Abstract:
This article outlines recent events concerning the conservation and management trajectory of a highly migratory shark species, the shortfin mako (Isurus oxyrinchus), in the North Atlantic, where it has been routinely captured recreationally and as part of commercial fishing operations alongside other species. Noting recent warnings concerning the high mortality of the species in this ocean region, and the threat of imminent population collapse, this article sets out a number of applicable law of the sea provisions, and carries out an evaluation of relevant measures for target and incidental capture species, discussing their applicability to the mako fishery. It also presents an analysis of regional and global governance actions taken to date by the international community and by individual actors, noting a number of shortfalls, and outlining potential responses.

Abstract:
In this article, we propose the comparative study of two works that use videos of Venezuelan political opponent Óscar Pérez who was killed during a military raid. Romain Champalaune’s film (The Life and Death of Óscar Pérez) and the website of the British collective Forensic Architecture question us about the future of user-generated content and the place of the artist and the researcher in the society of hyper-production of texts and documents. After introducing the Perez case and presenting the works, we analyze the regime of proof and the idea of truth and the archive in the era of algorithmic governmentalities. Finally, we study how investigation and the collection of user-generated content allow for a shift in our power regimes through the implementation of counter-narration to that of the powers that be.

The irony lies in the fact that the outcome of the UK referendum on the EU was, amongst other things, a rejection of experts; or rather, of current mobilizations of expertize and the political allegiances of a large number of experts. Despite this irony, or precisely because of it, I will reflect on three interrelated questions that, in my mind, determined the content and outcome of this historic referendum. First, I will discuss the discourse of ‘sovereignty’ and ‘control’ at the centre of the Leave campaign. Secondly, I will focus on the role of expertize and (technocratic) knowledge both in the construction of the European project and in the revolt against it. Finally, I will argue that given neoliberal hegemony and its heavily unequal distributive outcomes, revolts against contemporary structures of power, both national and inter/supranational are to be expected. Therefore, the question for progressive lawyers is how to mobilize our expertise so that these revolts do not become the exclusive playing terrain of the extreme right with unforeseen consequences.

This article investigates the Chinese director Li Shaohong’s film Bloody Morning (1992), which was adapted from Gabriel García Márquez’s novella Chronicle of a Death Foretold (1981), and the Chinese philosophical and cultural tradition that shaped this case of adaptation. By incorporating the Colombian story, Li Shaohong expressed her concern about China’s backwards rural areas. Her adaptation localizes and incorporates the foreignness of the source text to meet the ideological and aesthetic horizons of expectation and the common concerns of her Chinese audience. This article argues that the director’s domestication has its philosophical and cultural roots in China’s history of war against foreign aggression, although the Chinese film has nothing to do with war against foreign powers.

Abstract:
The asura’s demise at the hands of the goddess is a theme frequently revisited in Hindu myth. It is the chronicle of a death foretold. So too is the Bhadrakāḷīmāhātmya, a sixteenth century regional purāṇa from Kerala, that narrates the tale of fierce goddess Bhadrakāḷī and her predestined triumph over asura king Dārika. Violence is ubiquitous in this narrative, which was designed with one goal in mind: glorifying the ultimate act of defeating the asura enemy. In its course the story exhibits many kinds of violence: self-harm, cosmic warfare, murder, etc. This paper argues that (1) violence comes to serve as a structural aspect in the text. Reappearing consistently at key moments in the narrative, violence both frames and structures the goddess’s tale. Yet, it is not only the violent act that dominates, it is its accompaniment by equal acts of regeneration that dictates the flow of the narrative, creating a pulsating course of endings and beginnings; (2) these cycles, that strategically occur throughout the narrative, come to serve as a Leitmotif referring to the cyclic tandem of destruction and regeneration that has dominated post-Vedic Hindu myth in many forms. The pulsating dynamic of death and revival thus becomes a specific narrative design that aims to embed the regional goddess within a grander framework of Time.

Resumo: Este ensaio tem por objetivo utilizar perspectivas discutidas em torno das teorias pós-modernas e pós-coloniais como aporte para estabelecer aproximações com a literatura latino-americana, especificamente, com a obra Crônica de uma morte anunciada, do colombiano Gabriel García Márquez. Essa proposta de aproximação surge da impressão causada pela obra no leitor, denotando traços do que poderia ser visto como uma perspectiva pós-moderna e pós-colonial sobre a história e sobre a própria escrita literária. Esses caminhos da questão “pós” podem ser percebidos em uma sensibilidade trágica, que alinha o texto aos debates pós-modernos, bem como na forma como o autor hibridiza a narrativa ao colocar na mesma “persona”, narrador, personagem e autor. As chamadas “histórias menores”, isto é, discussões acerca de temas importantes da crítica pós-colonial também estão presentes, em referências tangenciais à raça, territorialidade e gênero. Além dessas circunscrições mais visíveis sobre o “pós” na estrutura da crônica, este texto é uma tentativa de decodificar alguns símbolos utilizados pelo autor para ressignificar e deslocar certos pontos fixos da ficção e da história latino-americana.Palavras-chave: literatura latino-americana; trágico; pós-modernidade e pós-colonialidade.Abstract: This essay aims to use perspectives discussed on postmodern and postcolonial theories as a contribution to establish approximations with the Latin American literature, specifically with the Chronicle of a Death Foretold by the Colombian Gabriel García Márquez. This proposal of approximation arises from the impression that the García Márquez’ work provokes in the reader, denoting traces of what could be seen as a postmodern and postcolonial perspective on history and on literary writing itself. These paths of the “post” theory can be perceived in a tragic sensibility, which aligns the text to postmodern debates, as well as in the way the author hybridizes the narrative by placing the narrator, character and author in the same person. Also present in the book are the so-called “minor stories,” that is, discussions about the central postcolonial critique matters, such as issues about race, territoriality, and gender. In addition to these more visible circumscriptions about the “post” in the structure of the Chronicle, this text is an attempt to decode some symbols used by the author to resignify and dislocate certain fixed points of Latin American fiction and history.Keywords: Latin American literature; tragic; post-modernity and post-coloniality.

The production of a tourist space on the Bahía de Banderas, on Mexico’s Pacific coast, has required converting the land, the river, and the bay into private property, dispossessing the citizenry of its access to them and interfering with the right of free transit. The production of this unequal and exclusive space demonstrates the absence of democracy in spatial production and the defenselessness of the citizenry in the face of the neoliberal project. La producción del espacio turístico de Bahía de Banderas, en la costa del Pacífico mexicano, require convertir en propiedad privada el suelo, el río y las playas, lo cual implicó despojar a la ciudadanía de su acceso al río, al mar y al derecho del libre tránsito. Tal producción de un espacio desigual y de exclusión social evidencia el alto déficit de democracia en la producción espacial, así como la indefensión de la ciudadanía que conlleva el neoliberalismo.
