setting is necessary to measure the clinical outcomes of LEN in daily practice. Methods: This is a multicenter retrospective analysis from 3 Korean referral cancer institutions. Between September 2018 and August 2019, a total of 74 pts received LEN for the management of BCLC B or C aHCC, and 66 pts who had at least one follow-up visit after the start of LEN were included in this analysis. Results: Median age was 58 years (range, 19-81), and 46 pts (69.7%) were male. Baseline characteristics were as follows; Child-Pugh class A/B/C in 46 (69.7%)/14 (21.2%)/6 (9.1%), BCLC B/C/D in 1 (1.5%)/63 (95.5%)/2 (3.0%), prior systemic therapy in 25 (37.9%) including 14 (21.2%) with prior immune checkpoint inhibitors (ICIs). LEN was used as first/second/third to fourth lines of therapy in 41 (62.1%)/13 (19.7%)/12 (18.2%) pts, and 27 (40.9%) had extensive disease extent excluded in the REFLECT trial. With a median follow-up duration of 4.8 months (95% CI, 3.4–6.1), the median PFS and OS were 4.6 (95% CI, 3.2-6.0) and 7.5 months (mo) (95% CI, 3.7–11.2), respectively, in overall pts: first-line setting, 4.2 (95% CI, 3.2-5.2) and 6.5 mo (95% CI, 5.0-8.1), respectively; ≥ second-line setting, 6.1 mo (95% CI, 3.6–8.5) and not reached, respectively. In pts with prior ICIs, median PFS was 6.1 mo (95% CI, 1.8-8.4) and median OS was not reached. According to the RECIST v 1.1, response rates and disease control rate were 12.1% and 71.2%, respectively, in overall pts. The most common grade 3-4 toxicities were hyperbilirubinemia (n=9, 13.6%), AST elevation (n=5, 7.6%), diarrhea (n=4, 6.1%) and fatigue (n=4, 6.1%). Conclusions: LEN was effective and well tolerated in pts with aHCC in Korean real-life setting.

Este artículo de reflexión es el resultado de la revisión analítica, interpretativa y crítica de los documentos, leyes y jurisprudencia relacionada con el derecho al olvido de los pederastas, la pedofilia y la pederastia, cumpliendo con los objetivos principales de clarificar los conceptos objeto de discusión y formular posibles alternativas frente a las escasas limitaciones para la vinculación al mercado laboral de quienes han sido condenados por delitos sexuales contra menores de catorce años. Mediante la utilización del tipo de investigación dogmática, descriptiva y de análisis estático de precedente se logró concluir que la pedofilia, al ser una enfermedad incurable, debe ser tratada con el fin de evitar su materialización en la pederastia y, como medida preventiva de delitos, el Congreso de la República de Colombia ostenta la misión de reglar el manejo de las bases de datos de los condenados por estos delitos a través de una ley estatutaria. Abstract Background: Cherubism, caused by autosomal dominant mutations in the SH3BP2 gene, is characterized by increased bone resorption with development of bilateral fibro-osseous lesions limited to the maxilla and mandible. The SH3BP2 gene is thought to be involved in osteoclastogenesis. Affected children, while usually asymptomatic at birth, typically present at 2–5 years of age with cheek and jaw swelling with upward tilting of eyes due to expansion of fibrous tissues. Bone resorption and proliferation of lesions continues until puberty after which spontaneous regression occurs. RANKL is a cytokine expressed on the surface of osteoclast precursors and is responsible for inducing osteoclast differentiation. Denosumab is an anti-RANKL monoclonal antibody which prevents osteoclast maturation. However, it has a short half-life, and effects on bone turnover have been found to be rapidly reversible after drug discontinuation. The rebound increased bone turnover can lead to severe hypercalcemia. Clinical Case: A 4 year old boy with cherubism (c.1253C>G pathogenic variant in SH3BP2), after failing a 10-month trial of tacrolimus, was placed on monthly denosumab (2 mg/kg) for a total of 10 doses. During denosumab therapy, he received calcium and vitamin D to prevent hypocalcemia; these were stopped once denosumab was discontinued. He presented to the hospital 4 months after the final denosumab dose with polyuria, polydipsia, fatigue, nausea and abdominal pain. Work-up revealed serum Ca 15.3 mg/dL (N: 8.4–10.2), PTH <3 pg/mL (N: 24–86), 25-OH vitamin D 32 ng/mL (N: >19 ng/mL), 1,25-dihydroxyvitamin D 6.7 pg/mL (N: 19.9–79.3), and urine Ca/Cr 0.48. Renal ultrasound showed normal kidneys with a small amount of layering debris in the bladder. During hospitalization, he received IV fluids, 1 dose of furosemide, 3 doses of calcitonin, 24 hours of hydrocortisone, and a single 0.5 mg/kg dose of pamidronate. He was discharged 48 hours after the bisphosphonate with serum Ca 9.5 mg/dL. He returned with serum Ca 13.5 mg/dL 9 days after the pamidronate and was readmitted. He again received 4 doses of calcitonin and 1 dose of pamidronate (0.5 mg/kg). Calcium levels improved to 9.5 mg/dL at discharge but rose to 11.6 mg/dL a week later. He received a 0.05 mg/kg dose of zoledronate outpatient, with improvement in serum Ca to 10.1 mg/dL. A week later, he twisted his ankle, resulting in transverse impacted buckle fractures of his left distal tibia and fibula; no lytic or sclerotic lesions were noted on x-ray. His leg was immobilized by Orthopedics. Calcium levels remained within range (9.9 mg/dL) 7 months after the zoledronate. Conclusion: Rebound hypercalcemia can occur months after denosumab withdrawal, indicating the need for close monitoring of calcium levels in patients who receive this drug. The hypercalcemia appears to respond best to bisphosphonates, with a more sustained response to zoledrenate compared to pamidronate.

This article seeks to deepen the debate on leadership, exploring specifcities of the Brazilian context on this topic, more specifically the principle of democratic management. The reflection focuses on both topics, explaining the path of the debate on democratic management since the mid-eighties of the twentieth century, passing through the Federal Constitution of 1988, the Law of Guidelines and Bases of National Education - Law number 9.394/96) and arriving on the most recent context, where the National Education Plan (PNE), of 2014, incorporates the subject to its goals. Considerations are presented on program contents of two national training programs: the Distance Training Program for School Managers (Progestão) and the National School Program for Managers of Basic Public Education (PNEGEB), also known as School of Managers. The main regulatory frameworks for democratic management are focused on relevant legislation. The study allows us to suggest the hypothesis that the principle of democratic management, associated with a political leadership, would have preponderated in the literature and initiatives of formation of school directors in the country, being the more technical dimension of the subject a little prioritized theme. In this sense, it can be said that the topic of leadership, as it is configured in other contexts, has become a repressed demand in Brazilian educational policy.ResumoEste artigo procura aprofundar o debate sobre liderança, explorando especificidades do contexto brasileiro em relação a esta temática, mais especificamente o princípio da gestão democrática. A reflexão detém-se sobre os dois temas, explicitando a trajetória do debate sobre gestão democrática desde meados dos anos oitenta do século XX, passando pela Constituição Federal de 1988, a Lei de Diretrizes e Bases da Educação Nacional – LDB (Lei nº 9.394/96) e chegando ao contexto mais recente, onde o Plano Nacional de Educação (PNE) de 2014 incorpora o assunto às suas metas. São apresentadas considerações sobre conteúdos programáticos de dois programas nacionais de formação: o Programa de Capacitação a Distância para Gestores Escolares (Progestão) e o Programa Nacional Escola de Gestores da Educação Básica Pública (PNEGEB), também conhecido como Escola de Gestores. Os principais marcos regulatórios da gestão democrática são focalizados na legislação pertinente. O estudo permite sugerir a hipótese de que o princípio da gestão democrática, associado a uma liderança de natureza política, teria preponderado na literatura e iniciativas de formação de diretores escolares no país, sendo a dimensão mais técnica do assunto um tema pouco priorizado. Child Distance Learning (CDL) during the pandemic has led to an optimal development of children and effective teaching and learning processes in kindergartens. To overcome this, teachers need to apply a teaching approach in accordance with the principles of kindergarten education. In addition, teachers' self-efficacy of their ability to teach is also important for developing children's skills. This study aims to describe the teaching approach and the efficacy of kindergarten teachers during the CDL process and to identify the relationship between the two. The research method used is quantitative through document analysis as a source of data findings. A total of 116 Public Kindergarten (PK) teachers in DKI Jakarta participated in filling out the Classroom Management Scale and Teachers' Sense of Efficacy Scale online. All data were processed using descriptive statistics and correlation. Furthermore, there is a document analysis carried out on the Daily / Weekly Learning Program Design in PK Jakarta. The findings identified that the teaching approach of kindergarten teachers during CDL included only two principles of kindergarten education, namely thematic teaching and developing life skills. Furthermore, PK teachers in the Jakarta area showed low self-efficacy during CDL. The teaching approach and self-efficacy were caused by teachers' unpreparedness in facing challenges during CDL. In addition, other findings indicate that there is a relationship between teaching approaches and teacher self-efficacy. Another CDL model Interventions to increase teacher self-efficacy and the extent to which the relationship between the two variables can be studied further in future studies. Abstract:
El objetivo del estudio fue analizar el nivel de compromiso laboral según factores sociolaborales en colaboradores de dos gobiernos locales, el estudio se realizó en 477 colaboradores de gestión local elegidos aleatoriamente, a quienes se les aplicó la escala UWES-17 (Utrecht Work Engagement Scale). Se encontró que el nivel de compromiso laboral en los colaboradores es de nivel medio, no se encontraron diferencias estadísticamente significativas según sexo y condición laboral, sin embargo, si se hallaron diferencias según centro de trabajo. En conclusión, el nivel de compromiso laboral en los colaboradores se debe a que aún no han experimentado totalmente un estado psicológico positivo hacia su trabajo, para poder dedicarse, involucrarse, entusiasmarse y sentirse bien en su espacio laboral. Background: Maternal and child morbidity and mortality in developing countries have been shown to be reduced by effective use of contraceptive methods. Contraceptive use also improves the lives of women and children. Experience with previous use of contraceptives may affect the uptake rate of modern contraceptive methods. Aim and objective: To determine the pattern of previous contraceptive usage, uptake rates of the contraceptives, the continuation and discontinuation rates and the sources of prior contraceptives. The socio-demographic characteristics and sources of information on current contraceptive use at the Rivers State University Teaching Hospital during the study period. Methods: This was a retrospective study of clients’ records in family planning clinic at theRivers State University Teaching (RSUTH) over a period of five years. Their cards were retrieved, reviewed; data was extracted, coded and analyzed using the statistical package for social sciences (SPSS) IBM version25.0 (Armonk, NY). Results: There were 874 contraceptive acceptors attending family planning clinic between 1st January, 2015 and 31st December, 2019 in the centre. Of this number, 566 (64.8%) were using one form of contraceptive method or the other while 308 (35.2%) were not on any form of contraception. Of this 566 women who used contraceptive method prior to their visit to the family planning clinic, intrauterine contraceptive device (IUCD) use accounted for 118 (20.8%), others were barrier method, 107 (18.9%), oral contraceptive pills (OCPs), 95 (16.8%), depot medroxyprogesterone acetate (DMPA), 72 (12.7%), implanon, 40 (7.1%), noristerat, 36 (6.4%), postinor, 28 (5.0%), withdrawal method, 26 (4.6%) and calendar method, 24 (4.2%). Most of the previous contraceptives used came from Government hospital accounting for 44.4%. Most women (72%) obtained their information concerning current contraception from clinical personnel. More than half of the clients (64.1%) were within the age range of 30-39 years and 2 (0.2%) were below 20 years. Age range for the study was 19-51years. Majority of the clients (70.7%) were multipara while 162 (18.5%) were grandmultipara. Modal parity was para 3. The women with formal education were 867 (99.2%). Married women and Christians accounted for843 (96.5%) and 867 (99.2%) respectively. Conclusion: Most clients were in their thirties, married, educated and multiparous. Thirty five percent of the women were not using any form of contraceptive method which is quite alarming and definitely would have led to unwanted pregnancies and possibly induced abortions with its sequalae.

Este trabajo es un estudio analítico y comparativo entre el régimen de contrato laboral vigente en Ecuador y el contrato de teletrabajo que busca resolver el problema legal de establecer si la relación laboral de teletrabajo configurada como contrato de trabajo puede estar sujeta a las reglas generales de los contratos o reglas específicas del contrato de vivienda contempladas en el Código de Trabajo Ecuatoriano. Como el teletrabajo no está reconocido por la legislación laboral ecuatoriana, el trabajo se divide en tres capítulos diferentes que buscan solucionar el problema legal mencionado. Se exponen todas las características, elementos y demás cuestiones relevantes al régimen de contratación laboral, sirviendo de antecedente para el análisis comparativo antes mencionado. Posteriormente, se hace una descripción y análisis de la figura del teletrabajo, así como sus características y elementos que lo convierten en una figura diferente y única. Finalmente, se hizo un análisis del trabajo a domicilio (modalidad que está regulada por la legislación laboral ecuatoriana) para luego pasar a compararlo con el teletrabajo. Abstract:
The pandemic of COVID-19 has afflicted every individual and has initiated a cascade of directly or indirectly involved events in precipitating mental health issues. The human species is a wanderer and hunter-gatherer by nature, and physical social distancing and nationwide lockdown have confined an individual to physical isolation. The present review article was conceived to address psychosocial and other issues and their aetiology related to the current pandemic of COVID-19. The elderly age group has most suffered the wrath of SARS-CoV-2, and social isolation as a preventive measure may further induce mental health issues. Animal model studies have demonstrated an inappropriate interacting endogenous neurotransmitter milieu of dopamine, serotonin, glutamate, and opioids, induced by social isolation that could probably lead to observable phenomena of deviant psychosocial behavior. Conflicting and manipulated information related to COVID-19 on social media has also been recognized as a global threat. Psychological stress during the current pandemic in frontline health care workers, migrant workers, children, and adolescents is also a serious concern. Mental health issues in the current situation could also be induced by being quarantined, uncertainty in business, jobs, economy, hampered academic activities, increased screen time on social media, and domestic violence incidences. The gravity of mental health issues associated with the pandemic of COVID-19 should be identified at the earliest. Mental health organization dedicated to current and future pandemics should be established along with Government policies addressing psychological issues to prevent and treat mental health issues need to be developed. Abstract:
Objetivo: Determinar la participación social a partir de la exploración de intereses ocupacionales y uso de los espacios de vida de los adultos mayores de 60 años del corregimiento de Obonuco de la ciudad de San Juan de Pasto. Metodología: Estudio de tipo cuantitativo descriptivo, con una muestra de 70 adultos mayores de 60 años, a quienes se les aplicó el Cuestionario de intereses ocupacionales para el adulto mayor, que determina el tipo de actividad, nivel de interés, frecuencia, autoeficacia percibida y con quién lo realiza, y la evaluación de espacios de vida con el cuestionario Life Space Assessment (LSA). Resultados: Las actividades que se presentan con mayor grado de interés son, asistir a misa, bailar, visitar familia y amigos, con una frecuencia de una vez por semana, con alta percepción de autoeficacia, sin ninguna compañía de algún familiar, amigo o cuidador, además de tener interés por participar de grupos de estudio. Conclusión: Prevalecen las relaciones intrafamiliares e intrapersonales, que han demostrado que llegar a esta etapa de la vida no es un impedimento para socializar y compartir con los suyos y la comunidad. La investigación se fundamenta en la normativa vigente y las sanciones correspondientes por evasión tributaria a las pequeñas y medianas empresas. El estudio se basó en analizar las contribuciones tributarias de todos los sectores económicos y la gestión que realiza el SRI para combatir las empresas fantasmas. El objetivo del estudio fue determinar los principales delitos que existen y las sanciones correspondientes por cada infracción. El diseño metodológico fue de orden mixto. Cualitativo porque se realizó un análisis descriptivo de los principales delitos especificados en el COIP Art. 298. Cuantitativo porque se analizó e interpretó datos económicos acerca de las PYMES, contribuciones tributarias generales y evasión de impuestos. Los resultados revelaron que las PYMES generan un alto valor tributario, por ende, existe incremento de empresas fantasmas que evaden impuestos y no existe una adecuada gestión para combatir este problema. La Revista Justicia & Derecho de la Universidad Autónoma de Chile se complace en presentar el segundo volumen correspondiente al año 2020 que constituye el término de un primer ciclo en el cual nos enfrentamos, entre otros retos, a la tarea de migrar la Revista a la plataforma Open Journal System. Junto con ese desafío cumplido, hemos iniciado también con éxito el camino a posicionar la Revista en índices relevantes (DOAJ, Latindex, Portal de Revistas Académicas chilenas, Dialnet) con miras a iniciar el 2021 la postulación para obtener su indexación a SciELO y en otros índices en el corto plazo. Cambios vendrán y serán anunciados en el sitio web del repositorio de revistas de la universidad (https://revistas. uautonoma.cl/), entre otros las modificaciones que se pondrán en aplicación para los envíos a partir de 2021 en lo referente a las directrices para los autores. El 2021 traerá consigo algunos cambios al equipo editorial de la revista a fin de fortalecerlo en beneficio de la calidad científica que es una prioridad para nosotros. En este volumen 2/2020 se han seleccionado nueve trabajos de investigación y reflexión científicojurídicos, un comentario de sentencia y una recensión de una obra dirigida por un profesor de nuestra universidad y miembro del Instituto de Investigación en Derecho (IID). El primer artículo, contribución del profesor don Carlos López Dawson, se titula “La didáctica participativa. La educación superior y su contexto” en donde se explora el tema siempre interesante y tanto más actual, en estos tiempos de cambios pandémicos, de la enseñanza del Derecho y de la metodología pedagógica de enseñanza-aprendizaje basadas en competencias como instrumento útil para la formación de competencias profesionales en los estudiantes de la disciplina. El segundo artículo, lleva por título “La ambivalencia de la Excma. Corte Suprema frente a la estabilidad en los empleos de la función pública” y es de autoría de don Héctor Muñoz Díaz, una interesante reunión y análisis de los criterios jurisprudenciales de la Corte Suprema en lo relativo a la no renovación de los empleos a contrata en el período 2015-2019. La tercera contribución la entrega don Tomás de Rementería Venegas, doctorando de la Universidad Paris 1 Panthéon-Sorbonne, Francia, bajo el título “Desentrañando la excepción: Análisis doctrinario y comparativo sobre los estados de excepción constitucional”, de actualidad evidente en tiempos de Covid-19, propone un examen jurídico comparativo en torno a la regulación normativa de los estados de excepción, acompañado de un análisis doctrinario e histórico de la institución. El cuarto trabajo titulado “La libre circulación de resoluciones en la UE en el caso de la sustracción internacional de menores” pertenece a la profesora española doña María González Marimón, en él aborda la regulación actual (Reglamento Bruselas II bis) y futura (Reglamento 2019/1111) del sector del reconocimiento y ejecución de resoluciones extranjeras en materia de sustracción internacional de menores en el ámbito de la Unión Europea. En quinto artículo, cuya autoría pertenece a la profesora doña María Constanza Cubillos Torres, y lleva por título “Hacia un Constitucionalismo Ambiental en la Región Andina: Breve estudio de las Constituciones de Bolivia, Ecuador y del proyecto de nueva Constitución de Chile del 2018”, trabajo que aborda la noción ambiental presente en el proyecto de nueva Constitución de 2018 (Boletín 11617-07), así como el diálogo ciudadano previo al proyecto, que persigue como objetivo el determinar hasta donde se extiende dicha protección y cuánto del Constitucionalismo Ambiental Andino de Ecuador y Bolivia está presente esa propuesta de reforma para Chile. El sexto artículo titulado “Nuevos estándares del ejercicio de la función pública de planificación territorial urbana. Análisis del artículo 28 decies de la Ley General de Urbanismo y Construcciones” es una contribución de la profesora doña Paola Román Fuentealba y entrega al lector un análisis del precepto a que se refiere su título, que constituye la piedra angular de la nueva forma de planificar territorialmente en Chile. La séptima contribución nos las entrega, en coautoría, los profesores don Alexander Espinoza Rausseo y doña Jhenny Rivas Alberti, y lleva por título “El concepto de la función administrativa y su delimitación frente a los actos de naturaleza jurisdiccional”, que nos entrega las pautas para distinguir entre una función administrativa y jurisdiccional tomando como punto de partida el criterio residual, así como su función de proteger los intereses generales. Por esa vía, los autores proponen que en aquellos casos que no puedan ser calificados de jurisdiccionales o legislativos la calificación de procederá será de naturaleza administrativa. El octavo trabajo, también en coautoría de don Sebastián Hassi Troxler y de don Matías Roa Navarrete, se titula “Acciones temerarias en la ley de protección de los derechos de los consumidores: Críticas a su regulación contenida en la ley N°19.496 y a su falta de desarrollo”, tiene como propósito entregar un análisis de las denominadas “acciones temerarias” reguladas en el artículo 50 E de la Ley Nº 19.496 sobre protección de los derechos de los consumidores, conteniendo además una interesante propuesta de lege ferenda. Finalmente, el noveno artículo cuyo título es “Feminismo y Derecho Penal”, pertenece al profesor don Luis Hernán Acevedo Espínola y de él el lector constatará cómo el feminismo ha influido en el Derecho Penal chileno, abordando para el efecto tres reformas a esa disciplina de este último tiempo. En la sección comentarios de sentencias, ofrecemos al lector nuevamente un interesante trabajo de Tomás Frenck “Daño emergente futuro. Corte Suprema, sentencia de fecha 14 de septiembre 2017, Rol N°400-2017”, en donde el Excmo. Tribunal sienta la doctrina que el daño emergente que se producirá en el futuro puede ser indemnizado, en la medida que exista certeza de su ocurrencia venidera. Finalmente, la profesora y Directora del IID de la Universidad Autónoma, doña Andrea Lucas Garín nos entregan la recensión de la obra “Estado y Pueblo Mapuche. Una mirada desde el Derecho y las políticas públicas”, bajo la Dirección del también investigador del IID, Dr. Francisco Bedecarratz S. (Santiago de Chile, RIL Editores y Universidad Autónoma de Chile, 2020). En esta obra, se presentan, en base a cuatro pilares, las interrelaciones entre el Pueblo Mapuche y del Estado de Chile: Derechos Fundamentales, Formas de Estado, Orden y Seguridad Pública y Fomento Económico, Social y Cultural, temáticas que evidentemente merecen reflexiones de cara al próximo debate constituyente. Vaya, entonces, sin más, el saludo del equipo editorial de la Revista Justicia & Derecho de la Universidad Autónoma de Chile para los lectores de este nuevo volumen y los deseos que la lectura de los trabajos expuestos abra nuevos horizontes del conocimiento del Derecho. Abstract Objectives Characterize the climatic, economic, and natural resource trends associated with nutritional and livelihood challenges for the inhabitants of three rural subsistence farming communities in the Andes of Ecuador. Methods The study utilized a mixed methods approach. In-depth interviews (n = 32), focus groups (n = 3), and structured observations (n = 10) were carried out to yield multiple perspectives on agricultural and food production practices and challenges. A quantitative household survey (n = 109) was used to collect a range of data including consumption and dietary information and anthropometric data for children under 5 years and their mothers. Height and weight measurements were collected using an Infant/Child/Adult ShorrBoard and a Seca digital scale-Model 874. A HemoCue Hb 201 + system was used to determine hemoglobin concentrations. Soil quality tests were conducted at 10 different locations and elevations using Rapitest soil testers. Results The qualitative data suggests that soil degradation linked to land overuse and changing weather patterns have led to decreasing agriculture production and economic hardship. The household survey indicates that families are extremely poor, living on .70 USD per capita per day, and rely on what they produce for the majority of their consumption. These challenges are exacerbated by a lack of support from the local government, as reported by study participants, leading many community members to migrate to cities in search of work. We argue that these trends have had a negative impact on participants’ sense of identity and the health of young children and their mothers. There was a high prevalence of stunting (59.5%), underweight (26.1%), and anemia (78%) in children under 5 years. The anemia prevalence among mothers was 30%. Conclusions Findings show the high prevalence of malnutrition among the study population is linked to agricultural and climatic challenges. The results suggest the need for a transdisciplinary agriculture focused intervention that sustainably improves food production and the populations’ resiliency to climate change. IntroductionTasmania hangs from the map of Australia like a drop in freefall from the substance of the mainland. Often the whole state is mislaid from Australian maps and logos (Reddit). Tasmania has, at least since federation, been considered peripheral—a region seen as isolated, a ‘problem’ economically, politically, and culturally. However, Tasmania not only cleaves to the ‘north island’ of Australia but is also subject to the gravitational pull of an even greater land mass—Antarctica. In this article, we upturn the political conventions of map-making that place both Antarctica and Tasmania in obscure positions at the base of the globe. We show how a changing global climate re-frames Antarctica and the Southern Ocean as key drivers of worldwide environmental shifts. The liquid and solid water between Tasmania and Antarctica is revealed not as a homogenous barrier, but as a dynamic and relational medium linking the Tasmanian archipelago with Antarctica. When Antarctica becomes the focus, the script is flipped: Tasmania is no longer on the edge, but core to a network of gateways into the southern land. The state’s capital of Hobart can from this perspective be understood as an “Antarctic city”, central to the geopolitics, economy, and culture of the frozen continent (Salazar et al.). Viewed from the south, we argue, Tasmania is not a problem, but an opportunity for a form of ecological, cultural, economic, and political sustainability that opens up the southern continent to science, discovery, and imagination.A Centre at the End of the Earth? Tasmania as ParadoxThe islands of Tasmania owe their existence to climate change: a period of warming at the end of the last ice age melted the vast sheets of ice covering the polar regions, causing sea levels to rise by more than one hundred metres (Tasmanian Climate Change Office 8). Eleven thousand years ago, Aboriginal people would have witnessed the rise of what is now called Bass Strait, turning what had been a peninsula into an archipelago, with the large island of Tasmania at its heart. The heterogeneous practices and narratives of Tasmanian regional identity have been shaped by the geography of these islands, and their connection to the Southern Ocean and Antarctica. Regions, understood as “centres of collective consciousness and sociospatial identities” (Paasi 241) are constantly reproduced and reimagined through place-based social practices and communications over time. As we will show, diverse and contradictory narratives of Tasmanian regionality often co-exist, interacting in complex and sometimes complementary ways. Ecocritical literary scholar C.A. Cranston considers duality to be embedded in the textual construction of Tasmania, writing “it was hell, it was heaven, it was penal, it was paradise” (29). Tasmania is multiply polarised: it is both isolated and connected; close and far away; rich in resources and poor in capital; the socially conservative birthplace of radical green politics (Hay 60). The weather, as if sensing the fine balance of these paradoxes, blows hot and cold at a moment’s notice.Tasmania has wielded extraordinary political influence at times in its history—notably during the settlement of Melbourne in 1835 (Boyce), and during protests against damming the Franklin River in the early 1980s (Mercer). However, twentieth-century historical and political narratives of Tasmania portray the Bass Strait as a barrier, isolating Tasmanians from the mainland (Harwood 61). Sir Bede Callaghan, who headed one of a long line of federal government inquiries into “the Tasmanian problem” (Harwood 106), was clear that Tasmania was a victim of its own geography:the major disability facing the people of Tasmania (although some residents may consider it an advantage) is that Tasmania is an island. Separation from the mainland adversely affects the economy of the State and the general welfare of the people in many ways. (Callaghan 3)This perspective may stem from the fact that Tasmania has maintained the lowest Gross Domestic Product per capita of all states since federation (Bureau of Infrastructure Transport and Regional Economics 9). Socially, economically, and culturally, Tasmania consistently ranks among the worst regions of Australia. Statistical comparisons with other parts of Australia reveal the population’s high unemployment, low wages, poor educational outcomes, and bad health (West 31). The state’s remoteness and isolation from the mainland states and its reliance on federal income have contributed to the whole of Tasmania, including Hobart, being classified as ‘regional’ by the Australian government, in an attempt to promote immigration and economic growth (Department of Infrastructure and Regional Development 1). Tasmania is indeed both regional and remote. However, in this article we argue that, while regionality may be cast as a disadvantage, the island’s remote location is also an asset, particularly when viewed from a far southern perspective (Image 1).Image 1: Antarctica (Orthographic Projection). Nielsen.Connecting Oceans/Collapsing DistanceTasmania and Antarctica have been closely linked in the past—the future archipelago formed a land bridge between Antarctica and northern land masses until the opening of the Tasman Seaway some 32 million years ago (Barker et al.). The far south was tangible to the Indigenous people of the island in the weather blowing in from the Southern Ocean, while the southern lights, or “nuyina”, formed a visible connection (Australia’s new icebreaker vessel is named RSV Nuyina in recognition of these links). In the contemporary Australian imagination, Tasmania tends to be defined by its marine boundaries, the sea around the islands represented as flat, empty space against which to highlight the topography of its landscape and the isolation of its position (Davies et al.). A more relational geographic perspective illuminates the “power of cross-currents and connections” (Stratford et al. 273) across these seascapes. The sea country of Tasmania is multiple and heterogeneous: the rough, shallow waters of the island-scattered Bass Strait flow into the Tasman Sea, where the continental shelf descends toward an abyssal plain studded with volcanic seamounts. To the south, the Southern Ocean provides nutrient-rich upwellings that attract fish and cetacean populations. Tasmania’s coast is a dynamic, liminal space, moving and changing in response to the global currents that are driven by the shifting, calving and melting ice shelves and sheets in Antarctica.Oceans have long been a medium of connection between Tasmania and Antarctica. In the early colonial period, when the seas were the major thoroughfares of the world and inland travel was treacherous and slow, Tasmania’s connection with the Southern Ocean made it a valuable hub for exploration and exploitation of the south. Between 1642 and 1900, early European explorers were followed by British penal colonists, convicts, sealers, and whalers (Kriwoken and Williamson 93). Tasmania was well known to polar explorers, with expeditions led by Jules Dumont d’Urville, James Clark Ross, Roald Amundsen, and Douglas Mawson all transiting through the port of Hobart. Now that the city is no longer a whaling hub, growing populations of cetaceans continue to migrate past the islands on their annual journeys from the tropics, across the Sub-Antarctic Front and Antarctic circumpolar current, and into the south polar region, while southern species such as leopard seals are occasionally seen around Tasmania (Tasmania Parks and Wildlife). Although the water surrounding Tasmania and Antarctica is at times homogenised as a ‘barrier’, rendering these places isolated, the bodies of water that surround both are in fact permeable, and regularly crossed by both humans and marine species. The waters are diverse in their physical characteristics, underlying topography, sea life, and relationships, and serve to connect many different ocean regions, ecosystems, and weather patterns.Views from the Far SouthWhen considered in terms of its relative proximity to Antarctic, rather than its distance from Australia’s political and economic centres, Tasmania’s identity undergoes a significant shift. A sign at Cockle Creek, in the state’s far south, reminds visitors that they are closer to Antarctica than to Cairns, invoking a discourse of connectedness that collapses the standard ten-day ship voyage to Australia’s closest Antarctic station into a unit comparable with the routinely scheduled 5.5 hour flight to North Queensland. Hobart is the logistical hub for the Australian Antarctic Division and the French Institut Polaire Francais (IPEV), and has hosted Antarctic vessels belonging to the USA, South Korea, and Japan in recent years. From a far southern perspective, Hobart is not a regional Australian capital but a global polar hub. This alters the city’s geographic imaginary not only in a latitudinal sense—from “top down” to “bottom up”—but also a longitudinal one. Via its southward connection to Antarctica, Hobart is also connected east and west to four other recognized gateways: Cape Town in South Africa, Christchurch in New Zealand; Punta Arenas in Chile; and Ushuaia in Argentina (Image 2). The latter cities are considered small by international standards, but play an outsized role in relation to Antarctica.Image 2: H. Image Credit: Nicki D'Souza.These five cities form what might be called—to adapt geographer Klaus Dodds’ term—a ‘Southern Rim’ around the South Polar region (Dodds Geopolitics). They exist in ambiguous relationship to each other. Although the five cities signed a Statement of Intent in 2009 committing them to collaboration, they continue to compete vigorously for northern hemisphere traffic and the brand identity of the most prominent global gateway. A state government brochure spruiks Hobart, for example, as the “perfect Antarctic Gateway” emphasising its uniqueness and “natural advantages” in this regard (Tasmanian Government, 2016). In practice, the cities are automatically differentiated by their geographic position with respect to Antarctica. Although the ‘ice continent’ is often conceived as one entity, it too has regions, in both scientific and geographical senses (Terauds and Lee; Antonello). Hobart provides access to parts of East Antarctica, where the Australian, French, Japanese, and Chinese programs (among others) have bases; Cape Town is a useful access point for Europeans going to Dronning Maud Land; Christchurch is closest to the Ross Sea region, site of the largest US base; and Punta Arenas and Ushuaia neighbour the Antarctic Peninsula, home to numerous bases as well as a thriving tourist industry.The Antarctic sector is important to the Tasmanian economy, contributing $186 million (AUD) in 2017/18 (Wells; Gutwein; Tasmanian Polar Network). Unsurprisingly, Tasmania’s gateway brand has been actively promoted, with the 2016 Australian Antarctic Strategy and 20 Year Action Plan foregrounding the need to “Build Tasmania’s status as the premier East Antarctic Gateway for science and operations” and the state government releasing a “Tasmanian Antarctic Gateway Strategy” in 2017. The Chinese Antarctic program has been a particular focus: a Memorandum of Understanding focussed on Australia and China’s Antarctic relations includes a “commitment to utilise Australia, including Tasmania, as an Antarctic ‘gateway’.” (Australian Antarctic Division). These efforts towards a closer relationship with China have more recently come under attack as part of a questioning of China’s interests in the region (without, it should be noted, a concomitant questioning of Australia’s own considerable interests) (Baker 9). In these exchanges, a global power and a state of Australia generally classed as regional and peripheral are brought into direct contact via the even more remote Antarctic region. This connection was particularly visible when Chinese President Xi Jinping travelled to Hobart in 2014, in a visit described as both “strategic” and “incongruous” (Burden). There can be differences in how this relationship is narrated to domestic and international audiences, with issues of sovereignty and international cooperation variously foregrounded, laying the ground for what Dodds terms “awkward Antarctic nationalism” (1).Territory and ConnectionsThe awkwardness comes to a head in Tasmania, where domestic and international views of connections with the far south collide. Australia claims sovereignty over almost 6 million km2 of the Antarctic continent—a claim that in area is “roughly the size of mainland Australia minus Queensland” (Bergin). This geopolitical context elevates the importance of a regional part of Australia: the claims to Antarctic territory (which are recognised only by four other claimant nations) are performed not only in Antarctic localities, where they are made visible “with paraphernalia such as maps, flags, and plaques” (Salazar 55), but also in Tasmania, particularly in Hobart and surrounds. A replica of Mawson’s Huts in central Hobart makes Australia’s historic territorial interests in Antarctica visible an urban setting, foregrounding the figure of Douglas Mawson, the well-known Australian scientist and explorer who led the expeditions that proclaimed Australia’s sovereignty in the region of the continent roughly to its south (Leane et al.). Tasmania is caught in a balancing act, as it fosters international Antarctic connections (such hosting vessels from other national programs), while also playing a key role in administering what is domestically referred to as the Australian Antarctic Territory. The rhetoric of protection can offer common ground: island studies scholar Godfrey Baldacchino notes that as island narratives have moved “away from the perspective of the ‘explorer-discoverer-colonist’” they have been replaced by “the perspective of the ‘custodian-steward-environmentalist’” (49), but reminds readers that a colonising disposition still lurks beneath the surface. It must be remembered that terms such as “stewardship” and “leadership” can undertake sovereignty labour (Dodds “Awkward”), and that Tasmania’s Antarctic connections can be mobilised for a range of purposes. When Environment Minister Greg Hunt proclaimed at a press conference that: “Hobart is the gateway to the Antarctic for the future” (26 Apr. 2016), the remark had meaning within discourses of both sovereignty and economics. Tasmania’s capital was leveraged as a way to position Australia as a leader in the Antarctic arena.From ‘Gateway’ to ‘Antarctic City’While discussion of Antarctic ‘Gateway’ Cities often focuses on the economic and logistical benefit of their Antarctic connections, Hobart’s “gateway” identity, like those of its counterparts, stretches well beyond this, encompassing geological, climatic, historical, political, cultural and scientific links. Even the southerly wind, according to cartoonist Jon Kudelka, “has penguins in it” (Image 3). Hobart residents feel a high level of connection to Antarctica. In 2018, a survey of 300 randomly selected residents of Greater Hobart was conducted under the umbrella of the “Antarctic Cities” Australian Research Council Linkage Project led by Assoc. Prof. Juan Francisco Salazar (and involving all three present authors). Fourteen percent of respondents reported having been involved in an economic activity related to Antarctica, and 36% had attended a cultural event about Antarctica. Connections between the southern continent and Hobart were recognised as important: 71.9% agreed that “people in my city can influence the cultural meanings that shape our relationship to Antarctica”, while 90% agreed or strongly agreed that Hobart should play a significant role as a custodian of Antarctica’s future, and 88.4% agreed or strongly agreed that: “How we treat Antarctica is a test of our approach to ecological sustainability.” Image 3: “The Southerly” Demonstrates How Weather Connects Hobart and Antarctica. The city is particularly strong as a centre of Antarctic research: signs at the cruise-ship terminal on the waterfront claim that “There are more Antarctic scientists based in Hobart […] than at any other one place on earth, making Hobart a globally significant contributor to our understanding of Antarctica and the Southern Ocean.” Researchers are based at the Institute for Marine and Antarctic Studies (IMAS), the Commonwealth Scientific and Industrial Research Organisation (CSIRO), and the Australian Antarctic Division (AAD), with several working between institutions. Many Antarctic researchers located elsewhere in the world also have a connection with the place through affiliations and collaborations, leading journalist Jo Chandler to assert that “the breadth and depth of Hobart’s knowledge of ice, water, and the life forms they nurture […] is arguably unrivalled anywhere in the world” (86).Hobart also plays a significant role in Antarctica’s governance, as the site of the secretariats for the Commission for the Conservation of Antarctic Marine Living Resources (CCAMLR) and the Agreement on the Conservation of Albatrosses and Petrels (ACAP), and as host of the Antarctic Consultative Treaty Meetings on more than one occasion (1986, 2012). The cultural domain is active, with Tasmanian Museum and Art Gallery (TMAG) featuring a permanent exhibit, “Islands to Ice”, emphasising the ocean as connecting the two places; the Mawson’s Huts Replica Museum aiming (among other things) to “highlight Hobart as the gateway to the Antarctic continent for the Asia Pacific region”; and a biennial Australian Antarctic Festival drawing over twenty thousand visitors, about a sixth of them from interstate or overseas (Hingley). Antarctic links are evident in the city’s natural and built environment: the dolerite columns of Mt Wellington, the statue of the Tasmanian Antarctic explorer Louis Bernacchi on the waterfront, and the wharfs that regularly accommodate icebreakers such as the Aurora Australis and the Astrolabe. Antarctica is figured as a southern neighbour; as historian Tom Griffiths puts it, Tasmanians “grow up with Antarctica breathing down their necks” (5). As an Antarctic City, Hobart mediates access to Antarctica both physically and in the cultural imaginary.Perhaps in recognition of the diverse ways in which a region or a city might be connected to Antarctica, researchers have recently been suggesting critical approaches to the ‘gateway’ label. C. Michael Hall points to a fuzziness in the way the term is applied, noting that it has drifted from its initial definition (drawn from economic geography) as denoting an access and supply point to a hinterland that produces a certain level of economic benefits. While Hall looks to keep the term robustly defined to avoid empty “local boosterism” (272–73), Gabriela Roldan aims to move the concept “beyond its function as an entry and exit door”, arguing that, among other things, the local community should be actively engaged in the Antarctic region (57). Leane, examining the representation of Hobart as a gateway in historical travel texts, concurs that “ingress and egress” are insufficient descriptors of Tasmania’s relationship with Antarctica, suggesting that at least discursively the island is positioned as “part of an Antarctic rim, itself sharing qualities of the polar region” (45). The ARC Linkage Project described above, supported by the Hobart City Council, the State Government and the University of Tasmania, as well as other national and international partners, aims to foster the idea of the Hobart and its counterparts as ‘Antarctic cities’ whose citizens act as custodians for the South Polar region, with a genuine concern for and investment in its future.Near and Far: Local Perspectives A changing climate may once again herald a shift in the identity of the Tasmanian islands. Recognition of the central role of Antarctica in regulating the global climate has generated scientific and political re-evaluation of the region. Antarctica is not only the planet’s largest heat sink but is the engine of global water currents and wind patterns that drive weather patterns and biodiversity across the world (Convey et al. 543). For example, Tas van Ommen’s research into Antarctic glaciology shows the tangible connection between increased snowfall in coastal East Antarctica and patterns of drought southwest Western Australia (van Ommen and Morgan). Hobart has become a global centre of marine and Antarctic science, bringing investment and development to the city. As the global climate heats up, Tasmania—thanks to its low latitude and southerly weather patterns—is one of the few regions in Australia likely to remain temperate. This is already leading to migration from the mainland that is impacting house prices and rental availability (Johnston; Landers 1). The region’s future is therefore closely entangled with its proximity to the far south. Salazar writes that “we cannot continue to think of Antarctica as the end of the Earth” (67). Shifting Antarctica into focus also brings Tasmania in from the margins. As an Antarctic city, Hobart assumes a privileged positioned on the global stage. This allows the city to present itself as central to international research efforts—in contrast to domestic views of the place as a small regional capital. The city inhabits dual identities; it is both on the periphery of Australian concerns and at the centre of Antarctic activity.
