Abstract:
This book explores the clash between antitrust, a body of law originally designed to address market failures in western democracies, and China, an economic superpower under authoritarian control. It analyses two simultaneous sources of conflict. The first is the significant challenges Chinese antitrust regulation poses to foreign multinational companies doing business in China. The second is the tremendous difficulties Chinese firms face in complying with antitrust rules in foreign countries. Ultimately, the book offers a cautionary tale of the challenges globalization poses to law and economic order by showing that the conflicts observed today are deeply rooted in institutional factors, both political and economic.

Abstract:
Mining is the largest sector of the Zambian economy but the relationship between mining companies and their host communities has been fractious, without a clear path towards sustainability. The severe social, economic, and environmental impacts of mining have been compounded by perceived shortcomings in corporate social and environmental responsibility programming by the industry, and by fragile regulatory capacity on the government’s part. This chapter examines the modalities and results of mining community development programmes in Zambia as part of the broader discussion on how large international mining companies can, and do, contribute to local and community development. It narrates the approaches adopted by five multinational mining corporates, two of which are Chinese-owned, and discusses their advantages and disadvantages.

Abstract:
This book argues that the desire for world status plays a key role in shaping the foreign policies of China and Russia. Applying social identity theory—the idea that individuals derive part of their identity from larger communities—to nations, the book contends that China and Russia have used various modes of emulation, competition, and creativity to gain recognition from other countries, and thus validate their respective identities. To make this argument, the book analyzes numerous cases, including Catherine the Great's attempts to westernize Russia, China's identity crises in the nineteenth century, and both countries' responses to the end of the Cold War. The book employs a multifaceted method of measuring status, factoring in influence and inclusion in multinational organizations, military clout, and cultural sway, among other considerations. Combined with historical precedent, this socio-psychological approach helps explain current trends in Russian and Chinese foreign policy.

En 1991, un employé du Ministère canadien de l’agriculture et de l’agroalimentaire récolte, en Chine, des semences de la plante de stévia. Il les séquence puis dépose les données obtenues sur la banque de séquences d’ADN étasunienne GenBank ®. Ces données seront utilisées, une décennie plus tard, par une entreprise de biotechnologie suisse, pour développer une souche de levure capable de sécreter, avec un meilleur rendement, l’édulcorant naturellement contenu dans la plante de stévia. Plusieurs brevets seront obtenus par la firme. En 2015, des ONG dénoncent l’appropriation de savoirs traditionnels détenus par des populations amérindiennes sur la plante de stévia, en violation des traités sur l’accès aux ressources génétiques et le partage juste et équitable des avantages découlant de leur utilisation (APA), à savoir la Convention sur la diversité biologique et le Protocole de Nagoya. Face à de tels processus, qui détient quels droits sur les organismes, l’ADN qu’ils contiennent, les données extraites de cet ADN et les connaissances traditionnelles ou techniques produites ? Mis en oeuvre depuis près de trente ans pour apporter une solution à ces problèmes, le régime sur l’APA peine, en pratique, à y répondre. Cet ouvrage explore les stratégies des États, des multinationales, des acteurs de la recherche publique, des institutions de conservation des ressources génétiques et des ONG, face aux droits de propriété et à ce régime sur l’APA, fragmenté, encore instable et souvent instrumentalisé. Il propose des pistes d’amélioration, en testant une proposition de régime alternatif et en formulant une série de recommandations.
