Abstract:
AbstractThis essay begins by situating Spanish scholarship on Islamic law in the wider context of Arabic and Islamic studies in Spain, stressing two salient characteristics of the latter: its concentration on Andalusī subjects and its relative isolation from the rest of Western scholarship. I then review the production of Spanish scholarship in the field of Islamic law, focusing on three historical periods: the first steps in the nineteenth century (Gayangos, Ribera and his pupils); the period of the Spanish Civil War (1936-1939) when the work of López Ortiz, Morata, and Vila was cut short just as Spanish scholarship on Islamic law was coming of age; and the post-war period, when several attempts were made to renew the study of Islamic law. In the conclusion, I assess the current situation and consider future prospects. A basic bibliography of Spanish scholarship on Islamic law follows the article.

Artur Duck, De Usu et Authoritate Iuris Civilis Romanorum in Regno Galliarum. The Overview of the BibliographySummaryDe Usu et Authoritate Juris Civilis Romanorum in Dominiis Principum Christianorum, the work by Artur Duck was published in London in 1653. Duck, one of the leading civil lawyers, a royalist, high commissioner, Master in Chancery, King’s Advocate and a chancellor of three dioceses wrote his book in exile in Oxford during the English Civil War. In his work he analysed the position and influence of the Roman Law in fourteen countries of 17th-century Europe. The chapter concerning the Kingdom of France deserves a special interest, mainly due to the great number of learned lawyers cited by Duck. His study shows his excellent knowledge of legal works on the French law of that time. This paper tries to present the complete bibliography of the books used by Duck to describe the influence of the Roman Law in the Kingdom of France.

Abstract:
The article “Law and Society: the structures and functions of the Law in English Law”, is the result of teaching aimed at students of the Master’s Degree in Law at the Pontifical Catholic University of São Paulo, in the first semester of 2020 – Discipline General Theory of Law I – “Law, Power and Justice: the Hyper-cycle and the Legal Order”. Its primary objective is to understand how legal rules are made and used in Common Law in its similarities and distinctions from Civil Law. Civil society (societas civilis) is opposed to “natural society” (societas naturalis), being synonymous with “Political society” (in correspondence, respectively with the derivation of civitas and polis). The study of society as a social system, its structures and macro and micro functions in the legal subsystem (according to Niklas Luhmann) is current, predominant, and will be the object of this study in Chapter I. Chapter II, aims to investigate the sources and models Common Law. Chapter III, analyzes the Hypercycle of Law and makes conjectures about Common Law. Since law is a multifaceted phenomenon and difficult to define rigorously, due to its ambiguity and syntactic imprecision in its current use in different cultures, the methodology used was Aristotelian Topic, in the focus of zetetic investigation, with constant opening for constant questioning. The Conclusions and Bibliography follow.

Transitional justice deals with the question of how States, a war or dictatorship ended, confront a situation of past-large-scale human rights violation in a period of transition to peace and democracy. Although the situations differ widely from one case to another, International Law has contributed to define the core elements of transitional justice. From this viewpoint the Spanish case is considered.

Abstract:
The objective of this article is the analysis of the humanitarian relief work of the International Committee of the Red Cross (ICRC) and the League of the Red Cross Societies through a joint body, the Joint Relief Committee (JRC), in France during the Second World War. Based on the treaties, convention and draft projects that shed light on the evolution and consolidation of the International Humanitarian Law relating to civilian defence and on the specialized bibliography, reports of the ICRC and the JRC, documentary sources of the ICRC Archives, and photo library of the same organization, the article focuses on humanitarian aid and priorities of the JRC in favour of the civilian population most vulnerable to and affected by war: children, women and internees in the concentration camps in South of France. This study, accompanied by photos, maps and quantitative data, sheds light on the channels of humanitarian action, the charitable organizations, associations, institutions, foundations, etc., that made this possible, as well as the loopholes and limitations of international humanitarian law, with important consequences for human life during a major conflict such as the Second World War.

Lekhawatthanapong, Thattaporn. "Establishing statutory ground for the public interest defence under international copyright law." Thesis, University of Nottingham, 2018. http://eprints.nottingham.ac.uk/50736/.

Full text
Abstract:
Maintaining a fair balance between individuals’ interests and the public interest is arguably believed to be the most effective approach in serving the ultimate objective of copyright: to promote social, economic and cultural development for the benefit of both rightsholders and the public at large. Through this balanced approach, creativity can be maximised and thrive better than by tilting towards one or the other. In copyright law, such balance is reflected by the way in which the short-term grant of exclusive rights respects the long-term public interest represented by limitations and exceptions to copyright. Despite an unclear and non-uniform definition and scope, the importance of the public interest has been implicitly and explicitly recognised through disparate forms of safeguards in different jurisdictions. However, the last few decades have seen a rapid development of information technologies which, in turn, has contributed to an unparalleled legislative drive at international level towards overprotecting the interests of rightsholders. This has then left the public interest under-protected and now constitutes an imbalance of copyright. This thesis therefore examines legislative intervention into the international copyright regime in an attempt to ensure that the public interest is uniformly and mandatorily safeguarded at international level. In particular, it strives to establish an overarching public interest defence capable of protecting certain aspects of public values embedded in copyright works. In achieving this, the thesis examines the scope of the defence, what it should entail, and what aspects are to be taken into account in the course of formulating and giving effect to the defence. The substantive chapters investigate the public policy grounds, the right to freedom of expression and the international three-step test, i.e. the roles they play in shaping the latitude and operations of the defence, respectively. Finally, the thesis also evaluates different ways in which the defence can be incorporated into the international copyright regime in order to effectively counterbalance the rightsholder-centric tendency and restore the balance of copyright.

Zhang, Min. "An investigation of query-by-drawing image search on mobile devices." Thesis, University of Nottingham, 2016. http://eprints.nottingham.ac.uk/46936/.

Full text
Abstract:
The rapid growth of touchscreen mobile devices has opened up many new opportunities for exploring Content-based Image Retrieval (CBIR) techniques, e.g., it has enabled the development of intuitive and natural user interfaces to facilitate the Query-by-Drawing (QbD) image search paradigm. Although ubiquitous mobile computing holds the promise of drastically changing the ways users search for images from large image repositories, there is yet no comprehensive and systematic study that examines the factors that influence the usability, user behaviours and task performance of a QbD image search mobile application (App). No guidelines and principles exist for designing fundamental user interface components such as the colour picker and little is known how its different designs affect system usability and task performance. Little research exists that examines how different user interface designs affect the ways users draw the queries and how users go about the search process for different types of tasks. The questions of whether or not it is possible or how well users can perform QbD image search by drawing from memory of previously-seen images are unexplored. An understanding of these questions is very important and useful in the development of effective and user-friendly systems for a QbD image search App on touchscreen mobile devices. This PhD project attempts to answer these questions and more by examining the factors that influence the usability and task performance of a QbD painting search mobile application. Starting with a comprehensive literature review and current mobile App review of various related fields, we first designed and implemented a Client-Server painting search mobile App based on an existing CBIR algorithm as the research platform for collecting empirical data; we then conducted a focus group study from whose findings we re-designed the user interfaces of our QbD App. An online survey about art preference was carried out, and we designed four comprehensive user studies and recruited a total of 123 participants to take part in the experiments. Both qualitative and quantitative measures are collected and analysed to discover the various factors that influence the usability and task performance of the interface designs of a QbD image search mobile App and the memory drawing over time. Finally, we made recommendations and suggestions on the design and implementation of various interface components of the QbD image search mobile App based on our findings. This thesis presents the following contributions summarised as: 1) We build a flexible platform that can be used for research in drawing-related fields, such as a new QbD technique or interface tests and psychological study. 2)We present a comprehensive and systematic review of the methods and techniques related to the investigation of QbD image search mobile App. 3) We propose a new way of categorising colour picker: ‘1D-1D-1D’, ‘1D-2D’, and ‘3D’ colour picker. 4) The rationales of choosing stimuli are proposed and a real-world painting database is built. 5) We also develop a variety of novel methodologies for experimental design, data collection and data analysis, and we formulated a new protocol for assessing drawing accuracy and search result. 6) We propose some colour picker design guidelines through a series of experiments and the analysis of comprehensive experimental data. 7) Although indeed memory decays over time, we found the participants are able to draw from the memory of a painting with simple compositional structure (6-7 colour blobs), even for the paintings viewed a month ago. And finally, 8) the experiments also provide valuable insights into how general users draw and modify a query, and judge the result relevance for different tasks on mobile phones, as well as search pattern and memorisation strategy, which also extend a scientific understanding of using current Query-by-Drawing techniques for real world image search.

Kim, Lauren J. "French royal acts printed before 1601." Thesis, University of St Andrews, 2008. http://hdl.handle.net/10023/463.

Full text
Abstract:
This thesis is a study of royal acts printed in French before 1601. The kingdom of France is a natural place to begin a study of royal acts. It possessed one of the oldest judicial systems in Europe, which had been established during the reign of St Louis (1226-1270). By the sixteenth century, French kings were able to issue royal acts without any concern as to the distribution of their decrees. In addition, France was one of the leading printing centres in Europe. This research provides the first detailed analysis of this neglected category of texts, and examines the acts’ significance in French legal, political and printing culture. The analysis of royal acts reveals three key historical practices regarding the role of printing in judiciary matters and public affairs. The first is how the French crown communicated to the public. Chapters one and two discuss the royal process of dissemination of edicts and the language of royal acts. The second is how printers and publishers manoeuvred between the large number of royal promulgations and public demand. An overview of the printing industry of royal acts is provided in chapter three and the printers of these official documents are covered in chapter four. The study of royal acts also indicates which edicts were published frequently. The last two chapters examine the content of royal decrees and discuss the most reprinted acts. Chapter five explores the period before 1561 and the final chapter discusses the last forty years of the century. An appendix of all royal acts printed before 1601, which is the basis of my research for this study, is included. It is the first comprehensive catalogue of its kind and contains nearly six thousand entries of surviving royal acts printed before 1601.

Sekele, Mantima Anna. "The administration of the disability grant by the South African Social Security Agency within Makhuduthamaga Local Municipality, Limpopo Province." Thesis, 2017. http://hdl.handle.net/10386/1984.

Full text
Abstract:
Thesis (MPA.) -- University of Limpopo, 2017<br>The disability grant administration and dispensation has always been a challenge to the Department of Social Development and cause for concern from recipients of the disability grant. The Government decided on establishing the South African Social Security Agency (SASSA) as an entity to specifically deal with the administration of social grants including the Disability Grant. A number of studies have been conducted around the management and administration of the disability grant. The purpose of this study was to assess the efficiency and effectiveness of the administration and management of the disability grant. It further shows that the South African government spends a substantial amount of money in dispensing this grant. It is therefore necessary to investigate through an empirical research if these funds reach their intended beneficiaries, namely, the disabled community. This study employed the qualitative method which involved documents analysis, Questionnaire, interview and observation. Policy documents and reports from SASSA were analysed. Twenty applicants and twelve officials and three assessing doctors were interviewed. The findings of the study reveal that, although the SASSA has an improved model in place to redress and to contribute towards the effectiveness of the administration, there are still certain policy areas that needs to be reviewed. These policy areas include, amongst others, the appeal process, turnaround time, access and processing of the grant. In view of the findings from this study, the major recommendation is that there is a need to review the current booking system to ensure that the applicants are not subjected to unnecessary transports costs, time and delays. The SASSA needs to embark on vigorous and on-going community campaigns to educate the society on the operations of the SASSA and its jurisdiction within the Makhuduthamaga area. KEYWORDS: Administration; applicants; assessment; beneficiaries; Care Dependency Grant; Disability Grant; Grant-in-Aid; Makhuduthamaga; Recipients and the SASSA.

Abstract:
Taking into account the instrumental drift in the uncertainty of measurement does not benefit at this time from a provided bibliography. Although an abundant literature (standards, articles, samples collections, etc.) dealing with the estimation of uncertainty by the GUM method exists, the question of the drift component is often avoided or inaccurate, usually limited to a point-to-point deviation divided by 2√3, which is based on an erroneous hypothesis and clearly confines to being immobile. The choice of a rectangular probability law supposes that the greatest variation observed is necessarily the greatest observable variation; in other words, during the observed history (sometimes reduced to two calibration certificates), we noted the maximum drift of which the instrument could be the object. If the method is effectively statistically questionable, it becomes completely useless as soon as a modification takes place; especially when the periodicity optimization (variable calibration frequency) is used or when the points are changed from one calibration to another, in number or level. We propose here an alternative method which intends to correct these defects and is at once compatible with the principles of the GUM and easily automatable.
